[A. The Santa Clara County Board of Education (SCCBOE) recognizes ten (10) SCCOE employees each year for outstanding service to students, parents, coworkers, and customers.]

AND THEIR SUPERVISOR TO THE PODIUM.

TRUSTEES AND DOCTOR DEWAN, AFTER THE EMPLOYEE OF THE MONTH IS INTRODUCED AND HONORED, I WILL ASK YOU TO PLEASE JOIN US AT THE PHOTO BACKDROP.

THANK YOU.

AND YEAH, I.

ALL RIGHT, SO OUR EMPLOYEE OF THE MONTH, THE SANTA CLARA COUNTY COUNTY BOARD OF EDUCATION RECOGNIZES TEN SANTA CLARA COUNTY OFFICE OF EDUCATION SCCOE EMPLOYEES EACH YEAR FOR OUTSTANDING SERVICE TO STUDENTS, PARENTS, COWORKERS, AND CUSTOMERS.

[00:05:02]

BERNADETTE O'DONNELL, STUDENT SERVICES SPECIALIST IN THE SPECIAL EDUCATION DEPARTMENT AT THE SANTA CLARA COUNTY OFFICE OF EDUCATION, IS FEBRUARY'S EMPLOYEE OF THE MONTH. BERNADETTE HAS WORKED AT THE SCCOE FOR SEVEN YEARS, AND IN THAT DURATION, SHE HAS CONSISTENTLY DEMONSTRATED DEDICATION TO THE SCCOE'S MISSION AND GOALS. AFTER SPENDING TIME RAISING HER CHILDREN, BERNADETTE WANTED TO REENTER THE WORKFORCE IN A CAREER THAT GAVE BACK.

SHE FIRST WORKED FOR THE SCCOE AS A SUBSTITUTE IN 2012, SPENDING TIME IN ACCOUNTING SERVICES AND HUMAN RESOURCES, WHICH INCLUDED COVERING THE FRONT DESK AT RITTER PARK.

AFTER BEING OFFERED A FEW DIFFERENT POSITIONS, BERNADETTE FOUND THE SPECIAL EDUCATION DEPARTMENT TO BE THE BEST FIT FOR HER.

BERNADETTE SPENDS HER DAY PROCESSING INVOICES AND REPORTS, COORDINATING WITH DISTRICTS, AND MAINTAINING STUDENT RECORDS.

SHE ALSO WORKS WITH THE SCHOOL OFFICE COORDINATORS AND ADMINISTRATIVE ASSISTANTS, PROVIDING DIRECTIONS AND COMPUTER SOFTWARE SUPPORT TO INSTRUCTIONAL PROGRAMS WITHIN THE SPECIAL EDUCATION DEPARTMENT.

BERNADETTE LEANS INTO HER TOP STRENGTHS OF RELATOR AND INDIVIDUALIZATION TO HELP HER COLLEAGUES.

EVERYTHING THAT I DO, THIS IS WHAT SHE SAYS.

EVERYTHING THAT I DO IS FINE TUNED TO THE PERSON THAT I'M WORKING WITH.

IT DEPENDS ON WHAT THEIR NEED IS, SAID BERNADETTE.

DOCTOR JEN ANNE, EXECUTIVE DIRECTOR OF SPECIAL EDUCATION DEPARTMENT, SHARED THAT BERNADETTE IS ATTENTIVE TO FAMILIES AND STAFF AND EXERCISES COMPASSION THROUGHOUT HER WORK. SHE ENSURES THAT ALL FUNDS ARE USED APPROPRIATELY AND THAT EVERY DOLLAR IS STRETCHED TO SERVE STUDENTS TO THE FULLEST EXTENT POSSIBLE, SAID DOCTOR ANNE.

SHE TAKES GREAT CARE IN FOLLOWING ALL REGULATIONS AND OFTEN BRINGS IDEAS FORWARD TO IMPROVE SYSTEMS AND PROCESSES.

IT IS WITH GRATITUDE THAT WE CONGRATULATE BERNADETTE ON BEING RECOGNIZED AS FEBRUARY'S EMPLOYEE OF THE MONTH.

[APPLAUSE] AS WITH ALL EMPLOYEES OF THE MONTH, WE ACKNOWLEDGE BERNADETTE FOR HER OUTSTANDING SKILLS AND ACCOMPLISHMENTS ON THE JOB, DEDICATION TO EXCEPTIONAL SERVICE TO CUSTOMERS, CONTRIBUTIONS OUTSIDE THE USUAL SCOPE OF THE JOB, AND OVERALL COMMITMENT TO EXCELLENCE.

TO SHOW OUR APPRECIATION, BERNADETTE WILL RECEIVE A PLAQUE RECOGNIZING HER CONTRIBUTIONS TO THE SCCOE, AND ENGRAVED CROSS PEN.

AND A RESERVED PARKING SPOT, CONGRATULATIONS, BERNADETTE.

THANK YOU SO MUCH FOR ALL YOU DO.

WE'LL INVITE DOCTOR ANNE AND BERNADETTE IF YOU'D LIKE TO SAY ANYTHING.

I THINK THIS IS THE MOST NERVOUS I'VE BEEN PUBLIC SPEAKING, BECAUSE I'M SO CONCERNED THAT I'M NOT GOING TO SAY THE RIGHT WORDS TO REALLY JUST SHARE HOW INCREDIBLE OF A HUMAN BERNADETTE IS.

SHE IS SO KIND, AND I KNOW SHE IS NERVOUS, WHICH MAKES ME NERVOUS, BUT I FEEL THAT PIECE OF SHE CARES SO MUCH ABOUT STUDENTS, SO MUCH ABOUT STUDENTS, AND SHE IS SO QUICK TO COME UP WITH IDEAS OR WAYS THAT WE CAN, LIKE I SAID, STRETCH OUR DOLLAR. BUT I WANT TO SAY I WISH SHE COULD FIX MY BUDGET.

SHE'S SO INCREDIBLE IN TERMS OF WHAT SHE CAN DO FOR OUR STUDENTS AND THE PASSION THAT SHE HAS FOR HER WORK AND HER DEDICATION.

SHE ALWAYS SHOWS UP TO WORK, SHE LOVES HER WORK, AND SHE ALSO LOVES HER FAMILY.

AND WE GET TO HEAR LITTLE FAMILY STORIES TOO.

SO SHE'S A WONDERFUL PERSON.

AND THERE'S JUST NO WAY MY NOTES COULD DESCRIBE THAT ENOUGH.

I'M SORRY. THANK YOU SO MUCH FOR THIS INCREDIBLE HONOR.

I FEEL PRIVILEGED TO WORK WITH JENNIFER ANNE, DOCTOR JENNIFER ANNE AND THE REST OF THE SPECIAL EDUCATION TEAM.

THEY'RE AMAZING PEOPLE, AND I'M ALWAYS HAPPY TO HELP.

THANK YOU AGAIN.

TRUSTEES IF YOU'D LIKE TO JOIN FOR A PICTURE.

[00:11:26]

CONGRATULATIONS AGAIN, BERNADETTE.

NEXT WE WILL HEAR FROM OUR STUDENT BOARD MEMBER.

[A. The student member of the Board may give reports on activities related to their duties as a member of the Santa Clara County Board of Education]

AT THIS TIME, I INVITE STUDENT BOARD MEMBER DE LA ROSA AGUILERA TO GIVE A REPORT.

GOOD EVENING AND BERTA SUPERINTENDENT, DOCTOR DEWAN AND ESTEEM BOARD MEMBERS.

TODAY I WANTED TO SHARE MY POINT OF VIEW ON BEING A STUDENT AT OSBORNE HIGH SCHOOL.

DUE TO US STUDENTS BEING INCARCERATED, THERE ARE LIMITS FOR OUR SCHOOL, BUT OVERALL, OSBORNE TREATS US LIKE ANY OTHER STUDENT IN SANTA CLARA.

OSBORNE STAFF NEVER JUDGES US BASED ON OUR LOOKS OR HISTORY.

OSBORNE HIGH SCHOOL PROVIDES A SAFE ENVIRONMENT, TEACHERS WHO PROMOTE LEARNING FOR ALL STUDENTS, AND CLASSROOMS THAT ARE ALWAYS INTERACTIVE AND HOLD NO JUDGMENT.

A TYPICAL DAY IN OSBORNE IS ALWAYS FUN.

FIRST PERIOD BEGINS AT 8:30 A.M.

AND SIXTH PERIOD ENDS AT 2:50 P.M..

DURING THOSE PERIODS, TEACHERS ALLOW US TO TAKE SMALL BREAKS TO NOT OVERWHELM OUR MINDS AND ARE ALWAYS CHECKING IN ON US AND HOW WE ARE TAKING THE INFORMATION.

THERE ARE A LOT OF DIFFERENT PROGRAMS OFFERED AT OSBORNE HIGH SCHOOL.

FOR INSTANCE, THERE IS AN ART CLASS OFFERED THROUGHOUT THE WEEK AND A MUSIC CLASS FOR THOSE WHO WANT TO PURSUE THEIR DREAMS IN THE MUSIC INDUSTRY.

THERE'S EVEN A CHANCE FOR US TO HAVE A CULINARY PROGRAM, WHICH IS STARTING NEXT WEEK.

OSBORNE HAS PROVIDED US WITH A WONDERFUL LIBRARY AND EVEN THE OPPORTUNITY TO MEET WITH SOME AUTHORS.

OUR LIBRARY GIVES US ALL THE BOOKS WE NEED, AND IT HAS ALL THE SUBJECTS THAT WE CAN LEARN ABOUT.

HERE AT OSBORNE SCHOOL, WE ALSO HAVE THE OPPORTUNITY TO BE DULY COLLEGE STUDENTS.

THERE ARE ALSO DIFFERENT CTE COURSE OFFERINGS SUCH AS HORTICULTURE AND AQUAPONICS.

I AM AWARE THAT THERE IS A PRESENTATION ABOUT THE SOLID PROJECT UPDATES LATER ON IN THIS MEETING.

I AM HAPPY TO SEE THIS PROCESS AND FOR THE [INAUDIBLE] STUDENTS TO GET THEIR HANDS ON EXPERIENCE AND PAID JOB OPPORTUNITIES.

I LOOK FORWARD TO HEARING FROM THE STUDENTS WHO WORK IN EARNER SHIP.

IN HONOR OF NATIONAL SCHOOL COUNSELOR WEEK, I WANTED TO THANK THANK MICHELLE DECARO FOR GIVING ME MANY OPPORTUNITIES THROUGHOUT MY SENTENCING.

I ALSO WANTED TO THANK MAGGIE BLANCO FOR BEING MY PERSONAL MENTOR AND GUIDING ME THROUGH THE RIGHT PATH.

THANK YOU. THANK YOU.

STUDENT BOARD MEMBER DE LA ROSA AGUILAR FOR YOUR REPORT.

WE APPRECIATE THE INSIGHT THAT YOU'RE GIVING US ON OSBORNE SCHOOL AS WELL, AND WE LOOK FORWARD TO HEARING FROM YOU AT EACH OF OUR MEETINGS.

WE WILL NOW MOVE ON TO ITEM FOUR.

[A. Santa Clara County Office of Education 2022-23 Annual Financial Audit Report]

WHICH IS OUR INFORMATION ITEM.

DOCTOR DEWAN, WILL YOU PLEASE INTRODUCE THIS ITEM? YES. THANK YOU, PRESIDENT BERTA.

AND GOOD EVENING TRUSTEES AND COMMUNITY.

IN ACCORDANCE WITH THE EDUCATION CODE 41020.3, AN ANNUAL AUDIT OF THE FINANCIAL RECORDS OF THE COUNTY OFFICE OF EDUCATION WAS CONDUCTED FOR THE FISCAL YEAR THAT ENDED IN JUNE 30TH OF 2023.

THE AUDITORS ISSUED AN OPINION ABOUT OUR FINANCIAL STATEMENTS AND OUR AUDITOR IS PRESENT HERE THIS EVENING.

THE 2223 SEC AUDIT REPORT WAS PLACED ON THE BOARD AGENDA FOR THE JANUARY 10TH MEETING AS AN INFORMATION ITEM AND AGAIN ON THE JANUARY 31ST, 2024 BOARD MEETING AS CONSENT INFORMATION.

THIS EVENING, HEATHER, FROM CHRISTIE WHITE, OUR EXTERNAL AUDITING FIRM, IS ATTENDING TO ANSWER ANY QUESTIONS THAT MAY BE PRESENT FOR THE BOARD.

[00:15:01]

AND SO I'D LIKE TO TURN TO OUR ASSISTANT SUPERINTENDENT GOMEZ.

OKAY. GOOD EVENING AGAIN.

JUST HAPPY TO ANNOUNCE THAT OUR AUDIT REPORT WAS COMPLETED SUCCESSFULLY.

WE HAD A CLEAN AUDIT OPINION, MEANING THAT ALL THE INFORMATION WAS PRESENTED FAIRLY AND ACCURATELY.

I HAVE HEATHER HERE THAT'S HERE TO ANSWER ANY QUESTIONS.

SO I WILL OPEN IT UP FOR ANY QUESTIONS.

THANK YOU. DO YOU HAVE ANY QUESTIONS OR WOULD YOU LIKE ME TO GO OVER A SMALL.

I THINK IF YOU COULD PRESENT YOUR REPORT AS WELL.

AND AND THEN WE CAN TURN IT TO QUESTIONS.

PERFECT. SO AGAIN, WE LEAD AUDITOR ON THE 2023 FINANCIAL STATEMENT AUDIT.

AND I JUST WANTED WHAT I WAS GOING TO PLAN TO DO IS GO OVER THE OPINIONS WE HAVE ON YOUR FINANCIAL STATEMENTS AND SOME OF THE PROCEDURES WE DO TO GET THERE.

TO START OFF, I WOULD TURN TO PAGE ONE.

I CONSIDER IT THE MOST IMPORTANT PART OF THE AUDIT REPORT.

IT'S THE AUDITOR'S OPINION.

SO THE SECOND PARAGRAPH SAYS IN OUR OPINION, WE BELIEVE THESE FINANCIALS ARE PRESENTED TO YOU FAIRLY OR MATERIAL FAIRLY IN ALL RESPECTS.

THIS IS THE UNAUDITED ACTUALS THAT YOU RECEIVE.

SO YOU LOOK AT THE BUDGET THE UNAUDITED ACTUALS.

AND WE AUDIT THOSE NUMBERS.

AND TO GET FEEL COMFORTABLE WITH THOSE NUMBERS WE DO THINGS LIKE WE LOOK AT CASH.

AND SO IF YOU SAY CASH IS 5 MILLION WE MAKE SURE WE CONFIRM WHAT THE COUNTY TREASURY THAT CASH IS 5 MILLION.

WE LOOK AT REVENUES AND YOUR THAT INCLUDES YOUR LCF CALCULATIONS, PROPERTY TAXES AND ALL THE DIFFERENT GRANTS AND PROGRAMS YOU RECEIVE, AND SO WE AUDIT THAT.

EXPENSES. THE HEAVIEST EXPENSE FOR COUNTY OFFICE OF ED IS PAYROLL.

AND SO WE LOOK AT THAT VERY CLOSELY.

ALL YOUR CONTRACTS PUBLIC CONTRACT CODE.

SO I CAN NAME IT'S JUST KIND OF A FEW YOUR JOURNAL ENTRY PROCESS.

AND SO WE'RE LOOKING AT THE CONTROLS OVER THOSE PROCESSES AND TESTING THEM, PULLING A NUMBER OF SAMPLES FOR EACH OF THESE ITEMS TO FEEL COMFORTABLE WITH THESE NUMBERS AND TO DETERMINE IF WE HAVE ANY ADJUSTMENTS.

I'M HAPPY TO SAY THAT WE HAD NO SIGNIFICANT DEFICIENCIES, NO MATERIAL WEAKNESSES, AND YOU RECEIVED AN UNMODIFIED OPINION, WHICH IS REALLY THE BEST OPINION YOU CAN GET ON YOUR FINANCIAL STATEMENTS.

IT'S LIKE AN A PLUS IF YOU ARE GRADING.

SO BECAUSE YOU'RE A COUNTY OFFICE OF ED, A LOCAL EDUCATION AGENCY, YOU'RE ALSO SUBJECT TO TWO MORE AUDITS, RIGHT? SO THERE'S, YOU KNOW, ALL MONEY COMES WITH CONDITIONS.

AND THOSE TWO AUDITS, ONE COMES FROM THE FEDERAL GOVERNMENT.

SO YOU RECEIVE LAST YEAR NOT RECEIVED, YOU SPENT $85 MILLION IN FEDERAL FUNDS.

OR YOU KNOW, SOME OF IT PASSES THROUGH.

THE OFFICE OF MANAGEMENT AND BUDGET HAS THEIR OWN AUDIT GUIDE AND REQUIREMENTS ON WHAT WE HAVE TO DO FOR THAT.

SO WE SELECTED YOUR ESSER AND GEAR FUNDS AND YOUR SPECIAL EDUCATION FUNDS.

AND REALLY IT'S JUST REALLY HEAVY, HEAVY EXPENDITURE TESTING TO DETERMINE IF IT'S ALLOWABLE.

WE PULL A NUMBER OF SAMPLES AND MAKE SURE THAT THE BASICALLY YOU SPENT THE FUNDS CORRECTLY, YOU KNOW, WHAT'S ALLOWABLE, AND YOU ALSO KNOW SIGNIFICANT DEFICIENCIES OR MATERIAL WEAKNESSES IN THAT AREA.

SO YOU HAVE AN UNMODIFIED OPINION, WHICH IS THE BEST OPINION YOU CAN GET ON YOUR FEDERAL FUNDS.

THE FINAL PIECE OF THE AUDIT IS YOUR STATE COMPLIANCE AUDIT.

A REALLY HARD AREA, REALLY, TO GET A PERFECT SCORE IN FOR TWO REASONS.

ONE, THE STATE DOES NOT HAVE A MATERIALITY THRESHOLD.

TWO, STATE COMPLIANCE CHANGES EVERY YEAR, EVERY TIME A NEW BILL LIKE JUST TODAY, I THINK THERE'S A TRAILER BILL AND THERE'S A HAY AND IT WILL BE AUDITED THIS WAY.

IT'S ALWAYS ADDED IN THERE.

SOMETIMES THAT AUDIT REQUIREMENT AND WHAT YOU HAVE TO DO IS AUDITED.

IT'S PUT IN THERE EVEN AFTER YOU IMPLEMENTED THE PROGRAM.

THINK OF DISTANCE LEARNING, INDEPENDENT STUDY.

SO THIS YEAR, I'M HAPPY TO REPORT THAT YOU ALSO HAD NO SIGNIFICANT DEFICIENCIES OR MATERIAL WEAKNESSES IN THAT AREA OR INSTANCES OF NONCOMPLIANCE, WHICH IS REALLY GOOD. AND REALLY, WHAT YOU GUYS HAVE DONE AND WHAT I'VE NOTICED THAT YOU DO AS A COUNTY OFFICE OF ED IS YOU ASK QUESTIONS, WHICH I THINK IS THE MOST IMPORTANT PART OF BEING COMPLIANCE IN THOSE AREAS.

SO YOU DO GOOD AT SAYING, HEY, THIS IS WHAT WE'RE DOING.

WE WANT TO GET YOUR THOUGHTS.

THIS IS CORRECT. HOW DOES THIS LOOK? AND SO OVERALL YOU DID A GREAT JOB.

THANK YOU SO MUCH FOR THE OVERVIEW.

TRUSTEES, ARE THERE ANY QUESTIONS? COMMENTS? VICE PRESIDENT.

I FEEL INCLINED TO ASK A QUESTION, BUT I DON'T HAVE ANY PREPARED, SO I'M SORRY.

THANK YOU. WELL, WE APPRECIATE YOU BEING HERE AGAIN TO SHARE THAT UPDATE AND GOOD NEWS WITH US.

OKAY. ALL RIGHT.

IT'S I BELIEVE.

SO THAT DOES CONCLUDE THAT ITEM.

AND SO WE AGAIN THANK YOU FOR BEING HERE.

OKAY. THANK YOU.

SO NOW WE WILL MOVE ON TO ITEM FIVE, WHICH IS OUR PUBLIC COMMENTS.

NOW IS THE TIME.

[00:20:03]

YES. AND BEFORE I MOVE TO PUBLIC COMMENTS, I WOULD LIKE TO EXCUSE STUDENT BOARD MEMBER DE LA ROSA AGUILERA.

STUDENT BOARD MEMBER DE LA ROSA AGUILERA, I APPRECIATE YOU JOINING US AND YOUR SERVICE ON OUR BOARD AND FOR YOUR REPORT AND PREPARATION TONIGHT.

OUR FIRST SPEAKER IS DAVID PUTNEY.

CLEARLY. STATE YOUR NAME AND PRESENT YOUR COMMENT.

GOOD EVENING. MY NAME IS DAVID PUTNEY, DIRECTOR OF SPECIAL PROJECTS HERE AT THE SANTA CLARA COUNTY OFFICE OF ED, AND I'M SPEAKING AS A COMMUNITY MEMBER.

I'D LIKE TO TAKE THIS TIME JUST TO EXPRESS MY APPRECIATION AND ACKNOWLEDGMENT OF DOCTOR DEWAN'S LEADERSHIP HERE AT SANTA CLARA COUNTY OFFICE OF ED.

I'VE BEEN HERE FOR SEVEN, OVER SEVEN YEARS, AND I'VE SEEN HER ABILITY TO SUPPORT AND GUIDE ALL THE DIVISIONS OF THE SANTA CLARA COUNTY OFFICE OF ED IN AN EXCEPTIONAL MANNER.

