Background

 

The Santa Clara County Board of Education (County Board) and the County Superintendent of Schools (County Superintendent) support civic engagement and understand the importance of public education as foundational to our democracy. The Santa Clara County Board of Education (County Board) and the County Superintendent of Schools (County Superintendent) believe it is important to seek and consider students’ ideas, viewpoints, and reactions to education. To provide Santa Clara County Office of Education (SCCOE) high school students with opportunities for civic engagement and to provide valued input to the County Board, the County Board shall ensure inclusion of a student member (Student Board Member) upon receipt of a petition for student representation (Student Representation Petition) consistent with Education Code section 1000 (as amended by Assembly Bill 824 of 2021). 

 

Pursuant to BB 9150, the County Superintendent of Schools received a petition from students of the SCCOE High School programs on May, 2022. The Student Representation Petition included the signatures of not less than 10 percent of the students regularly enrolled in the SCCOE high school program.  The County Superintendent finds that the petition does comply with the BB 9150 and therefore reports to the SCCBOE that it shall now establish a seat for the Student Board Member on the SCCBOE.  

 

The SCCBOE shall take action to adopt the attached Resolution to Establish Student Board Member Seat on Santa Clara County Board of Education.

Background

On June 3, 2022, the Charter Schools Department of the Santa Clara County Office of Education received a request to materially revise the Charter for Voices College-Bound Language Academy at Morgan Hill (VMH). VMH is seeking approval to materially revise its Charter to conform with any new laws enacted since the petition was last reviewed and temporarily relocate from one physical location to three while awaiting the completion of construction on a permanent facility. The request to temporary relocate the school is for the 2022-23 and potentially the 2023-24 school years but no later than the 2024-25 school which coincides with the renewal term. VMH, initially approved as a TK-8 school on appeal from Morgan Hill Unified School District on November 19, 2014, was renewed by the Santa Clara County Board of Education in 2017-18. The school's current term expires on June 30, 2025, due to the two-year charter term extension, resulting from the COVID-19 pandemic.

 

California Education Code Sections 47607 and 47605 require that “no later than 60 days after receiving a petition” the County Board of Education "shall hold a public hearing on the provisions of the charter, at which time the County Board of Education shall consider the level of support for the request for material revision to the charter petition by teachers, parents or guardians, and the school districts where the charter school petitioner proposes to place school facilities.”

 

The Education Code further stipulates the County Board of Education “shall either grant or deny the charter within 90 days of receipt of the petition.”

The Charter School Department provides oversight and monitoring for 22 County Board of Education-authorized charter schools.  VMH was authorized in 2014 and currently serves approximately 400 students.

Background

On March 17, 2020, the Governor issued Executive Order N-29-20 that suspended the teleconferencing rules set forth in the Brown Act enabling legislative bodies to meet remotely.  On September 16, 2021, the Governor signed AB 361 authorizing a legislative body subject to the Brown Act to continue to meet remotely using teleconference without compliance with the Brown Act teleconference rules if certain conditions are followed. On September 21, 2021, the County Health Officer issued a recommendation, which is attached hereto and incorporated herein, that public bodies continue to meet remotely. On October 6, 2021, November 17, 2021, December 15, 2021, January 19, 2022, February 2, 2022, February 16, 2022,  March 2, 2022, March 16, 2022, April 6, 2022, April 20, 2022, May 4, 2022, May 18, 2022, and June 8, 2022 the Santa Clara County Board of Education passed Resolution No. 2289-5 authorizing virtual board meetings pursuant to AB 361.

 

Student Impact

The County Health Officer has recommended that legislative bodies continue to meet remotely to promote social distancing as one means to reduce the risk of COVID-19 transmission. The Santa Clara County Office of Education has an important governmental interest in protecting the public health, safety, and welfare of those who participate in meetings of the various legislative bodies during COVID-19 and ensuring that all members of the public can participate safely in meetings of legislative bodies.

Background

The Local Control Accountability Plan (LCAP) Federal Addendum provides an overview of the SCCOE Educational Services Division alignment of federal funds (Title I, II, III, and IV) with of Local Control Funding Formula (LCFF) goals and expenditures. The purpose of the California LCAP Federal Addendum is to address the district’s attention to: education of English Learners and (a) students experiencing homelessness, (b) parent and family engagement, (c) support for incarcerated, delinquent, and socially economically disadvantaged youth, and (d) training for highly qualified staff as defined in the Every Student Succeeds Act (ESSA).  The LCAP Federal Addendum is submitted annually to the California Department of Education after Local Governing Board approval.

