Background

On March 17, 2020, the Governor issued Executive Order N-29-20 that suspended the teleconferencing rules set forth in the Brown Act enabling legislative bodies to meet remotely.  On September 16, 2021, the Governor signed AB 361 authorizing a legislative body subject to the Brown Act to continue to meet remotely using teleconference without compliance with the Brown Act teleconference rules if certain conditions are followed. On September 21, 2021, the County Health Officer issued a recommendation, which is attached hereto and incorporated herein, that public bodies continue to meet remotely. On October 6, 2021, November 17, 2021, December 15, 2021, January 19, 2022, February 2, 2022, February 16, 2022,  March 2, 2022, March 16, 2022, April 6, 2022, April 20, 2022, May 4, 2022, May 18, 2022, June 8, 2022, June 15, 2022, July 20, 2022, August 3, 2022,  September 7, 2022, September 21, 2022, October 5, 2022, November 2, 2022 and November 16, 2022 the Santa Clara County Board of Education passed Resolution No. 2289-5 authorizing virtual board meetings pursuant to AB 361.

 

Student Impact

The County Health Officer has recommended that legislative bodies continue to meet remotely to promote social distancing as one means to reduce the risk of COVID-19 transmission. The Santa Clara County Office of Education has an important governmental interest in protecting the public health, safety, and welfare of those who participate in meetings of the various legislative bodies during COVID-19 and ensuring that all members of the public can participate safely in meetings of legislative bodies.

Background

Pursuant to Government Code section 54953, subdivision (c) (3) and pursuant to the terms of the appointment salary agreement, Dr. Mary Ann Dewan, County Superintendent of Schools, is eligible for a pay increase effective July 1, 2022.  The pay increase is calculated on the current CPI of 5.7%. The new base salary is $390,373.18. The additional salary of $5,000.00 for the doctoral degree per the contract is added to the base. The new annual salary is therefore, $395,373.18. The County Superintendent will continue to receive the following fringe benefits: health, welfare, retirement, and other benefits as are provided to certificated/management employees, membership dues for professional organizations, and reimbursement of job related expenses.

Background

 

Trustee Rosemary Kamei was elected to the San Jose City Council in June 2022 and will assume her new office on January 1, 2023. Trustee Rosemary Kamei submitted her deferred resignation to the County Superintendent on October 21, 2022. By way of deferred resignation, the Trustee Area 3 seat will become vacant on December 21, 2022. The procedure for filling a vacancy on the County Board of Education is established by Education Code section 1008 and 5090-5093 and the process is set forth in Board Bylaw 9223 which requires that the Board order an election or make a provisional appointment within 60 days of the vacancy.

 

As a deferred vacancy, the Board must make a provisional appointment or order an election by December 21, 2022 which is 60 days from the date of notice of the vacancy. 

 

The Santa Clara County Board of Education, pursuant to Education Code sections 5090-5093, may make a provisional appointment to fill a vacancy from Board Trustee Area 3.  The provisional appointee will assume office on December 21, 2022 and serve until the term of office of the vacant seat expires in November 2024.

 

Applicants must be registered voters and must reside within Board Trustee Area 3, which includes Cambrian, Campbell Union, Luther Burbank, Moreland, Union and Campbell Union High school districts and a small portion of San Jose Unified and Santa Clara Unified.  Any registered voter residing in Trustee Area 3 is eligible to apply to serve on the County Board of Education except the county superintendent of schools or any member of her staff and any employee of a public school district or charter school within the jurisdiction of the Santa Clara County Board of Education

 

 

 

PROCESS FOR INTERVIEWS and FILLING BOARD VACANCY

November 28, 2022

 

Interview: First Round

 

Five candidates have been invited to participate in an interview with the County Board of Education at the Monday, November 28, 2022.

 

1. Candidates will be interviewed in alphabetical order by last name. While a candidate is being interviewed, those waiting for their interview will be placed in a separate Zoom waiting room. Each candidate has attested to not observing the Board meeting while interviews are in progress.

 

2. Each candidate will be interviewed for 30 minutes. A 30 minute timer will be set. The Board President will open and close each interview. There will be six (6) questions with each trustee asking a single question. The questions have been assigned one to each trustee to ask in alphabetical order by the trustee’s last name.

 

          Question #1 - Vice President Chon

          Question #2 - Trustee Di Salvo

          Question #3 - Trustee Mah

          Question #4 - President Ortiz

          Question #5 - Trustee Rossi

          Question #6 - Trustee Sreekrishnan

 

If time permits, candidates will be asked up to two (2) follow-up questions. The follow-up questions have been assigned one to each trustee to ask in alphabetical order by the trustee’s last name as follows:

Candidate 2: Trustee Mah (question 7) and President Ortiz (question 8)

3. Board members have been provided with an interview summary sheet to record the responses of each candidate. The use of this sheet is optional. Please note, summary sheets will be collected and are considered public documents. Any notes taken, whether on the summary sheet or otherwise recorded are public documents that must be submitted. 

 

4. At the conclusion of the interviews, the Board President may facilitate a board discussion centering on the strengths of each candidate. Staff will serve as recorder, if needed.

 

At the conclusion of the discussion, each board member will, by verbal roll call, be asked to state their top candidate. If any candidate receives four (4) or more nominations, the Board President will call for a motion supporting the appointment.

 

If there is no majority nomination for any candidate, the top candidates will be invited to participate in a second round of interviews.

  1. Candidates will be interviewed in reverse alphabetical order by last name. While a candidate is being interviewed, the other candidate(s) will wait in a separate zoom waiting room.
  2. Each candidate will be interviewed for approximately 10 minutes. The Board President will open and close each interview. There will be three (3) questions. The questions have been assigned one to each trustee to ask in reverse alphabetical order by the trustee’s last name. Board members may utilize the interview summary sheet if necessary.
  3. At the conclusion of the last interview, the Board President may facilitate a board discussion centering on the strengths of each candidate. Staff will serve as recorder, if needed.

Each board member will be asked to announce their top candidate. If any candidate receives four (4) or more nominations, the Board President will call for a motion supporting the appointment.

 

There are 5 candidates who submitted application and are eligible for appointment: Deborah Jyl Lutes, Donald Rocha, Michele Ryan, Jesus Salazar, and Basil Saleh. Basil Saleh withdrew his application on November 30, 2024 at 4:54 PM.