IT'S AS EVIDENT IN THE FINDINGS OF THE AUDIT, ILLUSTRATES HER CAPACITY TO SUPPORT THE BUSINESS OFFICE AND THEIR ABILITY TO MEET THEIR FISCAL OBLIGATIONS AND RESPONSIBILITIES.

THE EXPANSION OF A PROFESSIONAL LEARNING DIVISION TO SUPPORT INSTRUCTIONAL SERVICES ACROSS THE COUNTY IS EXCEPTIONAL AND UNMATCHED ACROSS THE STATE OF CALIFORNIA.

AS A RESULT, THE STATE OF CALIFORNIA, WE'RE SUPPORTING MENTORSHIP IN WAYS OF COMMUNITY SCHOOLS AND SOCIAL EMOTIONAL MENTAL HEALTH, SUPPORT FOR EMERGENCY ASSISTANCE TO LEARNING LOSS ACROSS MULTIPLE PLATFORMS. DOCTOR DEWAN IS AN EXCEPTIONAL LEADER AND I'M SO APPRECIATIVE AND THANKFUL FOR HER LEADERSHIP.

THANK YOU. OUR NEXT SPEAKER IS REED MEYERS.

PLEASE CLEARLY STATE YOUR NAME AND PRESENT YOUR COMMENT.

HI, I'M REED MEYERS AND I'VE WORKED WITH DOCTOR DEWAN IN MANY CAPACITIES FOR OVER TEN YEARS.

HER REVIEW HAS BEEN ON YOUR AGENDA MULTIPLE TIMES AND YOU'VE HIRED A LAWYER.

I KNOW HER WORK ETHIC, HER HEART, AND HER STRONG DESIRE TO DO WHAT'S RIGHT FOR KIDS, BUT I'M FAR FROM ALONE.

COUNTLESS PEOPLE WHO HAVE SEEN AND FELT THE DIRECT IMPACT OF HER GOOD WORK HAVE TAKEN TIME TO SPEAK AND WRITE TO YOU ON HER BEHALF.

[00:25:06]

DEDICATED EMPLOYEES HAVE TOLD YOU SHE IS THE REASON THEY ARE HERE.

50 OF OUR SANTA CLARA COUNTY TRUSTEES HAVE SIGNED A LETTER IN SUPPORT OF HER GOOD WORK.

PARTNERS HAVE SHARED THE SUCCESSES THEY HAVE HAD WITH DOCTOR DEWAN AND HER STAFF.

PARENTS, ELECTED OFFICIALS AND COMMUNITY MEMBERS HAVE HEARTFULLY SUPPORTED HER.

ALL I CAN ASK MYSELF IS, WHY WOULD YOU CONSIDER LETTING GO OF SUCH A WELL RESPECTED LEADER? IT TAKES A STRONG LEADER LIKE DOCTOR DEWAN TO SOLVE ISSUES AND RIDE OUT HARD TIMES.

SHE'S PROVEN THIS IN THE PAST AND SHE CAN CONTINUE TO PROVE IT WITH YOUR SUPPORT.

I'M SAD FOR THE STUDENTS, SAD FOR THE EMPLOYEES, AND SAD FOR THE COMMUNITY.

I'M FRUSTRATED WITH THE TIME AND PUBLIC FUNDS YOU'RE PUTTING INTO THIS PROCESS.

WHATEVER HAPPENS, LET THE RECORD SHOW.

OUR NEXT SPEAKER IS SARAH GENICHIRO.

PLEASE APPROACH THE PODIUM CLEARLY, STATE YOUR NAME AND PRESENT YOUR COMMENT.

OCCUPATIONAL THERAPIST AND SEIU CHAPTER PRESIDENT.

HOW WOULD YOU FEEL IF YOU WORKED FOR AN ORGANIZATION CLAIMING TO VALUE OUR WORKFORCE, YET THE [INAUDIBLE] MANAGERS WHO SPEAK DURING PUBLIC COMMENT GIVE THE SUPERINTENDENT CREDIT FOR THE WORK THAT YOU AND YOUR COWORKERS DO.

HOW WOULD YOU FEEL IF YOU, LIKE US, HAD AN ASSISTANT SUPERINTENDENT CALL YOUR SUPERVISOR TWICE TO QUESTION WHY YOU LEFT TEN MINUTES EARLY DUE TO THE STORMS, EVEN THOUGH YOU REPORT TO WORK 15 TO 30 MINUTES EARLY AND YOUR SUPERVISOR APPROVED IT.

HOW WOULD YOU FEEL IF YOU, LIKE US, KNEW THAT MANAGEMENT HAS THE FLEXIBILITY TO WORK FROM HOME FOR A VARIETY OF CIRCUMSTANCES, BUT YOU CANNOT, OR THAT YOUR DOCTOR'S NOTE IS ACCEPTED FOR TEN DAYS, BUT NOT THE ENTIRE DURATION WITHOUT EXPLANATION.

HOW DO YOU EXPECT CO WORKERS TO CONTINUE TO WORK UNDER THESE INEQUITABLE, DISHEARTENING CONDITIONS? ALL LEVELS OF MANAGEMENT, INCLUDING THE SUPERINTENDENT, NEED TO BE TRANSPARENT AND ACCOUNTABLE FOR SYSTEMS THAT OPPRESS THE WORKERS.

WE DON'T ASK FOR PERFECTION, BUT WE WON'T ACCEPT THE LIES REFUSAL TO ACKNOWLEDGE ISSUES AND FAILURE TO ADDRESS MISTAKES IN A TIMELY MANNER.

WE IMPLORE THE BOARD TO ENSURE THAT THE EVALUATION PROCESS INCLUDES STAKEHOLDER INPUT.

VALUES THE EXPERIENCE OF THE WORKERS, SETS CLEAR GOALS AND OBJECTIVES FOR ANY SUPERINTENDENT, AND CREATES A STRUCTURE OF ACCOUNTABILITY AND EQUITY.

OUR NEXT SPEAKER IS RITU KRISHNA.

PLEASE APPROACH THE PODIUM, CLEARLY STATE YOUR NAME AND PRESENT YOUR COMMENT.

I'M RAJAKRISHNAN AND I WORK AS A TEACHER COE.

THANK YOU TO SEIU AND ACE WORKERS WHO HAVE HELPED COMPLETE ALL THE WONDERFUL PROJECTS AND ENDEAVORS THAT HAVE MADE SCCOE SHINE.

THANK YOU TO ASSISTANT SUPERINTENDENT TERESA SHIP AND YOUR TEAM FOR ADDRESSING THE RECENT POWER OUTAGES AT THE SCHOOL SITES.

THANK YOU, BOARD MEMBERS FOR LISTENING AND CARING.

AND THANK YOU, DOCTOR DEWAN FOR RESOLVING SEVERAL RECENT ISSUES.

WHILE I HAVE MUCH TO BE THANKFUL FOR.

I AM ALSO EXTREMELY FRUSTRATED AND SAD THAT THESE ISSUES WERE RESOLVED ONLY AFTER THEY WERE BROUGHT TO YOU DOCTOR DEWAN.

WE SHOULD NOT HAVE TO TAKE THESE ISSUES TO YOU.

WHY ISN'T THERE ACCOUNTABILITY AND TRANSPARENCY IN OUR MANAGEMENT? ALL LEVELS OF WORKERS AND MANAGEMENT, INCLUDING OUR SUPERINTENDENT, NEED TO BE TRANSPARENT AND ACCOUNTABLE FOR SYSTEMS. I'M NOT BLAMING YOU, DOCTOR DEWAN.

I RESPECT YOU AND I DO ADORE YOU.

BUT AS THE CAPTAIN OF THIS SHIP, WHO ELSE DO WE TURN TO TO FIX THIS CULTURE THAT ACCEPTS THE LIES, REFUSES TO ACKNOWLEDGE ISSUES, AND FAILS TO ADDRESS CONCERNS IN A TIMELY MANNER? MORE IMPORTANTLY, YOU ARE THE ONE THAT CAN CHANGE THIS CULTURE.

THE TIME FOR ACCOUNTABILITY IS NOW.

PLEASE HELP. OUR NEXT SPEAKER IS YI YUAN.

PLEASE APPROACH THE PODIUM, CLEARLY STATE YOUR NAME AND PROVIDE YOUR COMMENT.

GOOD AFTERNOON. MY NAME IS YI YUAN.

I'M THE DIRECTOR OF STATE AND REGIONAL PROJECTS HERE AT THE SCCOE.

I'M HERE BECAUSE I FEEL COMPELLED TO SHARE MY EXPERIENCE, BOTH AS AN EMPLOYEE FOR 25 YEARS AND AS A RESIDENT OF SAN JOSE.

DURING DOCTOR DEWAN'S TENURE, SHE HAS POSITIONED THE SCCOE TO BE THE LEAD AGENCY ON MULTIPLE STATEWIDE AND REGIONAL INITIATIVES TO ADDRESS THE GAPS IN ACHIEVEMENT AMONG OUR MOST VULNERABLE STUDENT GROUPS.

I'M GRATEFUL TO DOCTOR DEWAN'S LEADERSHIP IN SUPPORT OF OUR STUDENTS.

OUR STATE AGENCY PARTNERS FREQUENTLY SEEK TESTIMONIALS FROM DOCTOR DEWAN TO SHARE WITH OUR STATEWIDE EDUCATIONAL COMMUNITY.

BECAUSE THEY VALUE HER EXPERTISE AND HER LEADERSHIP, I RESPECTFULLY REQUEST THE BOARD TO CONSIDER THE POSITIVE IMPACT OF DOCTOR DEWAN'S EXEMPLARY LEADERSHIP AT THE LOCAL, REGIONAL AND STATEWIDE LEVEL, WHICH HAS BEEN CONSISTENTLY SHARED BY MANY DIFFERENT STAKEHOLDERS.

THANK YOU. OUR NEXT SPEAKER IS DOUGLAS RICE.

PLEASE APPROACH THE PODIUM CLEARLY, STATE YOUR NAME AND PRESENT YOUR COMMENT.

THANK YOU. MY NAME IS DOUGLAS RICE.

I'M THE REGIONAL VICE PRESIDENT OF CAL PILOTS AND A RESIDENT OF LOS GATOS.

MY PURPOSE IN SPEAKING BEFORE YOU TODAY IS TO RESPOND TO THE OFFICE OF EDUCATION STAFF, WHO SPOKE AT THE SANTA CLARA COUNTY SUPERVISORS MEETING ON DECEMBER 12TH REGARDING THE FUTURE CLOSURE OF REID-HILLVIEW AIRPORT.

THEIR COMMENTARY INDICATED THAT THE CLOSURE OF THE AIRPORT REMOVED THE LEAD HAZARD AND BENEFIT THE COMMUNITY BY PROVIDING IMPROVED EDUCATIONAL OPPORTUNITIES.

THERE SEEMS TO BE A MISUNDERSTANDING ON THE PART OF THE OFFICE OF EDUCATION THAT AIRBORNE LED FROM THE AIRPORT IS IMPACTING THE COMMUNITY.

IT IS NOT OVER 80% OF THE AIRCRAFT OPERATIONS AT REID-HILLVIEW NOW USE UNLEADED FUEL.

[00:30:02]

ON OCTOBER 21ST, SORRY.

AUGUST 2021, THE SCCOE EXPENDED ITS OWN FUNDS AND RELEASED A WHITE PAPER ON CHILD'S EXPOSURE TO LEAD, LISTING LEADED AVIATION FUEL AS THE LARGEST REMAINING SOURCE OF LEAD EMISSIONS IN THE US.

THAT'S NO LONGER TRUE.

REID-HILLVIEW HAS BEEN UNLEADED COMPLETELY FOR OVER TWO YEARS.

OUR NEXT SPEAKER IS KAREN LARSON.

PLEASE APPROACH THE PODIUM, CLEARLY, STATE YOUR NAME AND PROVIDE YOUR COMMENT.

GOOD EVENING, TRUSTEES AND DOCTOR DEWAN.

MY NAME IS KAREN LARSON AND I AM A LIFELONG SANTA CLARA COUNTY RESIDENT, A REGISTERED VOTER, AND AN EMPLOYEE HERE AT THE SANTA CLARA COUNTY OFFICE OF EDUCATION.

I'VE BEEN WITH THE COUNTY OFFICE FOR TEN YEARS NOW, AND I'VE ENJOYED WORKING IN THE ENVIRONMENT THAT HAS ALLOWED CREATIVITY, INNOVATION, AND PERSONAL GROWTH FOR THOSE WHO WORK HERE. UNDER DOCTORS DEWAN LEADERSHIP, OUR TEAMS HAVE SUPPORTED THE COUNTY'S STUDENTS AND PROJECTS THAT INCLUDE BRIDGING THE DIGITAL DIVIDE, GUIDING CONTINUOUS IMPROVEMENT, PROVIDING HEALTH AND WELLNESS, BUILDING COLLEGE PATHWAYS AND CAREER READINESS, AS WELL AS PROFESSIONAL LEARNING THAT'S ROOTED IN OUR CORE PRINCIPLE OF EQUITY.

MY EXPERIENCES HAVE MADE ME A BETTER EDUCATOR AND EMPATHETIC LEADER, AND I ATTRIBUTE THAT TO DOCTOR DEWAN AND HER PERSONAL DEDICATION TO MAKING THIS COUNTY A BETTER PLACE FOR OUR CHILDREN AND OUR EDUCATORS.

THANK YOU. OUR NEXT SPEAKER IS PATRICIA ALONSO.

PLEASE CLEARLY STATE YOUR NAME AND PRESENT YOUR COMMENT.

GOOD EVENING. MY NAME IS PATRICIA ALONSO.

[00:35:11]

HMM'HMM. YEAH.

HA HA HA! OH. OH, HEY HEY HEY HEY.

OUR NEXT SPEAKER IS FABIOLA BOTTAS.

CLEARLY STATE YOUR NAME AND PRESENT YOUR COMMENTS.

SO I'M FABIOLA BOTTAS. MOTHER OF ALEXANDER BOTTAS.

LAST WEEK YOU GOT OR LAST TIME WE WERE HERE.

YOU GUYS TALK ABOUT THESE PERFECT SWINGS FOR THESE KIDS AT GATEWAY.

I BROUGHT THE PICTURE SO YOU GUYS CAN SEE.

NOT EVEN ATTACHED TO THE FLOOR.

HE CAN'T EVEN GET ON IT BECAUSE THEY ALL BEND IT IN HIS SHOULDERS, BECAUSE HE HAS A LONG TORSO.

THE AUDACITY TO THEM TO SAY THAT HE SAID THAT HE WAS OKAY WITH THE SWING.

BUT WHEN YOU GUYS CAN TOTALLY SEE THAT HE DOESN'T TALK.

I'M HIS VOICE.

I'M THE ONE HERE TALKING FOR HIM.

AND THEN FOR THEM TO SAY THAT I SAID THAT I WAS OKAY FOR THAT SWING.

ONCE IN THE BEGINNING, I TOLD YOU THAT SWING WAS NOT APPROPRIATE FOR THESE KIDS.

YOU GUYS KEEP GETTING THIS CHEAP MATERIAL, CHEAP THINGS FOR THESE KIDS.

THESE KIDS ARE NOT CHEAP.

THEY'RE WORTH MORE THAN ANY OF US HERE.

THEY'RE SPECIAL.

JUST LIKE ANYBODY HERE IN THE SANTA CLARA COUNTY, WHERE ALL THESE KIDS TREAT THEM THE SAME.

I'M NOT SAYING THAT YOU'RE DOING A JOB, A BAD JOB.

NO, IT SAYS YOU NEED TO PUT THE EMPHASIS IN ALL DEPARTMENTS, ALL THE KIDS, BECAUSE ALL THEY ALL MATTER.

NOT JUST SOME. JUST BECAUSE THEY THEY LIVE IN A RICH PLACE.

OUR NEXT SPEAKER IS CARLOS BOTTAS.

PLEASE APPROACH THE PODIUM, CLEARLY, STATE YOUR NAME AND PROVIDE YOUR COMMENT.

CARLOS BATAS. POUCO.

MY WIFE EXPLAINED SOME.

I HEARD IN OUR LAST MEETING I HEARD THAT PARENTS AND CHILDREN SAID SUPPOSEDLY THAT THE SWINGS WERE OKAY.

OKAY, I AM NOT SAYING THAT YOU GUYS ARE NOT DOING YOUR JOB.

NO, I AM NOT SAYING THAT I RESPECT YOUR JOB, BUT I JUST WANT TO SEE A LITTLE BIT OF A DIFFERENCE.

I ALSO HEAR, YOU KNOW, THE COMMENTS THAT PEOPLE MADE AND I RESPECT THAT TOO ABOUT, YOU KNOW, DOCTORS, THEY WANT JOB.

SHE'S DOING A GOOD JOB BUT THEY ARE JUST READING FROM A PAPER.

VIA EMAIL, YOU KNOW, STATING THINGS LIKE YOU HAVE TO SAY THIS, YOU HAVE TO SAY THAT.

SO IN THOSE CAN YOU JUST LEARN SOMETHING OR MEMORIZE SOMETHING BECAUSE IT'S JUST TWO MINUTES.

GRACIAS. OKAY. THANK YOU.

OUR NEXT SPEAKER IS TINA CHANG.

PLEASE APPROACH THE PODIUM CLEARLY.

STATE YOUR NAME AND PROVIDE YOUR COMMENT.

GOOD EVENING, DOCTOR DEWAN AND MEMBERS OF THE BOARD.

MY NAME IS TINA CHANG, AND, I AM A MEMBER OF THE PACK AND ALSO THE CAC.

IN MY AREA, MY SON EVAN ATTENDS A SPECIAL EDUCATION PROGRAM.

HE WAS BORN HARD OF HEARING AND HAS MEDICAL COMPLEXITIES AND INTELLECTUAL DISABILITIES.

I COME HERE ON HIS BEHALF AND ON BEHALF OF MANY SPECIAL NEEDS KIDS IN OUR COUNTY.

I UNDERSTAND THAT THERE WAS A BUDGET MEETING THIS AFTERNOON AND THAT BUDGETS ARE EXTREMELY DIFFICULT TO DEVELOP, AND SPECIAL EDUCATION IS EXTREMELY EXPENSIVE.

HOWEVER, I ASK THAT YOU CONTINUE TO DIG DEEP TO FIND SOLUTIONS FOR OUR KIDS, TO KEEP OUR PROGRAMS OPEN FOR THIS VERY VULNERABLE POPULATION THAT DO NOT DO WELL IN GENERAL EDUCATION PROGRAMS. AS YOU GO THROUGH CONSOLIDATING YOUR PROGRAMS, PLEASE CONSIDER THE FULL CONTINUUM AND THE NEEDS OF OUR STUDENTS AND TO REALLY SUPPORT THEM IN THEIR

[00:40:06]

IEPS. OUR NEXT SPEAKER IS NADAV KANAREK.

PLEASE APPROACH THE PODIUM, CLEARLY, STATE YOUR NAME AND PROVIDE YOUR COMMENT.

HI, MY NAME IS NADAV KANAREK.

I'M HERE TO TALK ABOUT THE RESOLUTION PASSED ON 1/29.

THE RESOLUTION WAS SO CLOSE TO BEING FAIR ON BOTH SIDES, BUT SINCE THE BOARD INSISTED ON KEEPING THE WORD CEASEFIRE, YOU MADE IT BIASED AND DIVIDING. HAMAS IS NOT EVEN MENTIONED ONCE IN THE RESOLUTION.

FOR SOMEONE WITH NO CONTEXT OUR KIDS, IT MAY APPEAR THAT THERE IS AT BEST EQUAL FAULT BETWEEN HAMAS AND ISRAEL, AND AT WORSE, ISRAEL IS AT FAULT.

SINCE THE BOARD TOOK UPON ITSELF TO COMMENT ABOUT GEOPOLITICAL AFFAIRS, I SEE TWO LOGICAL PATHS FOR THE CITY TO RESOLVE THE SITUATION.

OPTION ONE.

AMEND THE EXISTING RESOLUTION BY EITHER REMOVING THE WORD CEASE FIRE OR ADDING SOME MORE VERBIAGE THAN CONDEMNING HAMAS.

OPTION TWO RELEASING ANOTHER RESOLUTION CONDEMNING HAMAS, WHICH WILL SEND A CLEAR MESSAGE TO OUR CHILDREN..

THAT HAMAS SPEAKER, IS ELIZABETH HALLIDAY.

PLEASE APPROACH THE PODIUM, CLEARLY, STATE YOUR NAME AND PROVIDE YOUR COMMENT.

GOOD EVENING, MY NAME IS ELIZABETH HALLIDAY.

GOOD EVENING, PRESIDENT BERTA AND FELLOW TRUSTEES.

I'M HERE AS A CONSTITUENT OF TRUSTEE AREA THREE AND AS A MOTHER.

AND I HAVE TWO CHILDREN ATTENDING PUBLIC SCHOOLS HERE IN THE COUNTY.

ONE OF THEM HAS AN IEP AND HAS UNIQUE NEEDS.

I HAVE BEEN THRILLED IN MY EXPERIENCE WITH DOCTOR DEWAN TO SEE THAT SHE IS A CHAMPION FOR STUDENTS WITH SPECIAL NEEDS AND FOR ALL STUDENTS.

SHE IS WHAT I WOULD DEEM AN EQUITY WARRIOR.

SHE'S ALSO A CLIMATE WARRIOR AND PROMOTES CLIMATE RESILIENCE IN OUR SCHOOLS AND OUR CAMPUSES.

