[A. Announcement of 2023-2024 Student Board Member Appointed to the SCCBOE]

DR. DEWAN, COULD YOU PLEASE INTRODUCE THIS RECOGNITION? YES. THANK YOU. PRESIDENT CHON.

TONIGHT I'M REALLY PLEASED TO ANNOUNCE THAT WE HAVE A NEW STUDENT BOARD MEMBER JOINING US.

OUR CURRENT BOARD MEMBER, MARIO HERNANDEZ, IS EXITING HIS PROGRAM SOON AND HE IS WITH US TONIGHT AS WELL.

[00:05:04]

BUT TONIGHT WILL BE HIS LAST MEETING.

WE HAVE GREATLY APPRECIATED HIS SERVICE AND VOICE AND WE ARE INCREDIBLY PROUD OF HIM FOR HIS HARD WORK AND WHAT HE'LL BE DOING IN THE NEXT PHASE.

SO I WOULD NOW LIKE TO INTRODUCE NATHAN ALVAREZ.

NATHAN IS A SENIOR AT BLUE RIDGE HIGH SCHOOL AND IS IN GOOD ACADEMIC STANDING, COMMITTED IN WRITING TO CARRYING OUT THE RESPONSIBILITIES OF STUDENT BOARD MEMBERS BY COMPLETING AN AFFIDAVIT WHICH IS ON FILE IN THE OFFICE OF THE COUNTY SUPERINTENDENT OF SCHOOLS, AN ORIENTATION DESIGNED TO BUILD KNOWLEDGE OF THE SCHOOL AND AN UNDERSTANDING OF THE RESPONSIBILITIES AND EXPECTATIONS OF THE POSITION HAS BEEN PROVIDED TO THE STUDENT BOARD MEMBERS IN SUPPORT OF OUR STUDENT BOARD MEMBERS TRAINING ON THE BROWN ACT AND AN OVERVIEW OF BOARD BYLAWS.

DUE TO THE RULES AND REGULATIONS GOVERNING THE STUDENT PROGRAM, THE STUDENTS WILL PARTICIPATE VIA TELEPHONE ONLY.

NATHAN, CONGRATULATIONS AND WELCOME.

WOULD YOU LIKE TO SHARE A FEW WORDS? THANK YOU. AND YES, I WILL.

GOOD EVENING, PRESIDENT CHON, TRUSTEES SUPERINTENDENT, DR.

DEWAN AND COMMUNITY.

MY NAME IS NATHAN ALVAREZ AND I AM A SENIOR AT BLUE RIDGE HIGH SCHOOL.

I AM CURRENTLY DULY ENROLLED IN HIGH SCHOOL AND AT EVERGREEN VALLEY COMMUNITY COLLEGE.

I WILL BE TAKING TWO CLASSES PSYCHOLOGY AND BUSINESS MANAGEMENT.

I AM INTERESTED IN PURSUING MY BACHELOR'S DEGREE IN PSYCHOLOGY.

I WANT TO BE ABLE TO HELP YOUTH LIKE MYSELF NAVIGATE THROUGH THE PROBLEMS AND CHALLENGES THEY FACE.

FOR THE SHORT TERM, I AM ALSO INTERESTED IN THE HVAC OR WELDING TRADES.

I HOPE TO DO THAT WORK WHILE PURSUING MY DEGREE.

I RECENTLY WAS ELECTED TO BE AN ALTERNATIVE BOARD MEMBER FOR THE SANTA CLARA COUNTY OFFICE OF EDUCATION.

IN THIS POSITION, I HOPE TO NOT ONLY LET PEOPLE KNOW WHAT WE ARE DOING AT BLUE RIDGE, BUT TO ALSO HELP BRING MORE RESOURCES AND OPPORTUNITIES TO ME AND MY FELLOW PEERS.

NOT ONLY WAS I ELECTED TO BE A PART OF THE SCHOOL BOARD, BUT ALSO NOMINATED TO BE PART OF THE YOUTH ADVISORY COUNCIL.

ON THIS COUNCIL, I WILL BE ABLE TO ADVOCATE FOR MYSELF AND OTHERS TO MAKE CHANGE ON OUR CAMPUS AND HELP OTHERS UNDERSTAND THEIR RIGHTS.

MY HOPE FOR THE REST OF MY TIME AT THIS FACILITY IS TO GRADUATE HIGH SCHOOL, FURTHER PURSUE MY EDUCATION AND MAKE CHANGES AROUND OUR CAMPUS.

THANK YOU. THANK YOU, MEMBER ALVAREZ, AND WELCOME AGAIN.

PRESIDENT CHON LET'S GIVE EVERYONE A WARM WELCOME.

I HOPE YOU GUYS ARE ABLE TO HEAR THE APPLAUSE FOR BOTH OF YOU THIS EVENING.

SO THANK YOU, DR. DEWAN, AND WELCOME TO OUR NEW STUDENT BOARD MEMBER.

IT'S ALWAYS SUCH A PLEASURE TO HEAR FROM THE STUDENTS AND HAVE THEM JOIN US FOR OUR BOARD MEETING.

STUDENT VOICE IS DEFINITELY A PRIORITY OF THIS BOARD AND WHATEVER WE CAN DO TO SUPPORT THAT IS AMAZING.

SO THANK YOU SO MUCH.

WE WILL NOW MOVE TO PUBLIC COMMENT.

[A. At this time, members of the public may address the Board on any issue within the subject matter jurisdiction of the Board that is not listed on this agenda. Members of the public may also address the Board on an agenda item before or during the Board's consideration of the item.]

NOW IS THE TIME FOR THOSE WHO WOULD LIKE TO MAKE PUBLIC COMMENT ON ITEMS THAT ARE NOT LISTED ON THE AGENDA AND WITHIN THE SUBJECT MATTER.

JURISDICTION OF THE SANTA CLARA COUNTY BOARD OF EDUCATION.

PUBLIC SPEAKER CARDS MUST BE SUBMITTED AT THIS TIME.

AND ONCE WE BEGIN TAKING PUBLIC COMMENT, WE WILL NOT BE ABLE TO ACCEPT ADDITIONAL COMMENTERS.

MODERATOR DO WE HAVE ANY PUBLIC COMMENT? YES, THERE ARE FIVE CARDS FOR PUBLIC COMMENT.

OKAY. THANK YOU. THE SCC BOE STRIVES TO MAINTAIN A RESPECTFUL AND CIVIL ENVIRONMENT FOR THE CONDUCT OF ITS MEANING.

COULD WE PLEASE PRESENT THE TWO MINUTE TIMER? THE TIMER IS DISPLAYED AND WHEN THE ALLOTTED TIME IS UP, THE BUZZER WILL SOUND, YOU WILL BE MUTED AND YOUR TIME TO SPEAK WILL END.

SPEAKERS ARE ENCOURAGED TO AVOID REPEATING COMMENTS MADE BY OTHER SPEAKERS, AND SPEAKERS MAY CHOOSE TO SIMPLY STATE THEIR AGREEMENT WITH THE PREVIOUS SPEAKER.

IF YOU ARE USING TRANSLATION SERVICES, WE WILL DOUBLE THE TIME.

MODERATOR COULD YOU PLEASE BEGIN PUBLIC COMMENT? THANK YOU. AS YOU HEAR YOUR NAME, PLEASE LINE UP BEHIND THE PODIUM.

MICHELLE GARZA, RIVERA, YOLANDA GONZALEZ, FABIOLA PITAS.

CARLOS PATAS.

AND JORGE ARELLANO.

OUR FIRST SPEAKER IS MICHELLE GARZA RIVERA.

PLEASE CLEARLY STATE YOUR NAME AND BEGIN YOUR COMMENT.

MY QUESTION TO YOU GUYS.

GO AHEAD. GO AHEAD. OKAY.

SO MY QUESTION IS, WHY WAS GATEWAYS MEDICALLY FRAGILE CLASSROOM CLOSED? I'VE GOTTEN THREE DIFFERENT ANSWERS.

LOW ENROLLMENT.

I'VE GOTTEN FUNDING.

NOW I'VE GOTTEN.

NOW WE SHARE A CAMPUS WITH GLENVIEW AND THEY'RE NOW SO NOW THERE'S NOT ALLOWED ANY STUDENTS OVER FIFTH GRADE.

[00:10:02]

SO WHEN CHRISTOPHER WAS THREE, I CHOSE THIS CAMPUS BECAUSE OF HIS FRAGILITY.

YOU GUYS OFFERED A MEDICALLY FRAGILE CAMPUS.

NOW YOU'RE SAYING THAT THIS IS NO LONGER AN OPTION.

IT DOESN'T EXIST. BUT YET SAN JOSE HAS THREE MEDICALLY FRAGILE CLASSROOMS ON SHARED CAMPUSES.

K THROUGH 22, ALL IN ONE ROOM.

YOU WERE MOVING CHRISTOPHER FROM HIS MEDICALLY FRAGILE CAMPUS.

IT'S AN EXCLUSIVE ACT, NOT AN INCLUSIVE ACT.

HE WENT FROM HAVING A SCHOOL WITH FIVE CLASSROOMS OF SPECIAL ED STUDENTS TO HAVING A CLASSROOM FOR STUDENTS IN FIVE, INCLUDING HIM.

AND THAT'S ALL. AND YOU'RE WAREHOUSING HIM IN AN OFFICE COMPLEX IN SOUTH COUNTY ANNEX, AND HE'S THE ONLY SPECIAL ED CLASSROOM THERE.

AND THEY'RE ALL MOBILE.

THEY'RE VERBAL. THEY CAN COMPREHEND.

WHEN THE TEACHER'S TEACHING SOMETHING ON THE BOARD, THERE'S NO ONE ON ONE INSTRUCTION TO MY SON AND HE'S UNSAFE IN THAT CAMPUS IS INAPPROPRIATE WITH HIS MEDICAL NEEDS.

HE NEEDS TO BE ON A CAMPUS WITH A NURSE, WITH AN OT ROOM WITH ALL OF THEIR EQUIPMENT ON SITE BECAUSE HE CAN'T BRING ALL OF HIS EQUIPMENT TO HIM AT THE SITE. SO, YOU KNOW, THIS IS IT'S DISCRIMINATION.

IT'S UNFAIR. SOUTH COUNTY NEEDS TO HAVE A MEDICALLY FRAGILE CLASSROOM AVAILABLE TO ALL THOSE INCENTIVES.

AND MORGAN HILL AND GILROY AND HAVING THREE IN SAN JOSE AND NONE IN SOUTH COUNTY IS NOT RIGHT.

THANK YOU. OUR NEXT SPEAKER IS YOLANDA GONZALEZ.

BEFORE WE MOVE TO THE NEXT SPEAKER, CAN WE CHANGE THE MICROPHONE OR IF WE COULD JUST PAUSE REALLY QUICKLY AS I DON'T WANT THE PUBLIC COMMENT TO GET DISRUPTED BY THE MICROPHONE. KELLY, CAN YOU TRY THAT? CAN YOU HEAR ME RIGHT? YEAH, BUT I STILL WANT TO SWITCH IT OUT JUST BECAUSE THAT OTHER ONE.

BUT. YEAH.

OH, IF WE COULD SWITCH IT OUT.

GREAT.

GOOD AFTERNOON, EVERYBODY.

LAST TIME I WAS HERE AND I INTRODUCED TO YOU MY SON.

HE ATTENDS GATEWAY.

THIS TIME I'M HERE BECAUSE I KNOW THAT EVERY TIME YOU GUYS START WITH A MEETING, YOU START BY DOING THE PLEDGE FOR THE FLAG.

AND WE END UP SAYING WITH LIBERTY AND JUSTICE FOR ALL.

THIS IS NOT JUSTICE FOR ALL OUR KIDS BEING SENT TO SAN JOSE, REMOVED FROM THEIR COMMUNITIES.

IT'S NOT JUSTICE.

I WOULD LIKE YOU TO REMEMBER YOU GUYS BY CREATING, NOT DESTROYING GATEWAY, BY MAKING IN EVERY CITY A GATEWAY WHERE KIDS CAN BE KIDS WITH OR WITHOUT PROBLEMS LIKE HIM.

PEOPLE. KIDS THAT CAN WALK OR NOT WALK OR TALK AND NOT TALK.

PLEASE DO THE RIGHT THING.

THAT'S WHY YOU GUYS ARE HERE.

WE'RE COMING.

NOT JUST AS US AS THE COMMUNITY, AS PARENTS, AS FAMILY, AS COUSINS.

THESE KIDS DESERVE IT.

PLEASE DO THE RIGHT THING.

LET'S DO EQUALITY AND LIBERTY FOR ALL AND JUSTICE FOR ALL.

PLEASE DO SO.

OUR NEXT SPEAKER IS FABIOLA BATRES.

PLEASE CLEARLY STATE YOUR NAME AND BEGIN YOUR COMMENT.

HI, MY NAME IS FABIOLA VARGAS, MOTHER OF ALEXANDER BATRES.

THE KID HAS NOT BEEN AT SCHOOL SINCE IT START SINCE IT STARTED.

TODAY I WANT TO GO SEE THE HIGH SCHOOL BETTER OPTION THAN MARTIN MURPHY BECAUSE MARK MURPHY IS JUST FIASCO.

IT'S NOT A SCHOOL FOR THESE KIDS.

NOW, WHAT I FEEL FROM YOU GUYS THAT YOU GUYS ARE SENDING THEM TO MARK MURPHY SO YOU CAN USE THE FUNDS TO FIX UP THAT SCHOOL BECAUSE THAT SCHOOL IS UGLY.

THE FLOOR IS PEELING OFF AND IT'S MADE OUT OF METAL.

HE GETS DOWN. HE GETS CUT.

HE GETS OUT OF THE CLASSROOM.

HE'S DOWN A RAMP THAT'S MADE OUT OF PLYWOOD THAT THE PAINT IS COMING OFF.

THE ONLY PLAYED AREA THAT THEY HAVE ARE TWO LITTLE PATCHES OF A TEN BY 20 AREA AND A LITTLE SPOT HERE WITH CEMENT.

I GO THE CLASSROOM IS SO CLUTTERY.

THERE'S BLOCKS EVERYWHERE.

THERE IS NO WAY FOR HIM TO HAVE ANY DOWNTIME ON THE FLOOR.

YOU GUYS ARE MIXING ALL TYPES OF DISABILITY KIDS WITH KIDS WITH ATTITUDES.

KIDS WITH DISABILITIES, SEVERE DISABILITIES LIKE THIS LITTLE KID HERE THAT WON'T BE ABLE TO DEFEND HIMSELF FROM A KID THAT IS AGGRESSIVE AND THERE'S A KID THERE THAT'S AGGRESSIVE BECAUSE THE MOM TOLD ME HIS SON IS AGGRESSIVE.

