TONIGHT'S INFORMATION ITEM IS THE 2021-2022 ANNUAL FINANCIAL AUDIT REPORT FOR THE SANTA CLARA COUNTY OFFICE OF EDUCATION.

PRESENTING THIS ITEM THIS EVENING WILL BE OUR CHIEF BUSINESS OFFICER, STEPHANIE GOMEZ, WHO'S JOINED BY OUR AUDITOR FROM THE FIRM IDE BAILEY.

CHIEF GOMEZ, THANK YOU.

GOOD EVENING. THE AUDIT REPORT THAT IS PRESENTED IN THIS AGENDA ITEM, I JUST WANTED TO GIVE A HIGHLIGHT THAT THIS IS DONE EVERY YEAR ANNUALLY IN ACCORDANCE WITH EDUCATION CODE 41020.3 THAT AN ANNUAL AUDIT IS CONDUCTED OF OUR FINANCIAL RECORDS.

AT THE END OF EACH FISCAL YEAR, OUR AUDITORS HAVE ISSUED AN OPINION THAT THE FINANCIAL STATEMENTS ARE PRESENTED FAIRLY AND THAT WE HAVE A CLEAN AUDIT OPINION WITH NO FINDINGS.

THAT CONCLUDES MY OVERVIEW AND I'M HAPPY TO ANSWER ANY QUESTIONS.

HELLO, I'M SARA GINACARO, OCCUPATIONAL THERAPIST AND CHAPTER PRESIDENT OF SEIU, REPRESENTING 1059 CLASSIFIED WORKERS.

WE ARE DISAPPOINTED THAT MANAGEMENT INSISTS ON DELAYING RAISES AND HEALTH INSURANCE BY A MONTH EACH.

THE APPALLINGLY SLOW RATE IS DETRIMENTAL FOR WORKERS, AND YET ANOTHER EXAMPLE OF BAD FAITH BARGAINING AND RETALIATION AGAINST SEIU.

SCCOE SHOULD DO THE RIGHT THING FOR THOSE WE SERVE AND ALLOW PUBLIC COMMENTS BOTH IN PERSON AND VIRTUALLY TO PROMOTE PUBLIC PARTICIPATION.

ZOOM HAS ALREADY SET UP FOR THE STUDENT BOARD MEMBER AND MANY OTHER PUBLIC AGENCIES, INCLUDING THE SAN JOSE CITY COUNCIL, SANTA CLARA COUNTY BOARD OF SUPERVISORS, CUPERTINO AND OAK GROVE SCHOOL DISTRICTS AND MANY MORE ENGAGE IN THIS PRACTICE.

OUR COMMUNITY OF STUDENTS WITH DISABILITIES DESERVE THE SAME RIGHTS TO A SAFE SCHOOL ENVIRONMENT AS THEIR GENERAL EDUCATION PEERS.

YOU'VE ALL HEARD OUR PROPOSALS ON THIS ISSUE, AND EVERY DAY DELAYED MEANS MORE PREVENTABLE INJURIES TO STUDENTS AND STAFF.

WE MUST PRIORITIZE STUDENT AND STAFF SAFETY AND ENSURE SAFE CLASSROOMS FOR ALL.

IN THE LAST WEEK AND A HALF AT TWO DIFFERENT SCHOOL SITES, TWO PARA EDUCATORS WERE STRANGLED BY STUDENTS.

AND YESTERDAY'S INCIDENT, THE STAFF MEMBER WAS UNABLE TO BREATHE FOR SEVERAL SECONDS AND HAD DIFFICULTY BREATHING AND SPEAKING AFTER THE INCIDENT.

SHE STILL EXPERIENCES PAIN IN HER NECK FROM THE STRANGULATION.

AT THE OTHER SCHOOL, THE STAFF MEMBER WHO IS DEAF WAS NOT ONLY STRANGLED, BUT WAS ALSO PUNCHED, KICKED AND HAD SEVERE INJURIES TO HIS FINGERS.

TO THE EXTENT THAT THE DOCTOR RECOMMENDED HE NOT USE HIS HAND FOR FIVE DAYS, WHICH IS A SEVERE RESTRICTION FOR A DEAF PERSON WHO USES HIS HANDS TO COMMUNICATE.

THE STUDENTS IN THIS SITUATION HAVE ALSO ATTACKED OTHER STAFF MEMBERS AND STUDENTS, INCLUDING A STUDENT WHO NOW CRIES IN THE MORNING AND NO LONGER WANTS TO ATTEND SCHOOL.

WE MUST ENSURE A SAFE CLASSROOM FOR ALL STUDENTS AND STAFF.

LAST WEEK, MONDAY, A KINDERGARTEN STUDENT LEFT ONE OF OUR SPECIAL EDUCATION CLASSROOMS, WALKING ACROSS THE CAMPUS THROUGH THE CAFETERIA AND OUT THE FRONT DOOR, UNNOTICED BY ANY STAFF FROM COE OR THE DISTRICT.

HE LEFT THE NEIGHBORHOOD CROSSING MORE THAN TEN NEIGHBORHOOD STREETS AND WAS FOUND AFTER THE POLICE RECEIVED A 911 CALL ABOUT A YOUNG CHILD RUNNING IN THE MIDDLE OF THE VERY BUSY WHITE ROAD NEARLY AN HOUR AFTER HE LEFT SCHOOL.

FORTUNATELY, HE WAS UNINJURED.

WE MUST ANALYZE AND REFLECT ON WHAT CHANGES WE NEED IN OUR PROGRAMS TO ENSURE THAT STUDENTS ARE SAFE.

WE MUST ENSURE SAFE CLASSROOMS FOR ALL STUDENTS.

I'M A TEACHER AT GATEWAY SCHOOL IN GILROY.

FIRST OF ALL, I WANTED TO LET EVERYONE KNOW THAT I'M BREATHING A BIG SIGH OF RELIEF RIGHT NOW BECAUSE AS SOME OF YOU MAY HAVE HEARD, WE HAVE BEEN ALLOCATED A LITTLE JENGA PIECE AT THE END OF OUR FIELD THAT I'VE BEEN ADVOCATING FOR AT GATEWAY SCHOOL FOR OUR STUDENTS THERE WE HAVE THE FIELD SPACE ALLOCATED, AND I'VE BEEN ASSURED THAT THERE'LL BE A WALKING PATH AROUND THE AREA.

AND I WAS ALSO TOLD THAT THEY PLAN ON INPUTTING A STRUCTURE THAT'S APPROPRIATE FOR THE STUDENTS AT THAT SITE.

WE WILL HAVE AN ACCESS GATE FOR OPPORTUNITIES TO INCORPORATE INTO THE NEIGHBORING SCHOOL, WHICH IS A WELCOME ADDITION AS WELL. AND WE'LL DO THAT AS IT'S APPROPRIATE AND AS IT'S AVAILABLE, I'M SURE.

AND NOW I REALLY FEEL I JUST WANTED TO SAY THANK YOU FOR THAT.

AND I'M COMING TONIGHT BECAUSE I WAS INFORMED ABOUT SOME ALTERNATIVE PLANS FOR PARKING, WHICH I'M AFRAID ARE GOING TO BE PROBLEMATIC FOR THE SCHOOL.

I THINK ORIGINALLY OUR BUS DROP OFF WAS SEEN AS A VERY APPROPRIATE PLACE FOR PARENTS TO DROP STUDENTS FOR THE NEW EARLY START PROGRAM, WHICH

IS OBVIOUSLY A GREAT A GREAT DRIVE THROUGH AREA THAT'S SECURE FOR STUDENTS TO GET IN AND OUT OF CARS.

UNFORTUNATELY, WE HAVE BUSSES IN THAT BUS DROP OFF AND COORDINATING BUSSES IN CARS IS NEVER A GREAT PROPOSAL AND ALTERNATING TIMES IS NOT NECESSARILY A POSSIBILITY BECAUSE WE HAVE FOUR SCHOOLS AT THAT SITE AT DIFFERENT TIMES AND STARTING.