I HAVE TO LEAVE MY HUNGRY KIDS AT HOME INSTEAD OF MAKING DINNER FOR THEM RIGHT NOW TO COME OUT HERE AND BEG YOU TO PLEASE RESOLVE THIS CONTRACT SITUATION, THIS EVALUATION SITUATION, IT'S GONE ON TOO LONG.

SO THANK YOU FOR YOUR TIME.

THANK YOU FOR YOUR SERVICE.

OUR NEXT SPEAKER IS RONAN VAALSERBERG.

PLEASE APPROACH THE PODIUM CLEARLY, STATE YOUR NAME AND PROVIDE YOUR COMMENT.

HELLO, MY NAME IS RONAN.

I LIVE AND WORK IN THIS COUNTY AND MY CHILDREN GO TO SCHOOL HERE.

I'M ASKING THAT YOU AMEND THE RESOLUTION SPECIFICALLY REMOVING HUDNA WITH SUSTAINABLE PEACE.

HUDNA FROM ARABIC MEANS CALM OR QUIET AND SOMETIMES IS TRANSLATED AS CEASEFIRE.

HUDNA IS HAS A DISTINCT MEANING IN ISLAMIC FUNDAMENTALISTS SUCH AS HAMAS, WELL VERSED IN THEIR HISTORY.

MUHAMMAD STRUCK THE LEGENDARY LEGENDARY HUDNA WITH THE TRIBE THAT CONTROLLED MECCA.

TEN YEARS LATER, MUHAMMAD REARMED BROKE THE HUDNA TO LAUNCH THE FULL CONQUEST OF MECCA, THE HOLIEST CITY IN ISLAM.

IT'S A VERY SPECIFIC WORD.

I WAS VERY SURPRISED THAT IT WAS, WE INSISTED ON KEEPING THIS WORD.

CALLING FOR HUDNA IS VERY DIFFERENT FROM CALLING FOR SUSTAINABLE PEACE AS A BODY RESPONSIBLE FOR EDUCATION, WORDS DO MATTER, AND HUDNA DOES NOT MEAN SAFETY FOR ALL CHILDREN.

PLEASE DO THE RIGHT THING.

THANK YOU. OUR NEXT SPEAKER IS HANNAH.

PLEASE APPROACH THE PODIUM CLEARLY, STATE YOUR NAME AND PROVIDE YOUR COMMENT.

AH EVENING BOARD MEMBERS.

MY NAME IS HANOC RAVIV AND I WOULD LIKE TO NOTIFY THE BOARD ABOUT THE ISLAM POST THAT THE BOARD PRESIDENT DID SEVEN DAYS AGO.

FIRST, I WOULD LIKE TO REMIND YOU, THE BOARD, THAT WE ARE IN THE COUNTY OF SANTA CLARA, IN CALIFORNIA, IN USA, AND NOT IN THE MIDDLE EAST.

I'M SURE YOU ALL KNOW ABOUT IT.

YOU WERE ELECTED TO TAKE CARE OF THE ENTIRE STUDENT IN THE SANTA CLARA COUNTY, NOT ONLY ONE MINORITY OR THE OTHER.

HAVING A MESSAGE SUCH AS SUCH AS IN THE POST VICTORY, SHOW THAT YOU ALL CARE.

ALL YOU CARE ABOUT IS WINNING.

WINNING WHAT? WHO ARE THE WINNERS? WHO ARE THE LOSERS? ARE THERE ANY LOSERS? MAYBE OUR STUDENTS.

THE COLOR OF THE POST OF GREEN, RED AND BLACK IS NOT OUR FLAG.

YOU CAN SEE IT'S BLUE, WHITE AND RED.

WHAT ABOUT THE FIST? WHAT DOES IT MEAN THE FIST AND THE POST IN AN OFFICIAL POST.

THANK YOU. OUR NEXT SPEAKER IS SARIT POLLYWOG.

PLEASE APPROACH THE PODIUM CLEARLY, STATE YOUR NAME AND PROVIDE YOUR COMMENT.

I SORRY, DEAR MEMBER OF THE BOARD, I WANT TO SHARE MY FEELINGS WITH YOU AFTER THE RECENT MEETING.

LATELY, THE ISRAELI-AMERICAN COMMUNITY IN CALIFORNIA HAS BEEN UNDER ATTACK, EVEN THOUGH OUR FAMILIES AND FRIENDS HAS BEEN BRUTALLY ATTACKED BY A BLOODTHIRSTY TERRORIST ORGANIZATION. WE DIDN'T HEAR CONDEMNATION OF HAMAS ACT.

[00:45:01]

INSTEAD, THERE HAS BEEN AN UNJUSTIFIED FOCUS ON ACCUSING THE JEWISH AND ISRAELI COMMUNITY IN THE WAR THAT HAMAS HAS STARTED.

FURTHERMORE, WE ARE FOCUSED TO SIT AND LISTEN FOR OVER TEN HOURS TO FALSE ACCUSATION LIES AND ANTI-SEMITIC CALLS.

THIS IS AN ACT OF MENTAL ABUSE AND A CRIME OF HATE.

WILL YOU LET IT HAPPEN WITH ANY OTHER TOPIC? OUR COMMUNITY HAS BEEN UNFAIRLY ATTACKED BY THE THE POLITICAL FIGURE AND TERRORIST SUPPORTER.

UNDERWHELMING VALUE THAT ARE CRUCIAL TO THE BOARD, SUCH AS EMPATHY, DIVERSITY, INCLUSION AND COMPASSION.

I WANT TO EXPRESS MY GRATITUDE TO THE BOARD MEMBER WHO SHOW MY COMMUNITY, KINDNESS AND COMPASSION, THE ONES THAT HELP BALANCE THE RESOLUTION.

I URGE YOU TO FIX THE INJUSTICE..

CONCLUDES PUBLIC COMMENT.

THANK YOU MODERATOR.

THE BOARD WILL NOW ENTER CLOSED SESSION.

[6. CLOSED SESSION]

WE WILL RETURN IN APPROXIMATELY TWO HOURS..

PRESIDENT BERTA, SORRY TO INTERRUPT.

WE DO HAVE ONE COMMENT CARD FOR THIS ITEM.

THANK YOU MODERATOR.

YES. OKAY.

THE BOARD IS ABOUT TO ENTER CLOSED SESSION.

CLOSED SESSION INVOLVES CONFIDENTIAL INFORMATION.

ONCE IN CLOSED SESSION, I WILL CALL THE CLOSED SESSION TO ORDER AND REQUEST THAT EACH TRUSTEE STATE THEIR NAME TO RECORD WHO IS IN ATTENDANCE, AND TO AFFIRM AN UNDERSTANDING OF THE PARAMETERS FOR THE CONDUCT OF BUSINESS IN THE CLOSED SESSION.

OUR CLOSED SESSION AGENDA INCLUDES TWO ITEMS COUNTY SUPERINTENDENT EVALUATION AND PUBLIC EMPLOYMENT TITLE, SUPERINTENDENT OF SCHOOLS.

MODERATOR, DO WE HAVE COMMENTS ON THESE ITEMS? WE DO. WE HAVE ONE CARD.

OKAY. THANK YOU.

AS THE PUBLIC COMMENT PERIOD IS NOW COMMENCING FOR THIS AGENDA ITEM, WE WILL NOT BE ABLE TO ACCEPT ADDITIONAL COMMENTERS PURSUANT TO GOVERNMENT CODE SECTION 54957.95. THE SCCBOE STRIVES TO MAINTAIN A RESPECTFUL, ORDERLY, AND CIVIL ENVIRONMENT FOR THE CONDUCT OF ITS MEETINGS AND TO AVOID UNLAWFUL DISRUPTIONS.

PLEASE PRESENT THE TIMER.

THANK YOU. A TIMER WILL BE DISPLAYED WHEN THE ALLOTTED TIME IS UP.

THE BUZZER WILL SOUND, YOU WILL BE MUTED, AND YOUR TIME TO SPEAK WILL END.

MODERATOR, YOU MAY BEGIN.

THANK YOU. OUR SPEAKER IS JESSICA SPICER.

PLEASE APPROACH THE PODIUM CLEARLY.

STATE YOUR NAME AND PRESENT YOUR COMMENT.

HI, I'M JESSICA SPICER, AND I'M LEST TRUSTEE AND SCC SBA PRESIDENT, BUT ONLY SPEAK ON MY OWN BEHALF.

TONIGHT. I AM HERE YET AGAIN TO SPEAK REGARDING THE EVALUATION OF DOCTOR DEWAN.

I UNDERSTAND THAT YOU DISCUSSED HER EVALUATION AND TOOK ACTION ON IT LAST WEEK, AND I APPRECIATE THAT YOU'VE MADE SOME HEADWAY.

SO THANK YOU VERY MUCH FOR THAT.

HOWEVER, AS IT RELATES TO DISCUSSING THE SUPERINTENDENT'S EMPLOYMENT WITH LEGAL COUNSEL, I STILL OBJECT TO YOUR NEED TO HAVE THEM INVOLVED IN THE FIRST PLACE, CONSIDERING IT IMPLIES YOU MAY ACTUALLY FIRE HER AND TWO, ALL BY ALL METRICS.

DOCTOR DEWAN HAS PERFORMED A MORE THAN SATISFACTORY JOB THAT ALIGNS WITH THE OFFICE'S AND THE BOARD'S STATED MISSION AND VISION OF PROVIDING ALL STUDENTS IN THE COUNTY WITH AN EQUITABLE, HIGH QUALITY EDUCATION.

THAT BEING SAID, IT'S TIME FOR YOU TO ACTUALLY FINISH HER EVALUATION.

GIVE DOCTOR WAD ANY CONSTRUCTIVE FEEDBACK YOU HAVE AND MOVE ON SO THAT DOCTOR DEWAN THIS OFFICE AND THE BOARD CAN GET BACK TO WORK.

AS I STATED LAST TIME, DOCTOR DEWAN PROTRACTED EVALUATION HAS CAUSED A VERY DESTABILIZING FORCE HERE.

THIS CONCLUDES COMMENT.

THANK YOU.

SO AGAIN THE BOARD WILL NOW ENTER CLOSED SESSION.

WE WILL RETURN IN APPROXIMATELY TWO HOURS ON OR AFTER.

8 P.M..

THANK YOU FOR YOUR PATIENCE.

WE ARE READY TO RESUME OPEN SESSION.

[A. Report of Actions Taken in Closed Session]

UPON COMPLETION OF AGENDA ITEMS SIX A AND B OR CLOSED SESSION ITEMS, THERE ARE NO REPORTABLE ACTIONS.

WE WILL NOW MOVE ON TO CONSENT ACTION ITEMS.

[8. CONSENT ACTION ITEMS]

MOVE TO APPROVE. PRESIDENT BERTA, SORRY TO INTERRUPT.

WE DO HAVE, FIVE CARDS FOR ITEM EIGHT F.

OKAY. I KNOW WE'VE HAD A MOTION FROM TRUSTEE DI SALVO.

IS THERE A SECOND? I'LL SECOND. SECONDED BY TRUSTEE CHON.

AND WE'LL MOVE TO PUBLIC COMMENTS.

MODERATOR. PLEASE PROCEED WITH PUBLIC COMMENTS.

THANK YOU. AS YOU HEAR YOUR NAME, PLEASE LINE UP BEHIND THE PODIUM LOCATED AT THE CENTER OF THE ROOM.

DONNA GOULD, A ROAVILLE, DONNA WALLACH,

[00:50:05]

CHIROC LYNN, KAMAL, T LUONG AND OMAR.

OUR FIRST SPEAKER IS DONNA.

PLEASE CLEARLY STATE YOUR NAME AND PRESENT YOUR COMMENT.

HELLO. MY NAME IS DONNA.

I WAS AN EDUCATOR FOR NINE YEARS WITH CHILDREN WITH LEARNING DIFFICULTIES.

I'M HERE TODAY AS A COMMUNITY MEMBER TO SPEAK OUT ABOUT DOXING.

DOXING IS NOT SOMETHING NEW TO PALESTINIANS.

STUDENTS, SORRY.

WHY SHOULD WE NOT BE ALLOWED TO SPEAK OUT ABOUT GENOCIDAL INJUSTICES? WHY SHOULD THEY BE HARASSED AND HAVE THEIR IDENTITY REVEALED BECAUSE THEY ARE SPEAKING OUT ABOUT THESE INJUSTICES AND WAR CRIMES? DOXING HAS BECOME A TOOL IN THE WAR OF RIVAL HACKERS, DOXING THOSE WHO HOLD OPPOSING VIEWS.

THEIR JOBS ARE AT RISK, THEIR PERSONAL PHONE NUMBERS, PERSONAL PHOTOS, THREATS, ETC.

REGARDLESS OF MOTIVATION, THE CORE PURPOSE OF DOXING IS TO VIOLATE PRIVACY.

IT CAN RUIN LIVES.

WE ARE VOICING OUR CONCERNS.

THIS YEAR, 11 STATES HAVE PASSED LAWS AGAINST DOXING.

OUR NEXT SPEAKER IS GILAD ROBEL.

PLEASE APPROACH THE PODIUM.

CLEARLY STATE YOUR NAME.

OUR NEXT SPEAKER IS DONNA WALLACH.

PLEASE APPROACH THE PODIUM.

CLEARLY STATE YOUR NAME AND PRESENT YOUR COMMENT.

HELLO, MY NAME IS DONNA WALLACH.

I AM A COMMUNITY MEMBER.

I AM DEEPLY REQUESTING THAT YOU PASS A RESOLUTION BANNING DOXING ON ALL CAMPUSES THROUGHOUT SANTA CLARA COUNTY.

PRO-PALESTINIAN STUDENTS SHOULD BE PROTECTED FOR SPEAKING OUT AGAINST THE GENOCIDE IN PALESTINE.

THEY SHOULD NOT BE IN FEAR OF HAVING ALL THEIR PERSONAL INFORMATION, INCLUDING THEIR PHOTO, BE PUBLICIZED FOR ALL TO SEE.

DOXING MUST BE BANNED.

FREEDOM OF SPEECH MUST BE PROTECTED.

STUDENTS OF ALL AGES MUST BE ALLOWED TO SAY, FROM THE RIVER TO THE SEA AND FREE PALESTINE WITHOUT FEAR OF BEING EXPELLED, PUNISHED OR DOXXED. TRULY, THERE SHOULD BE LAWS BANNING DOXING.

THANK YOU. OUR NEXT SPEAKER IS CHIROC LYNN, PLEASE APPROACH THE PODIUM CLEARLY, STATE YOUR NAME AND PRESENT YOUR COMMENT. YES.

MY NAME IS CHIROC LYNN AND A MEMBER OF THE COMMUNITY.

AND YOU KNOW, I HAVE I HAVE A NUMBER OF OF FRIENDS WHO ARE STUDENTS AT, IN HIGH SCHOOLS AND COLLEGES, AND THEY HAVE BEEN DOXED.

AND THE PROBLEM WITH, WITH YOUNG PEOPLE IS THAT THEY DON'T HAVE A LOT OF, YOU KNOW, ONLINE, YOU KNOW, IF YOU GOOGLE THEM, THERE ISN'T A LOT OF INFORMATION ABOUT THEM BECAUSE THEY'RE JUST STARTING THEIR LIVES.

SO IF THEY'RE DOXED, IT'S THE DOX THING THAT COMES RIGHT TO THE TOP.

AND THAT'S REALLY WHAT HIT ME WHEN I STARTED, YOU KNOW, GOOGLING THE NAMES OF SOME OF MY PALESTINIAN FRIENDS.

SO IT'S REALLY DEVASTATING FOR THEM.

AND AND SO I REALLY URGE YOU TO DO WHATEVER TO TAKE WHATEVER MEASURES ARE NECESSARY TO, TO BAN DOXING IN THE SCHOOL DISTRICT. THANK YOU.

OUR NEXT SPEAKER IS GULIET A ROBLE.

PLEASE APPROACH THE PODIUM, CLEARLY STATE YOUR NAME AND PRESENT YOUR COMMENT.

HELLO. MY NAME IS GOULET ROBEL.

I'M A FATHER OF FIVE CHILDREN.

I DO RELATE THIS ISSUE BECAUSE I DO HAVE TWO KIDS WHO GOES TO HIGH SCHOOL, AND I DON'T THINK IT WOULD BE.

I DON'T THINK IT WOULD BE FAIR FOR THEM TO BE DOXXING IT.

AND I THINK ALSO BEING AN AFRICAN-AMERICAN IS VERY SENSITIVE.

I MEAN, THIS IS ANOTHER LAYER THAT WE ADDING IT.

SO I THINK, I WOULD REALLY HIGHLY ENCOURAGE ALL OF YOU GUYS, TO TAKE VERY SERIOUS AND PASS THIS, PERSONALLY. I MEAN, THAT'S AN ISSUE, THAT WE GO THROUGH A LOT AND, AND I CAN SEE FOR YOUNG GENERATION, SOMETIMES THEY MIGHT BE SAYING THEY'RE NOT EVEN AWARE OF IT.

SO I HIGHLY ENCOURAGE YOU GUYS REALLY PASS THAT AND INCLUDE ON THE AGENDA.

THANK YOU. OUR NEXT SPEAKER IS KAMAL.

PLEASE APPROACH THE PODIUM AND CLEARLY STATE YOUR NAME AND PRESENT YOUR COMMENT.

HI, MY NAME IS KAMAL.

THANK YOU FOR HAVING ME.

I HONESTLY DID NOT PREPARE MUCH TO TALK ABOUT, BUT THE DOXING SUBJECT IS IS KIND OF LIKE IT HITS CLOSE TO HOME.

I HAVE THREE KIDS WHO GO TO SANTA CLARA SCHOOLS, SANTA CLARA COUNTY SCHOOLS.

AND I WILL START BY KIND OF LIKE SAYING SOMETHING THAT I WAS LOOKING AT THE OTHER DAY.

I MEAN, BEING IN THE BLACK HISTORY MONTH, I WAS LOOKING AT ROSA PARKS AND READING ABOUT HER.

AND I MEAN, LIKE SHE SAID ONCE, THAT YOU MUST NEVER BE FEARFUL ABOUT WHAT YOU'RE DOING WHEN IT IS RIGHT.

[00:55:02]

AND WE KNOW THAT OUR FIRST AMENDMENT IN THE CONSTITUTION IS ABOUT FREEDOM OF SPEECH.

SO IT'S VERY IMPORTANT TO BE ABLE TO PROTECT THAT, TO BE ABLE ALSO TO SUPPORT OUR KIDS, ALL KIDS, ALL STUDENTS, NO MATTER THEIR RELIGION, NO MATTER THE ORIGIN, NO MATTER THE OPINION TO BE ABLE TO SPEAK THEIR MINDS.

BECAUSE IF WE DO NOT ALLOW THEM TO SPEAK THEIR MINDS AND SHAPE THEIR OPINIONS AND BE CRITICAL OF THINGS WHEN THEY ARE AT THIS AGE, WE WILL NEVER BE, LET THEM GROW UP AND KIND OF LIKE BE AND ACHIEVE THEIR POTENTIAL.

OUR LAST SPEAKER IS KEN.

PLEASE APPROACH THE PODIUM LOCATED AT THE CENTER OF THE ROOM.

CLEARLY STATE YOUR NAME AND PRESENT YOUR COMMENT.

HELLO, AND THANK YOU FOR HAVING US.

AS A COMMUNITY MEMBER, I'M STANDING IN FRONT OF YOU.

TO KINDLY LOOK INTO THIS, BECAUSE OUR KIDS, THEY NEED TO GROW UP A FREEDOM WHERE WE ALL DID BACK THEN THAT WHERE WE DON'T HAVE TO WORRY ABOUT DOXING. SO PLEASE FOLLOW THE OTHER STATES WHO ALREADY PASSED.

THERE IS AN 11 STATES THAT ALREADY PASSED ANTI DOXING.

SO PLEASE LOOK INTO IT AND THINK ABOUT IT HOW YOU WANT HOW YOU WANT IT TO BE TO BE.

JUST REMEMBER HOW WHEN YOU WERE GROWING UP THIS WASN'T EXIST.

BUT NOW IT'S OUT OF CONTROL.

SO LIKE TODAY WE DIDN'T PREPARE THIS.

BUT JUST WE NEED TO THINK AS A COMMUNITY AND AS A COMMUNITY, WE NEED TO HELP OUR CHILDREN'S, NO MATTER WHERE THEY COME FROM, WHERE THEIR RELIGION IS.

THANK YOU.

THIS CONCLUDES COMMENT.

THANK YOU.

WE WILL NOW VOTE.

TRUSTEES, REMEMBER TO CAST YOUR VOTE.

TRUSTEE SREEKRISHNAN, ALTHOUGH I KNOW THIS IS CONSENT ACTION, SO I'M RIGHT.

I WAS, GOING TO ASK BECAUSE, T LONG AND TANISHA WERE THE STUDENTS THAT WORKED ON THIS ITEM.

I GUESS THEY HAD TO LEAVE AND THEN, SO I FORGOT TO PULL THIS ITEM OFF.

CONSENT. BUT, I JUST WANTED TO RECOGNIZE THEIR WORK.

THAT WAS FROM OUR, A MEETING A FEW WEEKS AGO.

T LONG'S, SAN JOSE DISTRICT FOR YOUTH COMMISSIONER.

CAN I TURN TO OUR SUPERINTENDENT TO SPEAK ON THE WORK WITH THE STUDENTS ON THIS ITEM? I KNOW IT'S ON CONSENT.

JUST IF ALLOWED.

I WOULD LIKE TO.

