Background

Education Code (EC) 1620 requires that on or before July 1 of each fiscal year, the county board of education shall hold a public hearing on the County School Service Fund Budget. The public hearing shall be held prior to the adoption of the budget, and shall occur not less than three days following the availability of the budget for public inspection. Education Code (EC) 52068 (b)(1) also requires the public hearing for the Local Control and Accountability Plan (LCAP) shall be held at the same meeting as the public hearing required by Section 1620 for the proposed budget.

 

Budget Summary

The 2022-23 County School Services Fund Budget is developed based upon a set of assumptions and the most up-to-date information available from the May Revise, legislative budget proposals, with guidance from organizations such as the California Department of Education and Department of Finance.

 

For the County School Service Fund in 2022-23, total projected revenues are approximately $284.49M and projected expenditures are approximately $306.60M. This includes approximately $44.36M in expenditures for the return of local property taxes to the state and may change depending upon local property tax revenues. The 2022-23 projected reserve for economic uncertainty, after removing certain designations, is approximately $12.26M. This is based on a projected beginning fund balance of approximately $85.16M. The actual beginning fund balance will be determined after the fiscal books for 2021-22 are closed in late August/early September.

 

Education Code (EC) 1040 requires the county board of education to approve the annual County School Service Fund Budget of the county superintendent of schools and will be presented for approval at the June 15, 2022 board meeting.

Background

Pursuant to Education Code (EC) 52068(b)(1), school districts and county offices of education are required to hold a public hearing to solicit the recommendations and comments of members from the public regarding the specific actions and expenditures proposed to be included in the Local Control Accountability Plan (LCAP).  The public hearing shall be held at the same meeting as the public hearing required by EC 1622 for the County Office of Education Budget to be adopted for the subsequent fiscal year.

 

Recommendations and comments can be emailed to LCAP_Comments@sccoe.org

 

The adoption of the LCAP may be held no sooner than one day after the public hearing for the LCAP.  The adoption of the LCAP is scheduled for the June 15, 2022, meeting of the Board.

 

Current Status

The SCCOE’s Local Control Accountability Plan was developed with guidance from the California Department of Education and utilized the process and template adopted by the State Board of Education.  This document includes: (a) the Budget Overview for Parents, (b) the Supplement to the 2021-22 LCAP Annual Update which was presented to the Board in February, and (c) the 2022-23 Local Control Accountability Plan.  The 2022-23 Local Control Accountability Plan contains outcomes and updates regarding the planned: (a) goals, (b) actions, and (c) expenditures defined in the 2022-23 Local Control Accountability Plan. Educational partners to include: (a)  parents, (b) students, and (c) staff participated in the development of the LCAP through input protocols which included: (a) monthly LCAP Parent Advisory Committee meetings, (b) monthly LCAP District Advisory Committee meetings, (c) participation in the Annual LCAP Survey, and (d) participation in school site level LCAP engagement sessions. The final 2022-23 LCAP was presented for advisement to the: (a) Parent Advisory Committee, (b) the District English Learner Advisory Committee, and the (c) Special Education Local Plan Area committee pursuant to EC Section 52063.

Background

On March 17, 2020, the Governor issued Executive Order N-29-20 that suspended the teleconferencing rules set forth in the Brown Act enabling legislative bodies to meet remotely.  On September 16, 2021, the Governor signed AB 361 authorizing a legislative body subject to the Brown Act to continue to meet remotely using teleconference without compliance with the Brown Act teleconference rules if certain conditions are followed. On September 21, 2021, the County Health Officer issued a recommendation, which is attached hereto and incorporated herein, that public bodies continue to meet remotely. On October 6, 2021, November 17, 2021, December 15, 2021, January 19, 2022, February 2, 2022, February 16, 2022,  March 2, 2022, March 16, 2022, April 6, 2022, April 20, 2022, May 4, 2022 and May 18, 2022 the Santa Clara County Board of Education passed Resolution No. 2289-5 authorizing virtual board meetings pursuant to AB 361.

 

Student Impact

The County Health Officer has recommended that legislative bodies continue to meet remotely to promote social distancing as one means to reduce the risk of COVID-19 transmission. The Santa Clara County Office of Education has an important governmental interest in protecting the public health, safety, and welfare of those who participate in meetings of the various legislative bodies during COVID-19 and ensuring that all members of the public can participate safely in meetings of legislative bodies.