SO I WAS JUST HOPING THAT WE COULD WELCOME A LOT OF COOPERATION.

WE HAVE GOT A LOT OF TEACHERS WITH A LOT OF GREAT IDEAS.

I'M VERY COMMITTED TO OUR COMMUNITY AND THE SAFETY OF OUR STUDENTS.

SO I JUST CAME HERE TONIGHT TO SAY THANK YOU AND I LOOK FORWARD TO WORKING WITH YOU MORE IN THE FUTURE.

GOOD EVENING. I'M JONATHON BASS AND I WANTED TO ADD A LITTLE BIT MORE ABOUT THE SITUATION AT GATEWAY SCHOOL AND ABOUT THE PLAN FOR THE PARKING AND THE BUSSES.

I, ONE'S A SPECIFIC THING.

I, I WORK AT SOUTH VALLEY MIDDLE SCHOOL IN GILROY, WHICH UNTIL RECENTLY HAD A PARKING SITUATION THAT'S ACTUALLY VERY, VERY SIMILAR TO THE KIND OF SITUATION PHYSICALLY THAT'S GOING TO BE SET UP AT GATEWAY.

AND IT WAS VERY, VERY HECTIC, CLOGGED UP STREETS AND REALLY, REALLY MADE TRAFFIC LIKE DRIVING DOWN THE STREET JUST ONE BLOCK, TOOK ABOUT 15 MINUTES.

THAT'S BEEN CLEANED UP.

THE OTHER THING IS WHEN THERE IS A SITUATION LIKE THAT AND YOU HAVE A LOT OF CARS, THAT'S GREAT IF YOU HAVE HIRED A CROSSING GUARD WHO CAN BE THERE EVERY DAY.

I KNOW THAT BECAUSE I CURRENTLY PASS BY GILROY PREP SCHOOL EVERY DAY.

I KNOW NONE OF THESE ARE COUNTY OFFICE SCHOOLS, BUT THEY'RE JUST SCHOOLS WITH PARENTS AND PEDESTRIANS AND SO ON.

AND I WALK TO SCHOOL OR I RUN TO SCHOOL EVERY DAY.

AND WHEN THAT PARKING GUARD IS THERE, WOW, PARENTS ARE WELL BEHAVED.

AND WHEN THERE'S NO WHEN THERE'S NO CROSSING GUARD, THEY BEHAVE VERY DIFFERENTLY AND BECOMES VERY DANGEROUS.

SO THAT'S ONE ASPECT OF IT.

THE OTHER THING IS I HAD THE GOOD FORTUNE OF BEING AT A SCHOOL THAT HAS RECENTLY BEEN RECONSTRUCTED AND THAT SO I'VE SEEN THE WAY THAT PROCESS WORKED.

THERE IS AN ACTUAL CONSTRUCTION COMMITTEE BUILT OF TEACHERS, AND I'M NOT SURE WHAT OTHER STAKEHOLDERS WERE IN SOME OTHER COMMITTEES WITH A LOT OF INPUT.

AND IT JUST REALLY SURPRISES ME THAT A CONSTRUCTION PROJECT, THAT GATEWAY, THAT'S NOT A GATEWAY SCHOOL, THAT'S AN EARLY START THAT DIRECTLY IMPACTS GATEWAY STAFF AND STUDENTS DIDN'T INVOLVE ANY INPUT.

SO I WOULD LIKE TO URGE THE BOARD TO HALT PLANS MOVING FORWARD THAT AFFECT THE PARKING UNTIL AND TO GET INPUT FROM STAFF, BECAUSE I'M SURE THEY HAVE ENLIGHTENING THINGS TO SAY ABOUT SAFETY.

HI, MY NAME IS MICHELLE HOWARD AND I'VE BEEN WITH SUMMIT DENALI SINCE THE SIXTH GRADE AND MY SON NOW IS A SENIOR.

SO WHILE WHEN I STARTED THE SCHOOL, IT WAS HIGHLY RECOMMENDED TO GO.

HE HAS ADHD, HE HAS DYSLEXIA, LEARNING PROCESSING, AND THEY PROMISE TO FULLY SUPPORT WHATEVER HE NEED IN IEP.

WHAT HAD OCCURRED IN 2020 WAS THAT HE GOT ASSAULTED IN THE BOYS BATHROOM AND IT WAS RECORDED BY THE KID'S FRIENDS OR LIKE 15 KIDS. AND I HAD A I FOUND OUT ABOUT THIS ASSAULT MOTHER CALLED THE CALLED AND SAID THERE WAS RECORDING.

SO I HAD TO BUY THE RECORDING FROM THIS KID WHO RECORDED IT AND FOUND AND I REPORTED IT IMMEDIATELY TO LAURA ZITO AND KEVIN BACHMAN, WHO ARE NO LONGER THERE, BUT OUR ZITO IS STILL THERE.

SO I SPOKE TO HIS THERAPIST.

HE WAS SEEING A THERAPIST ALSO.

AND AFTER I SPOKE TO MY SON, HE HAD BEEN COMPLAINING THAT THIS KID HAS BEEN TORMENTING HIM FOREVER, PUSHING HIM TO HOLD KEVIN, AND NOTHING OCCURRED.

SO WE SPOKE TO LAURA AND SHE SAID, YOU KNOW, SHE WAS GOING TO TALK TO HER SUNNYVALE POLICE DEPARTMENT BUDDY PROGRAM.

AND MY HUSBAND, MY EX HUSBAND AT THE TIME SAID THAT HE I SHOULDN'T REPORT IT.

AND AT THAT TIME THEY HAD THE KID COME IN THE CLASS THE VERY NEXT DAY SITTING NEXT TO HIM BECAUSE THEY FELT THAT HE WASN'T POSING A THREAT ANYMORE.

SO THEY HAVE THIS KIND OF RESTORATIVE JUSTICE AND THAT'S THEIR ISSUES.

AND HE'S BEEN SUFFERING FROM EXACERBATED DEPRESSION AND ANXIETY SINCE THAT TIME.

THEY JUST DIDN'T TAKE IT SERIOUSLY.

AND NOW WITH HIS EDUCATION, YOU KNOW, THEY'VE JUST KIND OF PASSED HIM BY.

HE'S GOT A FIFTH GRADE EDUCATION AND HE'LL BE GRADUATING IN JUNE AND SOMETHING REALLY HAS TO BE DONE.

HE WAS JUST OFFERED TUTORING SERVICES AFTER ALL THESE YEARS AND TUTORS STILL HELPING.

IN OUR PROGRAM, WE HAVE THE RED STAR TEST EVERY 45 DAYS.

I AM HAPPY TO REPORT THAT MY CLASS SCORED THE HIGHEST OVERALL OUR SCHOOLS SCORES IMPROVED .

IN THE [INAUDIBLE] PRE APPRENTICESHIP PROGRAM, WE HAVE BEEN LEARNING CONCRETE TECHNIQUES AND WE WILL BE TAKING A WALK AROUND OUR SCHOOL.

SO ON FEBRUARY 2ND, I ATTENDED THE SANTA CLARA COUNTY CLIMATE LITERACY COMMITTEE MEETING AND I AM CO-PRESIDENT OF THE COMMITTEE WITH JORGE PACHECO OF THE OAK GROVE SCHOOL DISTRICT AND TRUSTEE DI SALVO ALSO ATTENDED AND THIS IS A NEWLY FORMED COMMITTEE.

WE TALKED ABOUT THE MARCH 18TH ENVIRONMENTAL LITERACY SUMMIT, OUR COUNTY OFFICES HOSTING.

WE DISCUSSED THE PROTECT EUROSTAT CAMPAIGN AND ALSO ADVOCACY FOR OUTDOOR AND GARDEN GARDEN BASED LEARNING.

