Background

On March 17, 2020, the Governor issued Executive Order N-29-20 that suspended the teleconferencing rules set forth in the Brown Act enabling legislative bodies to meet remotely.  On September 16, 2021, the Governor signed AB 361 authorizing a legislative body subject to the Brown Act to continue to meet remotely using teleconference without compliance with the Brown Act teleconference rules if certain conditions are followed. On September 21, 2021, the County Health Officer issued a recommendation, which is attached hereto and incorporated herein, that public bodies continue to meet remotely.

 

Student Impact

The County Health Officer has recommended that legislative bodies continue to meet remotely to promote social distancing as one means to reduce the risk of COVID-19 transmission. The Santa Clara County Office of Education has an important governmental interest in protecting the public health, safety, and welfare of those who participate in meetings of the various legislative bodies during COVID-19 and ensuring that all members of the public can participate safely in meetings of legislative bodies.

Background

The Educator Effectiveness funding may be used to support professional learning for certificated teachers, administrators, paraprofessional educators, and other certificated staff to promote educator equity, quality, and effectiveness. The SCCOE will receive $2,493,104.00 to be spent on specific professional learning priority areas during the 2021–2026 fiscal years. The specific focus areas are listed below and include training, coaching and support for student and staff wellness, trauma informed practices, STEAM communities of practice, early learning literacy, employee onboarding and retention, and inclusive and restorative practices.

 

 

The funding will be allocated to the following professional learning focus areas:

  1. Coaching and mentoring of staff serving in an instructional setting and beginning teacher or administrator induction, including, but not limited to, coaching and mentoring solutions that address a local need for teachers that can serve all pupil populations with a focus on retaining teachers, and offering structured feedback and coaching systems organized around social-emotional learning, including, but not limited to, promoting teacher self-awareness, self-management, social awareness, relationships, and responsible decision making skills, improving teacher attitudes and beliefs about one’s self and others, and supporting learning communities for educators to engage in a meaningful classroom teaching experience.
  2. Programs that lead to effective, standards-aligned instruction and improve instruction in literacy across all subject areas, including English language arts, history-social science, science, technology, engineering, mathematics, and computer science.
  3. Strategies to implement social-emotional learning, trauma-informed practices, suicide prevention, access to mental health services, and other approaches that improve pupil well-being.
  4. Practices to create a positive school climate, including, but not limited to, restorative justice, training around implicit bias, providing positive behavioral supports, multitiered systems of support, transforming a school site’s culture to one that values diverse cultural and ethnic backgrounds, and preventing discrimination, harassment, bullying, and intimidation based on actual or perceived characteristics, including disability, gender, gender identity, gender expression, language, nationality, race or ethnicity, religion, or sexual orientation.
  5. Strategies to improve inclusive practices, including, but not limited to, universal design for learning, best practices for early identification, and development of individualized education programs for individuals with exceptional needs.
  6. Instruction and education to support implementing effective language acquisition programs for English learners, which may include integrated language development within and across content areas and building and strengthening capacity to increase bilingual and biliterate proficiency.

Fiscal Implications

SCCOE will receive $2,493,104.00 to support professional learning for certificated teachers, administrators, paraprofessional educators, and other certificated staff.

 

 

Student Impact

Educator Effectiveness funds directly impact all SCCOE students. These funds will be used to support professional learning for certificated teachers, administrators, paraprofessional educators, and other certificated staff who work directly with students in all of our programs.

Background

California faces an increasing backlog of unfunded school modernization and construction projects as funds from previous bonds are currently reserved. The backlog currently totals more than $3 billion dollars. To address the backlog of school renovation and construction projects, California voters will see the Kindergarten-Community College Public Education Facilities Bond Act of 2022 (Bond Act of 2022) on the ballot. The Bond Act of 2022 originates from Assembly Bill 75 (AB 75). If passed by voters, $12 billion, as a statewide general obligation bond, would be available for renovations and improvements of existing classrooms, construction of new classrooms and school facilities, upgrades for HVAC systems and clean air filters, expansion of career technical education facilities to improve job and career training, charter school facilities, assistance for small school districts, and interim housing to help districts impacted by natural disasters.

The Santa Clara County Office of Education is committed to providing a quality education to our students and preparing them to succeed through equitable and accessible modern learning facilities.

Fiscal Implications

Carryover in the amount of $22.5 million from fiscal year 2020-2021 has been carried forward and budgeted in fiscal year 2021-2022.

