Background
Education Code 60119 requires that, in order to receive instructional materials funding, the Board of Education must hold a public hearing each year to determine whether students have sufficient textbooks and instructional materials.  Further, the Board of Education must affirm in a resolution that sufficient supplies exist at all sites operated by the Santa Clara County Office of Education and that it has adopted textbooks and instructional materials that are consistent with the state curricular frameworks and standards. 

 

Education Code 60119 was amended recently to implement the provisions of the Williams Settlement.  The amendment extends the definition of “sufficient textbooks or instructional materials” to mean that each pupil, including English learners, has textbooks and instructional materials, or both, to use in class and to take home.

 

Principals in Alternative Education, and Special Education undertook a review and determined textbooks and materials to be sufficient.

 

Student Impact

Instructional materials consistent with the state curricular framework and standards support the improvement and access to inclusive, equitable, and high-quality education.   Students have access to print and online materials that support their educational goals across all core academic content areas.

Background

On March 17, 2020, the Governor issued Executive Order N-29-20 that suspended the teleconferencing rules set forth in the Brown Act enabling legislative bodies to meet remotely.  On September 16, 2021, the Governor signed AB 361 authorizing a legislative body subject to the Brown Act to continue to meet remotely using teleconference without compliance with the Brown Act teleconference rules if certain conditions are followed. On September 21, 2021, the County Health Officer issued a recommendation, which is attached hereto and incorporated herein, that public bodies continue to meet remotely. On October 6, 2021, November 17, 2021, December 15, 2021, January 19, 2022, February 2, 2022, February 16, 2022,  March 2, 2022, March 16, 2022, April 6, 2022, April 20, 2022, May 4, 2022, May 18, 2022, June 8, 2022, June 15, 2022, July 20, 2022, August 3, 2022, September 7, 2022, and September 21, 2022, the Santa Clara County Board of Education passed Resolution No. 2289-5 authorizing virtual board meetings pursuant to AB 361.

 

Student Impact

The County Health Officer has recommended that legislative bodies continue to meet remotely to promote social distancing as one means to reduce the risk of COVID-19 transmission. The Santa Clara County Office of Education has an important governmental interest in protecting the public health, safety, and welfare of those who participate in meetings of the various legislative bodies during COVID-19 and ensuring that all members of the public can participate safely in meetings of legislative bodies.

Background

On November 6, 1979, the voters of the State of California approved Proposition 4/Gann Initiative. This initiative added Article XIII-B to the State Constitution, which has the effect of placing a limit on the amount of proceeds from taxes governmental entities may authorize for expenditure during each fiscal year.

 

Pursuant to California Education Code 1629, on or before October 15 of each year, the Santa Clara County Board of Education shall adopt a resolution pursuant to Division 9 (commencing with Section 7900) of Title 1 of the Government Code, to identify the estimated appropriations limit for the county office of education for the current fiscal year and the actual appropriations limit for the preceding fiscal year.  The resolution shall be adopted at a regular or special meeting of the Board. Section 7910 of the Government Code requires the documentation used in the identification of the appropriations limits be made available to the public fifteen days prior to the meeting. This documentation is available for public review on the SCCOE Homepage at www.sccoe.org.

 

Calculations of 2021-22 and the estimated 2022-23 Gann Appropriations Limits are reflected on the Unaudited Actuals for Fiscal Year 2021-22 County Office Appropriations Limit Calculations report provided by the State Department of Education. The 2021-22 Gann Appropriations Limit has been calculated using actual proceeds of taxes for comparison with the 2021-22 limit. The SCCOE is within the 2021-22 Adjusted Appropriations Limit of $196,838,503.87. The 2022-23 Gann Appropriations Limit has been calculated at $216,596,438.80.

Background

The Office of Head Start (OHS), Administration for Children and Families, (ACF) Department of Health and Human Services has funded SCCOE to provide services to preschool and infant/toddler children and families. The Head Start and Early Head Start grant promotes a child's development through services that support early learning, health, and family well-being. SCCOE provides these services to young children and families to prepare and succeed in their transition to elementary school.

 

SCCOE was awarded a 5-year grant for the period of May 1, 2020 to June 30, 2025 to serve 2,188 children ages 0-5 in Santa Clara and San Benito Counties. The Head Start/Early Head Start grant application was approved by the Head Start/Early Head Start (HS/EHS) Policy Council (PC) on December 15, 2019 and Santa Clara County Board of Education (SCCBOE) on January 15, 2020. The program requests that the unearned grant award of $12,851,910 from the previous program year be approved as carryover in the 2022-23 program year for program improvement. An approval will permit the program to fund one-time projects in accordance with the regulations of Head Start that enhance the capacity of SCCOE to deliver services to children and families.

 

In addition, SCCOE was awarded CARES Act grant funding for one-time activities in response to the COVID-19 pandemic. OHS has determined that the widespread impact of the coronavirus continues to adversely impact all Head Start grantees. OHS allows flexibilities for continuing grants to utilize unearned grant award from a previous program year with formal notification to the Head Start PC and SCCBOE. The program requests that the unearned grant award of $941,774 from the previous program year be approved as carryover in the 2022-23 program year. An approval will permit the program to fund one-time projects that enhance the capacity of SCCOE to respond to the widespread impact of the coronavirus in the delivery of services to children and families.

