Background

On July 1, 2020, AB 1505 took effect and significantly changed the Charter Schools Act. One of the changes was to revise the charter school renewal criteria and standards.

 

On September 16, 2020, and November 18, 2020, respectively, the Charter Schools Department provided an overview of the modified renewal criteria and a presentation on the new three tiered approach to renewals, including the use of the California School Dashboard and the revised grounds for denying a renewal based on school performance.

 

The Charter Schools Department will provide information on the renewal criteria and data for alternative charter schools that serve high-risk students including an explanation of the alternative accountability system known as DASS.

 

Student Impact

The Charter Schools Department provides monitoring and oversight for 22 charter schools authorized by the Santa Clara County Board of Education which serve approximately 10,000 students.

Background

On January 11, 2021, the Charter Schools Department of the Santa Clara County Office of Education (SCCOE) received a charter petition renewal request from Opportunity Youth Academy (OYA).  OYA is seeking approval to renew a SCCOE-authorized, dependent, countywide benefit charter. OYA was initially approved in August 2016 for a five-year term. Material revisions were approved in 2017, 2018, and 2019 regarding adjustments to the educational program and opening additional sites.  OYA's current enrollment is approximately 330 students (grades 9-12). 

 

OYA is an alternative school under the state's accountability framework.  California Education Code (EC) Section 52052(d) required: The State Superintendent, with the approval of the State Board of Education, shall develop an alternative accountability system for schools under the jurisdiction of a county board of education or a county superintendent of schools, community day schools, . . . and alternative schools serving high-risk pupils, including continuation high schools and opportunity schools.  The Dashboard Alternative School Status (DASS) program replaces the previously administered Alternative Schools Accountability Model (ASAM) and holds alternative schools and alternative schools of choice accountable for modified methods of measurement for accountability indicators, when appropriate.

 

California Education Code Section 47605.6 requires that “no later than 60 days after receiving a petition” the County Board of Education “shall hold a public hearing on the provisions of the charter, at which time the County Board of Education shall consider the level of support for the renewal petition by teachers, parents or guardians, and the school districts where the charter school petitioner proposes to place school facilities.”

 

The Education Code further stipulates that the County Board of Education “shall either grant or deny the charter within 90 days of receipt of the petition.  However, this date may be extended by an additional 30 days if both parties agree to the extension.”  This item will be placed on the April 7, 2021, board agenda for decision on the renewal, requiring an extension.

Student Impact

Refer to Board Bylaw 9322 Agenda/Meeting Materials for specific information related to the preparation of County Board of Education agendas.