HE ALREADY SENT A KID TO THE HOSPITAL.

YET. YOU WANT ME TO SEND THIS KID THERE? MAH MURPHY'S OUT OF THE QUESTION.

ANY SCHOOL FROM SAN JOSE IS A BIG NO FOR ME.

GILROY HIGH SCHOOL DID A GOOD JOB TODAY BY SHOWING ME SOMETHING MORE BETTER, BUT NOT AS EQUAL AS A GATEWAY.

I'M SORRY. I'M GOING TO SAY ALSO NO TO GILROY HIGH SCHOOL FOR THE SIMPLE FACT THAT THE WAY TO GO TO THE BATHROOM, YOU HAVE TO GO ALL AROUND THIS WAY OR YOU GOT TO GO AROUND THIS

[00:15:02]

WAY. I'M GOING TO SAY NO TO THAT.

IF YOU GUYS CANNOT COMPLY BY MAKING THE BATHROOM THAT'S RIGHT NEXT TO THAT CLASSROOM A BATHROOM FOR DISABLED KIDS, THE ANSWER IS NO.

AT THIS POINT. YOU GUYS HAVE DISRUPTED MY LIFE.

YOU GUYS MADE IT IMPOSSIBLE TO BE OKAY WITH MY FAMILY AND WITH THE COMMUNITY.

I AM DONE WITH YOU GUYS AND I HOPE GOD FORGIVES YOU FOR WHAT YOU GUYS DONE TO US AND THESE KIDS.

BECAUSE AT THIS POINT, I KNOW YOU GUYS DON'T EVEN CARE ONE HOOTS ABOUT THEM BECAUSE IF YOU DID, YOU WOULD HAVE MOVED SKIES AND DIRT FOR THIS KID AND YOU HAVEN'T DONE.

OUR NEXT SPEAKER IS CARLOS BERTA.

PLEASE CLEARLY STATE YOUR NAME AND BEGIN YOUR COMMENT.

. MY NAME IS CARLOS BATRES AND I DON'T KNOW IF YOU REALLY DOING YOUR JOB OR YOU AREN'T.

. SO IT'S BEEN I DON'T KNOW.

IT'S BEEN IT'S NOT 1 OR 2 MONTHS.

IT'S BEEN GOING ON SINCE MARCH.

I'M SORRY.

. THE POINT HERE IS THAT YOU DON'T REALLY CARE ABOUT CHILDREN WHO HAVE ISSUES.

YOU ONLY CARE ABOUT RECEIVING THE MONEY FROM THEM.

AND TO BE HONEST, I'M REALLY DISAPPOINTED.

I WOULD LIKE TO KNOW.

AND THIS IS AIMED TO ONE OF YOU.

WHEN WAS THE LAST TIME YOU VISITED A SPECIAL NEEDS SCHOOL? UH, TO BE HONEST, IT SEEMS LIKE YOU DON'T CARE AND YOU DON'T GIVE THE IMPORTANCE IT DESERVES.

[INAUDIBLE] . I DON'T KNOW IF YOU WILL SEND YOUR OWN KIDS TO THIS TYPE OF SCHOOL BECAUSE I PERSONALLY WOULDN'T I DON'T KNOW IF YOU HAVE HAD THE CHANCE OF VISITING THE [INAUDIBLE] SCHOOL.

[SPANISH] . TODAY I CANNOT TAKE A REST BECAUSE BEFORE I USED TO WORK AT NIGHT WHILE MY WIFE WILL TAKE CARE OF MY MY CHILDREN. AND NOW I'M WORKING NIGHT TIME AND I CANNOT EVEN REST.

[SPANISH] . SO I REALLY HAVE A LOT OF EXPENSES AND YOU DON'T REALLY GIVE ME HELP WHEN IT COMES TO RENT, FOOD, CLOTHING, GAS FOR MY CAR TO GO TO SCHOOL.

YOU DON'T REALLY CARE AND I DON'T GET ANY HELP.

[SPANISH] [SPANISH] AND I REALLY DON'T KNOW WHAT WHO MADE WHO OF YOU MADE THIS TERRIBLE DECISION? GATEWAY WAS A SCHOOL FUNDED BY PARENTS.

AND NOW YOU WANT TO TAKE IT AWAY FROM US? OUR LAST SPEAKER IS JORGE ARELLANO.

[00:20:04]

PLEASE APPROACH THE PODIUM CLEARLY, STATE YOUR NAME AND BEGIN YOUR COMMENT.

HERE. ALWAYS GO AFTER SOME INTENSE CONVERSATION.

SO CAN YOU HEAR ME? YOU CANNOT HEAR ME. ANYBODY GOING ONCE? TWICE. [INAUDIBLE].

CAN YOU HEAR ME NOW? YEAH, I CAN TALK LOUD IF I NEED TO.

CLOSER. GOING ONCE. GOING TWICE.

AND THEN YOU START. YEAH, BUT IT'S TOO HARD TO HEAR.

CAN. YEAH.

CAN WE GET ANOTHER MIC? BECAUSE WHEN HE'S NOT CLOSE ENOUGH, WE CAN'T HEAR VERY WELL.

YOU CAN JUST TAKE MY MICROPHONE IF THAT WORKS.

OKAY.

[INAUDIBLE].

THANK YOU. CAN YOU ALL HEAR ME? WELL, NOW? THAT'S A LOT BETTER.

I THINK IT WAS A MIC.

SO, GOOD EVENING, SUPERINTENDENT DEWAN, BOARD PRESIDENT, CHON AND TRUSTEES.

I WAS NOT EXPECTING TO RETURN SO SOON, BUT HERE I AM IN COLLABORATION WITH AMAZON AND THE FARMWORKER CARAVAN ALPHA.

JOSE HERNANDEZ HAS SECURED AN EXCLUSIVE SCREENING OF THE MOVIE A MILLION MILES AWAY.

IT IS THE STORY OF JOSE HERNANDEZ, A FARMWORKER WHO LITERALLY REACHED FOR THE STARS AND BECAME A NASA ASTRONAUT.

AT ALPHA, WE ARE PASSIONATE ABOUT EXPOSING OUR STUDENTS TO THE STEM FIELDS, AND THIS EVENT WILL BRING TOGETHER WONDERFUL ROLE MODELS FOR OUR COMMUNITY AND RESOURCES FOR OUR COMMUNITY. AT THE MEXICAN HERITAGE PLAZA IN EAST SAN JOSE.

OUR COMMUNITY IS GOING TO HAVE AN OPPORTUNITY TO MEET JOSE HERNANDEZ AND ASK HIM QUESTIONS AND BE INSPIRED BY HIS AMAZING LIFE JOURNEY.

I WANTED TO PERSONALLY EXTEND THAT INVITATION TO YOU TO ATTEND THE SCREENING.

I LEFT YOU SOME INVITATIONS IN THE BACK AND WE'LL ALSO BE FOLLOWING UP WITH AN EMAIL AND WE HOPE THAT YOU CAN JOIN US.

HAVE A GREAT DAY. THIS CONCLUDES THE CARDS FOR PUBLIC COMMENT.

THANK YOU. MODERATOR.

WE WILL NOW MOVE TO AGENDA ITEM NUMBER FOUR INFORMATION ITEMS.

[A. Charter Schools Update]

DR. DEWAN, COULD YOU PLEASE INTRODUCE THE FIRST ITEM? YES. OUR FIRST ITEM THIS EVENING IS OUR CHARTER SCHOOLS UPDATE.

TONIGHT'S PRESENTATION WILL BE PROVIDED BY EXECUTIVE DIRECTOR OF CHARTER SCHOOLS MEFULA FAIRLEY.

I HAVE TO. UM, THE DIRECTOR.

FAIRLEY. COULD YOU SPEAK A LITTLE CLOSER? OKAY. THE CHARTER SCHOOLS DEPARTMENT, FISCAL AND PROGRAM STAFF CONDUCTED WHAT WE CALL OUR WELCOME BACK TOUR, WHICH CONSISTED OF A BRIEF VISIT WITH THE SITE ADMINISTRATOR OF EACH OF THE 21 AUTHORIZED CHARTER SCHOOLS.

THE TEAM PUT TOGETHER A GOODIE BAGS CONSISTING OF VARIOUS SNACKS, SEVERAL STRESS BALLS AND A SAECO BRANDED CELL PHONE HOLDER.

DURING OUR VISITS, THE TEAM DELIVERED THE GOODIE BAGS AND HAD AN OPPORTUNITY TO INTRODUCE OURSELVES TO FOUR NEW CHARTER SCHOOL PRINCIPALS AND BRIEFLY SAY HELLO AND CATCH UP WITH THE RETURNING PRINCIPALS.

THE WELCOME BACK TOUR TOOK PLACE OVER THREE DAYS ON AUGUST 25TH.

WE VISITED 11 SCHOOLS.

ON SEPTEMBER 8TH WE VISITED.

TEN SCHOOLS.

AND ON SEPTEMBER 18TH, WE VISITED TWO SCHOOLS.

AT EACH SCHOOL SITE, STUDENTS LOOKED HAPPY AND ENGAGED AND STAFF APPEARED TO BE REFRESHED AND READY FOR THE SCHOOL YEAR.

WE ARE PREPARING TO GATHER INPUT FROM SCHOOLS IN ORDER TO SCHEDULE OUR REQUIRED ANNUAL VISITS, WHICH WILL EACH TAKE PLACE OVER THE COURSE OF ONE DAY STARTING THIS FALL.

THE VISITS WILL BE HYBRID, WITH THE TEAM VISITING THE SCHOOL FOR AN INTERVIEW WITH SITE AND NETWORK LEADERS.

CLASSROOM OBSERVATIONS AND AN INTERVIEW WITH A SMALL GROUP OF STUDENTS.

WE WILL MEET WITH EDUCATIONAL PARTNERS SUCH AS PARENTS AND TEACHERS AND CLOSE OUT THE VISIT WITH A LEADERSHIP DEBRIEF VIA ZOOM.

AND THEN MY SECOND SECOND TOPIC IS VOICES COLLEGE BOUND LANGUAGE ACADEMY, MORGAN HILL.

SO I'M PLEASED TO REPORT THAT VOICES HAS ANNOUNCED THAT IT IS SET TO CONSTRUCT A NEW PERMANENT SITE FOR VOICES.

MORGAN HILL. VOICES WILL CELEBRATE THE CONSTRUCT.

THE VOICES WILL CELEBRATE CONSTRUCTION.

[00:25:01]

GROUNDBREAKING. GROUNDBREAKING AT A CEREMONY BEGINNING AT 10:00 ON SATURDAY, SEPTEMBER 30TH IN MORGAN HILL.

AND THAT CONCLUDES MY REPORT FOR THE EVENING.

OKAY. THANK YOU.

ALL RIGHT. DR. DEWAN, COULD YOU PLEASE INTRODUCE THE NEXT ITEM?

[B. Annual Conflict of Interest Code Board Bylaw and Exhibit 9270 Reading]

THANK YOU. PRESIDENT CHON.

ON SEPTEMBER 6TH, 2023, THE POLICY SUBCOMMITTEE MET AND REVIEWED BOARD BYLAW 9270 AND APPROVED REVISIONS TO EXHIBIT 9270 CONFLICT OF INTEREST CODE.

THIS EXHIBIT IS UPDATED ANNUALLY TO ADD, REMOVE OR REVISE POSITION TITLES OF THOSE WHO ARE REQUIRED TO COMPLETE THE FORM 700.

AND THIS ITEM WILL ALSO BE IS ON THE AGENDA LATER THIS EVENING FOR APPROVAL AS PART OF OUR ANNUAL REVIEW AND UPDATE.

THANK YOU, TRUSTEE MAH.

THANK YOU, PRESIDENT CHON.

I HAVE A QUESTION WITH REGARDS TO THE LIST OF DESIGNATED POSITIONS, WHICH IS EXHIBIT A.

I NOTICED THAT THERE'S A LOT OF.

CHANGED POSITIONS, TITLES WHICH I THINK HAVE HAVE BEEN CHANGED FOR DIFFERENT PERSONNEL AND SOME NEW ONES THAT HAVE BEEN CREATED.

SO I GUESS MY QUESTION IS.

WITH AN ASIDE THAT IT WOULD BE NICE TO BE INTRODUCED TO ESPECIALLY CABINET MEMBERS AS THEY'RE BEING BROUGHT ON BOARD.

BUT TO UNDERSTAND KIND OF WHO ARE THESE PEOPLE AND WHETHER THE POSITION CHANGES ARE RELATED OR CHANGED BECAUSE OF PROMOTIONS OR RELABELING, AND WERE THERE ANY SALARY CHANGES RELATED TO THOSE TWO? SO THE PURPOSE OF THIS EXHIBIT IS SPECIFIC TO INCLUDE THE TITLES OF THE POSITIONS THAT ARE REQUIRED TO COMPLETE THE FORM 700. SO IT'S NOT A PERSONNEL REPORT.

IT IS A TITLE AND DESIGNATION SO THAT THE EMPLOYEES WHO MIGHT FILL THESE POSITIONS KNOW OF THEIR OBLIGATION UNDER THE CONFLICT OF INTEREST CODE AND WHICH OF THE CATEGORIES THEY'RE REQUIRED TO REPORT UNDER.

AND A LOT OF THE RED HERE IS ALSO JUST A REORDERING.

WE HAD TRIED TO CATEGORIZE OR REORDER THE POSITIONS IN GROUPS SO THAT THE EXHIBIT WAS EASIER TO READ.

SO YOU CAN SEE, FOR EXAMPLE, ALL THE EXECUTIVE DIRECTOR POSITIONS ARE GROUPED TOGETHER, THE DIRECTOR POSITIONS GROUPED TOGETHER, ETCETERA.

RIGHT. BUT I SEE THAT THERE HAVE BEEN SOME CHANGES OF POSITIONS LIKE CHIEF TECHNOLOGY OFFICER IS NOW HEAD OF TECHNOLOGY.

SO WAS THAT CHANGE? A ONLY A TITLE CHANGE OR HOW WAS THAT? I MEAN, BECAUSE THESE ARE ALL POSITIONS OF ACTUAL PEOPLE, RIGHT? I MEAN, REGIONS THAT WE WOULD HOPE TO HAVE PEOPLE IN THEM.

YES. THEY'RE ALL EXISTING POSITIONS FOR WITH REGARD I'M SORRY.

YOU ACTUALLY HAVE PEOPLE IN THE POSITIONS.

I THINK THE MAJORITY OF THEM ARE FILLED AT THIS TIME, BUT THEY MAY BE UNDER YOU KNOW, SOMETIMES WE HAVE VACANCIES AND THEY MAY BE UNDER RECRUITMENT.

