Background

On March 17, 2020, the Governor issued Executive Order N-29-20 that suspended the teleconferencing rules set forth in the Brown Act enabling legislative bodies to meet remotely.  On September 16, 2021, the Governor signed AB 361 authorizing a legislative body subject to the Brown Act to continue to meet remotely using teleconference without compliance with the Brown Act teleconference rules if certain conditions are followed. On September 21, 2021, the County Health Officer issued a recommendation, which is attached hereto and incorporated herein, that public bodies continue to meet remotely. On October 6, 2021, November 17, 2021, December 15, 2021, January 19, 2022, February 2, 2022, February 16, 2022,  March 2, 2022, March 16, 2022, April 6, 2022, April 20, 2022, May 4, 2022, May 18, 2022, June 8, 2022, June 15, 2022, July 20, 2022 and August 3, 2022 the Santa Clara County Board of Education passed Resolution No. 2289-5 authorizing virtual board meetings pursuant to AB 361.

 

Fiscal Implications

The County Health Officer has recommended that legislative bodies continue to meet remotely to promote social distancing as one means to reduce the risk of COVID-19 transmission. The Santa Clara County Office of Education has an important governmental interest in protecting the public health, safety, and welfare of those who participate in meetings of the various legislative bodies during COVID-19 and ensuring that all members of the public can participate safely in meetings of legislative bodies.

Background

The Consolidated Application (ConApp) is used by the California Department of Education (CDE) to distribute categorical funds from various state and federal programs to county offices, local educational agencies (LEA), and direct-funded charter schools throughout California. Annually, each local educational agency (LEA) submits the spring release of the application to document participation in these programs and provide assurances that the LEA will comply with the legal requirements of each program. Program entitlements are determined by formulas contained in the laws that created the programs.

 

Student Impact

The Consolidated Application directly impacts Santa Clara County Office of Education's students. The Consolidated Application is submitted annually to the California Department of Education and in the process, LEAs apply for federal funds to include Title I, II, III and Title IV.  Title I and IV funds provide supplemental services and support to meet academic and social and emotional needs of students who identify as low-income and students experiencing homelessness. Title II funds support the development of highly qualified teachers, and Title III funds provide supplemental support for students who identify as English Learners.

Background

 

Proposition 28 has met criteria to be placed on the ballot.  If approved, it would provide additional funding, estimated to be up to $1 billion annually, for arts and music education in PK-12 public schools, through an annual state General Fund allocation.

 

The annual allocation would equal one percent of the total Proposition 98 funding allocation provided in the prior year. Funding would be provided to local educational agencies (LEAs) via a formula, based on prior-year enrollment. Of the total allocation, 70 percent would be distributed based on the LEAs’ proposition of the statewide enrollment and 30 percent would be distributed based on the LEAs proportion of low-income students. LEAs who enroll 500 or more students would be required to spend at least 80 percent of their allocation to hire teachers and staff, with the remainder of the funding dedicated to training, materials and supplies, and partnerships. The measure provides discretion to school principals to develop a plan to spend these funds and requires the LEA to verify that the funds were spent to supplement existing programs.

 

The LAO assesses that the measure would result in additional spending in the range of $800 million to $1 billion annually for arts education in schools. Due to the fact that this measure requires funding to be provided in addition to the Proposition 98 minimum funding guarantee, it would result in a reduction in the amount of General Fund available for other non-Proposition 98 programs.

 

The board will consider a resolution in support of Proposition 28.

The SCCOE believes that the arts are an essential part of public education. The arts inspire creativity, problem solving and expression.  Youth Participation in the arts is associated with gains in math, reading, cognitive ability, critical thinking, and verbal skill and improve motivation, concentration, confidence, and teamwork.
