2. EMPLOYEE OF THE MONTH: (overview) The Santa Clara County Office of Education (SCCOE) recognizes ten employees each year for outstanding service to students, parents, coworkers and customers. Bertie Cooper is being honored as the Employee of the Month for May for her outstanding skills and accomplishments on the job, dedication to exceptional service and commitment to excellence.

C. *Request Approval of Contract Exceeding $100,000 for Excel Learning Academy (overview) The Migrant Education Program places a strong emphasis on powerful summer interventions with a particular emphasis on Algebra readiness. We have contracted with Excel Learning Academy for the past six years to facilitate Math and English-Language Arts intervention during summer. Excel works with Region 1 to tailor a program to meet the specific needs and requirements of the migrant students. The Academy will serve 150 Migrant Education students in grades 2-8 from across Region 1. The contract includes all aspects of the program including transportation. Funds have been incorporated for this purpose in the FY14-15 budget. Administration recommends approval of contract exceeding $100,000 for Excel Learning Academy. (Dr. Mary Ann Dewan)

D. *Request Approval of Resolution in Support of May 13, 2015 as the California Day of the Teacher (overview) The Association of Mexican American Educators (AMAE) and the California Teachers Association (CTA) co-sponsored the legislation that in 1982 established the California Day of the Teacher. Administration recommends adoption of resolution in support of May 13, 2015 as the California Day of the Teacher. (Superintendent Gundry)

E. *Request Approval of Resolution in Support of May 6, 2015 as National School Nurse Day (overview) National School Nurse Day was established in 1972 to foster a better understanding of the significance of school nurses in the educational setting. School nurses have played a vital role in improving the health and well-being of our nation's children. Administration recommends adoption of resolution in support of May 6, 2015 as National School Nurse Day. (Superintendent Gundry)

F. *Request Approval of Resolution in Support of May 2015 as National Asian-Pacific American Heritage Month (overview) National Asian-Pacific Heritage Month originated in a congressional bill. In 1977, Reps. Frank Horton of New York and Norman Y. Mineta of California introduced a House resolution that called upon the President to proclaim the first week of May as National Asian-Pacific Heritage Week. In 1978, President Jimmy Carter signed a Joint Resolution designating the annual celebration. Administration recommends adoption of resolution in support of May 2015 as National Asian-Pacific American Heritage Month. (Superintendent Gundry)

G. *Request Approval of Resolution in Support of Week of May 17-23, 2015 as Classified School Employee Week (overview) May 17-23 marks the annual Classified School Employee Week, a time for schools and communities statewide to celebrate the work of bus drivers, office and clerical staff, custodians, food service workers, paraprofessionals, maintenance and operations workers and other classified employees who work in a variety of jobs like print services, library and media assistance, security and technology. Administration recommends adoption of resolution in support of week of May 17-23 as Classified School Employee Week. (Superintendent Gundry)

H. * Withdrawal Request of Rocketships 10, 11, 12, 13, 14, 15, 16, 19, 21, 22, 23, 24 and 25 pursuant to the terms of the settlement agreement of Alum Rock Union Elementary School v. SCCBOE et al. (Santa Clara County Superior Court Case No. 114-cv-260070) On April 1, 2015 the Santa Clara County Board of Education (SCCBOE) approved a settlement in the above referenced litigation. The Boards of Education for the four plaintiff districts: Alum Rock Union Elementary, Evergreen, Franklin-McKinley and Mount Pleasant School Districts as well as the Board for Rocketship Education have also approved the settlement agreement. Pursuant to the terms of the Settlement Agreement, Rocketship is required to submit to the SCCBOE a request to withdraw the following 13 charters which were previously approved by the SCCBOE. Staff recommends receipt and approval of the request to withdraw Rocketships 10, 11, 12, 13, 14, 15, 16, 19, 21, 22, 23 and 25 and direct staff to notify CDE and provide copies of the notice to the Plaintiff School Districts. I. * Request Approval of 2015-16 Indirect Cost Rates In compliance with BP 3100, all programs that are not determined to be part of the Santa Clara County Office of Education's administrative activities necessary for the general operations will be charged the State approved indirect cost rate (ICR). Grant programs shall be assessed the State approved ICR, unless waiver is sought from the Superintendent due to funding agency restrictions that limit the ICR to a level less than the State approved ICR. All other programs shall be assessed an indirect fee, which is established by the Superintendent and approved by the County Board. On March 26, 2015, the noted indirect cost rates were reviewed and approved by Cabinet. On April 16, 2015, the indirect cost rates were presented and reviewed at the Budget Study Committee meeting. Administration recommends approval of the proposed indirect cost rates for 2015-16. (Micaela Ochoa)

10. ACTION ITEM
A. Interview Applicants and Possible Provisional Appointment to Santa Clara County Board of Education Trustee Area 3 Seat The Area 3 Trustee seat was vacated on March 31, 2015 when Board Member Leon Beauchman resigned. The Board must make a provisional appointment by May 31, 2015 to the seat or order an election to fill it. If the Board fails to take either action, the Education Code requires that the County Superintendent order an election to fill the vacancy. The Ad Hoc Process Committee appointed by Board President Green has pre-screened applicants for the position and recommended that all the candidates that applied for the vacancy be interviewed by the full Board. The candidates are the following: Judy Chirco, Rosemary Kamei, Debbie Rocha, Ramona Snyder and Robert Varich. Michael Kretsch, who had also applied for the vacancy, submitted a letter dated April 13, 2015 withdrawing from consideration. The Board will interview candidates for the Area 3 Trustee seat and either: pass a resolution making a provisional appointment or pass a resolution calling for an election to fill the vacancy.
