Background
The Santa Clara County Board of Education (County Board) and the County Superintendent of Schools (County Superintendent) believe it is important to seek and consider students ideas, viewpoints, and reactions to education. To provide Santa Clara County Office of Education (SCCOE) high school students with opportunities for civic engagement and to provide valued input to the County Board, the County Board agreed by policy to ensure inclusion of a student member (Student Board Member). A petition was received and duly verified by the County Superintendent of Schools in June of 2022.
The 2023-2024 Student Board Member has been selected by their peers. The student member is in good academic standing and committed in writing to carrying out the responsibilities of Student Board Members by completing an affidavit which is on file in the office of the County Superintendent of Schools.
This evening the selected student, Erick De La Rosa Aguilera, is being presented to the County Board at the regular meeting of January 31, 2024.
The Student Board Member will be filling the vacancy, completing the term, and will continue to serve through December 31, 2024. Should the term be extended beyond that time, that information will be provided to the Board. The Student Board Member shall perform duties as needed within the scope of the County Board. Student Board Members shall not be considered members of legislative body for purposes of the Brown Act, including for purposes of establishing quorum. Student Board Members shall not be included in determining the vote count necessary to carry any measure before the County Board. The Student Board Member shall participate virtually in the meetings. Should the County Board of Education meetings extend beyond 8:00 PM, the student board member will be automatically excused at 8:00 PM.

The SCCOE is committed to providing opportunities for students to engage civically and to pursue the State Seal of Civic Engagement on their diploma. Civic engagement promotes learning, critical thinking, and engagement.
The Bill of Rights for Children and Young Adults for Santa Clara County identifies the right to "be treated as equal partners in identifying problems, developing solutions, and making decisions" that impact youth.

Career and Technical Education (CTE) classes prepare students for high-demand careers. CTE covers many different sectors, including advanced manufacturing, the arts, health care, hospitality and management, and information technology, CTE encompasses a variety of educational settings, from classroom learning to certification programs to work-based learning opportunities outside the classroom.

February is Black History Month, an annual celebration of the achievements made by African Americans and the significant role they have played in United States (U.S.) history. Black History has been celebrated in the U.S. since 1926 when Carter G. Woodson established Negro History Week.
Student Impact
In alignment with the SCCOE goal to improve student equity, the SCCOE observes and honors Black History Month and encourages educators, students, and families to learn about the heritage and achievements of African Americans through appropriate programs and activities that reflect the theme for 2024. The SCCOE continues to partner with community-based organizations, including the African American Community Service Agency and the Santa Clara County Alliance for Black Educators to improve educational outcomes for African American students through school support programs (tutoring, after-school homework centers, mental health services, student advocacy).

The Ridder Park Early Learning Center project improves access to inclusive quality early learning and care (ELC) programs and services for children with disabilities including children with severe disabilities.
The Solar Energy Project supports efforts that address the climate emergency with sustainability practices in campus, curriculum, community, and culture (4Cs) and enhances climate science programs and supports youth led efforts.

The Statewide System of Support, established through the 2018 Budget Act, is a comprehensive structure of defined roles and responsibilities designed to ensure that local educational agencies (LEAs - school districts, charter schools, and county offices of education) in California receive support within a three-level framework.
Support for all local educational agencies (LEAs) and Schools (Level 1): Various state and local agencies provide an array of resources and voluntary assistance that all LEAs may use to improve student performance.
Differentiated Assistance (Level 2): County Superintendents, the California Department of Education (CDE) and the California Collaborative for Educational Excellence (CCEE) provide differentiated assistance for LEAs, in the form of individually designed assistance to address identified performance issues.
Intensive Intervention (Level 3): The State Superintendent of Public Instruction may require more intensive interventions for LEAs with persistent performance issues over a specified period.
Student Impact
As stated in the adopted Bill of Rights for Children and Young Adults for Santa Clara County, all children and young adults have the right to a relevant and engaging education that exposes them to other cultures and promotes lifelong learning. The Statewide System of Support aims to create a coherent system for addressing systemic bias and inequities within the current system. With support from the Geographic Lead Agencies, county offices of education strengthen their capacity to help local educational agencies support continuous improvement of student performance and address achievement gaps among student groups.