Background

Education Code Section 1240(l)(1)(A)(B) requires that the County Office of Education submit two reports during the fiscal year to the County Board of Education. The first report shall cover the actual revenues and expenditures of the County Office of Education for the period from July 1 through October 31, and updated projections for the balance of the year. The second report shall cover the period ending January 31, and updated projections for the balance of the year.  Both reports shall be reviewed by the County Board of Education and approved by the County Superintendent no later than 45 days after the close of the period being reported. As part of each report, the County Superintendent shall certify in writing whether or not the County Office of Education is able to meet its financial obligations for the remainder of the fiscal year and, based on current forecasts, for two subsequent fiscal years. 

 

This First Interim Financial Report, following the Standards and Criteria as set forth by the State of California, reports that the Santa Clara County Office of Education is able to maintain a Positive Certification as to its financial condition and is able to meet its financial obligations for the current fiscal year and two subsequent fiscal years.

The County Board shall hold an annual organizational meeting in accordance with law and the provisions of Board Bylaw 9100. At its organizational meeting, the County Board shall adopt a yearly calendar for its regular meetings. By Board action, the Board may deviate from its adopted calendar for the convenience of its members or for other reasons. (Education Code 1009.)

 

Regular meetings of the County Board shall be held at such time and place as members determine, but shall not be held less frequently than one meeting per month. The County Board shall generally hold its meetings at 5:00 p.m., in the San Jose Room of the Santa Clara County Office of Education, 1290 Ridder Park Dr., San Jose. Due to COVID19, it is anticipated that meetings may need to be held remotely.

The following routine travel for which SCCOE Funds may be expended for County Board member travel and for which County Board members may receive reimbursement for their expenditures are considered to be pre-approved by the County Board. No further approvals are required as long as budgeted funds have not been depleted. All fees and costs associated with these meetings shall be charged to the County Board’s Travel Fund. Background

 

California Education Code 1090 provides that, "On an annual basis, the County Board of Education may increase the compensation of individual board members beyond the limits delineated in this section, in an amount not to exceed 5 percent based on the monthly rate of compensation and in accordance with County Board Bylaw 9250.  Any increase made pursuant to this section shall be effective upon approval by the County Board of Education."

 

 

Fiscal Implications

 

Increasing the board compensation, effective January 1, 2022, would increase current board compensation from $1,010.79 to $1,061.33 per month.  This is an increase of $50.54 per month per member and an increase of $606.48 per year per member.  If all board members elect to take the increase, it would be a budget increase of $4,245.36 per year for all seven members.

Background

 

On October 1, 2021, Dewan  provided an update on the status of Census 2020 Data and the subsequent analysis of Trustee Areas. The 2020 census results were delayed due to the COVID19 pandemic. 

 

By education code, Trustee Areas must be reviewed following every decennial census.  Trustee Areas must remain “population balanced” utilizing the latest census data according to Education Code Section 5019.5.  If upon review of the census data, adjustments are required, then the trustee area boundaries must be adjusted before March 1 of the year following the year in which the results of each decennial census are released. (EC 5019.5) The Census Data was released on Thursday, August 12, 2021. Thus, the County Committee will be required to review and adjust trustee area boundaries before March 1, 2022.  

 

Every 10 years following the U.S. Census, the County Committee on School District Organization (County Committee) is required to review and if necessary, redraw the boundaries of the trustee areas of the County Board of Education to ensure that each has approximately the same number of residents. The criteria used by County Committee are derived from case law and Education Code.  Pursuant to Education Code 5019.5, trustee areas boundaries shall be adjusted so that one or both of the following conditions is satisfied:

 

1. The population of each area is, as nearly as may be, the same proportion of the total population of the district as the ratio that the number of governing board members elected from the area bears to the total number of members of the governing board.

2. The population of each area is, as nearly as may be, the same proportion of the total population of the district as each of the other areas.

Senior Associate Director with Cooperative Strategies have conducted the analysis and will provide a report of their findings.

 

Cooperative Strategies has conducted an analysis of Santa Clara County Board of Education’s (“SCCBOE”) Trustee Areas to determine population balance in accordance with Education Code Section 1002(b). The legal presumption for compliance with the population balance requirement is less than 10% variance of total population between the most populated trustee area and the least populated trustee area.


Based on 2020 US Census data (validated by California Department of Finance and finalized on September 27, 2021), it has been determined that SCCBOE’s current Trustee Areas are not in compliance based on total population distribution (greater than 10% variance). The chart below details the findings.

 

 

 

This report will offer the SCCBOE Trustees an opportunity to review the information before it is presented to County Committee. The SCCBOE will receive the information and may discuss whether to make no recommendation to the County Committee, recommend that only one of the proposed maps be presented to the County Committee, or recommend the County Committee consider both proposed maps.