THEN ON FEB THIRD, I MET WITH PARENTS OF STUDENTS AT SUMMIT DENALI THAT HAVE BEEN WORKING VERY HARD TO LOOK AT ALTERNATIVES TO CLOSURE. YOU KNOW, THEY'VE COMPILED MEETING MINUTES, THEY'VE LOOKED CLOSELY AT DENALI'S BUDGET AND HAVE BEEN VERY STRONG ADVOCATES FOR THE OVER 650 STUDENTS AT DENALI.

THEN ON THE FOURTH, I MET WITH A MOUNTAIN VIEW STUDENT, SARAVIA, WHO IS LOOKING TO ENGAGE FURTHER WITH THE WORK OF OUR BOARD.

SO DR.

DEWAN ACTUALLY ASSISTED IN CONNECTING HER WITH OUR COUNTY OFFICES.

YOUTH HEALTH AND WELLNESS WELLNESS ADVISORY GROUP, STUDENT WELLNESS ADVISORY GROUP, WHICH SHE'S LOOKING INTO.

THEN ON THE SEVENTH, I ATTENDED THE SIERRA CLUB'S CLIMATE LITERACY COMMITTEE MEETING.

WE DISCUSSED STATE ADVOCACY EFFORTS, INCLUDING THE CALIFORNIA CLIMATE EDUCATION BILL AB 285, WHICH WILL BE TRACKING.

I ALSO DISCUSSED OUR SUMMIT THERE AS WELL.

THEN ON THE EIGHTH, I MET WITH SUNNYVALE STUDENT FROM FREMONT HIGH SCHOOL, ROTEM, AND SHE'S LOOKING TO GET INVOLVED AS WELL AND FOR VOLUNTEERING OPPORTUNITIES WITH HER LEADERSHIP CLASS.

AND SO I CONNECTED HER WITH THE FREMONT UNION HIGH SCHOOL DISTRICT STUDENT SUSTAINABILITY COMMISSION, WHICH SHE'S JOINING NOW, WHICH IS GREAT.

THEN ON THE 11TH, I ATTENDED THE LEAGUE OF WOMEN VOTERS, CUPERTINO, SUNNYVALE.

THEY HOSTED A MEET AND GREET FOR LOCAL ELECTED OFFICIALS.

SO TRUSTEE MAH WAS THERE.

DR. DEWAN WAS THERE.

AND I WAS ABLE TO ATTEND WITH A RECENT GRADUATE, CURRAN, WHO'S SOMEONE WHO'S LOOKING TO GET INVOLVED IN COMMUNITY SERVICE, WHICH IS EXCITING.

THEN LASTLY, ON THE 11TH, I MET WITH A FEW FOLKS WHO TEACH AN INTRO TO WELDING CLASS TO STUDENTS IN SUNNYVALE, AT MAKER NEXUS. SO THEY'VE BEEN WORKING WITH STUDENTS TO HELP THEM DISCOVER DIFFERENT CAREER OPPORTUNITIES.

IT SEEMS LIKE IT'S BEEN VERY REWARDING FOR THESE STUDENTS, SO I'LL BE FOLLOWING UP ON THAT AS WELL.

WE ALSO TALKED QUITE A BIT ABOUT THE VAPING PROBLEMS WHICH ARE GOING ON IN OUR AREA, AND I ALSO MET WITH SOME PARENTS FROM SUMMIT DENALI.

HAD VERY GOOD CONVERSATION AND TRIED TO FIGURE OUT KIND OF WHAT WAYS AND HOW THINGS COULD BE DONE TO SUPPORT OUR KIDS THERE.

I ALSO ATTENDED A PRESENTATION BY THE UCLA CENTER FOR TRANSFORMATION OF SCHOOLS CALLED OUR CHILDREN CAN'T WAIT.

IT WAS A WEBINAR THAT TALKED ABOUT ALL THE DIFFERENT KINDS OF POLICY ISSUES THAT HAVE BEEN GOING ON AND ON AND ON AND HAVEN'T BEEN CHANGED.

AND SO THEY OFFERED SOME IDEAS.

THERE'S A BOOK CALLED OUR CHILDREN CAN'T WAIT THAT LOOKS REALLY GOOD TO PERHAPS REVIEW.

I'M ALSO WORKING ON THE CSBA LEGISLATIVE BRUNCH AND WANT TO REMIND YOU ALL TO PLEASE SIGN UP.

AND SO THAT'S A REALLY GREAT DATABASE TO ANALYZE ALL THE INFORMATION FOR ALL THE SCHOOL DISTRICTS IN THE WHOLE STATE IN MULTIPLE METRICS WITH RESPECT TO HEALTH, EDUCATION AND WELFARE FOR EVERY ONE OF CALIFORNIA'S 58 COUNTIES.

SO EVEN GOES DOWN TO THE COUNTY LEVEL DATA MAPPING, TRACKING KEY INDICATORS OF CHILD WELL-BEING OVER TIME, AND BY RACE AND BY ETHNICITY.

I WAS ABLE TO VISIT THE CLASSROOMS WITH A PLAN TO CONDUCT DIGITAL LITERACY CLASSES, IMMIGRATION OUTREACH PRESENTATIONS, READING AND LITERACY, SKILL BUILDING ACTIVITIES, COLLEGE AND CAREER PREPARATION, AMONG OTHERS.

OTHER ACTIVITIES.

WHILE I WAS THERE, I HAD THE OPPORTUNITY TO TOUR THE AREA OF THE ANNEX BUILDING WHERE THE OPPORTUNITY YOUTH ACADEMY IS HOSTED ON FEBRUARY 10TH.

I ATTENDED THE AFRICAN AMERICAN FLAG RAISING AT SAN JOSE CITY HALL IN CELEBRATION OF BLACK HISTORY MONTH, WHICH WAS ORGANIZED BY A FORMER TRUSTEE AND PRESENT VICE MAYOR ROSEMARY KUMAR, JOINTLY WITH THE NAACP AND THE BLACK LEADERSHIP KITCHEN CABINET.

IT WAS A VERY INSPIRING AND MOVING EVENT.

I STILL BELIEVE SUCH EVENTS ARE SO IMPORTANT AS WE BUILD AN INCLUSIVE SOCIETY FOR US AS STUDENTS.

ON FEBRUARY 11TH, I ATTENDED COUNCILMEMBER OMAR TORRES'S EVENT WITH THE DEPARTMENT OF TRANSPORTATION AT THE AFRICAN AMERICAN COMMUNITY SERVICE AGENCY.

I WAS ABLE TO TALK TO THE DOT REPRESENTATIVE ABOUT THE IMPORTANCE OF TRAFFIC TRAFFIC SAFETY INITIATIVES AROUND SCHOOLS.

SO THEY SAID THEY ARE IN THE PROCESS OF SIGNING UP SCHOOLS FOR EXACTLY SUCH AN INITIATIVE.

MILAN BURTON, FRANKLIN WATKINS BOARD MEMBERS SHOWED ME AROUND THE AAC FACILITY WHERE THEY HAVE A LIBRARY CORNER FOR STUDENTS IN PARTNERSHIP WITH SAN JOSE LIBRARY, AS WELL AS A COMPUTER TRAINING CENTER FOR YOUTH.

ALSO, ON FEBRUARY 4TH, I ATTENDED THE LEAGUE OF WOMEN VOTERS PRIORITIES PLANNING SESSION FOR THE NEXT YEAR.

I ADVOCATED FOR MENTAL AND PHYSICAL HEALTH AND WELLNESS WITH SPECIAL EMPHASIS ON SCHOOL AGED CHILDREN.

AS A RESULT, THE BAY AREA LEAGUE DECIDED TO INCLUDE MENTAL ILLNESS AS ONE OF THEIR THREE PRIORITIES, AND THE SAN JOSE SANATORIUM TOOK ON MENTAL AND PHYSICAL HEALTH AND WELLNESS. THANK YOU.