The SCCBOE will meet in Closed Session to discuss and prepare the County Superintendent's Evaluation.
The County Superintendent provided notice on October 3, 2023, of her waiver of the provision in the salary agreement for a salary increase for the 2023-2024 FY. The CPI would have been 2.9%. The waiver notice was provided due to the late tax filing dates in CA resulting in economic uncertainty, other factors impacting the COE budget including reductions in committed funding, and declining enrollment across Santa Clara County. The waiver was accepted on October 6, 2023.

The County Superintendent and Board President are collaborating to develop a framework for the inclusion of "future agenda items" as a topic for the Santa Clara County Board of Education (SCCBOE) agenda. The County Superintendent and Board President will provide an update on this collaboration.
According to the Santa Clara County Board of Education Governance Handbook, the following protocol is in place for bringing up new ideas or board agenda items (page 14):
Bringing up new ideas or agenda items:
Principle: SCCOE staff focus, energy, and time, as well as other SCCOE resources must be focused on achieving the agreed upon county vision, goals, and objectives and should not be diluted by new projects or the interests of individual Board Members. The County Superintendent is the sole employer of all SCCOE employees.
Protocol:
• A Board Member’s first step shall always be to discuss the new topic or idea with the County Superintendent.
• Excepting agenda items otherwise permissible by Education Code, Brown Act, or other rules, regulations, or policies for the Board to place on the agenda, a County Board Member may request an item be placed on the agenda either in writing or by request via email to the County Superintendent and SCCBOE President.
• All new ideas or agenda item topics will be weighed against their effect on staff’s ability to accomplish SCCOE’s vision and goals.
o Prior to placing an item on the Board agenda, the County Superintendent and the County Board President shall:
o The County Superintendent shall determine the impact of the item request on the operations of the office, the reallocation of SCCOE resources away from SCCOE mandates, priorities, and goals, assess the time and energy required of staff, and the fiscal impact on the office before placing the item on the agenda. If the item is determined to be within the Board’s jurisdiction, the County Superintendent will report back to the Board President and notify the requestor of the decision.
o The Board President shall have the final approval authority for agenda items so long as the agenda items approved are permitted by Education Code, Brown Act, are within the jurisdiction of the board, and adhere to other applicable rules and regulations.
The superintendent may give a report on any activities related to her duties.

Education Code Section 41020.3 states that by January 31 of each year, the governing body of each local education agency shall review, at a public meeting, the annual audit of the local education agency for the prior year, any audit exceptions identified in that audit, the recommendations or findings of any management letter issued by the auditor, and any description of correction or plans to correct any exceptions or management letter issue.
In accordance with Education Code 41020.3, an annual audit of the financial records of the Santa Clara County Office of Education (SCCOE) was conducted for the fiscal year ended June 30, 2023. The auditors issued an opinion that the financial statements are presented fairly, in all material respects, the respective financial position of the governmental activities, each major fund, and the aggregate remaining fund information of the Santa Clara County Office as of June 30, 2023, and the respective changes in financial position and, where applicable, cash flows thereof for the year then ended in accordance with accounting principles generally accepted in the United States of America. There were no audit exceptions, recommendations or findings or any description of correction or plans to correct any exceptions identified in the audit.
The 2022-2023 SCCOE Audit Report was placed on the board agenda for the January 10, 2024 meeting as an information item. The item is placed again on the January 31, 2024 board meeting as a consent information item. Christy White, SCCOE's external auditing firm will be attending the February 7, 2024 board meeting to address questions, if any about the 2022-2023 SCCOE Audit Report.