BUT WITH REGARD TO THE HEAD OF TECHNOLOGY THAT IS SOLELY A TITLE CHANGE, WE HAD MADE A DECISION TO NO LONGER UTILIZE THE TERM CHIEF.

SO W WE HAVE DECIDED, BASED ON SOME OF OUR AWARENESS, TRAINING AND JUST RECOGNITION OF OUR NATIVE AMERICAN COMMUNITY, THAT WE WOULD NO LONGER UTILIZE THE TITLE CHIEF.

SO WE CHANGED IT TO HEAD OF TECHNOLOGY.

AND SO ALSO THE CHIEF BUSINESS OFFICER, BESIDES NOT BEING A CHIEF, IS NOW AN ASSISTANT SUPERINTENDENT AS OPPOSED TO ASSOCIATE SUPERINTENDENT.

THAT'S CORRECT, BECAUSE UNDER EDUCATION CODE, THE ONLY POSITION, THE ONLY CLASSIFIED POSITION THAT CAN HAVE SUPERINTENDENT IN THE TITLE IS THE BUSINESS POSITION.

UNDER EDUCATION CODE ONLY CERTIFICATED PERSONNEL CAN HOLD THE TITLE OF SUPERINTENDENT OR ASSISTANT SUPERINTENDENT WITH THE EXCEPTION OF BUSINESS.

SO THAT'S WHY THE HEAD OF TECHNOLOGY AS HEAD OF TECHNOLOGY AND NOT ASSISTANT SUPERINTENDENT TECHNOLOGY, BECAUSE THAT WOULD BE PROHIBITED UNDER THE EDUCATION CODE.

AND I ALSO SEE I THINK IT'S A NEW POSITION.

ASSISTANT SUPERINTENDENT OF EDUCATIONAL PROGRESS NO, IT'S NOT A NEW POSITION.

[00:30:02]

IT'S A RETITLING THAT USED TO BE EQUITY AND EDUCATIONAL PROGRESS.

AND THAT POSITION FORMERLY WAS HELD BY DR.

GARY WADDELL. OH, SO DO WE HAVE A NEW PERSON IN THERE NOW? YES. WHO IS THAT? AND DEBBIE GHAREGOZLOU.

OKAY. WE HAVEN'T BEEN INTRODUCED TO THAT CABINET MEMBER YET.

OKAY. OKAY.

LOTS OF CHANGES. THANK YOU VERY MUCH.

YOU'RE WELCOME. TRUSTEE BERTA.

YES. THANK YOU.

I KNOW I HAD SENT A CLARIFICATION, BUT I JUST WANTED TO BE SURE ON THE CONSULTANTS PIECE SINCE CONSULTANTS WERE REMOVED AND IT'S MY UNDERSTANDING THAT WE DON'T HAVE ANY THAT WOULD FALL UNDER THAT CATEGORY RIGHT NOW.

DOES THAT MEAN THAT THE BOTTOM SECTION UNDER DISCLOSURES FOR CONSULTANTS SHOULD ALSO BE REMOVED OR.

NO, THANK YOU. THAT'S A REALLY HELPFUL CLARIFICATION.

SO WE MAINTAIN THE DESCRIPTION AND THE DISCLOSURE CATEGORY IN THE POLICY ITSELF.

BUT ANNUALLY WE UPDATE THE EXHIBIT TO MATCH WHAT IS CURRENTLY IN PLACE FOR THE YEAR.

SO WE WOULD MAINTAIN THE POLICY DESCRIPTION SHOULD THERE EVER BE A CONSULTANT POSITION AND A PERSON IN IT THAT MEETS THIS CRITERIA, THEN WE WOULD ADD THE TITLE BACK TO THE EXHIBIT.

AND WOULD THAT BE ABLE TO BE, YOU KNOW, IF DURING THE SCHOOL YEAR, FOR INSTANCE, WE GET A CONSULTANT, WOULD THAT BE THEN BROUGHT BACK TO THE BOARD? OR HOW DOES THAT WORK? YES, WHEN WE HAVE CHANGES THAT HAPPEN THROUGHOUT THE YEAR THAT CAUSE AMENDMENTS TO THE CONFLICT OF INTEREST CODE OR THE EXHIBIT, WE HAVE A CERTAIN NUMBER OF DAYS ONCE THAT IS ESTABLISHED, TO BRING IT BACK FOR ADOPTION.

OKAY. THANK YOU. AND JUST AS ANOTHER POINT, THIS ALSO GOES TO THE BOARD OF SUPERVISORS FOR APPROVAL AS WELL.

THANK YOU. OKAY.

THANK YOU, TRUSTEES.

AND THANK YOU, DR. DEWAN, FOR BRINGING THAT FORWARD.

WE WILL NOW GO TO AGENDA ITEM NUMBER FIVE.

[A. The members of the Board may give reports on activities related to their duties as members of the Santa Clara County Board of Education]

COUNTY BOARD OF EDUCATION MEMBER REPORTS IN COMPLIANCE WITH THE BROWN ACT, INFORMATION SHARED DURING COUNTY BOARD OF EDUCATION MEMBER REPORTS MUST ONLY INCLUDE THOSE ACTIVITIES SPECIFICALLY RELATED TO OUR DUTIES AS TRUSTEES OF THE SANTA CLARA COUNTY BOARD OF EDUCATION.

I WILL BEGIN BY INVITING OUR STUDENT BOARD MEMBERS TO PRESENT THEIR TOPICS.

THANK YOU. GOOD EVENING.

GOOD EVENING. PRESIDENT CHON TRUSTEE SUPERINTENDENT, DR.

DEWAN AND COMMUNITY.

CURRENTLY, THE STUDENTS IN THE LAGUNA PROGRAM ARE MAKING A CEMENT PATHWAY ON OUR CAMPUS TO PROVIDE OPPORTUNITIES FOR ALL PEOPLE TO ACCESS ALL AREAS WHICH MAY HAVE BEEN DIFFICULT IN THE PAST. IN HONOR OF NATIONAL HISPANIC HERITAGE MONTH, WE ARE PUTTING HISTORICAL EVENTS THAT HAVE OCCURRED IN THE PAST AND PRESENT AROUND THE CAMPUS AND PARTICIPATING IN ACTIVITIES THAT HELP THE YOUTH ENGAGE MORE IN THEIR CULTURE.

IN THEIR CULTURE OR UNDERSTAND THE BACKGROUND OF THE EVENT.

DURING HORTICULTURE, WE ARE LEARNING ABOUT THE DRIP IRRIGATION AND SAVING WAYS TO SAVE WATER.

THIS INCLUDES US MAKING OUR OWN DRIP LINES AND CONTROL THE SPRINKLER SYSTEM.

THROUGHOUT THE NEXT TWO WEEKS, WE WILL BE PARTNERING WITH THE SANTA CLARA COUNTY REGISTRAR OF VOTERS TO PROMOTE HIGH SCHOOL VOTER EDUCATION WEEK.

THANK YOU SO MUCH FOR THIS OPPORTUNITY AND IT WAS MY PLEASURE ATTENDING THE MEETINGS AND BEING ABLE TO PROVIDE PROVIDE ME THIS EXPERIENCE.

THIS HAS HELPED ME ENHANCE MY PUBLIC SPEAKING SKILLS.

DO YOU BOTH HAVE REPORTS THIS EVENING? NO, THAT IS ALL, MA'AM.

OKAY. THANK YOU FOR THE CLARIFICATION AND THANK YOU FOR YOUR REPORT.

I WILL NOW GO TO TRUSTEES.

TRUSTEES? DO YOU HAVE ANYTHING THAT YOU WOULD LIKE TO REPORT SPECIFICALLY RELATED TO YOUR DUTIES AS MEMBERS OF OR WITHIN THE JURISDICTION OF THE SANTA CLARA COUNTY BOARD OF EDUCATION? VICE PRESIDENT SREEKRISHNAN.

AND THEN TRUSTEE. LARI TRUSTEE.

I'M JUST GOING TO GO THIS WAY.

OKAY. TRUSTEE. LARI. TRUSTEE.

DI SALVO. TRUSTEE. BERTA.

TRUSTEE MAH. OKAY.

ALL RIGHT. VICE PRESIDENT SREEKRISHNAN.

THANK YOU. AND I REALLY ENJOYED THAT REPORT FROM OUR STUDENT TRUSTEE AND I WAS TAKING A LOOK AT SKULLY'S YOUTH VOTER GUIDE TOOLKIT, AND I ENCOURAGE MY COLLEAGUES TO TAKE A LOOK AT THAT.

SO ON THE 15TH OF THIS MONTH, I MET WITH TRUSTEE BERTA AND CUPERTINO STUDENT ADVOCACY, SETI, AND I KNOW I'VE MENTIONED ADEA BEFORE.

IN PREVIOUS MEETING REPORTS SHE'S AN ADVOCATE FOR SPECIAL EDUCATION INCLUSION.

SO WE HAD A GREAT CONVERSATION AND I KNOW SHE HAS A MEETING SET UP WITH DR.

DEWAN AS WELL, SO YOU'LL BE SEEING FUTURE COLLABORATIONS WITH ADEA THEN ON THE 16TH I ATTENDED THE CALIFORNIA ASSOCIATION OF STUDENT

[00:35:01]

COUNCILS REGION FOUR CONFERENCE.

THAT'S OUR LOCAL REGION OF CASC.

AND SO WE HEARD FROM STUDENTS WHO PRESENTED POLICY PROPOSALS THAT THEY'RE GOING TO TAKE TO THEIR LOCAL SCHOOL BOARDS, AND THEIR UPCOMING STATE CONFERENCE IN SACRAMENTO. AND CASC IS A CO-SPONSOR OF SB TEN, WHICH I KNOW I'LL BE TALKING ABOUT LATER AND WILL LIKELY BE IN OUR SUPERINTENDENT REPORT. IT'S A BILL CO-SPONSORED BY THE COUNTY OFFICE OF ED AS WELL.

SO I WAS ABLE TO SIT ON A PANEL AND HEAR THE STUDENT'S PROPOSAL AND GIVE FEEDBACK AND THEY'RE REFINING THE PROPOSALS THEY'RE WORKING ON, AND THEY TOUCHED ON COLLEGE AND CAREER READINESS, MENTAL HEALTH AND SCHOOL SAFETY.

THEN THE NEXT DAY ON THE 17TH, I ATTENDED THE COLLEGE OF ADAPTIVE ARTS ANNUAL BENEFIT.

AND IF YOU DON'T KNOW ABOUT THE COLLEGE OF ADAPTIVE ARTS, THEY ARE LOCATED ON THE WEST VALLEY MISSION COMMUNITY COLLEGE CAMPUS ON WEST VALLEY CAMPUS IN SARATOGA.

AND THEY ARE A VERY SPECIAL PROGRAM.

THEY PROVIDE LIFELONG, INCLUSIVE, HIGHER EDUCATION FOR ADULTS WITH DIFFERING ABILITIES.

AND STUDENTS CAN GRADUATE AND TAKE CLASSES AND COME BACK AFTER GRADUATION.

AND THEY TEACH THE ARTS, WELLNESS, VOCATIONAL SKILLS.

SO THEY'RE REALLY A MODEL FOR INCLUSIVE HIGHER EDUCATION.

THEN THE NEXT DAY ON THE 18TH, I ATTENDED A PRESS CONFERENCE RIGHT HERE ABOUT MELANIE'S LAW OR SB TEN TO COMBAT THE YOUTH FENTANYL CRISIS, AND IT'S CO-SPONSORED BY THE COUNTY OFFICE OF ED, AUTHORED BY SENATOR CORTEZ AND SUPPORTED BY OUR STATE SUPERINTENDENT OF PUBLIC INSTRUCTION, TONY THURMOND. THEN I WANTED TO MENTION LAST MONTH I DIDN'T GET TO MENTION I MET WITH STUDENTS, SASHA MASON, AND THEY ACTUALLY CREATED A CLIMATE LITERACY EDUCATIONAL BOARD GAME CALLED ECOQUEST FOR STUDENTS AGED SIX THROUGH 12.

AND SO THANK YOU TO DR.

DEWAN FOR CONNECTING SASHA WITH OUR COUNTY STAFF TO SEE TO LEARN MORE ABOUT THAT BOARD GAME.

AND THERE'S A KICKSTARTER AS WELL IF ANYONE'S INTERESTED.

LAST MONTH I ALSO GOT TO SPEAK WITH BAY AREA NONPROFIT ENOCH SPELLED A I N ARK AND THEIR WEBSITES MY ANACORTES ORG AND I MET THEM THROUGH MY ROTARY CLUB, SILICON VALLEY PASSPORT ROTARY CLUB AND THEY PROVIDE FREE VISION AND EYE CARE SERVICES AS WELL AS PRESCRIPTION GLASSES. AND SO I KNOW THEY'RE CONNECTING WITH THE COUNTY OFFICE AS WELL TO SEE IF THEY CAN SERVE STUDENTS.

THEN LASTLY, WANTED OR MY SECOND TO LAST ANNOUNCEMENT IS, AS YOU ALL KNOW, THE LEGISLATIVE SESSION HAS ENDED AND THERE ARE A COUPLE CLIMATE LITERACY BILLS THAT ARE ON THE GOVERNOR'S DESK.

I KNOW THE COUNTY OFFICE HAS BEEN TRACKING THEM, AND DR.

DEWAN WAS A LEAD WITNESS FOR ONE OF THE BILLS.

SO THEY ARE AB 285 AND SB 394, AUTHORED BY ASSEMBLY MEMBER LUIS RIVAS AND SENATOR GONZALEZ AND AB 285 WOULD REQUIRE CLIMATE CHANGE, EDUCATION BE TAUGHT IN SCHOOLS, AND SB 394 WOULD CREATE A MASTER PLAN UNDER THE CALIFORNIA ENERGY COMMISSION FOR CLIMATE RESILIENT SCHOOLS IN CALIFORNIA.

SO THAT WAS VERY EXCITING.

AND YOU CAN LEARN MORE AT CLIMATE READY SCHOOLS COALITION.ORG.

AND I KNOW THAT DR.

DEWAN WAS A CONTRIBUTING AUTHOR OF THAT RECENT REPORT FROM CLIMATE READY SCHOOLS.

THEN LASTLY, I SENT AN INVITATION TO YOUR EMAILS IF YOU GOT IT.

THERE IS A SAFE COMMUNITIES CONFERENCE.

IT'S BEING HOSTED BY THE SAN JOSE YOUTH EMPOWERMENT ALLIANCE, WHICH IS PART OF SAN JOSE PARKS AND REC, ALONG WITH THE EAST SIDE UNION.

IN HIGH SCHOOL DISTRICT.