AND WHAT WAS INTERESTING IS SHE'S ASKED TO DISCUSS SAN JOSE 2020, WHICH WAS AN EFFORT THAT THE COUNTY BOARD HAD IN 2010 THAT BY 2020 WOULD WE WOULD HAVE ELIMINATED THE ACHIEVEMENT GAP IN SAN JOSE, AND THEN IT EXTENDED TO SAN JOSE, SILICON VALLEY. SO WE DISCUSSED SHE WANTS TO REINVIGORATE THAT EFFORT AS A COMMUNITY COLLEGE TRUSTEE.

AND SO WE HAD A BEGINNING CONVERSATION ABOUT PERHAPS HOW TO DO THAT.

I ALSO WANT TO EXPRESS MY GRATITUDE FOR THE STUDENTS, FAMILIES AND FACULTY WHO'VE CONTINUED THIS CONVERSATION WITH US SINCE OUR MEETING AT THE DENALI CAMPUS ON JANUARY 11TH. THIS HAS BEEN A STRESSFUL AND CHALLENGING TIME, AND OUR COLLECTIVE GOAL HAS BEEN FIRST AND FOREMOST TO SUPPORT OUR STUDENTS.

OVER TEN YEARS AGO, SUMMIT PUBLIC SCHOOLS PETITIONED TO OPEN A COUNTY WIDE CHARTER SCHOOL ALONG THE 101 CORRIDOR BECAUSE OF THE VERY REASONS THAT PARENTS HAVE HAVE SHARED WITH YOU ALL OVER THIS PAST MONTH.

THE LACK OF A PUBLIC MIDDLE AND HIGH SCHOOL OPTIONS IS ACUTE.

THE PUBLIC SCHOOL THAT COULD PROVIDE A SMALL SCHOOL ENVIRONMENT WITH A PERSONALIZED LEARNING MODEL, APPLYING THE LEARNING SCIENCE TO A PROJECT BASED CURRICULUM WITH ONE ON ONE MENTORSHIP DID NOT EXIST.

FAMILIES CAME TO US IN SEARCH OF THIS SCHOOL BECAUSE SUMMIT HAD A MODEL THAT WAS DOING WELL IN OTHER PARTS OF THE BAY AREA.

TOGETHER. WE WANTED TO REPLICATE OUR SCHOOL MODEL, AND SO WE MAPPED OUT A PATHWAY TO DO THAT.

TO SAY THAT THIS PATHWAY HAS BEEN ROCKY WOULD BE A MASSIVE UNDERSTATEMENT.

WE'VE BEEN CHALLENGED AT EVERY TURN TO OVERCOME STRUCTURAL BARRIERS AND OBSTACLES, AND TOGETHER WITH OUR FAMILIES AND TEACHERS, HAVE INVESTED TIME, ENERGY AND DOLLARS INTO CREATING A SCHOOL WHERE ALL STUDENTS COULD THRIVE.

DENALI HAS SHOWN US ALL WHAT EDUCATION CAN BE.

AND I THINK THAT'S WHAT MAKES THIS MOMENT THAT WE'RE IN RIGHT NOW SO INCREDIBLY HARD.

WHAT WE'VE LEARNED AND WHAT WE'RE HERE TO TALK ABOUT THIS EVENING ARE THE DEEPLY SAD REASONS WHY WE BELIEVE IT'S BECOME UNSUSTAINABLE FOR US TO CONTINUE THIS SPECIAL SCHOOL BEYOND THIS SCHOOL YEAR.

I WANT TO BE VERY CLEAR UP FRONT THAT AS WE TALK ABOUT A BUDGET GAP, THE REVENUE CHALLENGES AND SPENDING PRESSURES WE IDENTIFY ARE NOT ONE TIME ISSUES.

IF THAT WERE TRUE, WE WOULD NOT BE HAVING THIS CONVERSATION TODAY.

WE'RE TALKING ABOUT STRUCTURAL ISSUES AND PROJECTIONS THAT WILL PREVENT US FROM RUNNING THIS VERY SCHOOL MOVING FORWARD.

IF WE COULD GO AHEAD TO THE NEXT SLIDE, PLEASE.

SEE. MAKE SURE WE'RE THE RIGHT ONE.

YEP. SO DURING FINALE'S TEN YEAR HISTORY, IT HAS ALWAYS HAD A BUDGET DEFICIT.

THE SUMMIT HOME OFFICE HAS PROVIDED FUNDS TO CLEAR DENALI DEFICIT EVERY YEAR.

WE'VE WORKED DILIGENTLY TO CLOSE IT AND TO PUT DENALI ON A SUSTAINABLE PATH.

AS STAFF HAVE SHARED, DENALI PROJECTIONS FOR NEXT YEAR ARE THAT IT WILL REQUIRE A $4.5 MILLION INVESTMENT TO STAY OPEN.

THE SUMMIT HOME OFFICE CASH RESERVES WILL LIKELY BE 5 TO 6 MILLION.

IN FY 2324.

AND SO THE HOME OFFICE WILL NOT BE ABLE TO MAKE THIS INVESTMENT.

SUMMIT AND DENALI LEADERSHIP TEAMS HAVE BEEN UNABLE TO IDENTIFY A PATHWAY TO SECURING FUNDS FOR THE NEXT YEAR OR INTO THE FUTURE.

OVER THE PAST OF THE OVER THE COURSE OF THE PAST FOUR WEEKS WE'VE BEEN MEETING WITH OUR EDUCATION PARTNERS IN OUR COMMUNITY, AND THIS REALITY HAS NOT CHANGED.

DENALI DOES NOT HAVE A PATHWAY TO FINANCIAL VIABILITY FOR NEXT YEAR.

AND IN THE ABSENCE OF SUCH A PATHWAY, OUR BOARD ANTICIPATES HAVING TO CLOSE DENALI AT THE END OF THIS SCHOOL YEAR.

A VERY SPECIFIC SERIES OF FINANCIAL ISSUES WHEN TAKEN TOGETHER, PUT DENALI IN AN UNFORTUNATE AND UNIQUE SITUATION.

I'M GOING TO TURN IT OVER TO ED NOW TO WALK THROUGH THE DETAILS OF THESE ISSUES.

IT IS NOT UNCOMMON TO HAVE STARTUP COSTS WHEN OPENING A NEW SCHOOL.

HOWEVER, AS MY COLLEAGUE KATE HAS MENTIONED, THERE'S BEEN A CONFLUENCE OF FACTORS THAT HAVE CONTRIBUTED TO MORE THAN THE TYPICAL SUPPORT FOR A NEW SCHOOL.

OVER THE PAST SEVERAL YEARS, THE OPERATIONAL GRANT SUPPORT FOR DENALI HAS GENERALLY BEEN INCREASING, THOUGH BUFFERED IN 20 TO 21 AND 20 2122 THROUGH ONE TIME COVID FUNDING.

THE CURRENT 2223 FISCAL YEAR IS THE LARGEST OPERATIONAL CONTRIBUTION EVER AT $3.8 MILLION.

AND THE FORECAST NEED FOR THE OPERATIONAL SUPPORT IS $4.5 MILLION FOR 2324.

AND IN THIS SLIDE, WE HAVE JUST A GENERAL HISTORY OF THE CONTRIBUTIONS TO DENALI.

AGAIN, MOST OF THESE CONTRIBUTIONS ARE SOURCED EITHER THROUGH PHILANTHROPIC DOLLARS OR THROUGH PUBLIC BOND FINANCING.

AND YOU CAN SEE IT'S CLOSE TO $45 MILLION THERE.

CAN I GO TO THE NEXT SLIDE, PLEASE? THIS HERE SHOWS JUST THE TREND LINE OVER THE PAST SEVERAL YEARS AND THE FORECAST OF THE HOME OFFICE OPERATIONAL SUPPORT, AGAIN, SOLELY BASED ON OPERATIONAL SUPPORT.