Background

The Early Learning Services Department has received notification from the Administration for Children and Families, Health and Human Services Department that the Santa Clara County Office of Education is eligible to apply for a Head Start/Early Head Start and Early Head Start Child Care Partnership Cost of Living Adjustment (COLA) and Quality Improvement (QI) funding increases. Funding increase for a COLA is in the amount of $758,278 and QI is in the amount of $127,551 for a total of $885,829

Student Impact

The Head Start/Early Head Start Program is federally funded to serve 2,188 children, ages 0-5, from very low-income families to promote their school readiness by enhancing their cognitive, social, and emotional development.  These services are provided in Santa Clara and San Benito Counties.

On May 4, 2022 the Policy Subcommittee met and approved updates to BP 0420.4 Charter Schools. This policy was brought to the Board on May 18, 2022 for first reading. BP 0420.4 Charter Schools was originally adopted on June 3, 2009 and revised on the following dates: November 15, 2017, November 6, 2019, June 10, 2020, and June 9, 2021.

The Education Omnibus Budget Trailer Bill, AB 130, approved in July 2021, included several changes to law affecting charter schools.  As a result, SCCOE staff reviewed the existing Board Policy 0420.4 on Charter Schools to determine if corresponding changes were required.  As part of this routine process for reviewing and updating County Board policies, staff recommended several revisions in order to clean-up and clarify provisions of BP 0420.4 consistent with applicable requirements of the Education Code and SCCOE practices.  The proposed revisions are minor updates that align with the requirements of the Charter Schools Act, specifically including Education Code Section 47604, 47604.1, 47604.3, 47605, 47605.6, 47607, and 47607.2, and further clarify charter school requirements and County Board practices and expectations.

The proposed updates to BP 0420.4 were considered at an open public meeting of the County Board’s Policy Subcommittee on May 4, 2022, in accordance with SCCOE’s standard procedure for reviewing and updating County Board policies.  At that meeting, any interested members of the public were able to provide input.  Thereafter, the policy was further updated to reflect changes requested by members of the Policy Subcommittee.  During the SCCBOE May 4, 2022, meeting, the Policy Subcommittee announced that it would be bringing the revised BP 0420.4 for first reading at the SCCBOE May 18, 2022, meeting.  Then – again consistent with the SCCBOE's established processes for updating its policies – the SCCBOE as a whole considered the proposed policy updates during a first reading at its May 18, 2022, Board meeting, at which all interested members of the public were again afforded an opportunity to comment.  During that meeting, several members of the public provided input during public comments, and County Board members also asked questions and/or made comments.  At the direction of the SCCBOE during the May 18, 2022, meeting, additional revisions have been made to BP 0420.4. 

The proposed updates to the policy include the addition of definitions of terms used in the policy for purposes of general understanding and the addition of clarifying language and/or details to track more specifically the applicable statutory requirements and/or to provide greater clarity to the policy’s meaning.  In recent years, there have been a number of revisions to the Charter Schools Act demonstrating the importance of equity in access to Charter Schools, including revisions to Education Code Sections 47605(e), 47605.6(e), and 47607(d) and (e).  The policy has been updated to include among the examples of items that should be addressed in material revision or charter renewal petitions any problems a charter school has experienced regarding admitting, enrolling, and/or serving all students who wish to attend the charter school.

The updated BP 0420.4 will be presented for second reading and approval.

Background

Thus far, there have been 27 school shootings in 2022. Gun violence on school campuses represents a particularly egregious and unacceptable threat to the lives of students, teachers and staff across the country. Policymakers need to take swift action to protect our youth and provide safe environments for them. The Santa Clara County Board of Education and County Superintendent urge Congress to take action to address gun violence and protect our youth. 

 

Student Impact

Gun violence in schools occurs in America with a frequency and severity that is unparalleled anywhere in the world. Exposure to trauma can adversely affect a child’s health for the rest of their life. The most effective approach to creating safe school environments is a comprehensive, coordinated effort including schoolwide, districtwide and communitywide strategies supplemented with legislation, resources, and support at the state and federal legislation level.