I'M JUST HESITANT, JUST IN TERMS OF THE ORDER OF THE MEETING, IN TERMS OF WE DON'T TYPICALLY HAVE DISCUSSIONS ON CONSENT ACTION ITEMS. YEAH.

SUPERINTENDENT. YEAH, THAT'S A GOOD IDEA.

SUPERINTENDENT'S REPORT.

BUT THANK YOU. YES, THANK YOU TO T LONG AND TANISHA.

THANK YOU. ALL RIGHT, THE TRUSTEES PLEASE VOTE IN BOARD DOCS.

THIS IS FOR CONSENT ACTION ITEMS. ALL ITEMS LISTED UNDER EIGHT.

VERBAL I FROM ME, PLEASE.

VERBAL I FROM TRUSTEE.

DI SALVO.

VERBALLY FOR ME, I ALSO DON'T SEE IT YET.

GREAT. ALL RIGHT.

AND THAT PASSES UNANIMOUSLY.

THANK YOU TRUSTEES.

OUR NEXT AGENDA ITEM IS NINE INFORMATION DISCUSSION ITEMS.

[A. Annual Training: Conflict of Interest]

MODERATOR. ARE THERE PUBLIC COMMENTS ON THIS ITEM? NO, THEY ARE NOT.

THANK YOU.

DOCTOR DEWAN, WILL YOU PLEASE INTRODUCE THE FIRST ITEM? GREAT. THANK YOU SO MUCH.

SO FOR ITEM NINE A, WE ARE REALLY PLEASED TONIGHT TO BE JOINED BY COLLEAGUES FROM THE OFFICE OF THE COUNTY COUNCIL.

AS YOU KNOW, ACCORDING TO OUR BOARD BYLAWS, BOTH BOARD BYLAW 9005 AND BOARD BYLAW 9240.

WE PROVIDE TRAINING EACH YEAR ON A NUMBER OF TOPICS FOR THE COUNTY BOARD OF EDUCATION.

THIS EVENING WE ARE JOINED BY SHAWNA HELLER, WHO WILL PROVIDE A PRESENTATION AND OVERVIEW OF CONFLICTS OF INTEREST.

SO WELCOME.

OKAY. THANK YOU, DOCTOR DEWAN AND BOARD MEMBERS.

SO THIS IS, DOCTOR DEWAN MENTIONED.

THIS IS A COMPLEX OF INTEREST OVERVIEW.

I WAS BEFORE YOU AT THE END OF THE SUMMER TO TALK ABOUT THE LEVINE ACT, WHICH IS PART OF THE SORT OF CONFLICTS OF INTEREST BODY OF LAW, BECAUSE WE ALREADY COVERED THAT.

I'M NOT GOING TO COVER THAT AGAIN TODAY.

NEXT SLIDE PLEASE.

SO THIS SLIDE MIGHT BE FAMILIAR FROM THAT TRAINING, BUT JUST TO SITUATE OURSELVES THE BIG PICTURE OF CONFLICTS OF INTEREST, THEY'RE GROUNDED IN TWO BASIC PRINCIPLES THAT GOVERNMENT OFFICIALS OWE A PARAMOUNT DUTY OF LOYALTY TO THE PUBLIC, AND THAT PERSONAL FINANCIAL CONSIDERATIONS SHOULD NOT ENTER THE DECISION MAKING PROCESS.

[01:00:08]

THE LAWS ARE GEARED TOWARDS PREVENTING SELF-DEALING, DIVIDED LOYALTIES, AND THE APPEARANCE OF IMPROPRIETY.

IN OTHER WORDS, PUBLIC OFFICIALS SHOULD PERFORM THEIR DUTIES IN AN IMPARTIAL MANNER, FREE FROM BIAS CAUSED BY THEIR OWN FINANCIAL INTERESTS.

WE WON'T BE GOING INTO THIS TODAY, BUT I JUST WANT TO NOTE THAT THERE'S ALSO COMMON LAW CONFLICTS OF INTEREST, WHICH ARE CAN BE BOTH FINANCIAL AND NON-FINANCIAL.

REALLY ANYTHING THAT MAY IMPAIR A PUBLIC OFFICIALS EXERCISE OF INDEPENDENT JUDGE JUDGMENT FOR THE PUBLIC'S INTEREST.

NEXT SLIDE, PLEASE.

SO HAVING A CONFLICT OF INTEREST DOES NOT NECESSARILY MEAN THAT AN INDIVIDUAL HAS DONE ANYTHING WRONG.

IT MEANS THAT THE INDIVIDUAL HAS A FINANCIAL OR OTHER DISQUALIFYING INTEREST THAT PREVENTS THEM FROM PARTICIPATING IN CERTAIN GOVERNMENT WORK, AND A PROBLEM OCCURS IF THE INDIVIDUAL PERFORMS GOVERNMENT WORK THAT THEY SHOULDN'T DO TO THE CONFLICT.

AND ACTIVITIES THAT MAY BE ALLOWED IN THE PRIVATE SECTOR, SUCH AS HAVING A CONTRACTOR PAY FOR AN EXPENSIVE LUNCH, IS NOT ALLOWED IN THE PUBLIC SECTOR.

NEXT SLIDE PLEASE.

SO CONFLICTS LAWS HAVE BOTH DISCLOSURE AND DISQUALIFICATION REQUIREMENTS.

AND WE'RE GOING TO GO THROUGH DISCLOSURE FIRST.

NEXT SLIDE PLEASE.

SO STATE LAW REQUIRES BOARD MEMBERS AND CERTAIN EMPLOYEES WHO PARTICIPATE IN THE MAKING OF GOVERNMENT DECISIONS THAT MAY REASONABLY HAVE AN EFFECT ON THEIR FINANCIAL INTEREST, TO DISCLOSE THOSE PERSONAL FINANCIAL INTERESTS ON A STATEMENT OF ECONOMIC INTERESTS.

THE FORM 700, WHICH I PRESUME YOU'RE ALL FAMILIAR WITH, IT'S A PUBLIC DOCUMENT INTENDED TO SUNSHINE FINANCIAL INTERESTS FOR THE PUBLIC AND ALERT THE COUNTY BOARD AND THE OFFICE OF EDITOR ABOUT THE TYPES OF INTEREST OFFICIALS AND EMPLOYEES HAVE THAT MAY CREATE CONFLICT IN THEIR WORK.

THE FORM 700 FILER IS INDIVIDUALLY RESPONSIBLE FOR COMPLETING THAT FORM ACCURATELY, AND IT MUST BE SUBMITTED UNDER PENALTY OF PERJURY.

THE FAIR POLITICAL PRACTICES COMMISSION PROVIDES THOROUGH GUIDANCE MATERIALS ON FORM 700.

NEXT SLIDE PLEASE.

AND SO, THE COUNTY'S CONFLICT OF INTEREST CODE AND BE A BOARD BYLAW 9270 IDENTIFIES THE DISCLOSURES THAT BOARD MEMBERS SPECIFICALLY MUST MAKE. AND IT'S TWO CATEGORIES OF DISCLOSURES INTEREST IN REAL PROPERTY.

AND THAT IS REAL PROPERTY LOCATED ENTIRELY OR PARTLY WITHIN THE COUNTY BOUNDARIES OR WITHIN TWO MILES OF COUNTY BOUNDARIES, OR OF ANY LAND OWNED OR USED BY THE COUNTY OFFICE OF ED, AND THEN ALSO INVESTMENTS IN AND BUSINESS POSITIONS IN AND INCOME, WHICH INCLUDES GIFTS, LOANS, TRAVEL PAYMENTS FROM SOURCES WHICH ARE ENGAGED IN EITHER THE ACQUISITION OR DISPOSAL OF REAL PROPERTY WITHIN COE'S BOUNDARIES ARE ENGAGED IN WORK OR SERVICES OF THE TYPE USED BY CO, OR MANUFACTURE OR SELL SUPPLIES, GOODS, MACHINERY OR EQUIPMENT OF THE TYPE USED BY CO.

NEXT SLIDE PLEASE.

SO THERE'S ABOUT SIX KIND OF BROAD CATEGORIES OF FINANCIAL INTEREST.

AND WE'LL GO THROUGH EACH OF THOSE.

SO THE FIRST IS INCOME WHICH IS ANY SOURCE OF INCOME AGGREGATING $500 OR MORE THAT'S PROVIDED, PROMISED TO OR RECEIVED BY THE PUBLIC OFFICIAL WITHIN THE 12 MONTHS BEFORE THE GOVERNMENTAL DECISION IS MADE.

AND THAT INCLUDES INCOME THAT A SPOUSE OR REGISTERED DOMESTIC PARTNER RECEIVED.

AND AS EXAMPLES, IT INCLUDES SALARY, RENTAL PROPERTY, INCOME, INCOME FROM THE SALE OF A HOUSE, ETC.

THE NEXT CATEGORY IS REAL PROPERTY, AND SO THAT'S ANY REAL PROPERTY IN WHICH THE PUBLIC OFFICIAL HAS A DIRECT OR INDIRECT INTEREST OF AT LEAST 2000.

AND THAT'S AS NOTED IN THE PREVIOUS SLIDE, PROPERTY LOCATED ENTIRELY OR PARTLY WITHIN THE COUNTY BOUNDARIES, OR WITHIN TWO MILES OF COUNTY BOUNDARIES, OR OF ANY LAND OWNED OR USED BY CO. AND THEN THE THIRD IS BUSINESS POSITION.

SO A BUSINESS ENTITY IN WHICH THE BOARD MEMBER IS A DIRECTOR, OFFICER, PARTNER TRUSTEE OR HOLDS ANY POSITION OF MANAGEMENT, EVEN IF THE OFFICIAL RECEIVED NO INCOME FROM THE BUSINESS ENTITY, IS CONSIDERED A FINANCIAL INTEREST.

SO IF THE OFFICIAL HOLDS SUCH A POSITION, THEY HAVE A FIDUCIARY RESPONSIBILITY TO THE ENTITY, AND THAT FIDUCIARY RESPONSIBILITY IS WHAT CONSTITUTES AND CREATES THAT FINANCIAL INTEREST. NEXT SLIDE PLEASE.

AND THEN THE NEXT CATEGORY IS INVESTMENTS.

SO ANY BUSINESS ENTITY IN WHICH THE OFFICIAL HAS A DIRECT OR INDIRECT INVESTMENT WORTH AT LEAST $2,000 AND THEN GIFTS.

AND SO THIS IS A LOW THRESHOLD GIFTS AGGREGATING $50 OR MORE IN A CALENDAR YEAR MUST BE REPORTED ON THE FORM 700.

AND THAT'S GIFTS RECEIVED FROM THAT EARLIER SLIDE THAT SECOND CATEGORY.

SO FROM ENTITIES THAT DO BUSINESS WITH CO OR MIGHT DO BUSINESS WITH CO OF THE TYPE, THE TYPES OF OF PRODUCTS THAT CO MIGHT BE BUYING.

SO IT'S NOT GIFTS FROM ANYBODY, NOT GIFTS FROM ALL OF YOUR FRIENDS, BUT WITHIN A LIMITED CATEGORY THAT MIGHT CONSTITUTE A CONFLICT BASED ON THE TYPE OF WORK THAT YOU'RE DOING.

[01:05:03]

AND A GIFT IS ANY TANGIBLE OR INTANGIBLE THING OF VALUE.

AND IT CAN INCLUDE TICKETS TO ENTERTAINMENT, EVENTS, TRAVEL, LODGING, OR CONFERENCE REGISTRATION, FORGIVENESSES OF LOANS.

IT'S A LONG LIST OF THINGS THAT CAN CONSTITUTE GIFTS.

BUT LIKE I SAID, GIFTS, FROM FRIENDS AND FAMILY MEMBERS ARE NOT GOING TO BE COVERED.

AND BUT THIS DOES COVER GIFTS THAT YOU ESPOUSE A REGISTERED DOMESTIC PARTNER OR DEPENDENT CHILD RECEIVES.

AND THEN LASTLY IS JUST PERSONAL FINANCES OF AN OFFICIAL OR THEIR IMMEDIATE FAMILY.

AND AS I MENTIONED, THE FAIR POLITICAL PRACTICES COMMISSION WEBSITE AND THE FORM 700 REFERENCE PAMPHLET GOES INTO THIS IN GREATER DETAIL OF ALL THE DIFFERENT EXCEPTIONS THAT THAT DO APPLY.

NEXT SLIDE PLEASE.

SO WHEN TO SUBMIT FORM 700.

YOU'RE ALL LIKELY AWARE, IT HAS TO BE SUBMITTED NO LATER THAN 30 DAYS FROM ASSUMING THE POSITION ANNUALLY EVERY YEAR BY APRIL 1ST AND THEN NO LATER THAN 30 DAYS AFTER LEAVING THE POSITION.

NEXT SLIDE PLEASE. THERE ARE PENALTIES FOR LATE OR INADEQUATE FORM SEVEN HUNDREDS FINES.

A MATTER CAN BE REFERRED TO THE FPC ENFORCEMENT DIVISION.

EXCUSE ME? WHICH MAY INCREASE THE FINE.

AND AS AN EXAMPLE, IN 2014, THE FPC COLLECTED OVER $81,000 IN FINES.

NEXT SLIDE PLEASE.

AND SO I MENTIONED THERE'S DISCLOSURE AND DISQUALIFICATION REQUIREMENTS.

AND SO NOW WE'RE TURNING TO THE DISQUALIFICATION REQUIREMENTS.

DISCLOSURE DOES NOT ITSELF BY ITSELF DISQUALIFY A GOVERNMENT OFFICIAL FROM PARTICIPATING IN A GOVERNMENT DECISION.

BUT IF THE FINANCIAL INTEREST CREATES THE CONFLICT, DISCLOSURE BY ITSELF ALSO IS NOT SUFFICIENT TO CURE THAT CONFLICT OF INTEREST.

AND IT'S GOING TO DEPEND BASED ON THE TYPE OF CONFLICT AND THE THE TYPE OF, GOVERNMENT ACTIVITY THAT'S BEING ENGAGED IN.

DISQUALIFICATION IS REQUIRED WHEN THE OFFICIAL IS FACED WITH PARTICIPATING IN A SPECIFIC GOVERNMENT DECISION THAT COULD HAVE AN EFFECT ON THEIR OWN PERSONAL FINANCIAL INTEREST.

SO DISQUALIFICATION MAY BE REQUIRED FOR ALSO INTERESTS THAT ARE NOT NECESSARILY INCLUDED ON THE FORM 700, LIKE COMMON LAW CONFLICTS OF INTEREST THAT ARE NOT NECESSARILY FINANCIAL IN NATURE. AND THAT JUST MAY, CREATE AN APPEARANCE OF IMPROPRIETY.

NEXT SLIDE PLEASE.

SO THERE'S TWO MAIN CATEGORIES OF DISQUALIFYING FINANCIAL CONFLICTS.

THERE'S GOVERNMENT CODE SECTION 1090 CONFLICTS WHICH ARE FINANCIAL CONFLICTS RELATED TO THE MAKING OF CONTRACTS.

AND THEN THERE'S POLITICAL REFORM ACT, FINANCIAL CONTRACTS, WHICH ARE BASICALLY ALL OTHER TYPES OF GOVERNMENT ACTIONS.

NEXT SLIDE PLEASE.

WE'RE GOING TO TAKE THESE IN REVERSE, CONFLICTS UNDER THE POLITICAL REFORM ACT OR THE PRA.

THE PRA SAYS THAT NO PUBLIC OFFICIAL AT ANY LEVEL OF STATE OR LOCAL GOVERNMENT SHALL MAKE PARTICIPATE IN MAKING OR IN ANY WAY ATTEMPT TO USE THEIR OFFICIAL POSITION TO INFLUENCE A GOVERNMENTAL DECISION IN WHICH HE KNOWS OR SHE KNOWS, OR THEY KNOW, OR HAS REASON TO KNOW THAT THEY HAVE A FINANCIAL INTEREST.

A GOVERNMENTAL DECISION IS DEFINED AS OR MEANS ANY ACTION TAKEN BY THE AGENCY THAT HAS A FINANCIAL EFFECT ON ANY PERSON OTHER THAN THE GOVERNMENT.

GOVERNMENT AGENCY MAKING THAT DECISION AND THEN MAKING PARTICIPATING IN MAKING AN USING THEIR POSITION TO INFLUENCE.

WE'RE GOING TO BREAK THOSE DOWN A LITTLE BIT.

SO MAKING INCLUDES AUTHORIZING OR DIRECTING ACTION INCLUDES VOTING ON AN ACTION, MAKING AN APPOINTMENT, OBLIGATING OR COMMITTING THE AGENCY TO ANY COURSE OF ACTION, OR ENTERING INTO A CONTRACT.

PARTICIPATING IN MAKING INCLUDES PROVIDING INFORMATION AND OPINION OR RECOMMENDATION FOR THE PURPOSE OF AFFECTING THE DECISION WITHOUT SIGNIFICANT INTERVENING SUBSTANTIVE REVIEW.

AND THEN ATTEMPTING TO INFLUENCE MEANS CONTACTING OR APPEARING BEFORE A COUNTY OFFICIAL FOR THE PURPOSE OF AFFECTING A DECISION.

AND THEN THERE'S KIND OF AS WITH EVERYTHING IN THE LAW, THERE'S A NUMBER OF EXCEPTIONS.

AND THAT TO KIND OF WHAT IS A GOVERNMENTAL DECISION.

AND THAT WOULD INCLUDE MINISTERIAL ACTIONS, APPEARANCES AS A MEMBER OF THE GENERAL PUBLIC, ACADEMIC DECISIONS, IF YOU'RE A TEACHER, ACTIONS RELATING TO YOUR OWN EMPLOYMENT AND THERE'S SOME OTHER ONES.

NEXT SLIDE PLEASE.

AND THEN IN THINKING ABOUT WHAT IS A FINANCIAL INTEREST, A PUBLIC OFFICIAL HAS A FINANCIAL INTEREST.

IF IT IS REASONABLY FORESEEABLE THAT THE DECISION, THAT GOVERNMENTAL DECISION WILL HAVE A MATERIAL FINANCIAL EFFECT DISTINGUISHABLE FROM ITS EFFECT ON THE PUBLIC, GENERALLY ON THE OFFICIAL, A MEMBER OF THEIR IMMEDIATE FAMILY OR ON ANY OF THE FOLLOWING.

AND WE WILL GET INTO THE ANY OF THE FOLLOWING.

SO ACTUAL BIAS IS NOT NECESSARY FOR DISQUALIFICATION.

AND JUST TO NOTE THAT FAMILY INCLUDES, SPOUSE AND DEPENDENT CHILDREN.

SO IF YOU'RE TAKING IF THE BOARD IS TAKING AN ACTION THAT'S GOING TO AFFECT KIND OF EVERYBODY OR A WIDE SWATH OF THE POPULATION, EVEN IF THAT IMPACTS KIND OF A FINANCIAL

[01:10:05]

INTEREST OF YOURS, THAT'S NOT GOING TO CONSTITUTE A CONFLICT OF INTEREST, BUT IT HAS TO BE SOMETHING THAT IMPACTS YOU OR A MUCH SMALLER, NARROWER GROUP OF PEOPLE.

NEXT SLIDE PLEASE.

AND THEN SO KIND OF WHAT IS A DISQUALIFYING FINANCIAL INTEREST.

IT'S ESSENTIALLY THE SAME CATEGORIES OF THINGS THAT HAVE TO BE, INCLUDED ON THE FORM 700.

AND THEN I'LL NOTE THAT FOR GIFTS, EVEN THOUGH YOU HAVE TO DISCLOSE ON THE FORM 700 GIFTS OF $50 OR MORE, WHAT IS DISQUALIFYING AS A FINANCIAL INTEREST IS GIFTS AGGREGATING $590 OR MORE, AND THAT AMOUNT GOES UP.

IT'S TIED TO SOME METRIC IN THE STATE LAW.

AND THAT GOES UP USUALLY A LITTLE BIT EVERY YEAR.

NEXT SLIDE PLEASE.

AND SO TO TAKE ACTIONS TO AVOID PRA PROBLEMS, ENSURE THAT YOUR FORM COMPLETING YOUR FORM 700 TIMELY AND ACCURATELY DISCLOSING ANY POTENTIAL OR ACTUAL FINANCIAL INTERESTS THAT MAY GIVE RISE TO A CONFLICT AT THE BOARD MEETING WHERE THE DECISION IS BEING CONSIDERED OR MADE.

DO NOT PARTICIPATE IN ANY GOVERNMENT DECISION THAT MAY AFFECT YOUR FINANCIAL INTERESTS.

AND SOMETIMES YOU MAY BE ABLE TO REVOKE YOUR FINANCIAL INTEREST AND CONTINUE WITH THE GOVERNMENTAL DECISION.

SO WHEN DISQUALIFICATION IS REQUIRED, YOU MUST STEP ASIDE FROM THE ENTIRE PROCESS LEADING UP TO THAT GOVERNMENTAL DECISION.

SO IT'S NOT JUST GOING TO BE THAT SPECIFIC DECISION OR THAT BOARD ACTION, BUT ANY OF THOSE KIND OF PARTICIPATING, ANY OF THOSE ORIGINAL DISCUSSIONS, LEADING UP TO THAT DECISION. NEXT SLIDE, PLEASE.

AND THEN CONSEQUENCES OF A PRA VIOLATION ESSENTIALLY CAN BE GUILTY OF A MISDEMEANOR SUBJECT TO FINES.