AND AS I MENTIONED EARLIER, THIS SUPPORT IS ONLY FORECASTED TO GROW WITH THE DIP BEING PRIMARILY ATTRIBUTED TO THE INFUSION OF ONE TIME COVID FUND SUPPORT.

THE STRUCTURAL THINGS ARE THINGS THAT ARE OUT OF OUR CONTROL AND THE NON STRUCTURAL ONES ARE THINGS THAT WE DO HAVE CONTROL OVER.

THE FIRST TWO THERE IS THE ENROLLMENT GAP TO FULL CAPACITY.

NUMBER TWO IS FACILITIES.

IN ORDER TO SERVE THE NUMBER OF STUDENTS THAT WE WANT TO, WE'VE HAD TO PROCURE TWO DIFFERENT SETS OF FACILITIES.

THAT IS THE ONLY SCHOOL IN OUR NETWORK THAT HAS TWO FACILITIES FOR ONE LEA.

AND I WANT TO HIGHLIGHT THE LAST FOUR VARIABLES THERE THAT ARE SOME DEEP STRUCTURAL DEFICIT CHALLENGES FOR US, UNDERFUNDED STUDENT SERVICES, LOWER FUNDING RATES RELATIVE TO OUR PEER SCHOOLS.

AGAIN, THIS IS EVEN WITHIN THE NETWORK.

BUT IF WE THROW IN EVEN OUR PEER DISTRICT SCHOOLS, THAT'S A SIGNIFICANT DIFFERENCE.

AND I JUST WANT TO HIGHLIGHT THAT AS SORT OF IN AN INEQUITABLE FUNDING STRUCTURE THAT I THINK SHOULD BE A CONTINUED DIALOG AS PART OF THIS, WHERE SOME OF OUR PRESCHOOLS WILL RECEIVE 50 TO 60% MORE STATE APPORTIONED FUNDING THAN OUR SCHOOLS.

I JUST WANT TO HIGHLIGHT THAT.

AND THE LAST TWO ITEMS THERE IS MIDDLE SCHOOLS, ACCORDING TO THE STATE FUNDING FORMULA, ARE FUNDED ROUGHLY AT TO 20% LESS FUNDING PER ADA.

AND OF WHICH, OUR DENALI CAMPUS HAS AN ADDITIONAL GRADE OF MIDDLE SCHOOL RELATIVE TO OUR PEER SCHOOLS IN THE AREA.

AND LASTLY, THE INELIGIBILITY OF STATE FACILITY FUNDING, WHICH IS SB 740, AGAIN, WHICH OF WHICH THE ELIGIBILITY IS DETERMINED BY THE SURROUNDING LOCALLY ZONED ELEMENTARY SCHOOL DISTRICT OF WHICH HAS SHIFTED OVER THE PAST COUPLE OF YEARS TO RENDER DENALI IS INELIGIBLE FOR APPROXIMATELY, YOU KNOW, $750,000 IN THAT ZONE.

I WANT TO TALK A LITTLE BIT ABOUT THE ENROLLMENT CHALLENGES AND THE ENROLLMENT DECLINE AT SUMMIT DENALI.

AS ED MENTIONED, YOU KNOW, ENROLLMENT ISSUES ARE THEORETICALLY SOMETHING THAT WE HAVE CONTROL OVER.

BUT I WANT TO CONTEXTUALIZE THIS AND WHERE WE ARE RIGHT NOW, AS I THINK ALL OF THE TRUSTEES KNOW, SCHOOLS AROUND THE COUNTRY ARE STRUGGLING WITH DECLINING ENROLLMENT.

SCHOOLS IN OUR AREA ARE STRUGGLING WITH DECLINING ENROLLMENT.

AND LAST SPRING, AS WE WERE ENTERING THIS YEAR, THIS PLANNING YEAR, WE ALONG WITH SCHOOLS AROUND THE NATION, REALLY ENDEAVORED TO UNDERSTAND WHAT WHAT WAS GOING ON.

AND INITIALLY, EVERYONE WAS LOOKING AT THE COVID IMPACT.

AND THAT THAT WAS A LOT OF THE CONVERSATION IN THE AREA AND AROUND THE COUNTRY.

ENROLLMENT WAS DOWN, BUT STUDENTS WOULD COME BACK AND THEN FOLKS STARTED DIGGING DEEPER.

AND WE DID TOO, BECAUSE IT JUST DIDN'T ADD UP.

AND WE STARTED TO SEE CONFIRMATION OF A TROUBLING HYPOTHESIS, WHICH WE BEGAN TO REALIZE THAT THROUGH OUR OUR OWN RESEARCH AND THAT OF INDEPENDENT ENTITIES THAT SUPPORT CHARTER SCHOOLS, THE CHARTER SCHOOL GROWTH FUND, WE STARTED TO UNDERSTAND A MORE COMPLEX PICTURE THAT THE PANDEMIC YEARS HAD REALLY MASKED.

POPULATION SHIFTS AND A DECLINING BIRTH RATE ARE GOING TO HAVE LONG TERM PERMANENT IMPACT ON OUR SUNNYVALE SCHOOLS.

AND, YOU KNOW, WE REALLY HAD TO LOOK TO SANTA CLARA UNIFIED, WHICH IS ONE OF THE PREDOMINANT FEEDER SCHOOLS DISTRICTS TO DENALI MIDDLE SCHOOL, WHO STARTED THIS YEAR IN THEIR BUDGET PROCESS, WONDERING WHERE THE STUDENTS WERE, BUT IN DECEMBER ALSO REPORTED OUT THEIR BELIEF AND UNDERSTANDING THAT THE STUDENTS WERE NOT GOING TO BE COMING.

THEY SAW PRECIPITOUS DROP IN STUDENTS IN KINDERGARTEN, WHICH LEADS US TO UNDERSTAND WHERE STUDENTS WILL BE COMING FROM FOR US ULTIMATELY . IF WE GO TO THE NEXT SLIDE, PLEASE.

AND THIS HERE IS JUST A REPRESENTATION.

I KNOW THAT THIS WAS A QUESTION AT THE LAST BOARD MEETING WHERE OUR DENALI STUDENTS WERE COMING FROM.

SO I JUST WANTED TO REPRESENT FOR YOU ALL PICTORIALLY.

OUR STUDENTS ARE PREDOMINANTLY FREMONT, UNION HIGH SCHOOL, SUNNYVALE, AND SANTA CLARA UNIFIED.

SO THIS IS NOT AN ISSUE AS DEEP IN THIS WAY AT OUR OTHER SCHOOLS.

THIS IS REALLY SPECIFIC TO THE SUMMIT DENALI CAMPUS.

AND ON THE RIGHT HERE, WE HAVE THE EFFECTIVELY, THE WAY THAT THE STATE FUNDING FORMULA WORKS IS DICTATED BY THE DUPLICATED COUNT.

I THINK THE BOARD IN THE PUBLIC MAY KNOW THAT OR MAY NOT KNOW THAT, BUT DUE TO SOME OF THE DEMOGRAPHIC SHIFTS AS WELL AS, AGAIN, JUST THE DEMOGRAPHIC NATURE OF THAT SCHOOL COMMUNITY, RELATIVELY SPEAKING, COMPARED TO OUR NETWORK PEER SCHOOLS, IT HAS A LOWER FRL STUDENT PERCENTAGE AND RELATIVELY SPEAKING COSTS.

YOU KNOW, THERE ARE APPROXIMATELY $900,000 OF REVENUE THAT IS NOT RECEIVED COMPARED TO OUR PEER SCHOOLS.

SO I JUST WANTED TO HIGHLIGHT THE COMPARISON RELATIVE TO HOW EXPENSIVE IT IS FOR US TO OPERATE THIS CAMPUS COMPARED TO OTHER PEER SCHOOLS.

CAN WE GO TO THE NEXT SLIDE, PLEASE? THIS SLIDE HERE SHOWS SOME OF THE SPECIAL EDUCATION SERVICES AND THEIR COSTS OVER TIME.