 

Student Impact

The LCAP Federal Addendum content directly impacts the academic and social emotional needs of the SCCOE students and families. The LCAP Addendum defines district use of federal funds and their alignment with Local Control Funding Formula (LCFF) goals and funding. This alignment impacts SCCOE students through a focus on: (a) rigorous, relevant, and engaging instruction, (b) a successful transition to college and/or career, and (c) a culturally responsive and safe learning environment grounded in partnership with community and family members.  Funds also support Santa Clara County foster youth and Santa Clara County expelled youth.

Background

California Education Code sections 41507 and 41572 require each school to consolidate all school plans for programs funded through the Consolidated Application and Reporting System, into the School Plan for Student Achievement (SPSA).

 

The School Site Councils from the three Santa Clara County Office of Education’s (SCCOE) schools, (Community Schools, Court Schools, and Special Education) revised and approved their SPSAs to include updated budget information.

 

Student Impact
The School Plan for Student Achievement (SPSA), formerly known as the Single Plan for Student Achievement is completed annually by school sites accepting federal funds. Through an educational partner engagement process including (a) staff, (b) students, and (c) parents, each school site sets goals and budgets funds to support student achievement and student and parent engagement. SPSAs directly impact SCCOE students through a focus on: (a) programming, (b) direct service to students and parents, and (c) professional development. SPSA goals are aligned with the SCCOE LCAP goals.

Background
The State Board of Education (SBE) approved standards for the local performance indicators that support local educational agencies (LEAs) in measuring and reporting their progress within the appropriate priority area. For each local indicator, the approved standard includes:

  1. Measuring the LEA progress on local indicators based on locally available information, and
  2. Reporting the results to the LEA's local governing board at a regularly scheduled meeting of the local governing board and to stakeholders and the public through the Dashboard
     

For each applicable local indicator, LEAs assign one of three performance levels:

LEAs make the determination for each applicable local indicator by using the self-reflection tool to measure and report their progress through the Dashboard. The collection and reflection on locally available information relevant to progress on local priority areas will support LEAs in local planning and improvement efforts.  LEAs determine if they meet the adopted performance standards using a self-reflection tool. 

The Performance Standard Indicators on the self-reflection tool include Basic Services and Conditions, Implementation of State Academic Standards, Parent and Family Engagement, School Climate, Access to Broad Course of Study, Coordination of Services for Expelled Students and Coordination of Services for Foster Youth.  These priority areas are considered local indicators and will be reported as Met, Not Met, or Not Met for Two or More Years using locally available data.   

 

 

Student Impact
The Alternative Education and Special Education Departments within the Educational Services Division provide individualized educational settings for some of the most diverse students within Santa Clara County in collaboration with local districts, community partners, and county agencies. The LCAP and California School Dashboard illustrate, inform, and highlight our unique programs that ensure inclusion, equity, and high-quality education for all students in addition to Foster Youth, homeless, and expelled youth services throughout Santa Clara County.

Background

On November 6, 2012, the voters of California approved Proposition 30, which temporarily increased the state’s sales tax and the personal income tax rates for upper-income taxpayers. Part of the revenue generated would be used to support Local Educational Agency (LEA) funding, with the remainder helping to balance the state budget.

 

Revenues generated from Proposition 30 are deposited into a state account called the Education Protection Account (EPA). The EPA began January 1, 2012, and continues for seven years (December 31, 2018), during the time that Proposition 30 will be effective. Proposition 55 was approved on November 8, 2016, which extends the EPA account through 2030.

 

Current Status

The creation of the EPA by Proposition 30 also comes with some accountability components. One requirement is having the spending plan approved by the governing board during a public meeting. Another requirement is that the LEA must publish on its website (each year) an accounting of the estimated revenue it will receive from the EPA and how much will be expended. In addition, EPA funds cannot be used for the salaries or benefits of administrators or any other administrative costs.

 

Enclosed is the Santa Clara County Office of Education’s estimated EPA spending plan for 2022-23.