November is National Homeless Youth Awareness Month. It was first declared as National Homeless Youth Awareness Month in 2007. Since then, November has been a time to acknowledge those children and families experiencing homelessness. Background

Indigenous People’s Day is nationally celebrated on the second Monday of October, and the month of November is National Native American Heritage Month. In 1990 President George H. W. Bush approved a joint resolution designating November 1990 “National American Indian Heritage Month.” Since 1991, dozens of cities, several universities, and a growing number of states have adopted Indigenous Peoples’ Day, a holiday that celebrates the history and contributions of Native Americans. The SCCOE is honored to acknowledge and celebrate local and national American Indians and the significant contributions made to grow the U.S.

 

Student Impact

The SCCOE  honors and supports the region’s first people as efforts are made to revive their culture, language, and history. The SCCOE is committed to enhancing equity, inclusion, diversity, and partnership and remains dedicated to providing schools and districts with resources and support to implement the History Social-Science standards and civic engagement, and promote understanding of economics, geography, world and U.S. history, and government in school.

This report reflects budget revisions for the month of September 2022. If an expenditure budget is increased, it is supported either by an increase in revenue, a decrease in carryover (use of carryover), a decrease in fund balance or any combination of the three. If an expenditure budget is decreased, the result could be due to a decrease in estimated revenue, or an increase to credit it back to fund balance.

 

During the month of September 2022, expenditure budgets were increased by $19,489,239; revenue was increased by $10,770,092; reserve for carryover was decreased by $8,397,343 and fund balance was decreased by $321,804.

 

Fiscal Implications

Restricted revenue in the amount of $3.4M was allocated to support the following initiatives:

Background

The Santa Clara County Office of Education Local Criteria for the State Seal of Civic Engagement has been developed for use with Special Programs which includes the Special Education Department, Opportunity Youth Academy, and Alternative Education Department. The State Seal of Civic Engagement was adopted on September 10, 2020, by the State Board of Education (SBE). It is for California students who demonstrate excellence in civics education, and participation and have an understanding of the democratic system of government. 

 

Student Impact

The vision is that ALL California students, especially those in traditionally marginalized populations and communities, have early and frequent civic learning opportunities during the PK through 12th grade experience. The main purpose is to formally recognize and/or promote student engagement in 11th and 12th grade; as well as, encourage and create pathways for students to become civically engaged in democratic institutions.

Background

Education Code 1628 states that on or before October 15 of each year, the county superintendent of schools of each county office shall prepare and file, in a format prescribed by the Superintendent of Public Instruction, an annual statement of all receipts and expenditures of the county office for the preceding fiscal year, and shall file the statement, along with the statements received pursuant to subdivision (b) of Section 42100, with the Superintendent of Public Instruction. 

 

Santa Clara County Office of Education's 2021-22 Unaudited Actuals Financial Report provides actual revenues, expenditures, ending fund balances, and reserves for the period of July 1, 2021 through June 30, 2022. In fiscal year 2021-22, the total County School Service Fund revenues (including transfers-in) were approximately $291.7M. Expenditures (including transfers-out) were approximately $299.1M. The unassigned amount for Fiscal Year 2021-22 is approximately $29.1M and $12.0M is designated for the Reserve for Economic Uncertainties (2% minimum mandated by the State and 2% additional per SCCOE Board Policy 3100).

Kathryn Meola, Attorney, AALRR will present part 2 in a 3 part training series regarding governance and roles and responsibilities of the County Board of Education. Counsel Meola's bio is attached.  Part 2 will provide more specifics of the legal frameworks and legal authority underlying the roles and responsibilities of the County Board of Education, elements of governance and highlight the Fair Political Practices Commission, Ethics, Brown Act and liability.  Part 3 will cover remaining elements and review of legal authority, governance, practices of board self-evaluation, and distinguish between the roles and responsibilities of the County Board of Education and the County Superintendent of Schools.

Background

Complaints filed for SCCOE school sites under the Williams Settlement are limited to insufficient textbooks or instructional materials, unsafe or unhealthy facility conditions or teacher vacancies or mis-assignments.

 

Williams Complaint Procedures are posted in all classrooms to inform parents, students and teachers of the procedure for making such complaints.

 

No Williams complaints were received during the July through September 2022 reporting period.

 

Student Impact

The Williams Report documents complaints regarding textbooks and instructional materials, conditions of facilities, and teacher mis-assignments and vacancies. SCCOE strives to provide students a quality education that encompasses all of these areas. No complaints were filed this quarter.

Student Impact

The Head Start/Early Head Start Program is federally funded to serve 1,946 children, ages 0-5, from very low-income families to promote their school readiness by enhancing their cognitive, social, and emotional development. These services are provided in Santa Clara and San Benito Counties.