AND YOU CAN SEE THE DIFFERENT GROUPS THERE BY SERVICE TYPE AS WELL AS THE TOTAL COSTS.

AND IT'S PROBABLY NOT LOST ON ANYONE HERE THAT THE INCREASE IN THE STUDENT SERVICES DIRECTLY CORRELATES TO THE PANDEMIC. AND THAT'S SOMETHING THAT WE HAVE SEEN, IS THAT THERE HAS BEEN A REALLY DEEP NEED IN MENTAL HEALTH COUNSELING AND MENTAL HEALTH SERVICES, YOU KNOW, IN ADDITION TO SOME OF THE INCREASED PLACEMENTS THAT WE HAVE IN SOME OF OUR NONPUBLIC SCHOOL PLACEMENTS.

BUT HOPEFULLY THIS GIVES YOU A SENSE OF SOME OF THE ADDITIONAL IMPACT THAT WE'VE SEEN.

AGAIN, THAT SOME OF THE KEY DRIVERS HERE HAVE BEEN INCREASE IN THE NUMBER OF STUDENTS, THE TYPE OF SERVICES THAT ARE RECEIVED BY THOSE STUDENTS AS WELL AS THE INCREASED COST OF THOSE SERVICES.

AND I ALSO WANT TO HIGHLIGHT A LITTLE BIT OF A STRUCTURAL CHALLENGE FOR A LOT OF SCHOOL SCHOOLS IN THE AREA AND IS JUST IS FILLING ANY KIND OF OPEN POSITIONS FOR SPECIAL EDUCATION TEACHERS.

AND IN THE INABILITY TO FILL THOSE POSITIONS, YOU OFTEN HAVE TO CONTRACT OUT THOSE SERVICES.

AND OFTENTIMES THOSE SERVICES CAN BE DOUBLE THE AVERAGE TEACHER SALARY FOR THAT KIND OF SERVICE.

SO THAT'S ALSO SOMETHING THAT WE'VE SEEN HERE.

CAN WE GO TO THE NEXT SLIDE, PLEASE? AND I WANT TO HIGHLIGHT SOME OF OUR OTHER TWO STRUCTURAL CHALLENGES.

THE ONE OF THE GRAPH ON THE LEFT SHOWS, AGAIN, IT'S A RELATIVE ADDITIONAL COST OR REVENUE LOSS, IF YOU WILL, TO COMPARED TO OTHER PURE SCHOOLS IN OUR NETWORK.

THE FACT THAT DENALI HAS A SIX GRADE OR JUST THE ONLY SIX GRADE THAT WE SERVE IN THE BAY AREA, IT DOES.

YOU KNOW, THE TRANSLATION THERE IS BECAUSE THAT IS FUNDED LESS BY THE STATE.

WE DO RECEIVE NEARLY $200,000 LESS IN FUNDING THAN IF THAT WERE SIMILAR TO SOME OF OUR OTHER PEER SCHOOL FUNDING RATES THERE. AND ON THE RIGHT HERE, WE HAVE THE STATE FACILITY FUNDING AND ELIGIBILITY.

SO UP UNTIL 2021, WE HAD RECEIVED SB 740 DUE TO DEMOGRAPHIC SHIFTS THAT ARE OUT OF OUR CONTROL IN OUR LOCALLY ZONED ELEMENTARY SCHOOLS.

FROM 21-22, WE HAVE NOT BEEN ELIGIBLE TO RECEIVE THOSE FUNDS FROM THE STATE.

AGAIN, THAT'S ON THE ORDER OF $750,000, YOU KNOW, LOSS IN REVENUE.

CAN WE GO TO THE NEXT SLIDE, PLEASE? THIS IS.

MAYBE A LITTLE BIT NUANCE TO UNDERSTAND HERE, BUT THAT TOP LINE HERE IN YELLOW IS EFFECTIVELY A THEORETICAL KIND OF A BUDGET NET INCOME OR NET DEFICIT OR SURPLUS.

AND IF DENALI DIDN'T HAVE ANY OF THESE KIND OF, YOU KNOW, NOT ONLY STRUCTURAL BUT ALSO NON STRUCTURAL KIND OF CHALLENGES, WE WOULD ESTIMATE THE DEFICIT TO SERVE THE COMMUNITY AT ROUGHLY A $500,000 DEFICIT ROUGHLY, WHICH WE BELIEVE IS ACHIEVABLE AND WOULD LEAD TO A PATH FORWARD.

HOWEVER, IF YOU SEE BELOW, WE HAVE THE STRUCTURAL AND THE NON STRUCTURAL DRIVERS AND THE VARIABLES THERE AS WELL AS SOME OF THE ASSUMPTIONS

FOR AGAIN, THIS IS FOR NEXT YEAR'S BUDGET, THE ONES THAT WE JUST DISCUSSED AS SB 740 AND SPECIAL EDUCATION TO LEAD US TO THAT $4.5 MILLION DEFICIT PROJECTED.

CAN WE GO TO THE NEXT SLIDE, PLEASE? SO SOME OF THE THINGS THAT WE HAVE CONSIDERED AND TO BE CLEAR, WE WANT TO KEEP THE SCHOOL OPEN.

I WANT TO MAKE SURE THAT THAT THAT IS THAT IS, YOU KNOW, WE COMMUNICATE THAT CLEARLY.

AND AS SUCH, WE HAVE DILIGENTLY EXPLORED SOME OTHER OPTIONS, SUCH AS THE ONES THAT YOU SEE ON THE SLIDE, INCLUDING FULLY ENROLLING THE SCHOOL. THAT'S HARD TO DO IN ONE YEAR IS THE TRUTH, GIVEN THE GAPS IN DIFFERENT GRADES OR, YOU KNOW, AVAILABLE SEATS WE HAVE IN DIFFERENT GRADES TO CREATE A VIRTUAL PROGRAM.

WE'RE NOT SURE THAT WE HAVE THE CAPABILITY TO ACTUALLY RUN A SUCCESSFUL VIRTUAL PROGRAM TO SLOWLY WIND DOWN THE SCHOOL.

AGAIN, THAT'S A VERY EXPENSIVE KIND OF OPTION THERE TO IS.

AND I WOULD ALSO INCLUDE MAYBE THAT'S THE ONE UNDERNEATH THAT IS TO CLOSE ONLY THE MIDDLE SCHOOLS.

YOU KNOW, WHEN WHEN FAMILIES ARE AWARE THAT THERE'S A FINANCIAL DEEP FINANCIAL ISSUE HERE, WE HAVE TO START MODELING OUT SCENARIOS WHERE ONLY THE SORT OF TERMINAL GRADE, THE, YOU KNOW, THE 11TH GRADERS AND MAYBE THE SEVENTH GRADERS ARE ACTUALLY ENROLLED.

AND WE NEED TO DEEPLY DISCOUNT ALL THE OTHER GRADES SO THAT ONES BECOME EXTREMELY CHALLENGING TO OPEN AND UTILIZE A LINE OF CREDIT.

I THINK THE CHARTER TEAM HERE MIGHT SHARE MORE, BUT WE'VE BEEN IN DISCUSSION WITH THEM AND WE SOME OF THE PUBLIC SCHOOLS CURRENTLY, NUMBER ONE, DOES NOT HAVE A LINE OF CREDIT.

SO AT THIS MOMENT IN TIME, THAT IS THAT IS NOT AN OPTION.

THAT BEING SAID, WE ARE EXPLORING A LINE OF CREDIT FOR REALLY TWO REASONS.

ONE IS WITH SORT OF A POTENTIAL RECESSION KIND OF ON THE CUSP OR SORT OF IN AND OUT OF IT.

WE WANT TO BE MINDFUL OF PLANNING FOR ANY STATE DEFERRALS, AGAIN, WHICH THE STATE HAS USED AS A TOOL FOR RECESSIONARY TIMES.