IT'S SATURDAY, SEPTEMBER 23RD AT INDEPENDENCE HIGH SCHOOL FROM 8:30 A.M.

TO 1:30 P.M.

AND IT'LL BRING RESIDENTS AND STUDENTS TOGETHER TO DISCUSS SAFE COMMUNITY SPACES FOR FOLKS OF ALL AGES.

SO CHECK THAT OUT AS WELL.

THANK YOU SO MUCH.

THANK YOU, VICE PRESIDENT SREEKRISHNAN.

TRUSTEE. LARI. THANK YOU, PRESIDENT CHON.

SO ON SEPTEMBER 9TH AND 10TH, I ATTENDED THE CALIFORNIA COUNTY BOARD OF EDUCATION'S ANNUAL CONFERENCE.

TWO SESSIONS THAT I FOUND PARTICULARLY ENGAGING WERE THE ONES ON INNOVATIONS IMPLEMENTED ACROSS CALIFORNIA TO ADDRESS WELL-BEING AND MENTAL HEALTH OF STUDENTS.

AND AS ONE OF THE SESSIONS MENTIONED, THE MAJOR ISSUES FACING OUR STUDENTS IN SCHOOLS THAT IS CHRONIC ABSENTEEISM, GRADES, SUSPENSIONS, SAFETY AND GRADUATION RATES ALL IMPROVE WHEN STUDENT HEALTH AND WELL-BEING IMPROVES.

AND ADDITIONALLY, ON SEPTEMBER 15TH, I ATTENDED THE ANNUAL BUILDERS BARBECUE CHARITY EVENT WHERE COMMUNITY ORGANIZATIONS, UNION,

[00:40:04]

COMMUNITY RESOURCES, AUGIE'S QUEST TO CURE ALS, BOYS AND GIRLS CLUB OF SILICON VALLEY AND THE SANTA CLARA COUNTY CONSTRUCTION CAREERS ASSOCIATION WERE THE AWARD RECIPIENTS IN RECOGNITION OF THEIR WORK, AND DR.

DEWAN WAS THERE.

ALSO ON SEPTEMBER 15TH, I STOPPED BY AT THE MEXICAN INDEPENDENCE DAY CELEBRATION AT SAN JOSE CITY HALL.

A RECENT REPORT RELEASED BY THE AMERICAN IMMIGRATION COUNCIL, IN PARTNERSHIP WITH THE SANTA CLARA COUNTY OFFICE OF IMMIGRANT RELATIONS, FOUND THAT MEXICO WAS THE SECOND TOP COUNTRY OF ORIGIN FOR IMMIGRANTS, WITH 15.7% OF IMMIGRANTS LIVING IN THE COUNTY ARE FROM MEXICO.

AND OF COURSE, OUR POPULATION OF MEXICAN HERITAGE IS ONE OF THE LARGEST.

ON SEPTEMBER 17TH, I ATTENDED A HEALTH EDUCATION EVENT ON PREVENTIVE SCREENINGS SPECIFICALLY FOR SOUTH ASIAN WOMEN HOSTED BY DEPARTMENT CHAIR PUBLIC HEALTH CAL STATE EAST BAY.

THE PROFESSOR IS WORKING ON BUILDING COMMUNITY PARTICIPATION BY IMMIGRANT GROUPS IN UNDERSTANDING, ADDRESSING AND TAKING OWNERSHIP OF THEIR OWN INDIVIDUAL AND COLLECTIVE HEALTH PROSPECTS.

ON SEPTEMBER 18TH, I ATTENDED THE PRESS CONFERENCE THAT HELD AT SCHOOL ABOUT SB TEN ON MELANIE'S LAW, NAMED AFTER MELANIE RAMOS, A 15 YEAR OLD WHO DIED TRAGICALLY FROM A SUSPECTED FENTANYL OVERDOSE.

THE IMPORTANT BILL, AS VICE PRESIDENT, SREEKRISHNAN SAID, IS CO-SPONSORED BY SKY AND WILL REQUIRE SCHOOLS TO INCLUDE A PROTOCOL TO ADMINISTER NARCAN IN THEIR SAFETY PLANS.

THANK YOU. THANK YOU.

TRUSTEE. LARI. TRUSTEE DI SALVO.

THANK YOU, MADAM PRESIDENT.

TODAY. PRIOR TO MY SAN JOSE STATE CLASS, I.

I VIEWED THE MARCHING BAND FOR SAN JOSE STATE THAT WAS HELPING CELEBRATE THE ANNIVERSARY OF THE MARTIN LUTHER KING LIBRARY OPENING, WHICH IS THE ONLY UNIVERSITY CITY COLLABORATIVE PROJECT.

THIS ONE WAS OVER $140 MILLION IN THE ENTIRE COUNTRY.

AND AT THAT TIME WE HAD MAYOR SUSAN HAMMER AND PRESIDENT OF THE UNIVERSITY, DR.

BOB CARET, THAT MADE THAT HAPPEN.

AND I THINK IT'S AN AMAZING AND I THINK THE MLK LIBRARY IS FOUNDATIONAL TO OUR CITY AND TO THE UNIVERSITY.

AND I FOUND OUT THAT THE MARCHING BAND DOESN'T HAVE ANY MONEY TO GET TO HAWAII FOR THEIR GAME, FOR THE SPARTAN GAME AGAINST UNIVERSITY OF HAWAII.

SO TODAY, ONE OF MY STUDENTS HIT ME UP FOR A DONATION TO SEND THEM TO HAWAII, AND IT WAS REALLY NICE TO SEE AN EXPERIENCE.

THE BAND OUT IN FRONT OF THE LIBRARY TODAY.

I. TALKED LAST TIME ABOUT AN EVENT, AND I'VE SPOKEN TO DR.

DEWAN ABOUT THIS. IT'S GOING TO BE THE DATE HAS BEEN SCHEDULED.

IT'S DEMOLISHING THE SCHOOL TO PRISON PIPELINE.

IT'LL BE AT SAN JOSE STATE AT THE IN THE STUDENT UNION AUDITORIUM THAT SEATS 300 PEOPLE.

SO WE HOPE TO HAVE UP TO 300 PEOPLE IN ATTENDANCE THAT DAY.

THE DATE IS FEBRUARY THE 6TH.

IT'S A TUESDAY.

MORE INFORMATION WILL BE COMING TO ALL OF YOU ONCE IT'S FINALIZED.

BUT THE KEYNOTE SPEAKER I MENTIONED LAST TIME IS THE DIRECTOR OF A NEW STATE OFFICE FOR REVISIONING CRIMINAL JUSTICE.

JUVENILE CRIMINAL JUSTICE REFORM.

AND THAT IS KATHRYN LUCERO.

SHE'S GOING TO BE OUR KEYNOTER.

AND I HOPE SHE STAYS FOR THE FIRST PANEL, WHICH WILL BE AN EXPERT PANEL ON HOW WHAT WE WHAT ACTION STEPS WE NEED TO TAKE TO DEMOLISH THAT SCHOOL TO PRISON PIPELINE, INCLUDING, AS I MENTIONED LAST TIME, A MAJOR COMPONENT WILL BE READING.

A READING EXPERT TO HELP US UNDERSTAND WHAT WE COULD DO TO ENSURE THE FACT THAT EVERY THIRD GRADER READS ON GRADE LEVEL AS.

LAST MEETING.

ONE OF OUR.

PUBLIC SPEAKERS ADDRESSING THE BOARD TALKED ABOUT MAYBE HAVING DURING CHARTER SCHOOL REPORTS SOMETHING POSITIVE TO SAY ABOUT CHARTER SCHOOLS INSTEAD OF MAYBE MORE NEGATIVE THINGS THAT ARE SAID.

AND SO I WAS GOING TO TAKE IT UPON MYSELF TO BEGIN THAT.

SO WHAT I CAME UP WITH IS AN EMAIL FROM THE CEO OF ROCKETSHIP, PRESTON SMITH, WHO TALKS ABOUT A PARENT THAT I'VE WORKED WITH OVER THE LAST DECADE EVA HERRERA HEREDIA, FOUNDING PARENT OF ROCKETSHIP DISCOVERY PREP, AND A SHOUT OUT TO HER AND HER OLDEST DAUGHTER THAT WENT TO THAT SCHOOL, THAT ROCKETSHIP SCHOOL, WHO JUST GOT WHO IS NOW ATTENDING UC IRVINE.

SO A SHOUT OUT TO EVA AND HER DAUGHTER FOR THEIR SUCCESS.

[00:45:06]

ESPERANZA IS THE NAME OF HER DAUGHTER.

AND LASTLY, BUT MAYBE MOST IMPORTANTLY.

I FOUND OUT.

BY A ZOOM MEETING THAT I HAD WITH KRISTIN BROWN THAT WAS THERE.

THE OFFICE OF EDUCATION AND THE SUPERINTENDENTS IN OUR SOME OF OUR PUBLIC SCHOOL DISTRICTS.

SCHOOL DISTRICTS ARE CHANGING THE STRUCTURE OF PARENT ADVISORY MEETINGS.

SO HERE ARE SOME NOTES THAT KRISTEN, AFTER MY ZOOM MEETING LAST NIGHT, SENT ME THAT I'D LIKE TO SHARE WITH THE BOARD.

SHE SAYS COMMUNITY ADVISORY COUNCIL SPECIAL EDUCATION LEADERS WERE INFORMED ABOUT THIS CHANGE BACK IN THE SPRING OF THIS YEAR AND IT WAS MADE CLEAR THAT IT WAS SOMETHING THAT DISTRICT SUPERINTENDENTS WANTED.

THE RATIONALE THAT KRISTEN AND MANY OF THE PARENTS WERE GIVEN IS THE LOGISTICS OF HAVING ONE MEETING FOR PLANNING FOR THE NORTHWEST INSTEAD OF FIVE WAS SOMETHING IMPORTANT TO THE DISTRICTS.

HOWEVER, SHE IS NOW, KRISTEN BROWN IS NOW THE CHAIR OF THE COMMUNITY ADVISORY COUNCIL SPECIAL EDUCATION AND SHE WAS VICE CHAIR FOR EIGHT YEARS AND I'LL READ FROM HER NARRATIVE.

I CAN'T BEGIN TO EXPRESS HOW DAMAGING THIS IS TO THE VOICES OF FAMILIES WHO HAVE BENEFITED FROM DISTRICT COLLABORATION IN A MORE INTIMATE SETTING.

WE HAVE EXPRESSED AT THE INFORMATIONAL MEETINGS OUR CONCERN THAT THIS CHANGE DILUTES THE PARENT VOICE IN SPECIAL EDUCATION THROUGHOUT SANTA CLARA COUNTY.

WE POINTED TO THE LACK OF VOICE ALREADY IN THE SPECIAL EDUCATION CONSORTIUM.

UM, SHE GOES ON.

BUT SHE MADE THAT POINT TO ME LAST NIGHT MULTIPLE TIMES AND SAID, ISN'T THERE SOMETHING DID THE COUNTY BOARD VOTE ON THIS? SHE THOUGHT WHEN SHE CALLED ME LAST WEEK THAT WE ALL KNEW ABOUT THIS AND VOTED ON THIS AND COULDN'T BELIEVE THAT I WOULD SUPPORT PARENTS LOSING VOICE ABOUT SPECIAL EDUCATION.

AND. I SAID WE DIDN'T.

I DIDN'T KNOW ABOUT IT, ACTUALLY.

AND I FOUND OUT A LOT MORE ABOUT IT LAST NIGHT AFTER A ZOOM MEETING WITH KRISTIN BROWN.

SO I WANTED TO BRING THAT TO EVERYBODY'S ATTENTION AND ASK OUR BOARD CHAIR AND OUR SUPERINTENDENT IF PERHAPS WE COULD IN AN OCTOBER MEETING.

AGENDIZE JUST AN INFORMATION ITEM SO WE LEARN MORE ABOUT.

HOW THIS HAPPENED, WHAT THIS IS ABOUT, AND HOW, FOR ALL THE PARENTS CONCERNED ABOUT THEIR VOICE BEING MUTED.

PARTICULARLY FOR A POPULATION THAT WE WE WORK WITH.

A INTEGRALI I THINK IT WOULD BE IMPORTANT FOR US TO HAVE MAYBE A VERY BRIEF INFORMATION ITEM SO THAT WE ALL UNDERSTAND WHERE WE STAND ON ALLOWING PARENTS TO HAVE VOICE ABOUT THEIR CHILDREN WITH SPECIAL NEEDS.

YEAH. END OF REPORT.

THANK YOU, TRUSTEE. DI SALVO.

AND THANK YOU FOR YOUR ADVOCACY.

I'M GOING TO GO TRUSTEE BERTA AND THEN TRUSTEE.

MAH. YES, THANK YOU.

I ALSO WITH TRUSTEE, LARI AND TRUSTEE MAH AS WELL AS DR.

DEWAN ATTENDED THE CCB ANNUAL CONFERENCE AND I'LL GIVE MY BOARD OF DIRECTORS UPDATE LATER ON, BUT I WANTED TO SPECIFICALLY MENTION SOME OF THE WORKSHOPS AND SESSIONS THAT I ATTENDED.

ONE WAS ON EXPULSIONS AND SPECIFICALLY THE EXPULSIONS APPEAL PROCESS, AND THE OTHER ONE WAS ON COMMUNITY SCHOOLS.

AND SO IT WAS REALLY INTERESTING TO HEAR MORE FROM THE COUNTY COUNTY OFFICES THAT ACTUALLY ARE THE REGIONAL CENTERS AND HOW THAT JUST STRUCTURALLY HOW COMMUNITY SCHOOLS IS BEING ROLLED OUT ACROSS OUR STATE.

AND THE OTHER SESSION THAT I FOUND REALLY INFORMATIVE WAS ACTUALLY ONE OF THE LUNCH PANEL DISCUSSIONS ON THE SUCCESSFUL ADVOCACY AROUND AB 906, THE COURT AND COMMUNITY SCHOOLS FUNDING AND SOME OF THE LESSONS LEARNED FROM THE WAYS THAT WE CAN COLLABORATE, ENGAGE AND REALLY WORK TOWARDS THIS COLLECTIVE ADVOCACY AND ALSO HOW WE CAN USE OPPORTUNITIES LIKE THIS TO EDUCATE THE LEGISLATURE ON THESE ISSUES.

AND I ALSO WANTED TO GIVE A SHOUT OUT TO TRUSTEE MAH, WHO I KNOW HELPED FACILITATE ONE OF THE WORKSHOPS ON BOARD GOVERNANCE AS WELL.