AND THEN WE ALWAYS NOTE THAT ONLY A FORMAL WRITTEN OPINION FROM THE FAIR POLITICAL PRACTICES COMMISSION, PROVIDED BEFORE THE GOVERNMENT ACTION IS TAKEN, WILL PROVIDE STATUTORY IMMUNITY FROM PROSECUTION UNDER THE POLITICAL REFORM ACT.

NEXT SLIDE PLEASE.

OKAY. SO NOW WE'RE MOVING TO GOVERNMENT CODE SECTION NINE 1090 CONFLICT.

SO THAT'S CONFLICTS WITHIN THE CONTEXT OF CONTRACTING.

SO PUBLIC OFFICIALS SHALL NOT BE FINANCIALLY INTERESTED IN ANY CONTRACT MADE BY THEM IN THEIR OFFICIAL CAPACITY, OR BY ANY BODY OR BOARD OF WHICH THEY ARE MEMBERS.

SECTION 1090 IS AIMED AT ELIMINATING, ELIMINATING TEMPTATION AND AVOIDING THE APPEARANCE OF IMPROPRIETY, AND PROHIBITS SELF-DEALING.

IN THE CONTEXT OF CONTRACTS, THE PUBLIC OFFICIAL DOESN'T NEED TO INTEND TO VIOLATE THE LAW OR KNOW THAT A VIOLATION WILL OCCUR.

THEY ONLY NEED TO INTEND TO MAKE THE CONTRACT AND KNOW THAT THERE'S A REASONABLE LIKELIHOOD OF A FINANCIAL INTEREST FOR A VIOLATION.

SO THERE'S A VERY BROAD INTERPRETATION INTERPRETATION OF FINANCIAL INTERESTS UNDER SECTION 1090.

A LITTLE BIT DIFFERENT THAN UNDER THE POLITICAL REFORM ACT.

SO AS AN EXAMPLE, ONE CALIFORNIA ATTORNEY GENERAL OPINION DISCUSSED THAT.

SO FOR EXAMPLE, IF A BOARD MEMBER, IN THEIR PRIVATE CAPACITY, YOU KNOW, WORKED FOR A PRIVATE BUSINESS, THAT THEY STILL WOULD HAVE A FINANCIAL INTEREST IN A CONTRACT BETWEEN THIS BODY AND THEIR PRIVATE EMPLOYER, EVEN IF THE CONTRACT WOULDN'T RESULT IN A CHANGE IN THEIR OWN INCOME.

WOULDN'T DIRECTLY INVOLVE THAT EMPLOYEE, BUT BECAUSE THE EMPLOYEE JUST HAS AN OVERALL INTEREST IN THE FINANCIAL SUCCESS OF THEIR FIRM, THAT THEY WORK FOR, THE BUSINESS THAT THEY WORK FOR, AND THEIR CONTINUED EMPLOYMENT, THAT CAN CONSTITUTE A A CONFLICT.

AND THEN A CONTRACT FOR PURPOSES OF SECTION 1090 INCLUDES A STANDARD CONTRACT, CONTRACT AMENDMENTS, GRANTS, DEVELOPMENT AGREEMENTS AND MORE.

NEXT SLIDE PLEASE.

SO IT DOESN'T MATTER IF THE CONTRACT IS FAIR OR MORE ADVANTAGEOUS TO THE PUBLIC ENTITY FOR A CONFLICT TO OCCUR.

IT DOESN'T MATTER IF THERE IS ACTUAL FRAUD, DISHONESTY, DISHONESTY, OR INJURY.

NOR DOES IT MATTER IF THE OFFICIAL ACTED IN GOOD FAITH OR ON THE ADVICE OF COUNSEL.

A VIOLATION OCCURS IF A VIOLATION OCCURS.

NEXT SLIDE PLEASE.

OKAY. SO UNDER GOVERNMENT CODE SECTION 1090, WHAT IS PARTICIPATING IN MAKING A CONTRACT.

AND THAT INCLUDES ALL ACTIVITIES LEADING UP TO THE EXECUTION OF A CONTRACT FROM PRELIMINARY DISCUSSIONS, PLANNING, CREATING PLANS OR SPECIFICATIONS, DRAFTING OR REVIEWING SOLICITATION FOR BIDS, NEGOTIATING AND EXECUTING CONTRACTS SO YOU DON'T HAVE TO BE THE ONE TO EXECUTE THE CONTRACT OR TO SIGN THE CONTRACT TO HAVE PARTICIPATED IN THE MAKING OF IT UNDER SECTION 1090.

AND ALL OF THESE ARE INCLUDED BECAUSE IT'S AIMED, LIKE ALL OF THE CONFLICTS OF LAWS AND ELIMINATING TEMPTATION AND AVOIDING THE APPEARANCE OF IMPROPRIETY.

NEXT SLIDE PLEASE.

THERE ARE SOME STATUTORY EXCEPTIONS UNDER SECTION 1090.

SO THERE'S A STATUTORY EXCEPTIONS FOR NON-INTEREST WHICH WE'LL TALK ABOUT FIRST.

[01:15:02]

AND THEN FOR WHAT ARE CALLED REMOTE INTERESTS, WHICH WE'LL TALK ABOUT NEXT.

SO THE NON-INTEREST ARE LISTED UNDER SECTION 1090 1.5.

AND THEY'RE BASICALLY INTERESTS THAT THE LEGISLATURE HAS CONSIDERED TO BE SO SMALL THAT THEY'RE CONSIDERED IMMATERIAL.

SO EXAMPLES ARE STOCK OWNER CERTAIN, SMALL AMOUNTS OF STOCK OWNERSHIP.

SO IF YOU HAVE THAT, YOU CAN STILL ENTER INTO THE CONTRACT.

IT'S CONSIDERED A NON INTEREST, EVEN THOUGH UNDER THE BROADER FRAMEWORK ONE MIGHT THINK THAT THAT THAT IS A CONFLICT, RECEIPT OF PUBLIC SERVICES LIKE ANY OTHER MEMBER OF THE PUBLIC NON-SALARIED MEMBERS OF NONPROFITS, THOSE ARE ALL CONSIDERED NON-INTEREST AND CAN PROCEED WITH ENGAGING IN THE MAKING OF A CONTRACT. NEXT SLIDE, PLEASE.

AND THEN REMOTE INTERESTS ARE DIFFERENT.

THEY'RE ALSO AN EXCEPTION, BUT THEY WORK DIFFERENTLY.

AND SO THIS IS WHEN AN OFFICER IS ALSO NOT DEEMED TO BE INTERESTED IN A CONTRACT, BUT HAVE A REMOTE INTEREST.

AND SO EXAMPLES OF THAT ARE LANDLORDS OR TENANTS OF THE CONTRACTOR, AN OFFICER OR AN EMPLOYEE OF A NONPROFIT THAT IS ENTERING INTO A CONTRACT WITH THE GOVERNMENT AGENCY, PERSON RECEIVING SALARY, PER DIEM OR REIMBURSEMENT FROM A GOVERNMENT ENTITY.

SO THERE'S OFTEN CONTRACTS BETWEEN TWO GOVERNMENT ENTITIES.

AND THAT CAN, RAISE A CONFLICT OF LAWS.

SO BOTH SECTION 1091 AND SECTION 1090 1.5 THAT DISCUSS THESE TWO EXCEPTIONS HAVE FAIRLY LONG LAUNDRY LIST OF CATEGORIES THAT FALL WITHIN THE EXCEPTIONS. AND IF A REMOTE INTEREST EXISTS, THE MEMBER, THE MEMBER OF THE BOARD MUST DISCLOSE THE INTEREST TO THE BOARD.

IT MUST BE NOTED IN THE OFFICIAL RECORDS, AND THE MEMBER MUST RECUSE FROM VOTING ON THE CONTRACT.

SO THIS IS DIFFERENT FROM.

IF ANY BOARD MEMBER HAS A TRUE KIND OF CONTRACT CONFLICT OF INTEREST THAT CONFLICTS THE ENTIRE BOARD OUT FROM ENTERING IN THE CONTRACT.

RECUSAL DOESN'T SAVE KIND OF THE SITUATION.

THE REMOTE INTEREST DOES ALLOW FOR THAT.

AND I JUST NOTE THAT THERE ARE INSTANCES IT DOESN'T COME UP OFTEN AT ALL.

BUT IF A CERTAIN NUMBER OF BOARD MEMBERS HAVE REMOTE INTERESTS, INTERESTS SUCH THAT THERE'S NOT QUORUM TO ENTER INTO THE CONTRACT, THERE'S WHAT'S CALLED THE RULE OF NECESSITY THAT CAN APPLY TO ALLOW THE BOARD TO ENTER INTO THE CONTRACT.

AND IT'S A VERY FACT SPECIFIC, SPECIFIC ANALYSIS THAT NEEDS TO BE DONE IN THOSE SCENARIOS.

NEXT SLIDE PLEASE.

SO CONSEQUENCES OF SECTION 1090 VIOLATIONS I'VE ALLUDED TO THIS.

IF THERE'S A SECTION 1090 VIOLATION THE CONTRACT IS VOID FROM ITS INCEPTION.

IT SAYS IF THE CONTRACT NEVER WAS MADE.

SO AS I MENTIONED IF ONE BOARD MEMBER HAS A CON A CONFLICT UNDER 1090, ALL BOARD MEMBERS ARE PRESUMED TO ESSENTIALLY HAVE ENTERED INTO THAT CONTRACT, AND THE CONTRACT IS VOID.

THE PARTIES MUST FORFEIT ALL MONIES RECEIVED UNDER THE CONTRACT.

THERE'S POTENTIAL CRIMINAL LIABILITY AND POTENTIAL PERMANENT BAN ON HOLDING PUBLIC OFFICE IN CALIFORNIA.

SO THERE'S ANY EVER, EVER ANY CONCERNS THAT THIS MIGHT ARISE? IT'S IMPORTANT TO CONDUCT A KIND OF VERY INDIVIDUALIZED, FACT SPECIFIC SCENARIO, BECAUSE THERE'S OFTEN WAYS TO GET AROUND IT.

SOMETIMES WE SEE INSTANCES WHERE THERE'S A DELEGATION OF AUTHORITY TO KIND OF AVOID THAT, TO ALLOW THE ENTITY TO STILL ENTER INTO THE CONTRACT, AND AVOID THE CONFLICT ISSUE.

NEXT SLIDE PLEASE. AND THEN LASTLY, JUST TO NOTE, THERE'S AIDER AND ABETTOR LIABILITY UNDER SECTION 1090.

SO THAT'S WHEN AN INDIVIDUAL MAY BE LIABLE, IF THEY HAVE KNOWLEDGE OF THE UNLAWFUL PURPOSE OF A SECTION 1090 VIOLATOR INTENDS TO COMMIT, FACILITATE OR ENCOURAGE THE VIOLATION AND BY ACT OR ADVICE THEY AID, PROMOTE, ENCOURAGES OR INSTIGATES THE VIOLATION.

SO TO BE LIABLE IN THIS MANNER, THE INDIVIDUAL DOESN'T NEED TO HAVE THE FINANCIAL INTEREST IN THE CONTRACT, BUT THEY CAN STILL BE LIABLE.

AND THAT IS IT.

ON THE VERY, VERY HIGH LEVEL.

SUMMARY AND OVERVIEW.

IT'S A AS I MENTIONED, A COMPLICATED AREA.

AND WE AT THE COUNTY COUNSEL'S OFFICE FOR AT LEAST FOR OUR COUNTY BOARD OF SUPERVISORS, DO A LOT OF AND FOR EMPLOYEES DO A LOT OF, KIND OF FACT SPECIFIC ANALYZES UNDER BOTH OF THESE LAWS SO IT CAN GET COMPLICATED, BUT THEY'RE IMPORTANT AND CRUCIAL.

SO I'LL TAKE ANY QUESTIONS IF THERE ARE ANY.

THANK YOU FOR THE PRESENTATION.

TRUSTEES, ARE THERE ANY QUESTIONS? WELL, WE APPRECIATE YOU BEING HERE THIS EVENING TO PROVIDE THAT TRAINING.

DOCTOR DEWAN, WOULD YOU PLEASE INTRODUCE THE NEXT ITEM? OKAY. THANK YOU.

PRESIDENT BERTA AND, TRUSTEES COMMUNITY THIS EVENING.

OUR NEXT ITEM IS THE CHARTER SCHOOLS UPDATE.

[B. Charter Schools Update]

[01:20:02]

AND OUR EXECUTIVE DIRECTOR, MEFULA FAIRLEY, WILL BE PROVIDING THE UPDATE.

WE CAN BARELY.

THE MIC'S NOT ON.

WOULD YOU MIND JUST GOING AHEAD? DO YOU MIND USING THE ONE AT THE TABLE? I'M NOT SURE IF THAT ONE GOT TURNED ON.

OKAY. SO GOOD EVENING.

PRESIDENT BERTA TRUSTEES, SUPERINTENDENT DEWAN STAFF AND COMMUNITY.

TONIGHT I HAVE FOUR SHORT ITEMS FOR YOU.

FIRST, BULLIS CHARTER SCHOOL.

AS A FOLLOW UP TO MY UPDATE REGARDING BULLIS LAST WEEK, I WANTED TO SHARE THAT CHARTER THAT THE CHARTER SCHOOLS TEAM HAD A SUCCESSFUL ANNUAL VISIT TO BULLIS CHARTER SCHOOL'S NORTH CAMPUS ON FEBRUARY 1ST.

AS WITH ALL OUR ANNUAL VISITS, WE MET WITH AND INTERVIEWED TEACHERS, STUDENTS, AND PARENTS.

WE ALSO HAD A POSITIVE AND PRODUCTIVE DISCUSSION WITH THE BULLIS NORTH CAMPUS ADMINISTRATIVE STAFF, INCLUDING PRINCIPAL DOCTOR CARRIE MONTESINO STEWART AND SUPERINTENDENT MAUREEN ISRAEL.

THE TEAM ADDITIONALLY VISITED CLASSROOMS AND REVIEWED STUDENT CUMULATIVE RECORDS AND SPECIAL EDUCATION FILES.

SECOND ANNUAL SITE VISITS.

ON MONDAY OF THIS WEEK, THE CHARTER SCHOOLS TEAM WAS SCHEDULED TO VISIT VOICES MOUNT MORGAN HILL.

HOWEVER, THE VISIT WAS POSTPONED TO A DATE YET TO BE DETERMINED DUE TO THE CANCELLATION OF CLASSES CAUSED BY IMPACTS FROM THE WEEKEND STORMS. WEATHER PERMITTING, WE WILL CONTINUE OUR SCHOOL VISITS TOMORROW AND FRIDAY WITH VISITS TO ROCKETSHIP BRILLIANT MINDS AND ROCKETSHIP LOS SUENOS, RESPECTIVELY. NEXT SCHOOL CLOSURES.

SEVERAL OTHER CHARTER SCHOOLS CANCELED CLASS ON FEBRUARY 5TH DUE TO THE IMPACT OF THE STORMS. THE CHARTER SCHOOLS AFFECTED INCLUDED VOICES MORGAN HILLS, AS I'VE ALREADY STATED, VOICES MOUNT PLEASANT, UNIVERSITY PREPARATORY ACADEMY, ROCKETSHIP ALMA, AND ALPHA JOSE HERNANDEZ.

SOME LEAS MAY HAVE BUILT IN EMERGENCY DAYS ON THEIR ON THEIR ANNUAL SCHOOL CALENDAR TO COVER EMERGENCY SCHOOL CLOSURES.

HOWEVER, IF AN LEA INCLUDING CHARTER SCHOOLS DOES NOT HAVE BUILT IN EMERGENCY DAYS AND IS UNABLE TO MAKE UP THE DAYS, THE LEA MAY REQUEST TO BE HELD HARMLESS FROM REVENUE LOSS BY SUBMITTING A REQUEST FOR ALLOWANCE OF ATTENDANCE DUE TO EMERGENCY CONDITIONS, ALSO KNOWN AS FORM J 13 A, AND THEN FINALLY DOWNTOWN COLLEGE PREP ALUM ROCK ON NOVEMBER 7TH, 2023, DOWNTOWN COLLEGE PREP REQUESTED AN EXTENSION FROM DECEMBER 15TH TO JANUARY 31ST, 2024 TO SUBMIT THEIR 22-23 FISCAL AUDIT FOR DCP ALUM ROCK.

DCP HAS STATED THE REQUEST IS DUE TO THE DELAYED COMPLETION AND ISSUANCE OF THEIR 21-22 AUDIT BY ITS FORMER AUDITOR ON NOVEMBER 30TH, 2023, THE BOARD OF DIRECTORS OF THE ACROSS THE BRIDGE FOUNDATION, DOING BUSINESS AS DOWNTOWN COLLEGE PREPARATORY, PASSED AND ADOPTED A RESOLUTION APPROVING THE EXTENSION.

AND ON JANUARY 26TH OF 2024, DCP'S AUDITOR SHARED A COPY OF THE DCP ALUM ROCK AUDIT FOR 22-23 WITH SCCOE.

ADDITIONALLY, THE AUDIT WAS ACCEPTED BY THE DCP BOARD AND OR RATHER AT ITS JANUARY 23RD MEETING.

AND THAT CONCLUDES MY REPORT.

THANK YOU EXECUTIVE DIRECTOR FAIRLEY.

TRUSTEES. TRUSTEE DI SALVO.

THANK YOU, MADAM PRESIDENT.

I DO NOT HAVE A QUESTION, BUT JUST NEWS RELATED TO CHARTER SCHOOLS LOCALLY, AND I THINK MANY OF THEM ARE OUR SCHOOLS.

THE EXECUTIVE DIRECTOR OF ROCKETSHIP, MARICELA GUERRERO, SENT OUT AN EMAIL, PROBABLY TO ALL OF US, THAT ROCKETSHIP WAS AWARDED $8.25 MILLION STATE GRANT.

I BELIEVE I DID SEE THAT EMAIL.

AND I THINK THAT IS SOMETHING THAT WE SHOULD REPORT, SOMETHING WE SHOULD ACKNOWLEDGE, SOMETHING WE SHOULD COMMEND ON THE ROCKETSHIP COMMUNITY, BECAUSE IT FAVORS OUR STUDENTS THAT ARE IN OUR CURRENT ROCKETSHIP SCHOOLS.

SO THANK YOU.

THANK YOU TRUSTEE DI SALVO.

WE'D BE HAPPY TO INCLUDE THAT IN OUR NEXT CHARTER SCHOOLS UPDATE.

ANY OTHER QUESTIONS OR COMMENTS FROM TRUSTEES?

[01:25:02]

WELL, WE APPRECIATE THE UPDATES EXECUTIVE DIRECTOR.

DR. DEWAN, WOULD YOU INTRODUCE THE NEXT ITEM, PLEASE? YES. AGAIN, THANK YOU, PRESIDENT BERTA.

THE NEXT INFORMATION ITEM THIS EVENING IS AN UPDATE ON THE SOLAR PROJECTS.

[C. Solar Project Update]

THIS SPECIFIC ITEM IS BEING PROVIDED AS A FOLLOW UP TO SOME OF THE INQUIRIES FROM TRUSTEES DURING OUR DIFFERENT PRESENTATIONS ABOUT THE SOLAR PROJECT DURING PREVIOUS MEETINGS.

THIS UPDATE WILL BE PROVIDED BY OUR ASSISTANT SUPERINTENDENT OF STUDENT SERVICES, AND EDUCATIONAL SERVICES, THERESA SHIPP.

THERESA. GOOD EVENING, DOCTOR DEWAN, PRESIDENT BERTA AND TRUSTEES.

IT'S NICE TO SEE YOU ALL TONIGHT.

I'M EXCITED TO PROVIDE SOME UPDATES ON OUR SOLAR PROJECT.

NEXT SLIDE PLEASE.

AS YOU KNOW, ASSISTANT SUPERINTENDENT GOMEZ HAS PREVIOUSLY SHARED THIS PROJECT'S ALIGNMENT WITH SSCOE'S COMMITMENT TO SUSTAINABILITY AND CLIMATE ACTION AS IT MINIMIZES THE IMPACT TO THE ENVIRONMENT THROUGH CARBON FOOTPRINT REDUCTION.

NEXT SLIDE PLEASE.

YOU WILL RECOGNIZE THIS SLIDE.

YOU'VE SEEN IT BEFORE AND THE SITES VISIT THE SITE.

VISITS ARE UNDERWAY AND WE ARE CURRENTLY PLANNING THE IMPLEMENTATION OF THE SUPPLEMENTAL SERVICES TO OUR STUDENTS.

NEXT SLIDE PLEASE.

AS WE PREVIOUSLY SHARED ALONG WITH THE SOLAR PANELS, WE WILL BE PROVIDED CURRICULUM, REAL LIFE LEARNING OPPORTUNITIES AND INTERNSHIPS FOR OUR STUDENTS.

NEXT SLIDE PLEASE.

IN SUMMER OF 2024, WE WILL BEGIN THE PROFESSIONAL DEVELOPMENT WITH EDUCATORS TO BUILD THEIR CAPACITY IN USING THE CLASSROOM SOLAR KITS PROVIDED AND BEGIN BUILDING ENGAGING LESSONS WITH THE HANDS ON LEARNING EQUIPMENT.

THIS EQUIPMENT WILL BE UTILIZED BY OUR STUDENTS TO ANALYZE THE REAL TIME SOLAR PRODUCTION AND THE POSITIVE EFFECTS OF SOLAR ENERGY, SO OUR STUDENTS WILL BE ABLE TO ACTUALLY SEE WHAT THE SOLAR PANELS ARE PRODUCING IN REAL LIFE.