SO THAT OFTEN RESULTS IN KIND OF UNEVEN CASH FLOWS FOR SCHOOLS.

AGAIN, THAT'S A VERY COMMON PRACTICE THAT A LOT OF OUR OTHER SCHOOLS IN YOUR PORTFOLIO ACTUALLY HAVE, AS WELL AS A TOOL.

SO THAT'S NOT AN UNUSUAL PRACTICE.

AND NUMBER TWO, AS IT RELATES TO THERE'S A COMPLEXITY WITH THE FINANCING OF THE NOT THE DENALI HIGH SCHOOL BUILDING, GIVEN THAT IT IS PUBLICLY THAT WE HAVE PUBLIC BONDS ISSUED FOR THAT.

SO IN ORDER TO MAKE SURE THAT WE ARE WORKING CLOSELY WITH OUR BONDHOLDERS.

IT FEELS PRUDENT TO POTENTIALLY HAVE THAT AS KIND OF A TOOL IN THE BACKGROUND.

BUT AGAIN, WE HAVE HOPEFULLY NO PLANS TO USE IT.

PHILANTHROPY AND GRANTS.

AGAIN, WE ESTIMATE QUITE A LARGE ENDOWMENT TO POTENTIALLY KEEP THIS SCHOOL GOING.

AND THAT IS NOT A SMALL FEAT.

ONGOING SCHOOL LEVEL FUNDRAISING.

AND WE'VE BEEN IN TOUCH WITH OUR FAMILIES.

AND, YOU KNOW, WHILE THERE'S BEEN A LOT OF GREAT WORK TO GET, YOU KNOW, SOME FINANCIAL PLEDGES AMONG A LOT OF THE PARENTS IN THE COMMUNITY, I THINK WE STRUGGLE WITH WHAT HAS BEEN PLEDGED AND WHAT THE GAP IS.

IT'S STILL FEELS QUITE, QUITE LARGE RELATIVE TO WHAT HAS BEEN PLEDGED AT THIS MOMENT IN TIME.

THEY PROMISED ME THAT THIS WOULD BECOME MY MENTOR FAMILY SUMMIT PROMISED ME THE TEACHERS WOULD LISTEN TO ME AND ACTUALLY SEE ME FOR WHO I REALLY AM AND HELP ME.

THE TEACHERS ACTUALLY KNOW WHO I AM.

THE STUDENTS GET TO WORK TOGETHER AND THAT IS AWESOME.

SUMMIT PROMISED ME THAT I WOULD FEEL SAFE AND I DID.

BUT THEN LESS THAN SIX MONTHS AFTER I STARTED IT, DENALI SUMMIT DROPPED ANVILS ON THE HEADS OF ALL OF THE DENALI STUDENTS AND TEACHERS BECAUSE THEY BROKE THEIR PROMISES AND THEY WERE CLOSING THE SCHOOL.

THERE WAS NO WARNING AND WE WERE TOTALLY DEVASTATED.

WE ARE CONFUSED, SAD, AND ALSO ANGRY.

SUMMIT SAYS THEIR PHILOSOPHY IS TO, QUOTE, GIVE STUDENTS AN EDUCATIONAL OPPORTUNITY LIKE NO OTHER AND TO SUPPORT THE WHOLE STUDENT THROUGHOUT THE SCHOOL DAY.

SUMMIT SAYS THAT THEY PUT STUDENTS FIRST, END QUOTE.

THAT'S WHAT WE HAVE AT DENALI.

IT'S A HIGH CALIBER EDUCATION THAT HELPS PUT STUDENTS IN CHARGE OF THEIR OWN SUCCESS.

BUT AFTER YEARS OF UNCERTAINTY, FINDING A LOCATION FOR DENALI MOVING FROM SPOT TO SPOT, THEY FINALLY SETTLED ON SANTA LISO.

MY KIDS AND I HELPED REMODEL SEVERAL SITES DURING THAT PERIOD AND WENT THROUGH THE INSTABILITY WHEN THE SANTA LISO SITE WAS FOUND, I HELPED PERSUADE THE SUNNYVALE CITY COUNCIL TO ALLOW THAT SCHOOL TO OPEN DESPITE SOME NEIGHBORHOOD CONCERNS ABOUT TRAFFIC AND NOISE.

I LIVE IN THE NEIGHBORHOOD AND WE'VE SEEN THAT DENALI HAS DONE NOTHING BUT CONTRIBUTE TO A VERY POSITIVE ATMOSPHERE SINCE ITS OPENING.

WE'VE SEEN SIX FACTORS PRESENTED HERE AND NONE OF THEM WERE SUDDENLY KNOWN IN DECEMBER.

740 MIDDLE SCHOOL ADDITIONAL GRADE, EVEN ENROLLMENT WAS KNOWN IN JUNE, MAXIMUM IN AUGUST.

SO WHY THE SCHOOL ADMINISTRATION WASN'T TRANSPARENT TO US.

WHAT ACTIONS HAVE THEY DONE TO DRIVE ENROLLMENT UP? CERTAINLY, AS PARENTS WERE NOT INCLUDED.

I REPRESENT THE HISPANIC COMMUNITY.

19 OUT OF THAT 22% GRADUATE.

GRADUATION RATE IS HIGH.

I DON'T SEE A REAL REASON WHY TO CLOSE SUMMIT DENALI.

ENROLLMENT ISSUES, I FEEL THEY COULD POSSIBLY BEING SOLVED WITH PARENT AND TEACHER INVOLVEMENT.

DENALI HAS A HUGE POTENTIAL TO CREATE AND DEVELOP GREAT COMMUNITY MEMBERS.

SUMMIT BOARD'S NOT WILLING TO KEEP DENALI OPEN, I WANT TO ASK IF IT'S POSSIBLE.

I DON'T EVEN KNOW IF IT'S POSSIBLE OR NOT THAT THE COUNTY TAKE OVER FROM THEM AND KEEP OUR KIDS TO SCHOOL OPEN.

MANY OF THE CHILDREN WHO HAVE COME AND SPOKEN ARE CHILDREN WHO ARE CURRENTLY IN MY CLASSROOM.

MANY OF THE PARENTS HERE I HAVE BEEN IN CONTACT WITH ME, CONNECTIONS WITH THEIR CHILDREN.

SO THERE'S APPROXIMATELY I'LL GET INTO DETAIL A LITTLE BIT ON THAT, A LITTLE OVER $600,000, WHICH IS A DEPRECIATION EXPENSE, AND THAT'S REALLY A FUNCTION OF A CAPITAL PROJECT, AN INVESTMENT FACILITY, AN INVESTMENT THAT WE CHOSE TO DO WITH TAHOMA, AND THAT HAS TO CORRESPOND WITH THE FACILITY USE AGREEMENT TIMELINE.

AND WHAT WE LEARNED THROUGH THIS SURVEY WAS THAT THE LEADERSHIP AT THE SCHOOL SITE LEVEL WAS REALLY THE PLACE WHERE THE VAST MAJORITY OF PARENT ENGAGEMENT AND DECISION MAKING WAS IMPORTANT.

THE DECISIONS THAT OUR SCHOOL SITE LEADERS MAKE AS AS AUTONOMOUS LEADERS OF THEIR SCHOOLS WERE THE TYPES OF ISSUES THAT THAT PARENTS REALLY WANTED TO HAVE THAT INPUT.

AND THAT LED US THEN TO TAKING A LOOK AT AS WE LOOKED AT OUR BOARD MEMBERSHIP, SAID, OKAY, GREAT, SO LET'S TAKE ALL THIS INPUT THAT WE'VE RECEIVED IN ADDITION TO THAT AND REALLY BUILD OUT WHAT A BOARD MEMBER PROFILE FOR OUR SCHOOLS LOOKS LIKE.

ADA FUNDING ACTUALLY IS IS SOME OF THE CHALLENGE THAT YOU SAW THERE.