Background

Pursuant to Education Code (EC) 52068(b)(1), the Santa Clara County Office of Education held a public hearing  to solicit recommendations and comments of members of the public regarding the specific actions and expenditures proposed to be included in the Local Control Accountability Plan (LCAP).  This public hearing was held on June 8, 2022.

 

Current Status

The SCCOE’s Local Control Accountability Plan was developed with guidance from the California Department of Education and utilized the process and template adopted by the State Board of Education.  Educational partners participated in the development of the LCAP pursuant to the regulation.  The LCAP was presented to the LCAP Parent Advisory Committee,  the District English Learner Parent Advisory Committee, and the Special Education Local Plan Area pursuant to EC Section 52063.  The LCAP was posted on the SCCOE web page for public comment on May 23, 2022.

Background

Education Code 1622 requires that on or before July 1 of each fiscal year, the county board of education shall adopt the annual county school services fund budget. Additionally, Education Code 1040 requires the county board of education to approve the annual county school services fund budget of the county superintendent of schools. The county board of education shall not adopt the annual county school services fund budget before the county board of education adopts a local control and accountability plan (LCAP).

 

Pursuant to Education Code (EC) 1620 on or before July 1 of each fiscal year, the county board of education shall hold a public hearing for the county school service fund budget. The public hearing was held on June 8, 2022, and the 2022-23 County School Service Fund Budget was presented and is attached for your reference.

 

Since the State budget has not been approved yet, the budget is developed based on a set of assumptions, and the most up-to-date information available from the Governor's May Revise. The State is required to adopt its budget by June 15th and any changes not included in the May Revise would need to be updated in the adopted county school services fund budget within 45 days after the State Budget is signed. Additionally, the books for 2021-22 will not be closed until late August/early September and will also require adjustments be made to the adopted county school services budget at first interim in accordance with prescribed rules and regulations. 

 

Budget Summary

The 2022-23 County School Service Fund is comprised of unrestricted and restricted funds. Unrestricted funding is to be used for a designated purpose and restricted funding is for a specified purpose and is subject to restrictions imposed by the grantor. Total projected revenues (including Transfer-in) are approximately $284.49M and projected expenditures (including Transfer-out) are approximately $306.60M. This includes approximately $44.36M in expenditures to be returned to the state from local “excess” property taxes. This amount may change depending upon local property tax revenues. SCCOE's projected reserve for economic uncertainty is $12.26M and meets the State mandated reserve requirement of 2%, and is able to maintain the additional 2% reserve requirement as set forth by Board Policy #3100, for 2022-23 and the two subsequent fiscal years.

 

The 2022-23 County School Service Fund budget reflects the SCCOE is in good fiscal health, will be able to meet it financial obligations and meets all the statutory requirements for adoption.

If an expenditure budget is increased, it is supported either by an increase in revenue, a decrease in carryover (use of carryover), a decrease in fund balance or any combination of the three. If an expenditure budget is decreased, the result could be due to a decrease in estimated revenue, or an increase to credit it back to fund balance.

Background

California's historic investments in early education have created new and expanded opportunities to provide equitable learning experiences for all young students. Universal pre-kindergarten (UPK) implementation will rely on a mixed delivery system, supported by investments in universal transitional kindergarten (TK), state preschool, and expanded learning, as well as comprehensive support for multilingual learners and students with disabilities.

 

AB 130 established an early education initiative to expand access to classroom-based pre-kindergarten (PK) programs offered by school districts, county offices of education, or charter schools. The collaboration among county offices of education, local educational agencies, state preschool programs, expanded learning programs, community partners, and families is essential to ensure a clearly articulated preschool through third grade education system for all students.

 

 

Student Impact

The passage of AB 130 will allow universal access to full-day TK programs to all 4-year-olds at no cost to families. By ensuring that all children have access to high quality Pre-K, this bill sets up every child for success in kindergarten and beyond.

 

TK will be gradually phased in over the next five years, until it includes all of the state's 4-year-olds by the 2025-26 school year. By the 2025-26 school year, at full implementation, the program is expected to benefit 300,000 children.

Student Impact

Supporting districts with continuous improvement services directly impacts students and the services that are offered to them. Through the practices of data review, root cause analysis, strategic planning, and program evaluation, districts, working with input from their communities, can better plan for robust and targeted programs to meet the needs of all students and address the ways they operationalize equity.