SO ON A CLOUDY DAY, WE WILL HAVE LESS PRODUCTION OF SOLAR ENERGY ON A SUNNY DAY, OBVIOUSLY HIGHER PRODUCTION, AND THEY'LL BE ABLE TO ANALYZE THE DATA AND USE IT IN REAL TIME.

SO WE WILL BEGIN THE PROFESSIONAL DEVELOPMENT ON THAT THIS SUMMER.

NEXT SLIDE PLEASE.

WALDEN WEST WILL BE USING THE STEM LESSONS THROUGHOUT THEIR SUMMER PROGRAM, WHICH WILL ALLOW THE STUDENTS NOT ONLY TO SEE THE SOLAR PROJECT BEING BUILT, SINCE THAT'S ONE OF THE SITES FOR THE SOLAR, BUT USING THE LESSONS TO LEARN ABOUT THE IMPORTANCE OF REDUCING OUR CARBON FOOTPRINT.

AGAIN, THIS WILL INVOLVE PROFESSIONAL DEVELOPMENT FOR OUR EDUCATORS AT WALDEN WEST AND BRINGING THESE LESSONS TO LIFE.

NEXT SLIDE PLEASE.

REALLY EXCITING THAT THIS SUMMER, SUMMER 2024, WE WILL HAVE TWO INTERNS THAT WILL BE WORKING ON THE SOLAR PROJECT.

THESE INTERNS WORK ON SPECIAL PROJECTS, INTERACT WITH COLLEGE INTERNS AND THE ENGIE LEADERSHIP WHO IS THE SOLAR COMPANY, AND PRESENT THEIR FINAL PROJECTS TO ENGIE AND REPRESENTATIVES OF THEIR DISTRICTS.

LAST YEAR, INTERNS LEARNED ABOUT GREEN BUILDING DESIGN AND THE CORE CONCEPTS OF LEADERSHIP AND ENERGY AND ENVIRONMENTAL DESIGN.

AS YOU HEARD OUR STUDENT BOARD MEMBER EARLIER THIS EVENING, HE IS REALLY INTERESTED IN SEEING THEIR PRESENTATION AT THE END AND IS HOPING THAT IT WILL BE BROUGHT TO THE BOARD.

NEXT SLIDE, PLEASE.

THANK YOU.

ANY QUESTIONS? THANK YOU FOR THOSE UPDATES.

IT'S ALWAYS GREAT TO HEAR YOU KNOW HOW WE'RE CONNECTING OUR PROJECTS BACK TO A LEARNING IN THE CLASSROOM AND FOR STUDENTS.

SO REALLY APPRECIATE THOSE UPDATES.

TRUSTEE DI SALVO. DID YOU HAVE JUST WANTED TO SAY IT'S LONG OVERDUE AND I SO APPRECIATE THAT THIS IS HAPPENING.

STARTED TALKING ABOUT THIS PROBABLY IN IN 2010 AND BLESS YOU.

THANK YOU. TRUSTEE BLESS YOU.

TRUSTEE MAH. BUT, THIS IS FANTASTIC.

AND AS YOU SAID, GETTING IT BACK TO THE STUDENTS, TO OUR STUDENTS IS.

IS EXCEPTIONAL. SO THANK YOU.

OF COURSE. THANK YOU.

THEIR COMMENTS OR QUESTIONS FROM TRUSTEES.

TRUSTEE CHON. I JUST WANT TO SAY THANK YOU.

I THINK IT'S GREAT THAT WE'RE DOING THIS WORK, AND I THINK WE'RE MOVING A LOT MORE TOWARD IN THE WORLD FOR SOLAR.

BUT, WITH THAT, I JUST REALLY APPRECIATED SEEING THE WAY THAT WE CAN WORK WITH STUDENTS.

AND I SAW THE THE S'MORES SOLAR PANELS IN THE PICTURES AND JUST THE IMPORTANCE OF LEARNING ABOUT THAT AND PUTTING, YOU KNOW, WE'RE DOING SOLAR ENERGY FOR OUR EFFICIENCY AND EVERYTHING TOO.

BUT BEING ABLE TO ACTUALLY PUT IT IN WITH EDUCATIONAL PROGRAMS IS, IS IS REALLY GREAT.

SO I JUST APPRECIATED THAT BEING A PART OF THE UPDATE TODAY.

[01:30:03]

SO THANK YOU FOR THAT.

THANK YOU. AND ALSO JUST EMPHASIZING LOVED LEARNING ABOUT THE STUDENTS AT SUNOL WHO WILL BE INCLUDED IN THAT SPECIAL CONNECTION. AND I THINK IT REALLY HELPS STUDENTS TAKE OWNERSHIP AND PRIDE IN THEIR WORK AS WELL.

SO IT IS REALLY EXCITING.

YEAH. THANK YOU SO MUCH FOR SHARING THOSE UPDATES.

THANK YOU, ASSISTANT SUPERINTENDENT.

ALL RIGHT, MOVING RIGHT ALONG.

WE WILL HAVE DOCTOR DEWAN.

CAN YOU INTRODUCE THE NEXT ITEM, PLEASE? SO THE NEXT ITEM WE HAVE FOR YOU TONIGHT IS THE LCAP MID-YEAR SUPPLEMENTAL REPORT.

[D. LCAP Mid-Year Supplemental Report]

AND THIS IS A NEW REQUIREMENT THAT CAME UNDER ASSEMBLY BILL 130, WHICH REQUIRES ALL LEAS TO PRESENT A MID-YEAR UPDATE ON THE 23-24 LCAP.

THE REQUIREMENT UNDER THE ASSEMBLY BILL IS THAT THE MID-YEAR UPDATE IS PRESENTED BY FEBRUARY 28TH OF THIS YEAR, AND IT MUST BE DONE AT A REGULARLY SCHEDULED MEETING OF THE COUNTY BOARD OF EDUCATION.

SO TONIGHT WE'RE GOING TO PROVIDE THE SUPPLEMENT FOR THE ANNUAL UPDATE.

WE'RE GOING TO SHARE MID-YEAR OUTCOME DATA AS RELATED TO THE METRICS AND SOME UPDATES.

MID-YEAR ON EXPENDITURES AND IMPLEMENTATION DATA.

PROVIDING THIS EVENING'S REPORT IS DOCTOR TERESA SHUPE, OUR ASSISTANT SUPERINTENDENT OF SERVICES, DOCTOR JEN ANNE, OUR EXECUTIVE DIRECTOR OF OUR SPECIAL EDUCATION PROGRAMS, AND OUR EXECUTIVE DIRECTOR OF THE ALTERNATIVE EDUCATION DEPARTMENT, DANE CALDWELL HOLDEN.

THANK YOU FOR BEING HERE TONIGHT.

OH. THANK YOU. THANK YOU.

GOOD EVENING AGAIN, DOCTOR DEWAN, PRESIDENT BERTA AND TRUSTEES.

TONIGHT WE ARE PRESENTING TO YOU THE MID-YEAR REPORT FOR OUR LOCAL CONTROL ACCOUNTABILITY PLAN.

I'M HERE TONIGHT WITH DIRECTOR OF SPECIAL EDUCATION, DOCTOR JEN ANN AND DIRECTOR OF ALTERNATIVE EDUCATION, DANE CALDWELL HOLDEN.

NEXT SLIDE PLEASE.

THE LOCAL CONTROL ACCOUNTABILITY PLAN IS USED BY SCCOE TO CREATE OR EXPAND UPON GOALS, CREATE ACTION PLANS FOR EACH, AND ENSURE THAT OUR BUDGETS ARE ALIGNED TO IMPROVE STUDENT OUTCOMES.

WE UPDATE OUR PLAN ANNUALLY BASED ON OUTCOME DATA AND COMMUNITY INPUT.

EACH YEAR, WE SURVEY STUDENTS, STAFF, AND PARENTS TO DETERMINE HOW WELL WE ARE MEETING OUR CURRENT GOALS AND FOR RECOMMENDATIONS FOR WHICH GOALS WE WILL PURSUE NEXT YEAR.

NEXT SLIDE, PLEASE.

AS YOU CAN SEE, WE HAVE CREATED FIVE GOALS THAT WE BELIEVE HELP US BEST SERVE OUR STUDENTS.

THESE INCLUDE GOALS TO INCREASE CULTURAL RELEVANCE IN INSTRUCTION, INCREASE ACCESS TO CAREER TECHNICAL EDUCATION AND COLLEGE PREPARATION PROGRAMS, AND SPECIFICALLY SUPPORTING THE NEEDS OF OUR FOSTER YOUTH AND COMMUNITY SCHOOL POPULATIONS.

NEXT SLIDE PLEASE.

EACH YEAR, WE SURVEY STUDENTS, STAFF AND PARENTS TO DETERMINE HOW WELL WE ARE MEETING OUR CURRENT GOALS AND FOR RECOMMENDATIONS FOR WHICH GOALS WE WILL PURSUE THE NEXT YEAR.

WE ALSO WORK WITH OUR DISTRICT AND SITE ADVISORY COMMITTEES AND PARENT ADVISORY COMMITTEE TO SOLICIT INPUT ABOUT OUR CURRENT AND FUTURE GOALS.

WE SURVEY IN MULTIPLE LANGUAGES TO ENSURE THAT EVERY FAMILY FEELS HEARD.

NEXT SLIDE, PLEASE.

THE CHART ABOVE REPRESENTS HOW MUCH OF OUR LCAP BUDGET HAS BEEN SPENT SO FAR THIS YEAR.

THE LOW PERCENTAGE SPENT FOR GOALS TWO AND THREE ARE A RESULT OF THE NECESSITY TO SPEND DOWN A NUMBER OF CATEGORICAL AND GRANT DOLLARS PRIOR TO SPENDING LCAP MONIES. WE WILL CONTINUE TO SPEND DOWN OUR LCAP BUDGET AND FULLY UTILIZE THAT FUNDING BEFORE THE END OF THE SCHOOL YEAR ON JUNE 30TH.

NEXT SLIDE, PLEASE.

AND MY COLLEAGUE, DOCTOR JENNY ANN WILL TAKE IT AWAY FROM HERE.

THANK YOU. THROUGHOUT THE SCHOOL YEAR, STAFF AND THE SPECIAL EDUCATION AND ALTERNATIVE EDUCATION DEPARTMENTS PARTAKE IN SPECIALIZED TRAINING FOCUSED ON THE UNIQUE NEEDS OF THEIR STUDENTS.

STUDENTS IN BOTH DEPARTMENTS ARE CREATING AND GROWING THEIR OWN GARDEN PROJECTS AT MULTIPLE SITES.

STUDENTS AT SUNOL COMMUNITY SCHOOL, FOR EXAMPLE, GREW OVER 300 POUNDS OF FRESH PRODUCE TO EAT AND DONATE TO LOCAL FOOD BANKS.

NEXT SLIDE PLEASE.

ALL COURT SCHOOL STUDENTS TAKE PART IN CTE CAREER EXPLORATION CLASSES.

EXCUSE ME. IN ADDITION, WE'VE OPENED A NEW HORTICULTURE PATHWAY AT OSBORNE SCHOOL IN PARTNERSHIP WITH FOOTHILL COLLEGE.

STUDENTS IN THIS PATHWAY CAN EARN DUAL ENROLLMENT CREDIT WITH FOOTHILL WHILE COMPLETING HIGH SCHOOL GRADUATION REQUIREMENTS AT BLUE RIDGE HIGH SCHOOL.

ALL STUDENTS TAKE PART IN CULINARY ARTS AND CONSTRUCTION PATHWAYS.

STUDENTS WHO COMPLETE THE CONSTRUCTION PATHWAY CAN BE ELIGIBLE FOR PRE-APPRENTICESHIP OPPORTUNITIES AND CAN EARN UP TO 14 INDUSTRY RECOGNIZED CERTIFICATES.

STUDENTS IN BOTH COMMUNITY SCHOOLS ARE ABLE TO EXPERIMENT WITH ROBOTICS AND HORTICULTURE PROJECTS, AND THE STUDENT AT THE SOUTH COUNTY ANNEX ALSO HAVE ACCESS TO A MAKERSPACE.

[01:35:07]

THE SPECIAL EDUCATION DEPARTMENT HAS RECENTLY BROUGHT ON A PROGRAM MANAGER TO SUPPORT THEIR STUDENTS AND STAFF WITH WORKABILITY PROGRAMS. CURRENTLY, THEY HAVE A PROGRAM MANAGER SUPPORTING THE POST-SECONDARY STUDENTS WITH MEANINGFUL EMPLOYMENT OPPORTUNITIES WHERE THEY ARE WORKING IN THE COMMUNITY AND EARNING A WAGE. IN ADDITION, THE PROGRAM MANAGER, IN COLLABORATION WITH OUR SPECIAL EDUCATION TEACHERS, HAS CREATED MICRO-BUSINESSES TO ENCOURAGE THE SKILL DEVELOPMENT FOR STUDENTS IN PREPARATION FOR WORKING IN THE COMMUNITY.

NEXT SLIDE PLEASE.

OUR ADMINISTRATIVE TEAMS PROVIDE COFFEE CHATS TO THE PARENTS OF OUR STUDENTS IN ORDER TO ENCOURAGE COLLABORATION, BUILD RELATIONSHIPS, PROVIDE RESOURCES, AND ANSWER QUESTIONS. ADDITIONALLY, BOTH DEPARTMENTS HAVE EXPANDED THEIR GARDENING PROGRAMS IN ORDER TO PROVIDE ADDITIONAL TIME TO OUR STAFF AND STUDENTS THROUGHOUT THE SCHOOL YEAR.

BOTH DEPARTMENTS CONTINUE TO UTILIZE MONTHLY MEETINGS TO ENGAGE STAFF WITH BEST PRACTICES FOR POSITIVE BEHAVIORAL SUPPORT, WHILE ALSO USING REFLECTIVE PRACTICES AND PRESENTING ON SUCH TOPICS AS MINDFULNESS AND SELF-CARE.

THE SPECIAL EDUCATION PROGRAM IS PROVIDING WEEKLY AMERICAN SIGN LANGUAGE CLASSES FOR ALL STAFF AND FAMILIES AS AN INTRODUCTORY COURSE TO SUPPORT OUR FAMILIES WITH COMMUNICATION, AND ALSO HOLDS MONTHLY FAMILY ENGAGEMENT NIGHTS.

NEXT SLIDE. EACH DISTRICT IN OUR COUNTY HAS AN ASSIGNED FOSTER, YOUTH SERVICES MANAGER AND FOSTER AND HOMELESS YOUTH SPECIALIST TO SUPPORT EVERY SCHOOL DISTRICT IN ITS RESPONSIBILITY TO SERVE QUALIFIED YOUTH FROM THE FOSTER AND HOMELESS SERVICES DEPARTMENT.

IN ADDITION, FOSTER YOUTH SERVICES MANAGERS HAVE SPECIFIC YOUTH CASES ASSIGNED TO THEM AS THEY PROVIDE EDUCATIONAL COORDINATION COORDINATION FOR YOUTH SERVED IN FOSTER CARE.

WORKING WITH THE DISTRICT TO WHICH THEY ARE ASSIGNED.

THE FOSTER AND HOMELESS YOUTH STAFF PROVIDE TECHNICAL ASSISTANCE FOR ALL DISTRICTS AT ITS MONTHLY COMMUNITY OF PRACTICE MEETINGS, AND DIFFERENTIATED ASSISTANCE AT THEIR CHECK IN MONTHLY MEETINGS.

IN ADDITION, THE FOSTER AND HOMELESS STAFF ADDRESS THE NEEDS OF SCHOOL SITES, DISTRICTS, FAMILIES, AND COMMUNITY BASED ORGANIZATIONS SERVING CHILDREN IN PARTNERSHIP.

DATA FROM ALL SCHOOL DISTRICTS.

SANTA CLARA COUNTY PROBATION AND SANTA CLARA COUNTY DEPARTMENT OF FAMILY AND CHILDREN'S SERVICES SEND THEIR DATA TO THE WAREHOUSE REGULARLY FOR POPULATION AND USAGE USAGE IN THE FOSTER VISION TOOL.

THE FOSTER VISION STEERING COMMITTEE CONTINUES TO MEET REGULARLY TO DISCUSS USAGE, FUNCTIONALITY AND DATA GOVERNANCE TOPICS FOR CONTINUOUS IMPROVEMENT OF THE TOOL.

NEXT SLIDE PLEASE.

AED CONTINUES TO WORK WITH OUR COMMUNITY PARTNERS TO PROVIDE A VARIETY OF MENTAL HEALTH SUPPORTS AND SOCIAL EMOTIONAL LEARNING FOR OUR COMMUNITY SCHOOL STUDENTS.

WE'VE OPENED A WELLNESS CENTER AT SOUTH COUNTY ANNEX TO SERVE OYA AND AED STUDENTS.

THE WELLNESS SPECIALIST THERE WORKS WITH COUNSELING STAFF FROM REBEKKA'S CHILDREN'S SERVICES TO INTEGRATE GROUP AND INDIVIDUAL COUNSELING SERVICES FOR OUR STUDENTS.

AT SNELL COMMUNITY SCHOOL, EE CONTINUE TO USE OUR OWN THERAPISTS TO SERVE STUDENTS AND INCREASE THE USE OF SOCIAL EMOTIONAL LEARNING, SEL CURRICULUM IN EACH CLASSROOM.

EACH COMMUNITY SCHOOL PRINCIPAL NOW ENCOURAGES OUR DISTRICT PARTNERS TO ATTEND IN PERSON TRANSITION MEETINGS APPROXIMATELY ONE MONTH PRIOR TO A STUDENT'S TRANSITION DATE.

WE HAVE FOUND THIS TO BE A VERY EFFECTIVE WAY FOR STUDENTS AND DISTRICTS TO CREATE A TRANSITION PLAN AND TO CREATE THE STUDENT, AND TO INCREASE THE STUDENT'S CHANCE OF SUCCESS ONCE THEY RETURN TO SCHOOL.

NEXT SLIDE, PLEASE.

AS MY COLLEAGUE DOCTOR GARGUILO PRESENTED LAST WEEK ON THE DASHBOARD, I'M GOING TO DIVE A LITTLE BIT DEEPER NOW.

NEXT SLIDE PLEASE.

THE CALIFORNIA ACCOUNTABILITY DASHBOARD AND SYSTEM OF SUPPORT EMERGED IN CALIFORNIA WITH THE ONSET OF THE LOCAL CONTROL FUNDING FORMULA, WHICH WAS IMPLEMENTED IN 2013.

THE CALIFORNIA SCHOOL DASHBOARD PRINCIPLES ARE LISTED ABOVE.

NEXT SLIDE, PLEASE.

THIS SLIDE SHOWS THE OVERALL SANTA CLARA COUNTY OFFICE OF EDUCATION DATA.

CHRONIC ABSENTEEISM IS 37%.

THE SUSPENSION RATE IS 4.1%, THE GRADUATION RATE IS 70%, WHICH IS AN 8.4 INCREASE FROM LAST YEAR.

ENGLISH LEARNER PROGRESS INCREASED BY 23.8%.

A NOTE ABOUT DISTRICT OF SPECIAL EDUCATION ACCOUNTABILITY AT THE LEA LEVEL DASHBOARD RESULTS FOR OUR SPECIAL EDUCATION PROGRAM, STUDENTS ARE ASSIGNED TO THEIR DISTRICTS OF RESIDENCE, BUT AT THE SCHOOL LEVEL, THEIR RESULTS STAY WITH OUR SPECIAL EDUCATION PROGRAM AND ARE REFLECTED ON SPECIAL EDUCATION'S SCHOOL DASHBOARD.

BECAUSE OF THIS DIFFERENCE, MANY MORE STUDENTS ARE INCLUDED IN THE CALCULATIONS FOR OUR SPECIAL EDUCATION PROGRAMS SCHOOL LEVEL DASHBOARD THAN FOR THE SCCOE LEA LEVEL DASHBOARD.

NEXT SLIDE, PLEASE.

THE SLIDE ABOVE SHOWS THE 2022 2023 CALIFORNIA DASHBOARD DATA FOR OUR COMMUNITY SCHOOLS.

[01:40:04]

NOTE THAT DUE TO THE TRANSIENT NATURE OF THE POPULATION AND RELATIVELY NO NUMBER OF STUDENTS, DATA POOLED MAY NOT REFLECT THE ACTUAL POPULATION AT ANY GIVEN TIME.

THE TWO DASHBOARD INDICATORS MEASURED ARE GOING TO BE SUSPENSION RATE AND GRADUATION RATE.

NEXT SLIDE PLEASE.

THIS SLIDE SHOWS THE 2022 2023 DASHBOARD SUSPENSION RATE FOR COMMUNITY SCHOOLS.

THE SUSPENSION RATE IS 10.7%, WHICH UNFORTUNATELY INCREASED 4.7% OVER THE PRIOR YEAR.

ALTHOUGH THIS IS NOT OPTIMAL, IT DOES POINT TO THE CHALLENGES THAT SOME OF OUR STUDENTS FACE WHILE UNDERGOING EXPULSION, AND AED IS NOW PUT INTO PLACE EVEN MORE INTERVENTIONS AND THERAPEUTIC SUPPORTS.

ALL SIGNS POINT TO A LOWER SUSPENSION RATE FOR OUR 2324 SCHOOL YEAR.

NEXT SLIDE. THE GRADUATION RATE FOR COMMUNITY SCHOOL IS 77.1%, WHICH IS WELL ABOVE THE STATE MINIMUM REQUIREMENT AND DEMONSTRATES AN INCREASE OF 16.2% FROM THE PREVIOUS YEAR.