AND SO WE LOOKED AT A SCENARIO WHERE AND NONE OF THESE ARE PLEASANT, BUT I JUST WANT YOU TO KNOW, WE LOOKED AT EVERY POSSIBLE SCENARIO.

WELL, MAYBE WHAT IF WE CLOSED THE MIDDLE SCHOOL GRADES AND ONLY HAD THE HIGH SCHOOL AND THEN ONLY HAD ONE BUILDING AND EVERY ONE OF THOSE SCENARIOS IN DETAIL WHEN WE RAN THEM, THEY STILL DON'T BECOME FINANCIALLY VIABLE AGAIN BECAUSE YOU HAVE THE SAME STRUCTURAL CHALLENGES.

AND SO NOT IN THE DIRECT WAY THAT WE'RE TALKING ABOUT HERE BECAUSE IT HADN'T COME TO THAT POINT.

BUT A NUMBER OF CONVERSATIONS ALONG THE WAY.

AND I WOULD SAY THERE'S ALSO.

RUNNING CHARTER SCHOOLS IS REALLY HARD.

IT'S A REALLY HARD ENVIRONMENT.

AND THERE IS THIS ALWAYS THIS BALANCE OF.

PROJECTING CONFIDENCE AND BELIEVING THAT YOU'RE GOING TO BE ABLE TO DO WHAT AND DELIVER SO THAT PEOPLE WILL COME AND BEING HONEST AND TRANSPARENT.

SO NO COMMUNITY MEETINGS REGARDING THE FISCAL CONCERNS.

THAT'S NOT WHAT I SAID, BUT THAT'S FINE.

SO I WANT TO ASK ABOUT THE TEACHERS AT DENALI.

HAVE THEY BEEN GIVEN ANY INDICATION OR ASSURANCES IF THEY'D GET PRIORITY IN TERMS OF TRANSFERRING TO ANOTHER SUMMIT SITE? SO TWO THINGS THAT ARE HAPPENING.

ONE, A SUMMIT IS CURRENTLY ENGAGED IN BARGAINING WITH UNITE SUMMIT ABOUT THE EFFECTS OF A POTENTIAL CLOSURE.

AND SO ALL OF THE POTENTIAL EFFECTS ARE BEING BARGAINED.

BUT IN OUR CURRENT CBA, WE HAVE A VOLUNTARY TRANSFER PROCESS AND WE HAVE OPENED UP THAT VOLUNTARY TRANSFER PROCESS ACCORDING TO THE CBA AND ACCORDING TO WHAT WE WOULD NORMALLY DO.

AND A SIGNIFICANT NUMBER OF THE DENALI TEACHERS.

AND WE CAN CERTAINLY PULL UP THE DATA RIGHT NOW IF YOU'D LIKE TO KNOW THE EXACT NUMBER.

A SIGNIFICANT NUMBER HAVE ALREADY APPLIED FOR A TRANSFER IN THAT PROCESS.

AND IN DAYS WE'LL RECEIVE OFFERS FOR FOR THOSE TRANSFERS.

THE CHARTER SCHOOLS TEAM HAS COMPLETED MORE THAN HALF OF THE REQUIRED ANNUAL VISITS TO SSCBOE AUTHORIZED CHARTER SCHOOLS AND WILL BE CONCLUDING OUR VISITS IN MARCH. SECOND SUMMIT PUBLIC SCHOOLS.

SO FIRST THING ABOUT SUMMIT PUBLIC SCHOOLS IS PERB.

FROM 2019 TO SOMETIME IN 2020, UNITE SUMMIT FILE WITH THE PUBLIC EMPLOYMENT RELATIONS BOARD, PERB.

FIVE UNFAIR PRACTICE CHARGES AGAINST SUMMIT PUBLIC SCHOOLS CLAIMING THAT SUMMIT VIOLATED THE EDUCATIONAL EMPLOYMENT RELATIONS ACT OR EDRA, BASED ON ONE VIOLATIONS RELATED TO THE INITIAL ORGANIZATION AND NEGOTIATION EFFORTS OF UNITE SUMMIT AND TWO, SUMMITS RESPONSE TO ISSUES PRESENTED BY THE COVID PANDEMIC.

SUMMIT ALSO FILED ONE UNFAIR PRACTICE CHARGE AGAINST UNITE SUMMIT.

AS OF FEBRUARY 8TH, 2023, EACH OF THOSE CHARGES FILED WITH HERB HAS BEEN RESOLVED.

THE LAST UNFAIR PRACTICE CHARGE RESOLVED WAS FILED JUNE 18, 2019 AND INVOLVE FIRING INVOLVED THE FIRING OF THREE SUMMIT TEACHERS, TWO FROM SUMMIT DENALI AND ONE ONE EXPEDITION'S TEACHER WHO WAS ASSIGNED TO THE HOME OFFICE.

IN THIS CASE, UNITE SUMMIT ALLEGED THAT SUMMIT TERMINATED THE THREE TEACHERS IN RETALIATION FOR ENGAGING IN UNION ORGANIZING AND RELATED ACTIVITIES. ON JANUARY 11, 2023, AN ADMINISTRATIVE LAW JUDGE FOUND BY A PREPONDERANCE OF EVIDENCE THAT, ONE, THE TEACHERS EXERCISED THEIR PROTECTED RIGHTS TO ORGANIZE UNDER EERA, TWO, SUMMIT, HAD KNOWLEDGE OF THE TEACHER'S EXERCISING THEIR RIGHTS AND TOOK ADVERSE ACTION AGAINST THE TEACHERS BY TERMINATING THEM.

AND THREE, THAT SUMMIT TERMINATED THE TEACHERS BECAUSE THEY EXERCISE THEIR RIGHT TO ORGANIZE, THUS VIOLATING THE UNITE SUMMIT HAS ALSO PROVED THAT SUMMIT UNLAWFULLY INTERFERED WITH UNITE SUMMIT'S RIGHT TO REPRESENT EMPLOYEES.

PERB IS AUTHORIZED TO ORDER A REMEDY DESIGNED TO RESTORE, SO FAR AS POSSIBLE THE STATUS QUO WHICH WOULD HAVE BEEN OBTAINED, BUT FOR THE WRONGFUL ACT.

THE REMEDY FOR THE CASE FOR THIS CASE INCLUDES THE FOLLOWING.

ONE, RESCIND THE TERMINATIONS AND REINSTATE THE TEACHERS TO THEIR FORMER POSITIONS, OR, IF THOSE POSITIONS DO NOT EXIST, IS SUBSTANTIALLY EQUIVALENT POSITION.

TWO, EXPUNGE ALL SUMMIT RECORDS.

EXPUNGE ALL SUMMIT RECORDS, ALL INFORMATION PERTAINING TO THE TERMINATIONS OF THE THREE TEACHERS.

THREE, PROVIDE PAYBACK OR PROVIDE BACK PAY AND BENEFITS AT THE RATE EACH TERMINATED TEACHER WAS PAID PRIOR TO TERMINATION AND SUBJECT TO ANY RAISES EXPERIENCED BY THEIR CLASSIFICATIONS SINCE THE TIME OF THEIR TERMINATION, WITH INTEREST AT THE RATE OF 7% PER ANNUM FOR WAGES AND BENEFITS LOST FROM THE DATE OF TERMINATION TO THE DATE OF REINSTATEMENT OR DECLINE THEREOF, THE BACK PAY ORDER IS SUBJECT TO OFFSET FOR WAGES EARNED DURING THE RELEVANT PERIOD.

THE SECOND BILL WOULD REMOVE BARRIERS TO ENROLLMENT OF CHILDREN WITH DISABILITIES IN CHILDCARE AND PRESCHOOL SETTINGS.

ALL OF THE HEAD START PROGRAMS IN OUR REGION AND MANY ACROSS THE COUNTRY ARE REALLY STRUGGLING TO MEET ENROLLMENT TARGETS AND ARE NOT EARNING THEIR FULL GRANTS.
