Background

 

The Santa Clara County Board of Education (County Board) and the County Superintendent of Schools (County Superintendent) believe it is important to seek and consider students’ ideas, viewpoints, and reactions to education. To provide Santa Clara County Office of Education (SCCOE) high school students with opportunities for civic engagement and to provide valued input to the County Board, the County Board agreed by policy to ensure inclusion of a student member (Student Board Member) upon receipt of a petition for student representation (Student Representation Petition) consistent with Education Code section 1000 (as amended by Assembly Bill 824 of 2021).  A petition was received and duly verified by the County Superintendent of Schools in June of 2022. Subsequently, the students of the SCCOE high school aged programs received information about the established seat and took steps to identify a student member and an alternate.

 

The student member and alternate are students in good academic standing and committed in writing to carrying out the responsibilities of Student Board Members by completing an affidavit which is on file in the office of the County Superintendent of Schools. 

 

This evening the selected student and alternate are being presented to the County Board at the regular meeting of September 21, 2022.  The Student Board Member and Alternate will be introduced to the County Board of Education. The Student Board Member is Santomy Smith and the Student Board Member Alternate is Jose Nevarez. 

 

The student board member term shall be for one school year commencing on October 1, 2022. The Student Board Member shall perform duties as needed within the scope of the County Board. Student Board Members will not be considered members of legislative body for purposes of the Brown Act, including for purposes of establishing quorum.  Student Board Members shall not be included in determining the vote count necessary to carry any measure before the County Board. The Student Board Member shall participate virtually in the meetings. Should the County Board of Education meetings extend beyond 8:00PM, the student board member will be automatically excused at 8:00PM.

 

An orientation designed to build knowledge of the SCCOE and an understanding of the responsibilities and expectations of the position has been provided to the student board members. In support of our Student Board Member and Student Board Member Alternate, training on the Brown Act and overview of Board Bylaws 9150 Student Board Members of the Santa Clara County Board of Education by Marcelo Quinones, Lead Deputy County Counsel on Friday, September 16.  Prior to each SCCBOE meeting, students will receive an agenda overview provided by the School Principal. In addition, the school counselor and a teacher will assist in prepping each student prior to each meeting.

 

Both students are members of the Youth Advisory Council (YAC).The Vice President of YAC, Susie Rivera, has also committed to ensuring that the students are supported and will be discussing their experiences as student board members with the other youth in YAC.

 

Marcelo Quinones, County Counsel will provide a few highlights of the preparation for the students to serve and the implementation of the student board member role.

Special Recognition

 

Santomy Smith and Jose Nevarez will be introduced to the board and receive special recognition for their commitment to serve on the SCCBOE.

The SCCOE is committed to providing opportunities for students to engage civically. Civic engagement promotes learning, critical thinking, and engagement.

Background

On March 17, 2020, the Governor issued Executive Order N-29-20 that suspended the teleconferencing rules set forth in the Brown Act enabling legislative bodies to meet remotely.  On September 16, 2021, the Governor signed AB 361 authorizing a legislative body subject to the Brown Act to continue to meet remotely using teleconference without compliance with the Brown Act teleconference rules if certain conditions are followed. On September 21, 2021, the County Health Officer issued a recommendation, which is attached hereto and incorporated herein, that public bodies continue to meet remotely. On October 6, 2021, November 17, 2021, December 15, 2021, January 19, 2022, February 2, 2022, February 16, 2022, March 2, 2022, March 16, 2022, April 6, 2022, April 20, 2022, May 4, 2022, May 18, 2022, June 8, 2022, June 15, 2022, July 20, 2022, August 3, 2022 and September 7, 2022 the Santa Clara County Board of Education passed Resolution No. 2289-5 authorizing virtual board meetings pursuant to AB 361.

 

Student Impact

The County Health Officer has recommended that legislative bodies continue to meet remotely to promote social distancing as one means to reduce the risk of COVID-19 transmission. The Santa Clara County Office of Education has an important governmental interest in protecting the public health, safety, and welfare of those who participate in meetings of the various legislative bodies during COVID-19 and ensuring that all members of the public can participate safely in meetings of legislative bodies.

The month of October is designated National Disability Employment Awareness Month, a celebration coinciding with the establishment of the American Disability Act (ADA), which acknowledges the contributions of workers with disabilities and promotes advocacy and education about the value of a workforce inclusive of their skills and talents. To promote the education of Disability Employment Awareness Month both the U.S. Department of Labor and the SCCOE encourage educators and youth service professionals to discuss and promote inclusion amongst their students; to create a display that shows people with and without disabilities in a variety of professions; educate about disability history.

Background

 

On August 3, 2022 the Policy Subcommittee met and reviewed BB 9270 and approved revisions to Exhibit 9270 Conflict of Interest Code. This bylaw and exhibit were brought to the Board on August 3, 2022 for first reading and on September 7, 2022 for second reading. The Board is being asked to make a final reading and approval of the full Conflict of Interest Code, Exhibits, and resolution.

 

 

Conflict of Interest Code Bylaw and Exhibits of Designated Positions

 

The Political Reform Act requires every local government agency to review its conflict of interest code biennially (every even-numbered year) to determine if it is accurate or if the code must be amended. Exhibit includes updates to positions and position titles.

Background

October is recognized as LGTQ+ History Month. This is a celebration of the diverse, rich history of the LGBTQ+ community and the positive contribution being made to society. First established in 1998, LGBTQ+ History Month is a learning opportunity as well as a collective agreement to build ally support.

 

Student Impact

Having an welcoming and inclusion school environment that promotes a sense of belonging is essential to the success of students. Currently, less than 30% of LGBTQ+ youth state they feel they have a trusted adult on school campuses. Recognizing October as LGBTQ+History Month allows for inclusive practices and the opportunity to build and sustain allies.

Annually, Ms. Charmaine Warmenhoven donates to the Inclusion Collaborative Department at the Santa Clara County Office of Education. This year, Ms. Warmenhoven is donating via Silicon Valley Creates through a wire transfer, for the amount of $100,000.00 for fiscal year 2022-23. This is the actual amount of the donation and a Consent Action Item is being submitted to the Board for approval. The donor restricts the entire donation to be used in direct support of the Inclusion Collaborative Department.

If an expenditure budget is increased, it is supported either by an increase in revenue, a decrease in carryover (use of carryover), a decrease in fund balance or any combination of the three. If an expenditure budget is decreased, the result could be due to a decrease in estimated revenue, or an increase to credit it back to fund balance.

 

During the month of June 2022, expenditure budgets were increased by $19,297,040; revenue was increased by $22,662,035 and fund balance was increased by $3,364,995.

As per the Head Start Act, all Head Start agencies are required to provide program information to the Board of Education. Attached are the following reports:

Provides information on progress of services provided to children and families to meet required timelines as per specific indicators and thresholds

 

 

 

Financial Reports:

The financial reports for the month are a snapshot in time. The final report for HS Basic/EHS Basic, Grant Year 2, will be completed in October after the close of the grant period May 1, 2021 – June 30, 2022. The financial reports for July 2022 reflect the alignment of the program fiscal year to SCCOE's July 1 - June 30 fiscal year.

 

 

 

 

 

 

 

 

Student Impact

The Head Start/Early Head Start Program is federally funded to serve 1,946 children, ages 0-5, from very low-income families to promote their school readiness by enhancing their cognitive, social, and emotional development. These services are provided in Santa Clara and San Benito Counties.