IT IS VERY ENCOURAGING TO US AND POINTS TO OUR ONGOING EFFORTS TO INCREASE RIGOR, RELEVANCE AND ENGAGEMENT IN INSTRUCTION.

NEXT SLIDE. THIS SLIDE SHOWS THE 2022-23 CALIFORNIA DASHBOARD DATA FOR COURT SCHOOLS.

BOTH OF OUR COURT SCHOOLS, JUVENILE HALL AND BLUE RIDGE AT THE RANCH ARE INCLUDED IN THIS REPORT.

THE SUSPENSION RATE IS 0%, WHICH REFLECTS A SHARED UNDERSTANDING BETWEEN SANTA CLARA COUNTY JUVENILE PROBATION AND THE COE THAT NO STUDENT WILL BE DENIED ACCESS TO EDUCATION BECAUSE OF BEHAVIOR ISSUES OUTSIDE OF THE CLASSROOM.

NEXT SLIDE.

THIS SLIDE SHOWS THE 2022-2023 GRADUATION RATE FOR COURT SCHOOLS.

AGAIN, NOTE THAT DUE TO THE TRANSIENT NATURE OF THE POPULATION AND RELATIVELY NO LOW NUMBERS OF STUDENTS DETAINED, DATA REPORTED MAY NOT REFLECT THE ACTUAL POPULATION AT ANY GIVEN TIME. THE GRADUATION RATE IS 66.7%, WHICH IS AN INCREASE OF 1.6% FROM THE PRIOR YEAR AND ONLY 1.3% BELOW THE STATE REQUIREMENT FOR ALL HIGH SCHOOLS.

ALTHOUGH THE NUMBER DISQUALIFIES SSCOE COURT SCHOOLS FOR COMPREHENSIVE SUPPORT AND IMPROVEMENT FUNDS, THE NUMBER IS EXCITING TO US AS OUR OUR STUDENTS TYPICALLY COME TO US YEARS BEHIND IN CREDITS AND ACADEMIC SKILLS.

AED STAFF WORKS DILIGENTLY TO HELP STUDENTS REGAIN THEIR OWN SENSE OF AGENCY AND TO TAKE CONTROL OF THEIR OWN EDUCATIONAL SUCCESS.

NEXT SLIDE. THIS SLIDE SHOWS THE 2023 CALIFORNIA DASHBOARD DATA FOR THE SPECIAL EDUCATION PROGRAM IN REGARDS TO OUR GRADUATION RATE OF 1.5%.

THIS NUMBER QUALIFIES AS SPECIAL EDUCATION DEPARTMENT FOR COMPREHENSIVE SUPPORT AND IMPROVEMENT FUNDS.

WHILE OUR GRADUATION RATE IS LOW, IT IS IMPORTANT TO NOTE THAT THE MAJORITY OF OUR STUDENTS ARE WORKING TOWARDS A CERTIFICATE OF COMPLETION, WHICH IS NOT COUNTED IN THE GRADUATION CALCULATION.

LOOKING FORWARD, OUR STUDENTS WHO TAKE THE CALIFORNIA ALTERNATE ASSESSMENT WILL HAVE THE OPPORTUNITY TO EARN A DIPLOMA THROUGH THE ALTERNATE PATHWAY.

NEXT SLIDE. OUR SCORES INDICATED IMPROVEMENT IN BOTH ELA AND MATH, AND WE CLOSELY MONITOR INDIVIDUAL STUDENT PROGRESS.

STUDENTS IN THE SPECIAL EDUCATION PROGRAM TAKE EITHER THE SMARTER BALANCED ASSESSMENT OR THE CALIFORNIA ALTERNATE ASSESSMENT IN ACCORDANCE WITH THEIR IEP.

OUR COUNTY OFFICE CONTINUES TO COLLABORATE WITH OTHER COUNTY OFFICE SPECIAL EDUCATION DEPARTMENTS THROUGHOUT THE STATE TO ADVOCATE FOR THE UNIQUE NEEDS OF STUDENTS WITH EXTENSIVE SUPPORT NEEDS AS IT RELATES TO STATE ASSESSMENTS.

NEXT SLIDE. THE TABLES REFLECTED HERE ARE SOURCED FROM DATAQUEST, WHICH IS A SYSTEM THAT CDE USES TO PROVIDE THE PUBLIC WITH EDUCATIONAL DATA. THIS IS SHOWN TO GIVE YOU EVEN MORE INFORMATION RELATED TO ATTENDANCE THAT CAN THEN CAN BE FOUND ON THE DASHBOARD.

THE FIRST TABLE SHOWS ABSENCES BY TYPE.

WE WANT TO POINT OUT THAT THE LAST TWO YEARS, WE ARE SEEING A POSITIVE TREND IN AN INCREASE IN EXCUSED ABSENCES COMPARED TO UNEXCUSED.

WITH THAT SAID, YOU CAN SEE ATTENDANCE IS STILL AN ISSUE THAT OUR DEPARTMENT IS ADDRESSING.

WE ARE ACTIVELY SUPPORTING FAMILIES WITH SOLUTIONS TO HAVE THEIR CHILDREN ATTEND SCHOOL ON A DAILY BASIS.

WE ARE DOING THIS BY CREATING RELATIONSHIPS, BUILDING PARTNERSHIPS AND CONNECTING OUR FAMILIES TO RESOURCES.

NEXT SLIDE. OUR SUSPENSION RATE REMAINS LOW AT 1.9%.

AS WE STRIVE TO LOOK AT ALTERNATIVES TO SUSPENSION FOR STUDENTS WITH EXTENSIVE SUPPORT NEEDS.

OUR STAFF ARE TRAINED IN POSITIVE BEHAVIOR INTERVENTION AND SUPPORTS AND PRO ACT, WHICH INCLUDES SPECIFIC TRAINING ON UTILIZING CRISIS COMMUNICATION AND DE-ESCALATION TECHNIQUES.

EACH OF OUR EIGHT CLUSTERS HAS A BOARD CERTIFIED BEHAVIOR ANALYST ASSIGNED TO SUPPORT WITH STUDENT NEEDS, SO THAT ALL STUDENTS HAVE THE APPROPRIATE SUPPORTS IN PLACE IN ORDER

[01:45:01]

TO ADDRESS THEIR INDIVIDUAL NEEDS, WHICH MAY INCLUDE BEHAVIOR GOALS AND OR BEHAVIOR PLANS AS NEEDED.

NEXT SLIDE. THIS CONCLUDES OUR PRESENTATION AND WE LOOK FORWARD TO AN EXCITING SCHOOL YEAR AHEAD.

THANK YOU TO ALL OF YOU FOR THE PRESENTATION AND UPDATES.

TRUSTEES, ARE THERE QUESTIONS OR COMMENTS? DID I HEAR CORRECTLY? 300 POUNDS OF PRODUCE.

THAT IS AMAZING.

THAT'S FROM ONE SCHOOL.

I NEED TO LEARN FROM THE STUDENTS CLEARLY.

THANK YOU FOR SHARING THAT.

I DID HAVE. OH, GO AHEAD.

TRUSTEE CHON I JUST WANTED TO SAY THANK YOU FOR THE PRESENTATION.

I KNOW THAT EL CAP IS, KIND OF A BEAST, AND SO I JUST SAY THANK YOU FOR, YOU KNOW, CLEARING IT, KIND OF EXPLAINING THE GOALS AND GIVING US A REALLY COMPREHENSIVE BUT OVER.

I KNOW, I KNOW, THIS IS A GREAT OVERVIEW OF WHAT IS ACTUALLY HAPPENING IN THE NITTY GRITTY DETAILS OF IT ALL.

BUT, I APPRECIATED THAT.

AND I JUST WANTED TO THANK YOU FOR YOUR WORK.

AND IN DOING THIS, BECAUSE I KNOW IT'S A LOT.

SO THANK YOU.

YOU KNOW, TRUSTEE CHON.

I HAD A QUESTION ON SPECIFIC TO THE COLLEGE AND CAREER CATEGORY.

I'M WONDERING IF YOU COULD EXPAND A LITTLE BIT MORE HOW THAT'S EVALUATED IN TERMS OF I KNOW WITHIN EACH OF THE DIFFERENT PROGRAMS, BUT, HOW THAT'S CALCULATED IN SOME OF THE DIFFERENT SETTINGS.

IF YOU COULD JUST PROVIDE A LITTLE BIT MORE INFORMATION FOR THE ALTERNATIVE ED DEPARTMENT, WE PRIMARILY CALCULATE THAT BASED ON THE NUMBER OF STUDENTS TAKING CAREER EXPLORATION OR CAREER TECHNICAL EDUCATION CLASSES.

THE MAJORITY OF OUR STUDENTS HAVE BEEN IN THOSE COURSES HAVE BEEN OUR COURT SCHOOL STUDENTS, BECAUSE THAT'S WHERE WE'VE DEVELOPED THE MOST PATHWAYS, AND WE'RE TRYING TO BRING MORE TO THE COMMUNITY SCHOOL STUDENTS, ESPECIALLY NEXT YEAR WITH ALL THE HORTICULTURE AND SOLAR PROJECTS THAT WE'RE PUTTING ON.

SO THAT'S THAT'S HOW WE MEASURE IT.

WE ALSO RUN A VERY SUCCESSFUL INDEPENDENT STUDY PROGRAM THROUGH THE COMMUNITY SCHOOLS, WHICH NOW, WELL, FOR THE FIRST TIME IN 20 2223, HAS BEEN UC AGD APPROVED AND NCAA CERTIFIED.

SO WE ACTUALLY HAVE STUDENTS THAT ARE THAT ARE LEAVING OUR INDEPENDENT STUDY PROGRAM AND GOING ON TO FOUR YEAR COLLEGES.

THAT'S AWESOME. THANK YOU FOR SHARING THAT.

SO THE SPECIAL EDUCATION PROGRAM IS A BIT DIFFERENT, BUT WE ARE VERY CENTERED ON OUR STUDENTS.

KIND OF GETTING TO THEIR FURTHEST POTENTIAL.

SO WE USE OUR WORKABILITY PROGRAM, WHICH I DO BELIEVE WE WILL HAVE OUR WORKABILITY PROGRAM MANAGER PRESENTING AT A FUTURE DATE.

TO GIVE SOME MORE DETAILS ABOUT WHAT THAT PROGRAM LOOKS LIKE, SOME OF OUR STUDENTS ARE ACTIVE IN ACTIVE OUT IN THE COMMUNITY IN JOB PLACEMENT, AND SOME ARE DOING MICROBUSINESS WORK. AND THEN ALSO OUR IEP, OUR STUDENTS IEPS REFLECT, SPECIFIC TRANSITION PLANS.

AND SO THOSE ARE VERY UNIQUE TO THE STUDENT.

IF IT'S EITHER IN, INDEPENDENT LIVING SKILLS, COLLEGE AND CAREER READINESS, DEPENDING WHAT THAT LOOKS LIKE FOR THE STUDENT.

SO THOSE ARE OUR TWO MEASURES.

THANK YOU.

AND CAN YOU TALK A LITTLE BIT MORE ABOUT THE WHERE WE'RE AT IN TERMS OF YOU HAD MENTIONED AN ALTERNATIVE PATHWAY TO EARNING A DIPLOMA OR THE THROUGH THE CERTIFICATE.

I GUESS IT'S THEY'RE SEPARATE THINGS.

BUT CAN YOU TALK A LITTLE BIT MORE ABOUT WHERE WE'RE AT IN TERMS OF OUR PROGRAMS WITH PROVIDING THAT PATHWAY TO STUDENTS? SURE. WE'RE IN COLLABORATION ON TWO DIFFERENT LEVELS.

I MEET WITH OTHER SPECIAL EDUCATION ADMINISTRATORS OF COUNTY OFFICE PROGRAMS, AND THIS HAS BEEN A FREQUENT TOPIC THERE, AS COUNTY OFFICES TRY TO MAKE SURE THAT WE'RE KIND OF ALIGNED IN HOW WE'RE, SUPPORTING OUR STUDENTS IN HAVING ACCESS TO THIS PATHWAY.

AND THEN ALSO, PARTICIPATING IN COLLABORATION BETWEEN BOTH NORTHWEST CELPA AND SOUTHEAST CELPA WHO HAVE GATHERED THEIR DISTRICTS TO TALK ABOUT WHAT THAT LOOKS LIKE FOR THEIR STUDENTS.

IT IS ACTUALLY VERY EXCITING.

AND IT IS I FEEL LIKE WE'RE RIGHT WHERE WE NEED TO BE IN TERMS OF WHEN WE COMPARE OURSELVES TO OTHER COUNTY OFFICES.

THERE ARE SOME INTERESTING, QUESTIONS THAT HAVE COME UP AS IT RELATES TO COUNTY OFFICE PROGRAMS IN TERMS OF WHO WILL ISSUE THE DIPLOMA, WOULD IT BE THE COUNTY OFFICE, STUDENTS, DISTRICT OF RESIDENTS, STUDENTS, DISTRICT OF ATTENDANCE? SO THERE'S A LOT OF DIFFERENT PIECES.

AND THEN WHAT? WHO IS CREATING THE MEASUREMENT? WILL IT BE ONE UNIFIED APPROACH? BUT THE GOOD NEWS IS I THINK WE ARE WE ARE HAVING THE CONVERSATION.

SO WE HAVE A SEAT AT THE TABLE AND I THINK WE'LL BE WE'RE RIGHT ON TRACK WITH WHERE WE NEED TO BE.

GREAT. IT WOULD BE GREAT FOR THE BOARD TO GET AN UPDATE OF THAT TOO, AS IT CONTINUES TO PROGRESS.

IT'S REALLY EXCITING TO HEAR ABOUT, DOCTOR DEWAN.

THANK YOU, PRESIDENT BERTA. I JUST WANTED TO ADD THAT THIS ALTERNATE PATHWAY TO A DIPLOMA IS A NEW PROVISION IN EDUCATION CODE THAT CAME ABOUT

[01:50:05]

AS A RESULT OF SENATE BILL 114, AND IT ALSO HELPS BRING THE STATE OF CALIFORNIA INTO CLOSER COMPLIANCE WITH IDEA AND FEDERAL REGULATIONS.

THANK YOU. WELL SEEING NO OTHER QUESTIONS OR COMMENTS.

THANK YOU SO MUCH FOR THE PRESENTATION INFORMATION.

THANK YOU. APPRECIATE IT.

THANK YOU.

ALL RIGHT.

THIS BRINGS US TO BOARD COMMITTEE REPORTS.

[A. Committee members may provide or report on recent committee activities.]

AT THIS TIME, WE WILL HEAR FROM COMMITTEE REPORTS FROM COMMITTEES THAT HAVE MET SINCE OUR LAST MEETING.

THE FOLLOWING COMMITTEE HAS MET SINCE THE LAST MEETING.

THE BUDGET STUDY COMMITTEE.

DOCTOR DEWAN, WILL YOU PLEASE SHARE ABOUT THE BUDGET STUDY COMMITTEE? YES. THANK YOU AGAIN. PRESIDENT BERTA.

SO THIS TRUSTEES THIS AFTERNOON, THE BUDGET STUDY COMMITTEE MET AND WE ADDRESSED THREE AGENDA ITEMS. THE FIRST WAS PROVIDING AN OVERVIEW OF THE GOVERNOR'S JANUARY BUDGET PROPOSAL, A VERY HIGH LEVEL OVERVIEW, BUT ALSO SOME OF THE CONSIDERATIONS FROM THAT BUDGET PROPOSAL AND HOW THEY IMPACT ASSUMPTIONS FOR BUDGET DEVELOPMENT FOR OUR OFFICE.

SECONDLY, WE PROVIDED AN OVERVIEW OF OUR COUNTY OFFICE BUDGET DEVELOPMENT AND FISCAL PLANNING TIMELINE, RESOURCES AND BUDGET ASSUMPTIONS, INCLUDING ADDRESSING THINGS RELATED TO OUR INDIRECT COST RATES, SALARIES, BENEFITS, AND SOME OF THE OTHER CALCULATIONS, TO WHICH WE'RE WE'RE REQUIRED TO BE RESPONSIVE, AND BUDGET DEVELOPMENT FROM EDUCATION CODE AND LIKEWISE AND FINALLY, WE PROVIDED AN UPDATE ABOUT SPECIAL EDUCATION PROGRAMING AND SOME OF THE ASSUMPTIONS AS WE ARE WORKING ON THE BUDGET FOR THE SPECIAL EDUCATION PROGRAM.

THANK YOU, DOCTOR DEWAN.

AND, I KNOW THAT THERE'S BEEN A COUPLE OF MEETINGS SINCE THE WARMENHOVEN INCLUSION COLLABORATIVE, COMMITTEE, BUT I THOUGHT I WOULD PROVIDE THAT UPDATE NOW SINCE IT'S AGENDIZED FOR BOARD COMMITTEE REPORTS.

SO THE WARMENHOVEN ADVISORY COMMITTEE MET ON JANUARY 12TH, 2024 WITH DOCTOR DEWAN COUNTY SUPERINTENDENT OF SCHOOLS PROVIDING A WELCOME TO ALL AND EXPRESSING GRATITUDE TO THE COMMITTEE BENEFACTOR, CHARMAINE WARMENHOVEN.

THE INCLUSION COLLABORATIVE INTRODUCED THEIR NEWEST TEAM MEMBER, HEATHER ANDERSON, INCLUSION TRAINING SPECIALIST, AND REVIEWED THEIR STATEMENT OF PURPOSE AND VALUES TO BEGIN 2024.

AND I KNOW BOTH OF THOSE STUDENTS HAVE REACHED OUT ALSO TO TRUSTEE SREEKRISHNAN AND HAVE COME BEFORE OUR BOARD AS WELL TO SHARE DURING PUBLIC COMMENTS.

SO IT WAS REALLY GREAT TO SEE, YOU KNOW, THEM EXTENDING THEIR THEIR REACH WITH THE COMMITTEE.

THE INCLUSION COLLABORATIVE, 2022 2023 ANNUAL REPORT WAS INTRODUCED.

KEY ATTENDANCE STATISTICS AND PARTICIPANT EVALUATION FEEDBACK WAS SHARED FROM THE 2023 INCLUSION COLLABORATIVE STATE CONFERENCE.

ADDITIONALLY, THE TEAM SHARED INFORMATION ON THE RECENT FEDERAL GRANT THAT THEY RECEIVED AND THEIR INTENDED PROGRAM DATA ADVENTURES.

THE MEETING CLOSED WITH INPUT FROM THE ADVISORY COMMITTEE ON HOW THE INCLUSION COLLABORATIVE CAN MAINTAIN SUSTAINABILITY, WIDEN THEIR COMMUNITY OUTREACH, AND BETTER CONNECT AND PARTNER.

THE NEXT ADVISORY COMMITTEE MEETING IS SCHEDULED FOR MAY 3RD, 2024.

ALWAYS A PLEASURE TO BE A PART OF THAT COMMITTEE.

AND THAT BRINGS US TO ARE THERE ANY OTHER COMMITTEE REPORTS THAT WE MISSED? OKAY. THAT BRINGS US TO COUNTY BOARD OF EDUCATION MEMBER REPORTS IN COMPLIANCE WITH BROWN ACT INFORMATION SHARED DURING COUNTY BOARD OF EDUCATION MEMBER REPORTS MUST ONLY

[A. The members of the Board may give reports on any activities related to their duties as members of the Santa Clara County Board of Education]

INCLUDE THOSE ACTIVITIES SPECIFICALLY RELATED TO OUR DUTIES AS TRUSTEES OF THE SANTA CLARA COUNTY BOARD OF EDUCATION.

NOW, WOULD ANY TRUSTEE WISH TO PROVIDE A REPORT ON ACTIVITIES SPECIFICALLY RELATED TO THEIR DUTIES AS MEMBERS OF, AND WITHIN THE JURISDICTION OF THE SANTA CLARA COUNTY BOARD OF

[01:55:04]

EDUCATION? TRUSTEE LARI.

AND SO I'VE BEEN WORKING ON A PUBLIC HEALTH SERIES WITH THE LEAGUE OF WOMEN VOTERS.

OUR SECOND EVENT IS ON POST INFECTIOUS DISEASE AND WILL BE ON ZOOM ON FEBRUARY 12TH AT NOON.

A SIZABLE PERCENTAGE OF PATIENTS SUFFERING FROM INFECTIOUS DISEASES LIKE COVID AND LYME AND TICK BORNE ILLNESSES DEVELOP CHRONIC SYMPTOMS. THESE CONDITIONS, LIKE LONG COVID AND CHRONIC LYME AND TICK BORNE DISEASES, ARE KNOWN TO HAVE A DEVASTATING IMPACT ON YOUNG PEOPLE WHEN THEY EITHER AFFLICTED THEMSELVES OR ARE IMPACTED WHEN THEIR FAMILY MEMBERS DEVELOP THESE CHRONIC HEALTH CONDITIONS.

OUR PANEL FROM UCSF AND THE BAY AREA LYME FOUNDATION WILL DISCUSS THE WORK BEING DONE TO DEVELOP DIAGNOSTICS AND THERAPEUTICS TO ADDRESS AND MANAGE THESE VERY CHALLENGING CONDITIONS. THANK YOU.

THANK YOU. TRUSTEE LARI.

OTHER BOARD MEMBER REPORTS.

TRUSTEE. SREEKRISHNAN.

YEAH, JUST VERY QUICKLY.

I MET WITH THE SANTA CLARA READING COALITION WITH DOCTOR DEWAN ON FRIDAY, AND I KNOW THERE WILL BE MORE UPDATES THERE.

AND DISCUSSED A BIT ABOUT THE DOXXING RESOLUTION WITH TAEHYUNG.

