Background
Education Code Section 41020.3 states that by January 31 of each year, the governing body of each local education agency shall review, at a public meeting, the annual audit of the local education agency for the prior year, any audit exceptions identified in that audit, the recommendations or findings of any management letter issued by the auditor, and any description of correction or plans to correct any exceptions or management letter issue.
In accordance with Education Code 41020.3, an annual audit of the financial records of the Santa Clara County Office of Education (SCCOE) was conducted for the fiscal year ended June 30, 2023. The auditors issued an opinion that the financial statements are presented fairly, in all material respects, the respective financial position of the governmental activities, each major fund, and the aggregate remaining fund information of the Santa Clara County Office as of June 30, 2023, and the respective changes in financial position and, where applicable, cash flows thereof for the year then ended in accordance with accounting principles generally accepted in the United States of America. There were no audit exceptions, recommendations or findings or any description of correction or plans to correct any exceptions identified in the audit.
The 2022-2023 SCCOE Audit Report was placed on the board agenda for the January 10, 2024 meeting as an information item. The item is placed again on the January 31, 2024 board meeting as a consent information item. Christy White, SCCOE's external auditing firm will be attending the February 7, 2024 board meeting to address questions, if any about the 2022-2023 SCCOE Audit Report.
At this time, members of the public may address the Board on any issue within the subject matter jurisdiction of the Board that is not listed on this agenda. Individual remarks will be limited to 2 minutes each, unless otherwise stipulated by the SCCBOE President.

Background
The SCCBOE will meet in Closed Session to discuss and prepare the County Superintendent's Evaluation.
The County Superintendent provided notice on October 3, 2023, of her waiver of the provision in the salary agreement for a salary increase for the 2023-2024 FY. The CPI would have been 2.9%. The waiver notice was provided due to the late tax filing dates in CA resulting in economic uncertainty, other factors impacting the COE budget including reductions in committed funding, and declining enrollment across Santa Clara County. The waiver was accepted on October 6, 2023.

By honoring and elevating these holidays, SCCOE is dedicated to transparency in supporting the Asian American Pacific Islander (AAPI) community. In alignment with the Santa Clara County Bill of Rights for Children and Young Adults, the SCCOE supports an education that exposes youth to other cultures.

Background
Members of the San Jose Youth Commission advocated for the development of a resollution to help raise awareness about doxxing. Youth Commisioners reproted that with social media and other digital expansions, youth are more vulnerable to doxxing today than ever before.
Doxxing is defined as the act of publicly providing personally identifiable information about an individual or organization, usually via the internet and without their consent. The personally identifiable information is obtained from public databases and social media and the information is usually shared with the intent to bully, shame, embarrass, or extort the individual or organization. However, studies have shown that some of the personal information may be obtained illegally through hacking and social engineering.
Student Impact
Doxxing includes dangers similar to cyberbullying as private information is shared with the intent to cause emotional, social and/or financial harm. The Bill of Rights for Children and Young Adults for Santa Clara County names online safety as a right as well as voice. Students are raising concerns around the harm of doxxing. Digital citizenship is something that the Santa Clara County Office of Education takes seriously and is committed to raising awareness about potential dangers and ways youth can protect themselves online. The SCCBOE adopted priorities include empowering child wellness, which the Board hopes to support by raising awareness of this issue.

Each year, pursuant to BB 9005 (Code of Conduct for the Santa Clara County Board of Education) and BB 9240 (Board Training), the SCCBOE engages in training. The Santa Clara County Board of Education desires to maintain the highest ethical standards and help ensure that decisions are made in the best interest of the Santa Clara County Office of Education (SCCOE) and the community it serves. In recognition of this responsibility, the County Board and its members will conduct themselves lawfully with integrity and high ethical standards that uphold the duty of elected office, build trust, public confidence, and credibility, as well as model the behaviors expected of staff and students.

Background
In accordance with California Government Code Section 4217.10 to 4217.18 (“Energy Savings Project”), a public hearing was held on Wednesday, November 1, 2023, for the purpose of taking public comments and consideration of adopting a resolution making certain findings, and approving an Energy Service Contract and Ground Lease with ENGIE Services U.S. for the implementation of certain energy related improvements (solar power generation) to SCCOE facilities and Lease Purchase Agreement to fund the Energy Savings Project and CEQA Exemption.
A Solar Energy Project presentation was provided at the public hearing and the following information was presented: ENGIE Solar Energy Project Scope, Environmental Benefits of the Energy Savings Project, Solar Energy Project Savings, which included the eligibility of the SCCOE to receive a $2 million Federal Direct Tax Credit and Lease Purchase Agreement terms to fund the Energy Savings Project.
As part of the project ENGIE is providing Educational Services the below items:
Living Laboratory
Data points from ENGIE Services-installed photovoltaic panels will be embedded into external facing dashboards to bring real, relevant data to students and teachers. All data for the living laboratories can be viewed by any computer with an internet connection.
Walden West Program Support
ENGIE will provide STEM lesson plans and activities to support Walden West. ENGIE support will focus on energy, electricity, sustainability, climate change, and engineering.
Hands-On Learning Kits
ENGIE will provide ten (10) classroom solar kits. Classroom sets will provide hands-on learning engagements with specific grade levels and lessons tied to educational standards. The kits include a variety of grade-appropriate equipment for conducting relevant experiments. The activity sets are provided once, and the materials can be used for multiple classes and years.
Student Internships
Up to four (4) total Santa Clara County High School students will be hired as paid interns with ENGIE. Our structured and student-focused internship program will provide students with mentors, opportunities to work on real energy projects, and a national intern network.
STEM Project Support
ENGIE staff will work with Santa Clara County Office of Education to develop two (2) STEM projects.
Professional Development
Sessions will provide background knowledge on the subjects covered, as well as the learning tools and activities provided above to enhance STEM classroom learning. Sessions are customized to the goals of Santa Clara County Office of Education.

The partnership with ENGIE provides students expanded opportunities to learn, engage, and explore solar power and STEM learning in accordance with the Board of Education priorities of Environmental & Climate Literacy and Workforce Pathways & Diversification.

Per Board Policy BP3270, when any Santa Clara County Office of Education instructional materials, equipment, supplies or other personal property with a value less than $25,000 becomes unstable, obsolete, or no longer needed, the Santa Clara County Superintendent of Schools or designee shall notify the Santa Clara County Board of Education.
Fiscal Implications
The report includes a list of the items sold, income received, and the method of sale. Items that are no longer usable by the Santa Clara County Office of Education are sold for surplus or disposed of as e-waste.