AND I ALSO ATTENDED THE WARMENHOVEN INCLUSION COLLABORATIVE MEETING, WHICH I'LL PROVIDE A MORE THOROUGH UPDATE ON LATER AND MET WITH COOPER'S STUDENT RDA AS WELL AS VICE PRESIDENT SREEKRISHNAN AND INCLUSION WAS VERY IMPRESSED WITH HER LEVEL OF ADVOCACY, BUT ALSO JUST HOW INFORMED SHE IS ON THE TOPIC OF

[00:50:06]

INCLUSION AND SPECIAL EDUCATION, WHICH IS REALLY REASSURING, YOU KNOW THAT OUR YOUTH ARE LEADING ON THESE TOPICS.

AND I'M ALSO LOOKING FORWARD TO UPDATES, FUTURE UPDATES TO THE BOARD ON OUR PRIORITIES.

AND I KNOW THERE WAS A BOARD SURVEY SENT OUT THAT I THINK IS DUE TOMORROW.

SO HOPEFULLY MY COLLEAGUES ALSO GET A CHANCE TO DO THAT SO THAT WE CAN REVISIT THAT AND BRING THAT BACK TO THIS BOARD, BUT ALSO FOR PUBLIC ENGAGEMENT.

AND THEN FINALLY, I DID WANT TO JUST REITERATE A REQUEST FOR CLARIFICATION ON THE GATEWAY SCHOOL CHANGES AND A POTENTIAL PUBLIC UPDATE ON THE CHANGES TO THOSE PROGRAMS I THINK WOULD HELP PROVIDE A LOT OF CLARITY.

THANK YOU. TRUSTEE BERTA.

TRUSTEE. MAH. THANK YOU, PRESIDENT CHON.

SO I HAVE A FEW THINGS.

ONE IS I ATTENDED THE APESMA MEETING ON UNIQUE BARRIERS TO SUCCESS FOR SOUTHEAST ASIAN STUDENTS AND FAMILIES.

IT WAS A PISBA, WHICH IS THE API SCHOOL BOARD MEMBER ASSOCIATION, KIND OF A SUBSET OF CSB.

AND THE DISCUSSION WAS REALLY INTERESTING.

WE TALKED LARGELY ABOUT THE CAMBODIAN ETHNIC STUDIES CURRICULUM, WHICH IS BEING CREATED AND IMPLEMENTED MOSTLY DOWN IN SOUTHERN CALIFORNIA WHERE THERE'S A LARGE, LARGE CAMBODIAN COMMUNITY.

AND WE TALKED ABOUT OTHER SOUTHEAST ASIAN AREAS WHICH ARE LESSER KNOWN AND HOW THERE'S SOME EFFORTS TO BRING THEIR STORIES AND HISTORIES INTO THE ETHNIC STUDIES CURRICULUM.

I ALSO ATTENDED A SILICON VALLEY COUNCIL OF NONPROFITS TRAINING ON THE BOARD OF SUPERVISORS BUDGET AND HOW THEY DO THEIR BUDGETING.

AND THERE'S SOME VIDEOS THAT ARE AVAILABLE FROM THAT TRAINING AND ALSO A COUPLE OF PRIOR ONES THAT I WOULD BE HAPPY TO SHARE IF OTHER BOARD MEMBERS ARE INTERESTED IN KNOWING.

I WILL TALK ABOUT SILICON VALLEY READS IN THE COMMITTEE REPORTS.

AND THEN I ALSO WANTED TO MENTION THAT I FOUND THE CCP CONFERENCE VERY INFORMATIVE.

THERE WERE A NUMBER OF REALLY GOOD TALKS IN ADDITION TO THE ONES THAT HAVE BEEN MENTIONED.

SO JUST TO SAY THERE WERE A LOT OF GOOD THINGS THERE.

THE ONES THAT I FOUND PARTICULARLY INTERESTING ONE WAS ON SOLVING THE TEACHER SHORTAGE AND THAT THERE'S A WRAP FOR THAT.

AND AS IT TURNS OUT, THE WRAP IS A REGISTERED APPRENTICESHIP PROGRAM.

AND NOW FOR THE FIRST TIME, THE DEPARTMENT OF LABOR HAS BROUGHT ABOUT APPRENTICESHIP FUNDING THAT CAN BE USED FOR JOB EMBEDDED DEGREES FOR CLASSIFIED STAFF TO BECOME TEACHERS.

SO ESSENTIALLY THEY CAN BE PAID DOING THEIR REGULAR JOB AS A CLASSIFIED STAFF AS THEY DO CLASSWORK AND WORK TOWARDS GETTING THEIR CREDENTIAL.

AND SO THERE'S A NUMBER OF GROUPS WHICH ARE A NUMBER OF AREAS AND LARGELY COMMUNITY COLLEGES WHICH ARE PARTICIPATING IN THIS. AND THIS IS ACTUALLY DONE BY I DON'T KNOW IF SOME OF YOU REMEMBER JOE ROSS, WHO WAS A SAN MATEO COUNTY BOARD MEMBER.

HE WAS CCP PRESIDENT FOR A WHILE ALSO.

BUT ANYWAY, HIS ORGANIZATION REACHED UNIVERSITY, HAS DONE A LOT OF WORK WITH A NUMBER OF.

COMMUNITY COLLEGES ALL OVER CALIFORNIA.

AND I'M REAL INTERESTED IN TRYING TO SEE WHETHER SOME OF THE LOCAL ONES HERE COULD DO THE SAME THING, BECAUSE IT'S ESSENTIALLY FUNDING FROM THE FEDERAL GOVERNMENT HELPING OUR PIPELINE WHERE OUR CLASSIFIED EMPLOYEES WHO ARE, YOU KNOW, ENGAGED IN EDUCATION CARE ABOUT STUDENTS AS THEY WANT TO BECOME TEACHERS, CAN HELP FUND THEIR PROGRESSION INTO A CREDENTIALED PROGRAM AND BECOMING A TEACHER. SO IT REALLY IS A GREAT PIPELINE SUPPORT.

THE OTHER ONE THAT I WENT TO THAT WAS GOOD WAS THE ONE TALK ABOUT CRISIS TO COLLABORATION AND NURTURING TRUST AND ENGAGEMENT IN PUBLIC SCHOOLS. AND THIS WAS A PRESENTATION BY THE CALIFORNIA SCHOOL PUBLIC RELATIONS ASSOCIATION AND I DIDN'T KNOW THEY EXISTED, BUT THEY ACTUALLY EXIST.

AND THEY TALKED ABOUT EFFECTIVE COMMUNICATION AND ENGAGEMENT, AND THEY ASKED, WHICH I DIDN'T HAVE AN ANSWER FOR, WHETHER OUR COUNTY OFFICE, FOR INSTANCE, HAD A COMMUNICATION PLAN, WHICH I PRESUME WE DO.

SO IT WOULD BE NICE IF WE COULD GET A COPY OF WHAT OUR COMMUNICATIONS PLAN ARE BOTH IN EMERGENCY SITUATIONS, WHICH IS WHAT THEY TALKED ABOUT, BUT ALSO JUST IN GENERAL EFFECTIVE COMMUNICATION.

SO I'M NOT SURE IF DR.

[00:55:02]

DEWAN, IF WE CAN GET A COPY OF THE COMMUNICATION PLAN, BUT I THINK THAT WOULD BE REALLY HELPFUL.

THEY ALSO HAVE SOME OTHER TRAINING AND INFORMATION ABOUT COMMUNICATION PLANS THAT ARE COMING UP THAT I CAN SEND YOU A NOTE ABOUT IF YOU WANT TO ATTEND THEIR WEBINAR.

AND THEN THE LAST ONE, JUST A LITTLE PLUG, IS THAT THE BOARD SHARED GOVERNANCE JOURNEY, WHICH WAS THE PRESENTATION THAT I CO PRESENTED WITH A COUPLE OF OTHER COUNTY BOARD MEMBERS I THOUGHT HAD A LOT OF GOOD THINGS FROM OTHER COUNTY BOARDS AS FAR AS BEST PRACTICES ON HOW BOARDS ARE SHARING THEIR GOVERNANCE.

AND SO I WILL TAKE THE LIBERTY OF SENDING THAT PRESENTATION TO DR.

DEWAN TO PERHAPS INCLUDE IN THE SUPERINTENDENT'S WEEKLY SO THAT ALL BOARD MEMBERS CAN SEE WHAT KINDS OF THINGS OTHER DISTRICTS, OTHER COUNTY OFFICES ARE DOING. AND THEN MY LAST COMMENT IS THAT I AM ALSO LOOKING FORWARD TO THE DISCUSSION OF PRIORITIES FROM THE BOARD RETREAT AND THAT THE SURVEY THAT WAS SENT OUT, I'M A LITTLE CONCERNED THAT IT'S NOT VERY TRANSPARENT FOR OUR PRIORITIZATION PROCESS.

SO I HOPE THAT SURVEY AND RESULTS WILL BE PRESENTED AS IT AS WE PROGRESS TOWARDS OUR NEXT STEPS THAT ARE OUR BUSINESS FOR THE PUBLIC IS DONE IN THE PUBLIC.

AND THAT'S IT.

THANK YOU, TRUSTEE MAH.

AND THANK YOU TRUSTEES FOR YOUR REPORTS.

I ALSO WANT TO TAKE THE TIME TO MAKE SURE TO THANK OUR STUDENT BOARD MEMBER HERNANDEZ, FOR HIS SHORT TIME ON OUR BOARD.

BUT WE APPRECIATE YOUR WORK AND HEARING THE REPORTS THAT YOU BRING TO US.

AND WE LOOK FORWARD TO OUR NEW STUDENT BOARD MEMBER.

ALL RIGHT, TRUSTEES, WE ARE GOING TO MOVE ON TO OUR CONSENT ACTION ITEMS WITH THE EXCEPTION OF ITEM SIX E THAT WAS PULLED BY TRUSTEE BERTA.

[6. CONSENT ACTION ITEMS]

SO I WILL ENTERTAIN A MOTION TO APPROVE CONSENT ACTION ITEMS SIX A THROUGH H WITH THE EXCEPTION OF SIX E SO MOVED. SO MOVED BY TRUSTEE BERTA AND A SECOND.

SECOND A SECOND BY TRUSTEE MAH TRUSTEES.

PLEASE VOTE IN BOARD DOCS.

AND THAT MOTION CARRIES WITH SIX YESES AND ONE NOT PRESENT AT VOTE.

THANK YOU, TRUSTEES.

OKAY. GOING TO ITEM SIX E TRUSTEE BERTA.

[E. Request Approval of the 2023-24 Real Estate Leases]

SINCE YOU PULLED THIS ITEM, I WILL GIVE THE MIC TO YOU.

THANK YOU.

I KNOW SOME OF THESE QUESTIONS.

I HAD TOUCHED BASE WITH DR.

DEWAN PRIOR TO THE MEETING, BUT I JUST WANTED TO CLARIFY AND ALSO HAD A COUPLE OF FOLLOW UPS.

ONE WAS IN PARTICULAR TO THE ACCOUNTS RELATED TO MARTIN MURPHY.

THERE WAS A COST OF 9000.

DR. DEWAN, CAN YOU EXPLAIN WHAT THAT COST WAS AND WHY THE AGREEMENT FOR THAT WAS LISTED AS ENDING IN OCTOBER, ON OCTOBER 1ST OF THIS YEAR? YES. FOR THE MARTIN MURPHY, THERE ARE TWO COSTS THERE, AND THE APPROXIMATE $9,000 FOR THE YEAR IS LEASES THAT WE PAY FOR THE PORTABLE CLASSROOMS THAT WE'RE UTILIZING THAT BELONG TO MORGAN HILL.

AND IT IS LISTED AS, I THINK, ENDING OCTOBER OR SOMETHING LIKE THAT BECAUSE IT IS PENDING RENEWAL.

AND IS THERE A REASON THAT WASN'T LISTED AS PENDING LIKE SOME OF THE OTHER ONES INSTEAD OF I DON'T KNOW, I'M GOING TO DEFER TO OUR EXPERT TO SAY WHY THE DIFFERENCE BETWEEN INCLUDING THE ENDING DATE VERSUS THE PENDING THIS PARTICULAR AGREEMENT IS ACTUALLY IN THE PROCESS OF BEING ROUTED.

SO THAT'S WHY I BELIEVE THEY HAVE THE DATE, BECAUSE THE PENDING IS WE'RE STILL WORKING ON THE AGREEMENT WITH SOME OF THE DISTRICTS.

THIS ONE IS ACTUALLY IN THE PROCESS OF BEING FINALIZED.

SO AT THE DATE WHEN IT WAS SUBMITTED, IT'S IN THE FINAL STAGES.

SO THE NEXT REPORT WE DO FOR NEXT YEAR WILL HAVE THE EXTENDED TERM AND THERE WON'T BE ANY LAPSE IN, I GUESS, COVERAGE OR ANYTHING WITH THAT END DATE BEING SO IMMINENT.

NO. WITH ALL OF OUR LAND LEASE AND PORTABLE LEASES WITH THE DISTRICTS THERE, THEY'RE ALWAYS KIND OF OVERLAPS AND TIMING AND THINGS OF THAT NATURE.

BUT THERE'S NO RISK OF LOSING THE LAND OR THE PORTABLES.

[01:00:03]

OKAY. AND MY OTHER QUESTION WAS SPECIFIC TO THE ITEMS THAT WERE LISTED AS GLENVIEW ONE AND TWO.

HOW WAS THAT AMOUNT DETERMINED? AND WE CAN SHARE THE SPECIFICS, BUT GENERALLY THOSE COSTS ARE UTILITIES AND CUSTODIAL.

CORRECT? YEAH, THOSE ARE THE ESTIMATED UTILITY AND CUSTODIAL COSTS FOR THAT SITE.

SO THAT'S WHY IT'S REFLECTED THAT WAY.

BUT IT DOES VARY BASED ON USAGE.

SO. OKAY.

AND. YEAH, THAT WAS PART OF MY QUESTION IS JUST FROM A FINANCIAL POINT WHY THE FUNDING WAS BEING SPLIT.

FROM THE ASPECT OF IF IT'S.

THE NUMBERS ON HERE LISTED LOWER AT GLENVIEW, BUT HIGHER AT MARTIN MURPHY.

WHETHER THERE WAS A SPECIFIC REASON THAT WAS ALLOCATED LIKE THAT, YEAH, THEY'RE JUST DIFFERENT KINDS OF COSTS AND DIFFERENT DISTRICTS.

SO MORGAN HILL WERE LEASING.

MARTIN MURPHY IS A SOUTH COUNTY SCHOOL SITE.

IT BELONGS TO MORGAN HILL SCHOOL DISTRICT.

AND SO WE ARE JUST LEASING THE PORTABLE.

SO IT'S JUST THE COST THAT WE AGREED TO FOR THAT.

