Background
On May 3, 2023 the Policy Subcommittee met and approved a first reading of Board Bylaw 9270.1 the Levine Act: Conflict of Interest. This bylaw and exhibit were brought to the Board on May 17, 2023 for the first reading.
BB 9270.1 Levine Act: Conflict of Interest Board Bylaw 9270.1 is being established due to a change in the law. The Levine Act, as part of the Fair Political Practices Reform Act, now applies to all members of local governmental agencies who are directly elected by the voters, including the Santa Clara County Board of Education (SCCBOE) members. The Levine Act prohibits an Officer of an Agency from accepting, soliciting, or directing a contribution of more than $250 from any Party or Participant (or their agent) while a proceeding involving a License, Permit, or Other Entitlement for Use (1) is pending before the Agency, (2) in the 12 months preceding the final decision, and (3) for 12 months following the date a final decision is made if (1) the Officer knows or (2) has reason to know that the Party of Participant (or their agent) has a financial interest in the final decision. Local elected officials who received campaign donations in excess of $250 in 2022 are not required to recuse themselves from related proceedings in 2023. Local elected officials will need to monitor their contributions as of January 1, 2023 as it applies to the implementation of this new law.
Compliance with the Levine Act is an individual responsibility of SCCBOE members. SCCBOE members should independently seek legal counsel or consult with the Fair Political Practices Commission (FPPC) at 1-866-ASK-FPPC (1-866-275-3772)r other entitlement for use and makes a contribution of more than $250 to a County Board of Education member, parents or volunteer board members would not qualify as a party if they are not the petitioners (and therefore do not file applications to become charter schools) or are not otherwise acting as the partys agent. See Cal. Gov. Code 84308(a)(1). The FPPC has advised that when an entity is a party, individual board members of that entity are not parties. See Cal. Fair. Pol. Prac. Com. Adv. A-03-094 (2003) (finding that the Port of Stockton was a party as it was an applicant in a proceeding, but that the individual members of its Board of Directors were not). Please note that parents or volunteer board members could be participants if they meet the definition of a participant.
The FPPC recently issued the attached opinion, which confirms that charter school petitions approved by a board are subject to the Levine Act. Charter school petitions are considered entitlement for use proceedings.

On July 26, 1990 the United States (U.S.) was the first country to draft and sign a comprehensive piece of legislation that remains a driving force towards equal opportunity, inclusion, independent living and economic self-sufficiency for the 61 million individuals with disabilities in the U.S.
Student Impact
The signing of this historic act was and remains a declaration of equality for individuals with disabilities. It is the guiding legislation to ensure that students with disabilities have the same access and opportunities as their non-disabled peers which is in direct alignment to the Santa Clara County Board of Education priority of inclusive practices.

Complaints filed for SCCOE school sites under the Williams Settlement are limited to insufficient textbooks or instructional materials, unsafe or unhealthy facility conditions or teacher vacancies or mis-assignments.
Williams Complaint Procedures are posted in all classrooms to inform parents, students and teachers of the procedure for making such complaints.
No Williams complaints were received during the April 1, 2023 through June 30, 2023 reporting period.
Student Impact
The Williams Report documents complaints regarding textbooks and instructional materials, conditions of facilities, and teacher mis-assignments and vacancies. SCCOE strives to provide our students a quality education that encompasses all of these areas. No complaints were filed this quarter.

Per Board Policy BP 3270, when any Santa Clara County Office of Education instructional materials, equipment, supplies, or other personal property with a value less than $25,000 becomes unusable, obsolete, or no longer needed, the Santa Clara County Superintendent of Schools or designee shall notify the Santa Clara County Board of Education.
Fiscal Implications
The report includes a list of the items sold, income received, and the method of sale. Items that are no longer usable by the Santa Clara County Office of Education are sold for surplus or disposed of as e-waste.
The next Santa Clara County Board of Education regular meeting is scheduled for August 2, 2023.
