Background
On September 30, 2016, the Charter Schools Office of the Santa Clara County Office of Education received a Petition for Renewal for Rocketship Si Se Puede (a district-wide K-5 charter school) located in the Alum Rock Elementary School district and serves 581 students. Rocketship Si Se Puede (initial petition as Rocketship 2) was approved September 17, 2008, by SCCOE Board of Education, after having being denied by Alum Rock Elementary School district on July 28, 2008. Rocketship Si Se Puede was initially approved for three years, and was renewed by SCCOE Board of Education on December 14, 2011, for the duration of five years. Rocketship Si Se Puede focuses on Responsibility, Persistence, Respect, Empathy, and Healthy Choices as their core values. Per the petition, Rocketship Education is a non-profit network of public elementary charter schools serving primarily low-income students in neighborhoods where access to excellent schools is limited. If approved, Rocketship Si Se Puede shall be renewed for five more years beginning July 2017 through June 30, 2022.
California Education Code Section 47605.6 (b) requires that “no later than 60 days after receiving a petition” the County Board of Education “shall hold a public hearing on the provisions of the charter, at which time the county board of education shall consider the level of support for the petition by teachers,
parents or guardians, and the school districts where the charter school petitioner proposes to place school facilities.”
The Education Code further stipulates that the County Board of Education “shall either grant or deny the charter within 90 days of receipt of the petition. However, this date may be extended by an additional 30 days if both parties agree to the extension.” This item will be placed on the November 16, 2016, board
agenda for a decision.

Background
Complaints filed for SCCOE school sites under the Williams Settlement are limited to insufficient textbooks or instructional materials, unsafe or unhealthy facility conditions or teacher vacancies or mis-assignments.
Williams Complaint Procedures are posted in all classrooms to inform parents, students and teachers of the procedure for making such complaints.
No Williams complaints were received during the July through September 2016 reporting period.

Background
At a special meeting on December 14, 2015 the County Board of Education requested a standing item regarding charter schools on every regular board meeting agenda to provide the board with information about issues and follow up to questions that have been raised by members of the board.
Unaudited Actuals
As of September 15 of every year school districts and charter schools are to submit the prior year’s unaudited actuals report to the County Office for review to be submitted to the California Department of Education by October 15. As of October 6, 2016 all but one charter school have submitted their reports. Silicon Valley Flex, located in Morgan Hill, which closed effective July 25, 2016 has not sent Santa Clara County Office of Education (SCCOE) the required documents. Multiple attempts have been made to acquire the completed financials but the response is continually “we are working on them.” As these documents are then to sent to CDE; discussion has been had with CDE regarding sanctions or penalties which could be imposed on SCCOE should the documents not be submitted. CDE stated that salary sanctions of the County Superintendent’s salary or withholding of payments to members of the governing board only happens if school districts and Joint Powers Authorities (JPA) do not submit their unaudited actuals to the State. These sanctions do not apply to a charter school’s failure to comply. Charter Schools Department staff will continue to monitor this process and keep the board informed.

Marko Mosunic has joined the department as the second Charter Fiscal Administrator. Freddie Lacson is now the new Administrative Assistant III for the department.
Charter School Leaders Meeting
Charter Schools Department staff held a Charter School Leaders' Meeting on October 7, 2016. Representatives from most of the 22 authorized SCCOE charter schools were in attendance. Topics discussed were: introductions of the new staff, annual visit expectations, department goals, Local Control and Accountability Plan (LCAP), SCCOE services, the upcoming Board Charter Study Session on December 14, 2016 and the anticipated Charter Schools Dialogue with the community at a Special Meeting of the SCC Board of Education to be scheduled in 2017.

Alpha Jose Hernandez Middle School
On October 14, 2016, the Charter Schools Office received the renewal petition for Alpha Jose Hernandez Middle School which is located in Alum Rock Elementary School District. Last year, Alpha Jose Hernandez brought a material revision petition to shift from serving grades 6-8 to grades 5-8. This new renewal petition is seeking to adjust the population further and now serve grades TK-8. The public hearing for Alpha is scheduled for November 2, 2016.