AND FOR GLENVIEW, THOSE ARE JUST UTILITY AND CUSTODIAL COSTS AND THOSE CAN VARY FOR LIKE MAYBE THE AGE OF THE BUILDING, THE TYPES OF UTILITIES, THE AMOUNT OF USAGE AND SOMETIMES THE NEEDS OF THE PROGRAMS THEY MAY HAVE MORE OR LESS IN CUSTODIAL COSTS.

OKAY. AND THEN OTHER AGREEMENTS WE MIGHT BE PROVIDING OUR OWN CUSTODIAL IN SOME CASES, DISTRICTS MIGHT BE PROVIDING IT.

SO IT CAN VARY.

OKAY. BUT THIS IS SPECIFIC TO THE TWO CLASSROOMS AT GLENVIEW THAT ARE BEING UTILIZED.

YES. OKAY.

THANK YOU. TRUSTEE BERTA.

TRUSTEE MAH. THANK YOU, PRESIDENT CHON.

I GUESS I'M ALSO CURIOUS, AS IF WE COULD GET MORE DETAIL ON WHAT THE AGREEMENT AND LEASE, WHAT THE LEASE AGREEMENT IS AND HOW THAT AFFECTS THE OR HOW IT'S, I GUESS, INTERRELATED TO THE MOU WITH BOTH MORGAN HILL UNIFIED AND GILROY UNIFIED WITH RESPECT TO THE SPECIAL EDUCATION LEASES WHICH ARE LISTED HERE AND THE WHOLE AGREEMENT AS FAR AS HOW WE BUILD BACK AND BUILD FORTH THE DIFFERENT STUDENTS THAT ARE FROM THE THOSE AREAS.

SO FOR INSTANCE, IN THE GILROY HIGH SCHOOL SITE, THERE'S, YOU KNOW, ZERO ANNUAL AGREEMENT AMOUNT FOR GILROY, AND THAT'S WITH THE CELPA.

AND I GUESS THAT'S DIFFERENT THAN AT GATEWAY, WHERE WE HAVE, YOU KNOW, LAND AND DESIGNATED AMOUNT OF LAND FOR ONLY A DOLLAR.

AND I GUESS THAT'S NOT WITH THE CELPA.

THAT'S AGREEMENT OUT TO, YOU KNOW, 2043.

SO. JUST KIND OF WHAT? WHAT EXACTLY ARE OUR SPECIAL EDUCATION AGREEMENTS ON THOSE PARTICULAR SITES AS THEY'VE BEEN BROUGHT UP? AND AS TRUSTEE BERTA WAS SAYING, I AM REALLY INTERESTED IN HOW THOSE SITES ARE MANAGED FINANCIALLY IN THESE LEASES. AND THE MOU AGREEMENTS WITH THE DISTRICT.

YEAH, AND IT DOES VARY AND CAN ALSO BE LIKE LEGACY, YOU KNOW, LEGACY AGREEMENTS FROM MANY YEARS AGO, BUT THEY DO VARY QUITE A BIT.

TYPICALLY WHEN IT'S NOTED AS UNDER CLP, IT'S PART OF THE HOUSING AGREEMENT.

SO BECAUSE ALL OF THE STUDENTS ARE RESIDENT THERE, DISTRICT STUDENTS, THEY BELONG TO AN INDIVIDUAL SCHOOL DISTRICT.

THEN THERE'S A PROVISION FOR THOSE DISTRICTS TO PROVIDE SPACE FOR THE STUDENTS PROGRAM AND THAT OVER TIME, OVER MANY DECADES, SOME OF THESE LAND AND BUILDING AGREEMENTS WERE ENTERED INTO.

BUT THERE MAY ALSO BE PROVISION OF SPACE ON A SCHOOL CAMPUS OR A VARIETY OF OTHER PLACES.

SO THESE ARE JUST SPECIFIC TO THOSE AREAS WHERE WE'RE UTILIZING LAND THAT HAS BEEN PROVIDED BY A DISTRICT. AND TYPICALLY YOU'LL SEE THOSE ARE LIKE $1 OR $0 OR $12.

[01:05:05]

AND THEN SOMETIMES IT'S NOT FOR THE LAND.

IT MAY BE FOR A FACILITY.

AND I GUESS THE OTHER ONE THAT'S INTERESTING FOR ME IS THE ANNE DARLING SITE IN SAN JOSE UNIFIED, WHICH WE HAVE CLASSROOMS, SQUARE FOOTAGE, AGAIN, A ZERO AMOUNT AGREEMENT, AND THAT'S OUT UNTIL 2030.

AND THAT IS THE MEDICALLY FRAGILE DESIGNATED SITE.

RIGHT. AND ANNE DARLING IS THE MEDICALLY FRAGILE CLUSTER.

YES, MEDICALLY FRAGILE CLUSTER.

AND SO THERE'S NONE OF THE FEDERAL, FEDERAL AND STATE FUNDING FOR MEDICALLY FRAGILE STUDENTS THAT GOES TOWARDS THESE LEASES.

AND I GUESS BECAUSE THEIR LEASES ARE JUST ABOUT ZERO, THAT'S NOT SO.

THE FUNDING THEN GOES TOWARDS THE THE MOAS THAT THAT ARE IN AGREEMENT WITH.

THE STUDENT DISTRICTS THAT.

THERE OR WITH THE DISTRICTS THE STUDENTS COME FROM, WHICH I GUESS IN IN DALI'S CASE, ARE THEY ALL FROM SAN JOSE UNIFIED NECESSARILY, OR FROM OTHER DISTRICTS, TOO? NO, THEY CAN BE FROM A VARIETY OF DISTRICTS.

OKAY. THANK YOU VERY MUCH.

THANK YOU. TRUSTEE MAH. TRUSTEE.

LARI. SO, DR.

DEWAN, YOU DID SAY THAT IN SOME CASES THE AMOUNT IN THE LEASE IS TO COVER ESTIMATED UTILITIES AND CUSTODIAN COSTS.

SO WHAT DETERMINES THAT? SOME. SOMETIMES THEY COVER THE COST AND SOMETIMES THEY DON'T.

YEAH, IN SOME CASES, WE'RE BILLED DIRECTLY FROM THE UTILITY COMPANY AND SO IT'S NOT PART OF THE LEASE.

AND OTHER CASES, THE UTILITIES ARE HOOKED UP TO THE DISTRICT'S, YOU KNOW, PROVISION OF THAT UTILITY.

AND SO THEY PASS ON THE COST.

SO WE'RE JUST REIMBURSING THE DISTRICT FOR THE ACTUAL COST OF UTILITIES.

IN OTHER CASES, WE'RE HOLDING THE ACCOUNT WITH THE UTILITY COMPANY.

AND SO WE PAY THOSE COSTS DIRECTLY AND JUST TO FOLLOW UP ON THAT, IN THAT AMOUNT, WHERE WE HAVE THE COST IS NOT REALLY REFLECTED ON THIS.

THAT'S CORRECT. OKAY.

OKAY. THANK YOU.

UM, THIS ITEM WAS PULLED, SO IF THERE ARE NO MORE QUESTIONS, THEN I WOULD ENTERTAIN A MOTION TO APPROVE ITEM SIX E.

WAS THAT A QUESTION? TRUSTEE MAH.

OKAY, ONE MORE QUESTION.

SORRY, ONE MORE QUESTION.

I WAS NOTICING UNDER EDUCARE THAT THERE'S TEN CLASSROOMS THERE AND THAT ONE WITH IS FOR SQUARE FOOTAGE WITH AN ANNUAL AGREEMENT OF ZERO AND THAT THE AGREEMENT END IS PENDING.

IS THAT. IS THAT PENDING SOON OR WHY IS THAT ONE? YEAH, I THINK WE CAN JUST SAY WE DON'T.

WE DON'T COVER.

WE DON'T HAVE A LEASE AT EDUCARE.

WE UTILIZE THOSE SPACES AT NO COST.

WE'RE A PARTNER THERE, BUT WE DO SOMETIMES OUTSIDE OF THE LEASE AGREEMENT, HAVE OR OUTSIDE OF USING THE SPACES WE HAVE SHARED COSTS LIKE AROUND UTILITIES AND CUSTODIAL AND THINGS OF THAT NATURE.

BUT I THINK IT'S JUST PENDING BECAUSE IT'S IN THE PROCESS FOR ITS ANNUAL RENEWAL.

BUT IT'S THERE'S NO RISK.

WE'RE NOT GOING TO LOSE THE TEN CLASSROOMS. GREAT. THANK YOU.

ANY MORE QUESTIONS? OKAY. NOW I'LL ENTERTAIN A MOTION TO APPROVE AGENDA ITEM SIX E.

I'LL MOVE TO APPROVE ITEM SIX E SECOND AND THEN A SECOND FROM VICE PRESIDENT SREEKRISHNAN.

TRUSTEES, PLEASE VOTE IN BOARD DOCS.

AND THAT MOTION CARRIES WITH FIVE YESES, ONE ABSTENTION FROM TRUSTEE, BERTA AND ONE NOT PRESENT AT VOTE.

THANK YOU, TRUSTEES.

OKAY. MOVING ON TO OUR ACTION ITEMS.

[A. Request Approval of the Budget Revisions for the Month of June 2023]

DR. DEWAN, COULD YOU PLEASE INTRODUCE OUR FIRST ACTION ITEM? YES. THANK YOU. OUR FIRST ACTION ITEM THIS EVENING IS RELATED TO OUR BUDGET REVISIONS FOR THE MONTH OF JUNE.

AND STEPHANIE GOMEZ, OUR ASSISTANT SUPERINTENDENT OF BUSINESS, AND NEETI SHARMA, OUR DIRECTOR OF INTERNAL BUSINESS SERVICES, WILL PROVIDE AN INTRODUCTION TO THIS ITEM. OKAY.

[01:10:05]

THANK YOU, DR. DEWAN, AND GOOD EVENING.

A SIGNIFICANT PORTION OF THE BUDGET REVISIONS FOR THE MONTH OF JUNE ARE REVISIONS NECESSARY FOR THE CLOSE OF FISCAL YEAR 20 2223, AND THAT IS THE REASON FOR THE TWO MONTH DELAY IN PRESENTING THE BUDGET REVISION REPORT FOR THE MONTH OF JUNE.

I WOULD ALSO LIKE TO HIGHLIGHT SOME OF THE NEW FUNDING RECEIVED IN THE MONTH OF JUNE.

WE RECEIVED 5.8 MILLION FOR CALIFORNIA COMMUNITY SCHOOL PARTNERSHIP PROGRAM AND REGIONAL TECHNICAL ASSISTANCE CENTERS, WHICH IS TO SUPPORT COMMUNITY SCHOOL IMPLEMENTATION.

WE ALSO RECEIVED 514,000 FOR UNIVERSAL PRE-KINDERGARTEN MIXED DELIVERY PLANNING GRANT, WHICH IS FOR PLANNING FOR THE PROVISION OF HIGH QUALITY FULL DAY AND PART DAY LEARNING EXPERIENCES.

ADDITIONALLY, WE ALSO RECEIVED.

375,000 FOR CALIFORNIA COMMUNITY SCHOOL PARTNERSHIPS PROGRAM COORDINATION GRANT, WHICH IS FOR COORDINATING NONPROFIT ENTITIES AND PARTNERSHIPS TO SUPPORT COMMUNITY SCHOOL IMPLEMENTATION.

I WOULD ALSO LIKE TO SHARE THAT THE JUNE REPORT REFLECTS SOME REDUCTIONS IN FUNDING FROM CALIFORNIA DEPARTMENT OF EDUCATION.

THERE HAS BEEN A REDUCTION IN THE ARTS, MUSIC AND INSTRUCTION MATERIALS, DISCRETIONARY BLOCK GRANT, AS WELL AS THE LEARNING RECOVERY EMERGENCY BLOCK GRANT AND APPROXIMATE COMBINED AMOUNT OF 242,000.

THAT CONCLUDES THE BUDGET DIVISION REPORT FOR THE MONTH OF JUNE.

THANK YOU FOR THE REPORT.

ASSISTANT SUPERINTENDENT GOMEZ AND DIRECTOR, NEEDY TRUSTEES.

ANY QUESTIONS? TRUSTEE MAH.

THANK YOU, PRESIDENT CHON.

ONE THING THAT I NOTICED IN THIS JUNE BUDGET REVISION IS THAT THERE IS A YEAR END BUDGET REALIGNMENT OF REVENUES OF $4.4 MILLION, OF WHICH I GUESS WE HAD I'M SORRY, THE EXPENDITURE WAS 4.4 MILLION, REVENUE WAS 7.7 MILLION.

AND SO I GUESS WE TOOK SOME MONEY OUT OF THE FUND BALANCE.

I KIND OF DON'T REMEMBER THE PLUSES AND MINUSES, WHICH DIRECTION.

SO IF THAT COULD BE JUST CLARIFIED.

DID WE? LOSE MONEY OR GET MONEY ON THAT PARTICULAR BUDGET LINE.

$4 MILLION IS A LOT OF MONEY.

KIND OF NEITHER. BUT WE'LL DEFINITELY EXPLAIN.

YES. THANK YOU. SO THE URINE PROCESS REQUIRES REALIGNMENT.

SO THIS ISN'T LOSING MONEY.

WHAT IT IS IN ORDER TO CLOSE OUR BOOKS FOR JUNE 30TH, ALL THE BUDGET EXPENDITURE ACCOUNTS FOR THE ENTIRE ORGANIZATION HAVE TO BE REALIGNED.

THEY HAVE TO BE PROCESSED AS A BUDGET ENTRY.

WHAT WE DO IS WE CLOSE THE BOOKS AND THEN WE RESET JULY 1ST.

SO IT'S NOT THAT WE LOST MONEY, IT'S JUST PART OF OUR CLOSING PROCESS.

AND SO THIS MONEY, THOUGH, I MEAN, THESE BUDGET REVISIONS ARE REVISIONS TO OUR ORIGINAL BUDGET.

IT'S THE BUDGET THAT WE HAD IN THE SYSTEM.

IT'S REALIGNING THEM TO BE ABLE TO CLOSE OUT THE SYSTEM, TO BALANCE EVERYTHING.

SO IN THIS PARTICULAR INSTANCE, IT'S CLOSING OUT THE BUDGET.

IT'S DOING AN ENTRY, I GUESS YOU WOULD SAY.

AND THEN JULY 1ST, IT REVERSES AND THE BUDGETS RESET.

AND SO I GUESS I'D LIKE A MORE DETAILED EXPLANATION AS FAR AS THE REALIGNMENT OF REVENUES AND EXPENDITURES FOR THE GENERAL FUND PROGRAMS, BECAUSE THAT'S A PRETTY GENERIC COMMENT AND IT WOULD BE INTERESTING TO FIND OUT.

