Motion for Option 1: Pursue a Provisional Appointment

Motion for Option 2: Call for an Election to fill Vacancy

Administrator

Mary Ann Dewan, Ph.D., County Superintendent of Schools

Background

Trustee Rosemary Kamei was elected to the San Jose City Council in June 2022 and will assume her new office on January 1, 2023. Trustee Rosemary Kamei submitted her deferred resignation to the County Superintendent on October 21, 2022. By way of deferred resignation, the Trustee Area 3 seat will become vacant on December 21, 2022. The procedure for filling a vacancy on the County Board of Education is established by Education Code section 1008 and 5090-5093 and the process is set forth in Board Bylaw 9223 which requires that the Board order an election or make a provisional appointment within 60 days of the vacancy.

As a deferred vacancy, the Board must make a provisional appointment or order an election by December 21, 2022 which is 60 days from the date of notice of the vacancy.

The Santa Clara County Board of Education, pursuant to Education Code sections 5090-5093, may make a provisional appointment to fill a vacancy from Board Trustee Area 3.  The provisional appointee will serve until the term of office of the vacant seat expires in November 2024.

Applicants must be registered voters and must reside within Board Trustee Area 3, which includes Cambrian, Campbell Union, Luther Burbank, Moreland, Union and Campbell Union High school districts and a small portion of San Jose Unified and Santa Clara Unified.  Any registered voter residing in Trustee Area 3 is eligible to apply to serve on the County Board of Education except the county superintendent of schools or any member of her staff and any employee of a public school district or charter school within the jurisdiction of the Santa Clara County Board of Education

Board Action

In order for the Board to discuss whether to make a provisional appointment or order an election, the item has been placed on the agenda and the discussion must be held in open session. The Board may choose to take action in one of the following ways:

Option 1:  Pursue a Provisional Appointment and Designate a Board Subcommittee to Review Applicants for Provisional Appointment

If the Board chooses to make a provisional appointment, they must advertise in the local media to solicit Board candidate applicants and nominations; may form a committee consisting of less than a quorum of the Board to review applications; interview the candidates at a public meeting and select the provisional appointee by majority vote. If the Board chooses to make a provisional appointment it must do so by December 20, 2022.

Should the Board elect to pursue a provisional appointment, advertisement in the local media could be initiated on November 3, 2022. The Board could immediately begin soliciting applications with the intent to hold interviews of eligible applicants at the regularly scheduled meeting of November 16, 2022.

Option 2: Call for an Election to fill Vacancy

When an election is ordered, the election must be held on the next established election date not less than 130 days after the election is ordered. If the Board decides to order an election on November 2, 2022, the election date would be established.

The financial impact of Option 1 includes the cost of advertising in local media which is estimated to be $1,500. This estimate is based on costs for the San Jose Post Record, Bay Area News Group, and Mountain News Network.

The financial impact of Option 2 includes the cost of advertising in local media and the cost of holding an election. The estimated cost of advertising in the local media is $1,500. The estimated combined cost of an election in both Santa Clara County and Santa Cruz County will likely be in the $1.6 to 3.9 million dollar range.

If the Board fails to act within the 60-day period, the County Superintendent shall order an election to fill the vacancy.

Attached is Board Bylaw 9223 and a summary memorandum of process.