AND SO, AND I KNOW THERE ARE MORE UPDATES ABOUT OUR STUDENT ADVISORY BOARD MEETING.

AND SO, THANK YOU FOR ALL OF STAFF'S WORK ON THOSE.

THANK YOU. THANK YOU.

TRUSTEE SREEKRISHNAN.

ANY OTHER BOARD UPDATES? OUR BOARD REPORTS, I SHOULD SAY.

AND I'LL JUST SHARE BRIEFLY THAT I HAD THE OPPORTUNITY TO PROVIDE A KEYNOTE AT THE SANTA CLARA COUNTY SERVICE CENTER THROUGH CTA.

THEY HAD THEIR ANNUAL BOARD MEMBERS DINNER WITH A LOT OF OUR LOCALS AND, AND LOCAL SCHOOL BOARD MEMBERS.

SO IT WAS GREAT TO, TO, BE ABLE TO BE IN COMMUNITY WITH THEM.

AND SO THANK YOU FOR THOSE REPORTS, TRUSTEES.

WE WILL NOW MOVE TO OUR NEXT AGENDA ITEM, THE SUPERINTENDENT'S REPORT.

[A. The superintendent may give a report on any activities related to her duties.]

DOCTOR DEWAN. YES.

THANK YOU. JUST A FEW HIGHLIGHTS I WANTED TO SHARE ON.

ON FEBRUARY 5TH, I PRESENTED AT THE CHILDREN AND YOUTH BEHAVIORAL HEALTH INITIATIVES KICKOFF WEBINAR FOCUSED ON THE SCHOOL LINK PARTNERSHIPS AND CAPACITY GRANT. THIS IS A SPECIFIC GRANT THAT I HAD SHARED, A NUMBER OF MONTHS AGO WITH THE BOARD THAT OUR OFFICE, ALONG WITH THE SACRAMENTO COUNTY OFFICE OF EDUCATION, ARE OVERSEEING AND SUPPORTING THE DISTRIBUTION OF FUNDS TO ALL 58 COUNTY OFFICES OF EDUCATION ACROSS THE STATE. AND OUR OFFICE IS ALSO PROVIDING TRAINING AND TECHNICAL ASSISTANCE TO HELP COUNTY OFFICES OF EDUCATION SUCCESSFULLY IMPLEMENT THE STATEWIDE MULTI-PAYER FEE SCHEDULE, AND LINKING SCHOOL AND LINKING BEHAVIORAL HEALTH SERVICES TO SCHOOLS.

THIS COLLABORATIVE AIMS TO MAXIMIZE THE IMPACT OF THE GRANTS AND ALSO TO BENEFIT CALIFORNIA'S CHILDREN, YOUTH AND FAMILIES.

WE ARE SUPPORTING THE DISTRIBUTION OF $550 MILLION IN FUNDING TO K-12 SCHOOLS VIA THE COUNTY OFFICES OF EDUCATION ACROSS THE STATE. THIS ONE TIME INVESTMENT WILL ENHANCE SCHOOL LINKED BEHAVIORAL HEALTH SERVICES AND SUPPORT OPERATIONAL READINESS.

SO WITH THE GOAL THAT EACH AND EVERY SCHOOL DISTRICT THAT WISHES TO PARTICIPATE IN USING THE FEE SCHEDULE WILL BE ABLE TO DO SO THAT SAME DAY, IN THE EVENING, I PARTICIPATED IN THE EDUCATIONAL REVENUE AUGMENTATION FUND CALL TO ACTION SESSION OR ERAF.

THE SESSION WAS HOSTED BY COUNTY SUPERVISOR CINDY CHAVEZ AND COUNTY EXECUTIVE JAMES WILLIAMS. THIS WAS TO ADDRESS, A CONSIDERATION THAT GOVERNOR NEWSOM INCLUDED IN HIS JANUARY BUDGET PROPOSAL, IN WHICH HE INDICATED AN INTEREST IN CLARIFYING HOW SOME OF THE FUNDS ARE CALCULATED AND THIS WOULD AFFECT ABOUT FIVE BAY AREA COUNTIES, IN OUR COUNTY, IF THE PROPOSED CHANGE WOULD GO INTO EFFECT, IT COULD REDUCE THE COUNTY OF SANTA CLARA'S BUDGET BY APPROXIMATELY $32 MILLION A YEAR.

AND IT WOULD ALSO AFFECT THE CITIES AND SPECIAL DISTRICTS WITHIN THE COUNTY, WHICH MAY RESULT IN A LOSS OF ABOUT $10 MILLION A YEAR IN FUNDING.

SO THE ALTHOUGH THIS WILL NOT HAVE ANY IMPACT AT ALL ON THE COUNTY OFFICE OF EDUCATION OR OUR BUDGET.

WE DO PAY CLOSE ATTENTION TO THIS EFFORT BECAUSE MANY OF OUR FAMILIES BENEFIT FROM THE SERVICES THAT THE COUNTY PROVIDES.

THESE FUNDS GO INTO THE COUNTY'S GENERAL FUND, AND THEY USE THEM TO SUPPORT SOME OF OUR PARTNERSHIP EFFORTS, SUCH AS CHILD CARE SERVICES, BEHAVIORAL HEALTH CARE,

[02:00:02]

SUPPORTIVE HOUSING, AND INTIMATE PARTNER VIOLENCE SERVICES.

SO WE'LL CONTINUE TO MONITOR THIS.

WE REALLY DON'T KNOW.

THE TRAILER BILL LANGUAGE HASN'T COME OUT YET, SO WE DON'T KNOW SPECIFICALLY WHAT THE GOVERNOR IS SUGGESTING.

BUT WE'LL MONITOR THAT.

AND AT THE REQUEST OF TRUSTEE MAH, I'LL BE INCLUDING IN FRIDAY'S WEEKLY TO THE BOARD THE SPECIFIC CALL TO ACTION PROVIDED BY COUNTY EXECUTIVE JAMES WILLIAMS AND COUNTY SUPERVISOR CINDY CHAVEZ.

ALSO, MY STAFF AND I HAVE HAD THE PLEASURE OF WORKING WITH THE LOCAL STUDENT ANOUSHKA, AS TRUSTEE SREEKRISHNAN MENTIONED, WHO IS ASSISTING US IN CONDUCTING RESEARCH ON STUDENT ADVISORY COUNCILS AND COMMISSIONS BASED ON THE RESEARCH FROM OUR STUDENT.

WE HAVE BEEN MEETING WITH HER AND GETTING UPDATES, AND ARE EXPLORING THE POSSIBILITY OF ESTABLISHING A STUDENT OR YOUTH ADVISORY COUNCIL.

OUR GOAL IS TOWARDS HAVING THIS COUNCIL AT SOME POINT IN THE 2024, 2025 SCHOOL YEAR, AND I DO WANT TO THANK ANOUSHKA ALREADY FOR HER, THE EXTENSIVE RESEARCH THAT SHE'S BEEN DOING AND FOR HER PARTNERSHIP WITH US IN THIS WORK, AND ALSO TO THANK TRUSTEE SREEKRISHNAN FOR INTRODUCING US TO ANOUSHKA.

WE REALLY APPRECIATE IT.

AS A FOLLOW UP TO AN INQUIRY FROM THE TRUSTEES ABOUT THE USE OF COUNTY OFFICE OF EDUCATION FACILITIES.

I DID WANT TO ASSURE THE TRUSTEES AND LET THE PUBLIC KNOW THAT THERE IS A CONFERENCE CENTER BROCHURE THAT LIVES ON.

OUR WEBSITE HAS BEEN THERE, FOR QUITE SOME TIME, THAT CONTAINS THE INFORMATION ABOUT AVAILABLE SPACES AND THE PROCESS FOR SUBMITTING A REQUEST.

I WILL ALSO BE INCLUDING THIS LINK ON FRIDAY IN MY WEEKLY.

THERE ARE A FEW UPCOMING EVENTS THAT I WANTED TO SHARE WITH THE BOARD.

MAKE SURE IS ON YOUR CALENDAR, SO PLEASE SAVE TUESDAY, APRIL 2ND FROM 9 TO 4.

THIS HAS ALSO BEEN POSTED IN THE BOARD SCHEDULER, SO IT SHOULD BE ON YOUR CALENDARS ALREADY.

BUT THIS IS THE DAY THAT WE ARE PLANNING FOR OUR SACRAMENTO ADVOCACY DAY.

DURING OUR CSO ADVOCACY DAY, WE WILL ADVOCATE ON LEGISLATIVE BUDGET ISSUES, CONNECT WITH ELECTED LEGISLATORS AND HIGH LEVEL EDUCATION STAFF, AND EMPHASIZE THE RELEVANCE OF SOME KEY LEGISLATION.

WE WILL ALSO ENGAGE SOME OF OUR PARTNERS IN THIS EVENT.

FURTHER DETAILS WILL BE SHARED IN THE FUTURE.

THE DATE AGAIN IF YOU WANT.

OH, YES. I'M, APRIL 2ND.

THANK YOU. ALSO, PLEASE SAVE THE DATE.

IT'S ALREADY BEEN ADVERTISED IN THE WEEKLY, BUT THE LEGISLATIVE BRANCH IS SATURDAY, MARCH 9TH.

AND THE SCHOOL BOARDS ASSOCIATION HAS CONFIRMED THAT JOHN FINSTERWALD WILL BE FACILITATING THE PANELS AGAIN THIS YEAR.

THE EVENT WILL BE AT FREMONT UNION HIGH SCHOOL DISTRICT IN THEIR BOARD ROOM.

ALSO, JUST A REMINDER, YOU'RE CORDIALLY INVITED TO JOIN US AT THIS YEAR'S ASSET CHAMPIONS BREAKFAST TO RECOGNIZE SILICON VALLEY SCHOOLS.

WE PARTICIPATE IN THIS AS PART OF OUR PARTNERSHIP WITH PROJECT CORNERSTONE.

THE EVENT IS ON FRIDAY, MARCH 15TH, BUT RSVP ARE REQUIRED BY FRIDAY, FEBRUARY 9TH.

SO IF YOU'RE INTERESTED IN GOING, PLEASE LET ME KNOW BY THE END OF THE WEEK SO WE CAN SECURE YOUR RESERVATION.

JUST A COUPLE OTHER ITEMS. A COUPLE OF OUR TRUSTEES ARE AWARE THAT WE'VE BEEN IN CONVERSATION WITH AMANDA HAASE, FROM THE SAFE JOBS COALITION FOR ABOUT TWO AND A HALF, THREE YEARS OR SO NOW.

AT THE LAST BOARD MEETING, THE BOARD ADOPTED A RESOLUTION, THAT TALKED ABOUT OUR COMMITMENT TO WORKING WITH MANDY ON PUTTING TOGETHER A COMMUNICATIONS CAMPAIGN AND TO TRY TO RAISE AWARENESS, ABOUT THIS RESEARCH INITIATIVE.

AND I'VE CONTINUED TO MEET WITH MANDY AND OUR COMMUNICATIONS TEAM, AND WE'RE DEVELOPING A PLAN WILL PROVIDE MORE INFORMATION TO THE BOARD AS SOON AS IT'S AVAILABLE.

I ALSO WANTED TO SHARE WITH THE BOARD THAT THE, THE CALIFORNIA TEACHER CREDENTIALING DEPARTMENT CONDUCTED A SITE VISIT OF OUR EDUCATOR PREPARATION PROGRAMS AND WHICH THEY DO PERIODICALLY TO CHECK ON OUR CREDENTIALING PROGRAMS AND OUR WORK.

THEY ALSO RECENTLY REVIEWED ONE OF OUR PROPOSALS, AND WE RECEIVED EARLY WORD THAT IT IS LIKELY THAT OUR ADDITIONAL CREDENTIAL PROGRAM WILL BE APPROVED.

AND LASTLY, I JUST WANTED TO.

I MENTIONED THAT WE HAD A VERY SUCCESSFUL SILICON VALLEY READS KICKOFF, AND I'VE BEEN MEETING WITH THE CO-CHAIRS AND WANTED TO JUST REMIND THE BOARD THAT THE SILICON VALLEY READS INITIATIVE WILL CONTINUE THROUGH MARCH.

[02:05:04]

THAT CONCLUDES MY REPORT.

THANK YOU, DOCTOR DEWAN.

WE WILL NOW MOVE TO ITEM 13.

[A. Future Agenda Items]

INFORMATION ITEMS. DOCTOR DEWAN, WILL YOU PLEASE INTRODUCE THIS ITEM? YES. THIS IS THE NEW ITEM THAT PRESIDENT BERTA AND I INTRODUCED LAST WEEK.

SO THIS IS JUST AN OPPORTUNITY.

SHOULD THE BOARD WISH TO MENTION ITEMS? JUST. AND AGAIN, IN ACCORDANCE WITH THE BROWN ACT, ANY ITEMS MENTIONED UNDER THIS ITEM ARE BEING SUGGESTED.

SO THEY MAY BE CONSIDERED AND EXPLORED FOR FOLLOW UP.

ACCORDING TO OUR EXISTING BOARD, BYLAWS AND TOPICS RAISED UNDER THIS ITEM ARE NOT AGENDIZED FOR BOARD DISCUSSION THIS EVENING, BUT DO CREATE A SPACE FOR TRUSTEES TO MENTION TOPICS FOR FUTURE CONSIDERATION.

THANK YOU, THANK YOU DOCTOR DEWAN TRUSTEES.

NOW IS THE TIME TO NAME TOPICS OF INTEREST FOR FUTURE CONSIDERATION.

KNOWING THAT THE ITEM HAS TO BE WITHIN THE JURISDICTION OF THE COUNTY BOARD OF EDUCATION.

I SEE SOME CARDS, SO TRUSTEE CHON AND THEN TRUSTEE MAH.

YEAH, I'LL MAKE MINE QUICK, BUT I'LL ALSO EMAIL IT TO YOU.

AND I HAVE TO ADMIT THAT I STOLE THIS IDEA FROM MY LOCAL SCHOOL BOARD IN MY OWN DISTRICT, BUT I THINK IT'S GREAT.

THEY DO SOMETHING AND CALLED A SPOTLIGHT.

SO I WOULD THINK IT WOULD BE GREAT IF OUR, IF OUR DISTRICT COULD DO THAT, HIGHLIGHTING, THE SCHOOLS THAT WE OVERSEE.

SO OUR COURT SCHOOLS, WALDEN WEST TO KIND OF INSTEAD OF GETTING I KNOW WE GET A LOT OF DATA AND BUDGET PRESENTATIONS, BUT IT WOULDN'T BE NICE TO JUST SEE.

WHAT ARE THEY DOING THERE? WHAT KIND OF PROGRAMS ARE THEY DOING? WHAT ARE SOME HIGHLIGHTS? EVEN IF IT'S LIKE, DID THEY PUT ON AN EVENT OR DID THEY GET SOME ACHIEVEMENTS? KIND OF THOSE THINGS ABOUT WHAT OUR SCHOOLS ARE DOING.

AND I KNOW OIA HAS LIKE IS ONE BIG PROGRAM, BUT MAYBE WE COULD SEE LIKE WHAT THE DIFFERENT CAMPUSES ARE DOING.

THAT WAY ALSO, AS TRUSTEES, WE CAN GET A MORE OF A EVERYDAY FEEL OF WHAT GOES ON IN OUR SCHOOLS.

AND SO I WOULD LOVE IF WE COULD DO SOMETHING LIKE THAT.

BUT ALSO THAT IT BE PRESENTED BY INDIVIDUALS THAT WORK THERE, LIKE NOT WELL, WORK THERE AS OUR ADMINISTRATORS, MAYBE OUR EDUCATORS, BUT ALSO LIKE OUR PARENTS. OR I WOULD LOVE IT IF OUR STUDENTS COULD PRESENT.

BUT I KNOW OUR BOARD MEETINGS ARE LATE, SO I'M I'M REALISTIC IN MY ASK ABOUT THAT.

BUT I WOULD, REALLY APPRECIATE BEING ABLE TO SEE THAT.

I DON'T EXPECT IT AT EVERY BOARD MEETING.

BUT JUST SOMETHING LIKE HIGHLIGHTS OF OF WHAT'S GOING ON AT OUR SCHOOLS AND BEING PRESENTED BY THE, THE PEOPLE THAT ARE THERE EVERY DAY.

SO WE'D LOVE TO SEE SOMETHING LIKE THAT.

HAPPY TO DISCUSS IT FURTHER OFFLINE TOO.

THANK YOU. TRUSTEE CHON TRUSTEE MAH.

THANK YOU, TRUSTEE CHON.

THAT'S ONE OF THE THINGS THAT WE HAVE DONE IN THE PAST IS TO, SCHOOL HIGHLIGHTS AND SPECIFICALLY ASK THE PRINCIPALS, WHAT CAN WE DO TO HELP AT THE SCHOOL, WHAT WHAT'S GOING ON AND WHERE ARE THE CHALLENGES? WHERE ARE THE OPPORTUNITIES? NOT SO MUCH A DOG AND PONY SHOW BECAUSE WE DON'T HAVE TO HAVE THAT.

BUT RATHER, YOU KNOW WHAT? WHAT ARE THE THINGS THAT ARE GOING ON, ON THE GROUND AND WHERE CAN WE HELP? AS, AS A BOARD.

AND SO, WE'VE DONE THAT BEFORE FOR ALL ALT ED AND SPECIAL ED, OUR, JUVENILE COURT SCHOOLS.

BUT ALSO ONE THING THAT WE'VE DONE IN THE PAST IS ALSO, GET KIND OF A HIGHLIGHT.

AND AGAIN, NOT DOG AND PONY, BUT JUST, YOU KNOW, WHAT'S WHAT'S GOING ON AT, THE CHARTER SCHOOLS THAT WE AUTHORIZE BECAUSE THOSE ARE OUR SCHOOLS, TOO.

AND SO IT'D BE NICE TO GET A AGAIN, JUST KIND OF HIGHLIGHTS OF WHAT ARE GOING, WHAT'S GOING ON AT THOSE SCHOOLS THAT, YOU KNOW, WE'RE IN CHARGE OF.

I HARKEN ALSO BACK TO A NUMBER OF SCHOOL BOARD, SCHOOL BOARDS IN MY, TRUSTEE AREA, WHICH I'VE GONE TO.

AND THEY'VE HAD, YOU KNOW, THEIR ELEMENTARY SCHOOL GIVE A HIGHLIGHT OF WHAT'S GOING ON.

AND, THEIR HIGH SCHOOL GIVING A HIGHLIGHT OF GOING ON.

AND SO IT'S JUST KIND OF NICE TO HEAR WHAT'S HAPPENING IN THE CLASSROOMS AND ON THE GROUND.

ONE OTHER THING I WOULD LIKE TO GET AN UPDATE ON IS, EDUCARE.

I UNDERSTAND THAT EDUCARE IS GOING THROUGH SOME CHANGES, AND I'D LIKE TO GET AN UPDATE ON WHAT SOME OF THOSE CHANGES ARE AND THE, KIND OF, FINANCIAL IMPACTS OF, THE CHANGING TRANSITIONS THAT ARE KIND OF GOING ON.

THAT'S IT FOR NOW. THANKS.

THANK YOU. TRUSTEE MAH AND VICE PRESIDENT ROCHA.

THANK YOU. I HAVE A LIST OF 27 ITEMS I'LL JUST GIVE YOU.

OH, I DON'T HAVE ANYTHING.

I'M JUST KIDDING. I WAS ABOUT TO SAY I MOVED TO ADJOURN RIGHT NOW.

LET'S NOT SCARE ANYONE WITH THIS NEW NEW ITEM, WITH THIS NEW ITEM ON OUR AGENDA.

I APPRECIATE TRUSTEES, YOU KNOW, UNDERSTANDING, AND I HOPE THAT THIS CAN BE A COLLABORATIVE SPACE.

[02:10:06]

AND, AND BEING ABLE TO CONTINUE TRUSTEE MAH.

OKAY. I REMEMBER ANOTHER THING, ONE THING THAT WE HAD DONE IN THE PAST, WHICH WAS I THOUGHT REALLY HELPFUL FOR THE BOARD, WAS TO ACTUALLY GET KIND OF BRANCH REPORTS.

SO EVERY DEPARTMENT KIND OF GAVE AGAIN, A KIND OF HIGHLIGHTS, CHALLENGES, OPPORTUNITIES FOR, YOU KNOW, THE THE BUSINESS DEPARTMENT, FOR THE PROFESSIONAL SERVICES, FOR, EACH OF THE DIFFERENT GROUPS THAT WE HAVE.

AND SO THAT WAS SOMETHING THAT.

WAS VALUED BY A NUMBER OF BOARD MEMBERS AT THE TIME.

THANK YOU. TRUSTEE MAH.

ALL RIGHT. AND THAT BRINGS US TO ADJOURNMENT.

THE NEXT SANTA CLARA COUNTY REGULAR MEETING IS SCHEDULED FOR FEBRUARY 21ST, 2024.

MAY I HAVE A MOTION TO ADJOURN? SO MOVED. MOVED BY TRUSTEE.

CHON. SECOND.

SECOND. SECONDED BY VICE PRESIDENT ROCHA.

WE ARE NOW ADJOURNED AT 9:38 P.M..

THANK YOU EVERYONE.

IF YOU STILL HAVE YOUR DEVICE OPEN AND COULD VOTE FOR THE ADJOURNMENT.

OTHERWISE, GIVE US A VERBAL AYE AND WE'LL RECORD.

WE'RE ASSUMING WE'RE ASSUMING IT'S A YES, BUT WE WANT TO RECORD IT.

THANKS EVERYONE.