I THINK WHEN I ASKED DR.

DEWAN A LITTLE BIT ABOUT THIS AND SHE SAID IT WAS DUE TO DIFFERENT DEPARTMENTS AND I WAS WONDERING COULD WE GET A BREAKDOWN OF WHAT WHICH DEPARTMENTS ACTUALLY, YOU KNOW, HAD THE BIGGER OR LESSER REALIGNMENTS? BECAUSE IF THESE ARE CHANGES TO THE BUDGET FROM EARLIER, THEN IN THE SIMILAR WAY THAT WE HAVE OUR BOARD POLICIES KIND OF RED LINED, YOU KNOW WHAT CHANGES WHAT WAS THE BEFORE AND THEREFORE WHAT'S THE AFTER.

IT'D BE NICE TO KNOW WHAT WAS THE $4 MILLION, $7 MILLION, $3 MILLION CHANGES THAT HAPPENED FROM THE PREVIOUS BUDGET? WHICH DEPARTMENTS PLUS AND MINUS THOSE HUGE NUMBERS.

I MEAN, IT'S JUST BECAUSE IT'S A REALLY BIG NUMBER THAT I CARE MORE ABOUT IT.

WELL, WHAT WE COULD JUST SUGGEST IN TERMS OF LIKE THE BUDGET DEVELOPMENT PROCESS, IS THAT WHERE YOU'LL SEE MORE OF THAT KIND OF COMPARISON IS NOT IN THE MONTH TO MONTH BECAUSE AS ASSISTANT SUPERINTENDENT GOMEZ WAS EXPLAINING, WE JUST PROVIDED THESE AS LIKE ALIGNMENTS.

THEY'RE NOT REALLY REVISIONS, THEY'RE JUST WE CLOSED OUT THE BOOKS AND THEN WE HAVE TO OPEN THE NEW BOOKS.

[01:15:02]

SO YOU KNOW, HOW WE HAD TO REALIGN EVERYTHING TO IN ORDER TO OPEN THE NEW BUDGET YEAR.

BUT WHEN WE BRING THE FIRST INTERIM BUDGET REPORT THAT WILL BRING IN DECEMBER, THEN THAT'S WHERE WE PROVIDE TO THE BOARD WHAT HAS CHANGED SINCE THE ADOPTED BUDGET AND HELP THE BOARD AND PROVIDE THAT, YOU KNOW, DISCUSSION AROUND ANY CHANGES TO THE BUDGET SINCE THE BUDGET WAS ADOPTED IN JUNE.

OKAY. THAT MIGHT BE FOR THE GENERAL FUND KIND OF QUESTION ON THAT LINE ITEM.

BUT THEN I ALSO ASKED ON FURTHER DOWN, THERE WAS A YEAR END BUDGET REALIGNMENT FOR SPECIAL EDUCATION FUNDS OF $260,000 AND ALSO A YEAR END BUDGET REALIGNMENT FOR WALDEN WEST OF $800,000.

AND SO THOSE BEING TIED TO THOSE SPECIFIC AREAS, WHAT WERE THE, YOU KNOW, REALIGNMENT ACTIVITIES THAT CAUSED SUCH A CHANGE IN BUDGET? SO IT WAS JUST AN UPDATE AS PART OF THE PROCESS.

SO FOR THE SPECIAL EDUCATION ITEM, IT WAS THE FEES THAT WE RECEIVED FOR DISTRICTS AND THE EXPENSES INCURRED.

IT WAS JUST BALANCING THOSE OUT AT THAT POINT IN TIME.

AND SO THAT'S REALLY WHAT IT WAS JUST NETTING IT OUT TO ZERO TO CLOSE THE BOOKS FOR THAT LINE.

SAME THING WITH WALDEN WEST.

WHEN WE FINISHED UP OUR YEAR, WE HAVE OUR BUDGET THAT WE HAVE.

SO OUR ADOPTED BUDGET IS WHEN WE DO IT IN JUNE, WE HAVE OUR INTERIM PERIODS OR FROM SECOND INTERIM TO THE END OF THE YEAR.

THERE'S NOT REALLY A BUDGET ADJUSTMENTS, IT'S JUST ALIGNING IT TO CLOSE THE BOOKS.

SO IT WAS JUST REALLY JUST LOOKING AT THE REVENUES FOR WALDEN WEST THAT WERE COLLECTED DURING THAT PERIOD OF TIME AND THEN JUST ALIGNING IT AGAINST THE EXPENDITURES THAT WERE INCURRED FOR THAT SAME TIME PERIOD.

SO I WOULDN'T SAY IT WAS A CHANGE PER SE.

IT WAS JUST LIKE I SAID, ALIGNING IT SO WE COULD BALANCE THE BOOKS TO CLOSE THEM.

YEAH, AND IT'S PARTLY THE TIMING.

SO IN ORDER TO CLOSE THE BOOKS, WE HAVE TO ACCOUNT FOR IT.

SO THEN WE CAN OPEN THE BOOKS IN JULY AND HAVE EVERYTHING IN THE, YOU KNOW, THE RIGHT BUDGET AREA BASED ON THE ADOPTED BUDGET.

BUT ONE OF THE THINGS THAT WAS MENTIONED AS FAR AS THE EXPENDITURES, FOR INSTANCE, FOR WALDEN WEST WAS THAT THEY WERE CHARGED FOR SUMMER REGISTRATION, MERCHANDISE SALES AND WALDEN WEST SCHOLARSHIPS.

AND I MEAN, THESE WERE DOLLARS THAT WERE NOT BUDGETED EARLIER OR WERE THEY BUDGETED EARLIER AND THEN BECAUSE OF TIMING.

YEAH. SO WHEN WE LOOK AT THE BUDGET FOR WALDEN WEST, WE HAVE OUR BUDGET THAT WE GOT WHEN WE ADOPTED THE BEGINNING OF THE YEAR.

AND THEN AS THEY SEE THE REGISTRATION GO UP THROUGHOUT THE YEAR, THAT'S FOR FIRST AND SECOND INTERIM, WE MAKE THOSE ADJUSTMENTS TO THE BUDGET AND WE BRING THAT TO THE BOARD.

SO THIS IS US JUST FINALIZING THE AMOUNT OF COLLECTIONS FOR THAT FISCAL YEAR END PERIOD AND THEN JUST ALIGNING OUR BUDGETS TO THE EXPENSES.

SO IT REALLY IS A CLOSEOUT PROCESS OF, YOU KNOW, BUDGET AS TO WHAT WE'VE RECEIVED AND THEN RECOGNIZING IN OUR IN OUR SYSTEM.

BUT GIVEN THAT WALDEN WEST MOST OF IT, I MEAN, WITH THE SUMMER CAMPS ESPECIALLY, IS KIND OF IN THE SUMMER.

SO DID WE DID WE GET A LOT MORE REGISTRATIONS THAN WE HAD ORIGINALLY PLANNED? DID WE SELL A LOT MORE MERCHANDISE THAN WE? ORIGINALLY BUDGETED AND DID WE GIVE MORE SCHOLARSHIPS? YEAH, NOT REALLY.

I MEAN, I THINK TO ANSWER YOUR QUESTION EARLIER, LIKE, WAS THIS REVENUE WE WERE EXPECTING? YES, WE ALWAYS EXPECT AND AGAIN, TIMING BECAUSE THE REVENUE THAT WALDEN WEST GENERATES IN THE SUMMER HELPS US OPERATE THE PROGRAM DURING THE SCHOOL YEAR.

AND WE DON'T ALWAYS KNOW WHAT THAT'S GOING TO BE INCLUDING.

WE DON'T ALWAYS KNOW WHAT IT'S GOING TO COST DURING THE SCHOOL YEAR.

SO OFTEN WE HAVE TO USE GENERAL FUND TO COVER COSTS UNTIL WE ACTUALLY RECEIVE THE REVENUE FROM WALDEN WEST FROM THEIR REVENUE GENERATING OPERATIONS.

WE DON'T WE DON'T RECOVER ENOUGH DURING THE SCHOOL YEAR FOR THE SCHOOL YEAR PROGRAM TO KEEP THAT PROGRAM WHOLE.

SO WE NEED THEY NEED THE REVENUE FROM THEIR SUMMER PROGRAM.

SO IT'S LIKE STEPHANIE SAID, IT'S A REALIGNMENT.

IT'S WE HAD THESE FUNDS, WE HAD TO COVER THE COST THROUGHOUT THE YEAR.

WE ANTICIPATE REVENUE COMING IN.

WE'VE ALREADY PAID STAFF.

WE'VE ALREADY, YOU KNOW, PROVIDED BENEFITS AND THE LIKE.

AND TO CLOSE THE BOOKS, WE HAVE TO ACCOUNT FOR THAT REVENUE AS SOON AS WE KNOW IT AND THEN REOPEN THE BOOKS ON JULY 1ST.

SO I DON'T KNOW IF WE'RE MAKING IT CLEARER, CLEARER OR MUDDIER, BUT IT'S ESSENTIALLY IT'S NOT NECESSARILY A BUDGET REVISION.

I KNOW THE TITLE OF THIS REPORT IS BUDGET REVISION, BUT THOSE JUNE REPORTS ARE ALWAYS MORE LIKE THE REALIGNMENTS.

AND I GUESS IT'S ALSO A LITTLE BIT I MEAN, AGAIN, IT'S KIND OF ACCOUNTING VERNACULAR, WHICH I'M NOT THAT GREAT AT.

[01:20:06]

BUT WHEN THE FIRST COLUMN SAYS EXPENDITURE INCREASE OF 800,000 AND A REVENUE INCREASE OF 800,000, THIS IS SPECIFICALLY FOR WALDEN WEST, THEN THAT ACTUALLY IS COVERED SO THAT THERE WAS NO USE OF FUND BALANCE.

IS THAT CORRECT? THAT'S CORRECT.

THAT'S THE REALIGNMENT.

SO WE ANTICIPATE WE KNOW NOW WHAT OUR EXPENDITURES WERE.

WE KNOW WHAT THE REVENUE INCREASES.

SO WE'RE JUST ALIGNING THAT SO THAT WE CAN CLOSE OUT THE BOOK.

AND THEY JUST HAPPEN TO MATCH.

I MEAN, ARE THERE SEPARATE ACCOUNTS THAT SHOW ACTUALLY WHAT THE WALDEN WEST PROGRAM? YOU KNOW, REVENUE AND EXPENDITURES ARE SO WE CAN SEE WHAT THE GENERAL FUND IS.

YEAH, WE AND AGAIN AT FIRST INTERIM, WE ALWAYS SHOW WHAT WE, YOU KNOW, WHAT THE GENERAL FUND CONTRIBUTION WOULD BE BY PROGRAM.

WE DO. YES. GREAT.

YEAH. WE ALWAYS PROVIDE THAT TO THE BOARD.

OKAY. SO BASICALLY, YOU'RE ASKING FOR AN INCOME STATEMENT FOR ALL INVESTORS? YES. BUT AGAIN, WE CAN SHOW SOME OF THAT IN THE FIRST INTERIM.

BUT THE PURPOSE OF THE BUDGET REVISIONS IS JUST TO SHOW HOW WE'VE FOR THE JUNE 1ST, ESPECIALLY HOW WE CLOSED OUT THE YEAR AND REALIGNED BALANCE THE BOOKS SO THAT WE COULD OPEN THE BOOKS AGAIN JULY 1ST.

I CAN RESPECTFULLY REQUEST THE APPROVAL OF THE JUNE REPORT.

THANK YOU, TRUSTEE.

OKAY. MAY I HAVE A MOTION TO APPROVE THE BUDGET REVISIONS FOR JUNE 2023? SO MOVED. THANK YOU, VICE PRESIDENT SREEKRISHNAN.

AND A SECOND. SECOND.

A SECOND. BY TRUSTEE LARI.

TRUSTEES, PLEASE VOTE IN BOARD DOCS.

AND THAT MOTION CARRIES WITH FIVE YESES AND ONE ABSTENTION FROM TRUSTEE MAH AND ONE NOT PRESENT AT VOTE.

THANK YOU, TRUSTEES.

DR. DEWAN, COULD YOU PLEASE INTRODUCE THE NEXT ACTION ITEM?

[B. Request Approval of the Budget Revisions for the Month of August 2023]

YES. SO CONTINUING WITH OUR BUDGET REVISIONS AND GETTING CAUGHT UP FOR THE YEAR, WE'VE CLOSED OUT THE BOOKS.

WE'RE NOW SHARING WITH YOU THE BUDGET REVISIONS FOR THE MONTH OF AUGUST.

AND AGAIN, OUR ASSISTANT SUPERINTENDENT AND DIRECTOR ARE HERE TO PROVIDE AN INTRODUCTION TO THIS ITEM AND THEN WE'LL BE HAPPY TO ANSWER ANY QUESTIONS.

AND THANK YOU, DR. DEWAN, FOR THE MONTH OF AUGUST.

A LARGE PORTION OF THE BUDGET REVISIONS ARE CARRYOVER ALLOCATIONS FROM THE CLOSE OF FISCAL YEAR 22-23 TO FISCAL YEAR 23-24.

SOME OF THE NEW FUNDING WE HAVE RECEIVED IN THE MONTH OF AUGUST IS $750,000 FOR SPECIAL EDUCATION RESOURCE LEADS GRANT, WHICH IS TO IMPROVE PUPIL OUTCOMES AS PART OF THE STATEWIDE SYSTEM OF SUPPORT.

AND WE ALSO RECEIVED $497,000 FOR CALIFORNIA GEOGRAPHIC LEAD AGENCY PROGRAM, WHICH IS TO HELP BUILD THE CAPACITY OF THEIR LOCAL OF LOCAL EDUCATIONAL AGENCIES. THAT CONCLUDES THE REPORT FOR THE MONTH OF AUGUST.

THANK YOU FOR THE REPORT.

QUESTIONS TRUSTEE BERTA.

YES. QUICK QUESTION ABOUT THE INCREASE IN REVENUE FOR THE SPECIAL EDUCATION RESOURCE LEADS GRANT.

WAS THAT A NEW GRANT THAT WE RECEIVED OR WAS THAT AN INCREASE IN FUNDING FOR THAT GRANT? THIS IS A NEW GRANT.

IT WAS A COMPETITIVE GRANT IN THE STATEWIDE SYSTEM OF SUPPORT, AND THE GRANT IS SPECIFICALLY FOR THE COUNTY OFFICE OF EDUCATION AND OTHER PARTNERS TO SUPPORT LEA'S STATEWIDE WITH INCLUSION AND INCLUSIVE PRACTICES.

