Background

On March 17, 2020, the Governor issued Executive Order N-29-20 that suspended the teleconferencing rules set forth in the Brown Act enabling legislative bodies to meet remotely.  On September 16, 2021, the Governor signed AB 361 authorizing a legislative body subject to the Brown Act to continue to meet remotely using teleconference without compliance with the Brown Act teleconference rules if certain conditions are followed. On September 21, 2021, the County Health Officer issued a recommendation, which is attached hereto and incorporated herein, that public bodies continue to meet remotely. On October 6, 2021, November 17, 2021, December 15, January 19, and February 2 the Santa Clara County Board of Education passed Resolution No. 2289-5 authorizing virtual board meetings pursuant to AB 361.

 

Student Impact

The County Health Officer has recommended that legislative bodies continue to meet remotely to promote social distancing as one means to reduce the risk of COVID-19 transmission. The Santa Clara County Office of Education has an important governmental interest in protecting the public health, safety, and welfare of those who participate in meetings of the various legislative bodies during COVID-19 and ensuring that all members of the public can participate safely in meetings of legislative bodies.

Per Education Code Section 32281 (b) (1) Except as provided in subdivision (d) with regard to a small school district, the School Site Council established pursuant to former Section 52012, as it existed before July 1, 2005, or Section 52852 shall write and develop a comprehensive school safety plan relevant to the needs and resources of that particular school or the School Site Council may delegate this responsibility to a school site safety planning committee.

 

Student Impact

The Comprehensive School Safety Plan provides a cohesive approach to prevent, respond to, and to minimize safety issues, natural disasters, and unplanned events on campus. When basic safety needs are met, students have better attendance, stronger engagement, and perform better overall.

On February 2, 2022 the Policy Subcommittee met and approved revisions to BP 5113 Absences and Excuses and BP 6173 Education for Youth Experiencing Homelessness.

 

BP 5113 Absences and Excuses

Board policy updated to reflect new law to include on the list of excused absences, absence for the benefit of a pupil's mental or behavioral health. Corresponding regulation also includes the addition of a twice yearly notification to parents/guardians regarding student access to mental health services.

BP 6173 Education for Youth Experiencing Homelessness

Policy updated to remove barriers to identification, enrollment, and retention of homeless children, ensure homeless students are not segregated or stigmatized, provide for professional development, and ensure transportation is provided to and from school of origin. Policy not updated since 2010, reflects updated/new laws and procedures educating and providing services for homeless youth and families.

Student Impact

The Head Start/Early Head Start Program is federally funded to serve 1,946 children, ages 0-5, from very low-income families to promote their school readiness by enhancing their cognitive, social, and emotional development. These services are provided in Santa Clara and San Benito Counties.

Background

Per Board Policy BP 3100, budget amendments are submitted for County Board approval when the state budget is adopted, collective bargaining agreements are accepted, SCCOE income declines, increased revenues or unanticipated savings are made available to the SCCOE, or program proposals are significantly different from those approved during budget adoption. 

 

Budget revisions (amendments) are typically presented to the County Board monthly with the exception of October, January and June of each year as more time is needed to compile information for first and second interim and fiscal year-end reporting periods.

 

The table below provides an updated timeline of when the monthly budget revisions will be presented to the County Board for the remainder of fiscal year 2021-2022.
