Background

Per the California Education Code 48240, all school districts must appoint a Supervisor of Attendance to oversee pupil attendance. Recent amendments now require the Supervisor of Attendance to create a culture of attendance within the district and establish a system to accurately track pupil attendance. As a result, Supervisors of Attendance may institute appropriate attendance interventions if and when necessary. Per Education Code 48245, the County Office of Education Board must certify Supervisors of Attendance in districts with ADA of 1,000 or more for this work.

Student Impact

The Santa Clara County Office of Education's School Climate, Leadership & Instructional Services Department conducted a Supervisors of Attendance Certification Training on August 25, 2021. The three-hour session focused on the duties of the Supervisors of Attendance and the three tiers to attendance supervision to support Local Education Agencies' tiered re-engagement strategies for students, reviewed Education Code 48240-226 (Supervisor of Attendance requirements) and law updates (SB98), guidance on fulfilling mandates, data analysis, and best practices to promote daily attendance.

Background

On November 6, 1979, the voters of the State of California approved Proposition 4/Gann Initiative. This initiative added Article XIII-B to the State Constitution, which has the effect of placing a limit on the amount of proceeds from taxes governmental entities may authorize for expenditure during each fiscal year.

 

Pursuant to California Education Code 1629, on or before October 15 of each year, the Santa Clara County Board of Education shall adopt a resolution pursuant to Division 9 (commencing with Section 7900) of Title 1 of the Government Code, to identify the estimated appropriations limit for the county office of education for the current fiscal year and the actual appropriations limit for the preceding fiscal year.  The resolution shall be adopted at a regular or special meeting of the Board. Section 7910 of the Government Code requires the documentation used in the identification of the appropriations limits be made available to the public fifteen days prior to the meeting. This documentation is available for public review on the SCCOE Homepage at www.sccoe.org.

Indigenous People’s Day is nationally celebrated on the second Monday of October, and the month of November is Native American Heritage Month. In 1990 President George H. W. Bush approved a joint resolution designating November 1990 “National American Indian Heritage Month.” Since 1991, dozens of cities, several universities, and a growing number of states have adopted Indigenous Peoples’ Day, a holiday that celebrates the history and contributions of Native Americans. The SCCOE is honored to acknowledge and celebrate local and national American Indians and the significant contributions made to grow the U.S.

 

Student Impact

The SCCOE joins the City of San Jose in honoring and supporting the region’s first people as efforts are made to revive their culture, language, and history. November is National Homeless Youth Awareness Month. It was first declared as National Homeless Youth Awareness Month in 2007. Since then, November has been a time to acknowledge those children and families experiencing homelessness. The SCCOE recognizes the need to bring awareness to and support the more than 1.5 million students, from kindergarten

through grade 12, who experience homelessness.

Congress is currently considering the Build Back Better Act, a bill to provide for reconciliation pursuant to title II of the Concurrent Resolution on the Budget for Fiscal Year 2022, Senate Constitutional Resolution 14. Build Back Better Act includes $450 billion to support early learning and childcare and $35 billion for school nutrition programs.

 

Student Impact

The act includes a proposal to help subsidize the cost of childcare so that middle-income families in Santa Clara County spend no more than 7% of their income on childcare. The school nutrition provision proposes changes to the community eligibility provision to make it significantly easier for schools in Santa Clara County to qualify to provide universal meals to all students regardless of income.

On March 17, 2020, the Governor issued Executive Order N-29-20 that suspended the teleconferencing rules set forth in the Brown Act enabling legislative bodies to meet remotely.  On September 16, 2021, the Governor signed AB 361 authorizing a legislative body subject to the Brown Act to continue to meet remotely using teleconference without compliance with the Brown Act teleconference rules if certain conditions are followed. On September 21, 2021, the County Health Officer issued a recommendation, which is attached hereto and incorporated herein, that public bodies continue to meet remotely.

 

Student Impact

The County Health Officer has recommended that legislative bodies continue to meet remotely to promote social distancing as one means to reduce the risk of COVID-19 transmission. The Santa Clara County Office of Education has an important governmental interest in protecting the public health, safety, and welfare of those who participate in meetings of the various legislative bodies during COVID-19 and ensuring that all members of the public can participate safely in meetings of legislative bodies.

Background

On September 15, 2021, the Charter Schools Office of the Santa Clara County Office of Education received from Bullis Charter School (BCS) a request to revise the preferences for admission into BCS. BCS is seeking approval to revise its admission preferences in order to increase access to and diversity in enrollment and to better align its student population with that of Los Altos School District (LASD). The Santa Clara County Board of Education (SCCBOE) originally approved the BCS charter on appeal from Los Altos School District (LASD) in 2003, to serve students in grades K-8. BCS has been renewed several times and its current term expires June 30, 2024, due to the two-year term extension granted by recently added Education Code Section 47607.4.

 

Consideration for Board Decision

California Education Code Section 47605(e)(2)(A) states that “A charter school shall admit all pupils who wish to attend the charter school” and provides for admission preferences to be permitted by the chartering authority on an individual charter school basis. Section 47605(e)(2)(B) sets forth requirements for any such admission preferences, and specifies, “Each type of preference shall be approved by the chartering authority at a public hearing.”

 

BCS has specified that it is proposing the change to its admission preferences as part of an ongoing effort by SCCOE to work with BCS on increasing enrollment access and diversity at BCS, and specifically in response to the Notice in Accordance with Education Code Section 47607(e) and Notice of Concern sent to BCS on May 21, 2021 (“Notice”). The Notice described serious concerns about the lack of diversity at BCS, and specifically that students who are socioeconomically disadvantaged, who have disabilities, who are English learners, and who are Hispanic are underrepresented at BCS, and the need for BCS to establish and implement a corrective action plan to address these issues. SCCOE specifically recommended in the Notice that BCS consider adding to and revising its admission preferences as appropriate among its actions to remediate these concerns.

 

BCS proposes that its admission preferences be changed to the following (the proposed new preferences are indicated in bold font):

 

BCS is requesting approval of these modifications so they may take effect for the 2022-23 Open Enrollment period, which begins November 1, 2021.

Background

Education Code 60119 requires that, in order to receive instructional materials funding, the Board of Education must hold a public hearing each year to determine whether students have sufficient textbooks and instructional materials.  Further, the Board of Education must affirm in a resolution that sufficient supplies exist at all sites operated by the Santa Clara County Office of Education and that it has adopted textbooks and instructional materials that are consistent with the state curricular frameworks and standards. 

 

Education Code 60119 was amended recently to implement the provisions of the Williams Settlement.  The amendment extends the definition of “sufficient textbooks or instructional materials” to mean that each pupil, including English learners, has textbooks and instructional materials, or both, to use in class and to take home.

 

Principals in Opportunity Youth Academy, Alternative Education, and Special Education undertook a review and determined textbooks and materials to be sufficient.

 

 

Student Impact

Instructional materials consistent with the state curricular framework and standards supports the improvement and access to inclusive, equitable, and high quality education.   Students have access to print and online materials that support their educational goals across all core academic content areas.

The Head Start/Early Head Start Program is federally funded to serve 1,946 children, ages 0-5, from very low-income families to promote their school readiness by enhancing their cognitive, social, and emotional development. These services are provided in Santa Clara and San Benito Counties.