AND WE WILL ALSO BE REQUIRED TO PROVIDE HIGH END TECHNICAL SUPPORT TO DESIGNATED SCHOOL DISTRICTS THROUGHOUT THE COUNTY WHO GO DEEPER INTO THE DIFFERENTIATED ASSISTANCE TIERS.

SO THEY'VE ALREADY BEEN IN DIFFERENTIATED ASSISTANCE, THEY'VE HAD SUPPORT FOR A NUMBER OF YEARS AND THEY NEED MORE TARGETED ASSISTANCE SPECIFIC TO INCLUSION OR INCLUSIVE PRACTICES, AND THAT WILL COME OUT OF THIS RESOURCE GRANT.

AND WILL THERE BE A FURTHER BREAKDOWN OF WHERE THOSE FUNDS ARE GOING WITHIN THE BUDGET? AND THE FUNDS ARE SPECIFICALLY FOR STAFF WHO ARE PROVIDING THE TECHNICAL ASSISTANCE.

[01:25:01]

OKAY. THANK YOU.

THANK YOU. OKAY, TRUSTEES.

I WILL ENTERTAIN A MOTION TO APPROVE THE BUDGET REVISIONS FOR AUGUST 2023.

SO MOVED. MOVED BY VICE PRESIDENT SREEKRISHNAN.

THANK YOU. TRUSTEE BERTA WOULD YOU PLEASE SHARE ABOUT THE CALIFORNIA COUNTY BOARDS OF EDUCATION, BOARD OF DIRECTORS AND THE WORMHOLE INCLUSION COLLABORATIVE ADVISORY BOARD? YES. THANK YOU.

SO I PARTICIPATED IN THE CBE BOARD OF DIRECTORS MEETING ON SEPTEMBER 8TH AND THE GENERAL MEMBERSHIP MEETING ON SEPTEMBER 9TH.

[01:30:03]

ON THE EIGHTH, CBE BOARD OF DIRECTORS VOTED ON ESTABLISHING TWO POLICY PLATFORMS FOR THE COMING YEAR.

THE FIRST IS ON ADVOCATING FOR A MOVE AWAY FROM ADA.

SO IN ALIGNMENT WITH MORE ON THE BASIS OF ENROLLMENT, WE KNOW THAT ADA HAS BEEN IMPACTED BY OR USING ADA AVERAGE DAILY ATTENDANCE HAS BEEN IMPACTED BY CHALLENGES RELATED TO THE PANDEMIC AS WELL AS CHRONIC ABSENTEEISM.

AND THE OTHER PRIORITY PLATFORM IS AROUND ADVOCATING TO ENSURE THAT PLAYGROUNDS ARE ADA ACCESSIBLE.

DURING THE GENERAL MEMBERSHIP MEETING, WE ALSO VOTED ON CHANGES TO THE BYLAWS, WHICH GOES INTO THE CANDIDACY PROCESS FOR INDIVIDUALS INTERESTED IN RUNNING FOR THE BOARD OF DIRECTORS AND OTHER ROLES WITHIN THE CCB.

THANK YOU. THANK YOU.

TRUSTEE. LARI AND TRUSTEE MAH.

COULD YOU PLEASE SHARE ABOUT THE SILICON VALLEY READS ADVISORY COMMITTEE? SURE. THE SILICON VALLEY READS ADVISORY COMMITTEE MET AND WE TALKED ABOUT POTENTIAL BOOKS THAT WE WILL BE THAT WE WILL BE RECOMMENDING FOR THIS NEXT YEAR.

THE TOPIC IS ENVIRONMENTAL SUSTAINABILITY.

AND SO WE'RE CONSIDERING A NUMBER OF BOTH NONFICTION AND SOME FICTION BOOKS TO COVER THAT AREA UNDER KIND OF A BROAD

[01:35:03]

INTEREST LEVEL BECAUSE WE WANT TO TRY TO GET AS MANY PEOPLE TO READ AND JOIN IN THE ACTIVITIES AND EVENTS THAT WE HAVE.

SO WE HAVEN'T MADE THE FINAL SELECTION YET, BUT THERE'S A LOT OF REALLY INTERESTING ONES BEING CONSIDERED.

AND WE ARE ALSO LOOKING FOR A MODERATOR SINCE OUR GOOD FRIEND SAL PIZARRO IS TAKING A BREAK THIS NEXT YEAR. SO IF YOU HAVE ANY SUGGESTIONS FOR A GOOD MODERATOR, WE HAVE SOME, BUT WE COULD ALWAYS ASK SOME MORE SINCE WE DON'T HAVE ANYONE BOOKED YET.

THANKS. THANK YOU.

TRUSTEE MAH. ANY OTHER COMMITTEE REPORTS I MAY HAVE MISSED? OKAY. THANK YOU FOR THE REPORTS.

WE WILL NOW MOVE TO OUR NEXT AGENDA ITEM.

SUPERINTENDENTS REPORT.

[A. The superintendent may give a report on any activities related to her duties.]

DR. DEWAN. YES.

JUST WANT TO HIGHLIGHT A FEW OF THE ACTIVITIES.

SINCE OUR LAST MEETING ON SEPTEMBER 7TH, OUR OFFICE PARTICIPATED ALONG WITH THE OTHER GEO LEAD LEADERS FROM DIFFERENT REGIONS IN THE STATE.

THE GEO LEAD IS A NEW DUTY FOR OUR OFFICE, WHERE WE'LL BE PROVIDING SUPPORT AS PART OF THE STATEWIDE SYSTEM OF SUPPORT TO COUNTIES AND DISTRICTS WITHIN OUR GEOGRAPHIC REGION, WHICH INCLUDES ALAMEDA, SAN MATEO, CONTRA COSTA AND SAN FRANCISCO. AND WE'RE LEARNING MORE ABOUT HOW TO IMPLEMENT THE GEO LEAD WORK WITHIN THE STATEWIDE SYSTEM OF SUPPORT, FOCUSING ON SOME OF THE HIGH NEED AREAS THAT WE'RE SEEING DISTRICTS CONTINUE TO WRESTLE WITH.

AND ONE OF THE TOPIC AREAS THAT WE'RE CONSIDERING FOR ADDITIONAL SUPPORT IS CHRONIC ABSENTEEISM.

ON SEPTEMBER 7TH, I ALSO WELCOMED GUESTS TO OUR AAPI EDUCATORS NETWORK, SEPTEMBER 8TH AND NINTH, I ATTENDED CCB ANNUAL CONFERENCE WITH TRUSTEE, LARI, TRUSTEE, BERTA AND TRUSTEE MAH.

ALSO AT THE CONFERENCE, THE CCP HONORED A LEGISLATOR OF THE YEAR AND IT HAPPENED TO BE ONE OF THE LEGISLATORS IN OUR DELEGATION AND WE WERE ABLE TO HAVE A PERSONAL CONVERSATION AND JUST ALSO PERSONALLY CONGRATULATE OUR LEADER.

ON SEPTEMBER 11TH, I JOINED WITH SACRAMENTO COUNTY OFFICE OF EDUCATION TEAM MEMBERS AND OUR LEADERS, AND DR.

JESSICA BANDURA'S FACILITATED A PLANNING DAY WHERE WE'RE WORKING WITH SACRAMENTO ON THE IMPLEMENTATION OF THE STATEWIDE FEE SCHEDULE.

AND THIS IS A SPECIALIZED GRANT PROGRAM, BUT THAT SACRAMENTO AND SANTA CLARA HAVE BEEN DESIGNATED TO CO-LEAD AND THAT WE'LL BE DOING OVER THE NEXT COUPLE OF YEARS TO BUILD INFRASTRUCTURE AND CAPACITY AMONGST ALL LEAS SO THAT THEY CAN TAKE ADVANTAGE OF THE FEE SCHEDULE WHEN IT GOES INTO PLACE. AND THE FEE SCHEDULE WILL BE THE MECHANISM WHERE SCHOOLS AND COUNTY OFFICES OF EDUCATION CAN BILL MANAGED CARE ORGANIZATIONS AND PRIVATE INSURERS FOR SERVICES THAT WE PROVIDE ON SCHOOL CAMPUSES.

ON SEPTEMBER 12TH, I ATTENDED THE STRONG START COALITION MEETING AND SERVED AS A GUEST SPEAKER TO THE AXA RETIREE CHARTER.

ON SEPTEMBER 13TH, WE PARTICIPATED IN THE NOTICE OF FUNDING AVAILABILITY, THE NOFA FOR THE ARPA CHILDCARE INFRASTRUCTURE GRANTS THAT ARE BEING ADMINISTERED BY THE VALLEY HEALTH FOUNDATION, AND THAT TRUSTEE LARI MENTIONED THAT WE ALSO SPOKE ABOUT AT STRONG START AND IN PARTICULAR, WE'RE SUPPORTING THIS EFFORT AND PROVIDING TECHNICAL ASSISTANCE AROUND FACILITIES AND FACILITY DEVELOPMENT.

AND THE FUNDS ARE AVAILABLE TO FAMILY CHILD CARE, HOME PROVIDERS AND CENTER BASED PROVIDERS, AS WELL AS POTENTIALLY LEAS WHO ARE LOOKING TO EXPAND THEIR CHILD CARE INFRASTRUCTURE.

ON THAT SAME DAY I ATTENDED OUR SANTA CLARA COUNTY SCHOOL BOARDS ASSOCIATION MONTHLY MEETING AND PROVIDED AN UPDATE TO THE MEMBERSHIP.

I ATTENDED OUR SILICON VALLEY READS ADVISORY BOARD MEETING ON THAT SAME DAY AND ON SEPTEMBER 15TH WE I WELCOMED GUESTS AT THE WARMENHOVEN ADVISORY COMMITTEE MEETING AND ALSO PARTICIPATED IN THE SCHOOL EMPLOYERS ASSOCIATION OF CALIFORNIA BOARD MEETING AND ATTENDED A MEET AND GREET WITH THE FIRST EVER EXECUTIVE DIRECTOR OF THE EASTSIDE EDUCATION FOUNDATION, NEWLY APPOINTED DIRECTOR CARLOS SEEING. ON SEPTEMBER 18TH, WE HOSTED THE PRESS CONFERENCE WITH SENATOR CORTEZ THAT YOU HEARD ABOUT EARLIER FROM VICE PRESIDENT SREEKRISHNAN.

[01:40:03]

THE PRESS CONFERENCE WAS ATTENDED BY BOTH VICE PRESIDENT SREEKRISHNAN AND TRUSTEE LARI.

I WANT TO THANK YOU FOR ATTENDING THERE.

AND REALLY THE PURPOSE OF THE PRESS CONFERENCE WAS TO DO TO RAISE AWARENESS ABOUT THE PREVALENCE OF FENTANYL IN OUR COMMUNITY AND TO ELEVATE THE IMPORTANCE AND THE NEED OF SENATE BILL TEN TO BUILD UPON THE WORK THAT'S ALREADY HAPPENING, BUT TO REQUIRE SCHOOLS TO INCLUDE IN THEIR SCHOOL SITE SAFETY PLANS CONSIDERATIONS FOR OPIOID OVERDOSE PREVENTION AND REVERSAL.

ONE OF THE IMPORTANT MESSAGES THAT WE'RE TRYING TO SHARE RELATED TO THIS IS THE INCREDIBLE NEED TO INVEST IN PREVENTION AND EDUCATION SO THAT YOUNG PEOPLE ARE GOING TO BE LESS LIKELY TO ENGAGE IN, EXPERIMENT WITH OR BE COAXED INTO USING DRUGS IN THE FIRST PLACE.

AND WE ALSO CO-HOSTED YESTERDAY A SCHOOL SAFETY HOMICIDE THREATS TRAINING.

THIS WAS A TRAINING SPECIFIC FOR SCHOOL LEADERS TO HELP THEM UNDERSTAND SOME OF THE NEW REQUIREMENTS ON THE SEE, SEE SOMETHING, SAY SOMETHING LAW AND THE REQUIREMENTS TO NOTIFY LAW ENFORCEMENT WHEN THERE IS KNOWLEDGE OF A HOMICIDE THREAT.

AND TODAY WE HAD OUR JLAC SUBCOMMITTEE MEETING.

I ALSO WANTED TO SHARE WITH THE BOARD AND THE COMMUNITY THAT ON SEPTEMBER 15TH WE RECEIVED TWO NOTICES FROM THE CALIFORNIA DEPARTMENT OF EDUCATION.

THE FIRST NOTICE WAS AN APPROVAL OF OUR 23-24 COUNTY OFFICE OF EDUCATION ADOPTED BUDGET AND THE SECOND WAS APPROVAL OF OUR SANTA CLARA COUNTY OFFICE OF EDUCATION, LOCAL CONTROL ACCOUNTABILITY PLAN FOR THE 2324 SCHOOL YEAR.

I ALSO WANT TO PERSONALLY INVITE ALL THE TRUSTEES TO OUR LGBTQ PLUS HISTORY MONTH SHOWCASE.

THIS IS SCHEDULED FOR THURSDAY, OCTOBER 5TH.

IT WILL BE FROM 3 TO 6 P.M.

WE ARE HOSTING THIS THE SHOWCASE AT SOUTH COUNTY ANNEX IN GILROY.

THIS YEAR, FOR THE FIRST TIME, WE WILL ALSO BE HONORING DISTRICTS AND CHARTER SCHOOLS IN SANTA CLARA COUNTY FOR THEIR EFFORTS IN PROMOTING LGBT PLUS INCLUSIVITY.

SO WE HAVE A NUMBER OF HONOREES THAT WILL BE CELEBRATING, AND OUR KEYNOTE SPEAKER WILL BE KEN YEAGER, AND HE'S GOING TO SHARE ABOUT HIS LEGACY OF SERVICE AND PROMOTING INCLUSION AND THE RIGHTS OF THE LGBTQ PLUS COMMUNITY.

SO I HOPE THAT YOU WILL ALL JOIN US.

IF YOU'RE INTERESTED.

PLEASE JUST RSVP WITH WITH JAMIE SO WE MAKE SURE TO HAVE SPACE FOR YOU.

AND THAT CONCLUDES MY REPORT.

ALL RIGHT. THANK YOU, DR.

DEWAN. THE NEXT SANTA CLARA COUNTY BOARD OF EDUCATION REGULAR MEETING IS SCHEDULED FOR OCTOBER 4TH, 2023.

MAY I HAVE A MOTION TO ADJOURN? MOVED BY VICE PRESIDENT SREEKRISHNAN AND SECOND, SECOND, SECOND BY TRUSTEE LARI.

WE ARE NOW ADJOURNED AT 9:14 P.M.

HAVE A GOOD NIGHT, EVERYBODY.

GOOD NIGHT.
