Every fall the Teacher Recognition Celebration honors Santa Clara County's finest teachers, each selected by their respective school districts. The SCCOE produces the annual gala with the generous support of community partners Texas Instruments and Santa Clara County Federal Credit Union. A fine tradition enduring for almost 50 years, the Teacher Recognition Celebration is the oldest and largest celebration of teachers in California, and the most prestigious local award given to classroom teachers.
Today, October 10, 2018, we will honor Janet Blake: County Office of Education, Oster - Deaf and Hard of Hearing Program and Jessica DeAnda: County Authorized Charter School, Sunrise Middle School as the Santa Clara County Office of Education and County Authorized Charter School Teachers of the Year.
At this time, members of the public may address the Board on any issue within the subject matter jurisdiction of the Board that is not listed on this agenda. Members of the public may also address the Board on an agenda item before or during the Board's consideration of the item. No action can be taken on an item not on the agenda at this time, but may be referred to the administration or put on a future agenda. Background
On September 26, 2018, the Charter Schools Department of the Santa Clara County Office of Education received a Petition for Renewal from Sunrise Middle School (a district appeal grades 6-8 charter school) located in the San Jose Unified School District. Sunrise Middle School was approved on March 19, 2014, by SCCOE Board of Education, after having been denied for renewal by San Jose Unified School District on January 14, 2014. Sunrise serves 220 students. If approved, Sunrise shall be renewed for five more years beginning July 2019 through June 30, 2024. Sunrise is also seeking approval to increase its grade levels served by adding 5th grade starting July 2019.
California Education Code Sections 47605 and 47607, and section 11966.4 of the California Code of Regulations, Title 5 requires that “no later than 30 days after receiving a petition” the County Board of Education “shall hold a public hearing on the provisions of the renewal charter, at which time the county board of education shall consider the level of support for the petition by district teachers, other district employees, and parents or guardians.”
The Education Code further stipulates that the County Board of Education “shall either grant or deny the renewal charter within 60 days of receipt of the petition. However, this date may be extended by an additional 30 days if both parties agree to the extension.”
This item will be placed on the November 7, 2018, Board agenda for a decision.

The Charter School office provides oversight and monitoring for 22 County Board of Education authorized charter schools. Sunrise was authorized in 2014 and currently serves 220 students.

Background
Education Code 60119 requires that, in order to receive instructional materials funding, the Board of Education must hold a public hearing each year to determine whether students have sufficient textbooks and instructional materials. Further, the Board of Education must affirm in a resolution that sufficient supplies exist at all sites operated by the Santa Clara County Office of Education and that it has adopted textbooks and instructional materials that are consistent with the state curricular frameworks and standards.
Education Code 60119 was amended recently to implement the provisions of the Williams Settlement. The amendment extends the definition of “sufficient textbooks or instructional materials” to mean that each pupil, including English learners, has textbooks and instructional materials, or both, to use in class and to take home.
Principals in Alternative Education, Special Education and the Opportunity Youth Academy undertook a review and determined textbooks and materials to be sufficient.

Background
On November 6, 1979, the voters of the State of California approved Proposition 4/Gann Initiative. This initiative added Article XIII-B to the State Constitution which has the effect of placing a limit on the amount of proceeds from taxes governmental entities may authorize for expenditure during each fiscal year.
Calculations of 2017-18 and the estimated 2018-19 Gann Appropriations Limits have been made on the attached forms provided by the State Department of Education.
The 2017-18 Gann Appropriations Limit has been calculated using actual proceeds of taxes for comparison with the 2017-18 limit. The SCCOE is within the 2017-18 limit of $208,010,087.
The 2018-19 Gann Appropriations Limit has been calculated at $305,404,071.
The attached forms were made available to the public for review on September 7, 2018 at the main office of the Santa Clara County Office of Education at 1290 Ridder Park Drive, San Jose, CA 95131. The Board of Education is required to have a public hearing and then adopt a resolution to establish the 2018-19 Gann Appropriations Limit.
Requested Action
Conduct a public hearing and adopt the resolution for the 2017-18 Gann Appropriations Limit and the estimated Gann Appropriations Limit for 2018-19.

Background
Santa Clara County services currently funded by Measure A (2012) are scheduled for funding to end. The current Ballot Measure A (2018) will continue the existing one-eighth-cent sales tax to ensure local organizations that provide services to students and families within Santa Clara County.

Education Code 1628 states that on or before October 15 of each year, the county superintendent of schools of each county office shall prepare and file, in a format prescribed by the Superintendent of Public Instruction, an annual statement of all receipts and expenditures of the county office for the preceding fiscal year and shall file the statement, along with the statement received pursuant to subdivision (b) of Section 42100, with the Superintendent of Public Instruction.
Current Status
The attached Santa Clara County Office of Education's Unaudited Actual Financial Report provides 2017-18 actual revenues, expenditures, ending fund balances, and reserves.
In 2017-18, the total County School Service Fund revenues (including transfer-in) were approximately $249 million. Expenditures (including transfer-out) were approximately $242.6 million. The unassigned amount for 2017-18 is approximately $18.9 million, which includes the $9.7 million designated for Reserve for Economic Uncertainty (2% Minimum mandated by the State and 2% additional per SCCOE Board Policy 3100).

This report reflects budget revisions for the month of September 2018. If an expenditure budget is increased, it is supported either by an increase in revenue, a decrease in carryover (use of carryover), a decrease in fund balance or any combination of the three. If an expenditure budget is decreased, the result could be due to a decrease to estimated revenue, or an increase to credit it back to fund balance.
During the month of September 2018, we increased expenditure budgets by $5,175,239, increased revenue by $3,567,932, decreased carryover by $1,537,122 and decreased fund balance by $70,185.

Excepting agenda items otherwise permissible by Education Code, Brown Act or other rules, regulations, or policies for the Board to place on the agenda, a County Board member may request an item within the jurisdiction of the County Board be placed on the agenda. A process for reviewing requested agenda items is described in the board bylaw. In summary, the process includes a review to determine if the item is within the Board's jurisdiction, where it could be placed on the agenda and an assessment of the resource impact of preparing the item.
