I WILL CONDUCT A PUBLIC HEARING ON THE DISCLOSURE OF THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE COUNTY SUPERINTENDENT OF SCHOOLS AND THE ASSOCIATION OF COUNTY EDUCATORS CALIFORNIA TEACHERS ASSOCIATION IN ACCORDANCE WITH GOVERNMENT CODE 3547.5.

I'M DR. MARY ANN DEWAN, COUNTY SUPERINTENDENT OF SCHOOLS AND SOLE EMPLOYER.

I AM PRESIDING OVER THIS HEARING.

IN NEGOTIATING AGREEMENTS, THE COUNTY SUPERINTENDENT SHALL BALANCE THE NEEDS OF STAFF AND THE PRIORITIES OF THE SANTA CLARA COUNTY OFFICE OF EDUCATION WITHIN THE PARAMETERS OF A SOUND REALISTIC BUDGET.

THE AGREEMENT IS FOR THREE YEARS, COMMENCING ON JULY 1ST, 2022, AND ENDING JUNE 30TH, 2025.

AS REQUIRED BY THE EDUCATION CODE, STUDENT BOARD MEMBERS SHALL BE LIMITED TO PREFERENTIAL VOTING RIGHTS, WHICH ALLOW STUDENT BOARD MEMBERS TO SHARE THEIR OPINION, INCLUDING WHETHER THEY ARE IN FAVOR OF AN ITEM AND HAVE THEIR OPINION RECORDED IN THE MINUTES BEFORE A MEASURE IS FORMALLY VOTED ON BY THE COUNTY BOARD.

A STUDENT BOARD MEMBERS FORMAL EXPRESSION OF OPINION WILL NOT COUNT AS A VOTE IN DETERMINING THE VOTES REQUIRED TO CARRY ANY MEASURE BEFORE THE COUNTY BOARD.

MY NATIVE ANCESTORS WERE BAPTIZED AT MISSION SAN JOSE, GOING BACK TO THE YEAR 1814, WHEN MY GREAT GREAT, GREAT GRANDMOTHER, EFREN AKINTOLA, WAS MECHANIZED INTO MISSION SAN JOSE FROM HER VILLAGE ON THE NORTH SIDE OF THE KAKINADA STREET.

HER HUSBAND LIBERATED DIXIE FROM THE CYCLONE AND HARLEQUIN TRIBES, WAS BAPTIZED AT MISSION SAN FRANCISCO IN 1801.

THE LANDS ON WHICH SANTA CLARA HAS BEEN SANTA CLARA COUNTY HAS BEEN ESTABLISHED, WAS AND CONTINUES TO BE OF GREAT SPIRITUAL SIGNIFICANCE AND HISTORICAL IMPORTANCE FOR A MORE WALLONIA TRIBAL PEOPLE AND OTHER FAMILIAL DESCENDANTS OF THE VERONA BAND.

WE RECOGNIZE THAT EVERY MEMBER OF THE GREATER SANTA CLARA COMMUNITY HAS AND CONTINUES TO BENEFIT FROM THE USE AND OCCUPATION OF THIS LAND SINCE IT WAS FOUND IN 1777, CONSISTENT WITH OUR VALUES OF COMMUNITY INCLUSION AND DIVERSITY.

MY NAME IS TONY TIEDEMAN AND I AM A SOPHOMORE STUDENT AT SMALL COMMUNITY HIGH SCHOOL.

I WAS BORN AND RAISED IN MILPITAS, AND I WAS ALWAYS INTERESTED IN JOINING THE SCHOOL BOARD.

THE REASON I WANT TO BE THE STUDENT REPRESENTATIVE ON OUR SCHOOL BOARD IS BECAUSE I'M INTERESTED IN GETTING A STUDENT VOICE ON THE SCHOOL BOARD.

I'M INTERESTED IN CIVIC ENGAGEMENT SO THAT THE VOICES AND EXPERIENCES OF STUDENTS CAN BE HEARD AND HELP INFLUENCE THE DECISIONS OF THE BOARD.

IT IS ALWAYS SAID THERE IS NOT ENOUGH MONEY TO PARA EDUCATORS MORE, AND YET THERE ALWAYS SEEMS TO BE MONEY TO GIVE RAISES TO THE TOP ADMINISTRATORS AT THE COE.

A HALF DOZEN INDIVIDUALS EMPLOYED BY THE COE EACH MAKE MORE THAN THE GOVERNOR OF OUR STATE.

A 10% RAISE FOR JUST THOSE INDIVIDUALS IS OVER $150,000.

MONEY THAT COULD BE USED TO LIFT VALUABLE EMPLOYEES OF THE COE OUT OF POVERTY WAGES.

IN A PERFECT WORLD, EVERYONE COULD GET RAISES, BUT IN A WORLD WITH LIMITED FUNDING, IT SHOULD BE DIRECTED TO THE PEOPLE WHOM IT WOULD BENEFIT THE MOST.

IF I MADE 250,000 A YEAR AND DIDN'T GET A RAISE, I AM STILL IN THE 95TH PERCENTILE FOR THE AREA.

WELL, IF I MADE 40 K A YEAR, I WOULD BE IN THE BOTTOM 20TH PERCENTILE.

A 10% RAISE TO THE TOP COULD BUY A CAR WHILE THE SAME RAISE FOR THE BOTTOM EARNER COULD MAKE THE DIFFERENCE BETWEEN PAYING RENT AND NOT GOING HUNGRY.

WE MUST END THE CULTURE OF SILENCE AROUND INJURIES AND STAFFING THAT LEAVES WORKERS ISOLATED AND STUDENTS UNSAFE.

ONE OF OUR FAMILIES JUST RECEIVED YET ANOTHER INCIDENT REPORT, THIS TIME ABOUT HER DAUGHTER BEING BAREFOOT OUTSIDE THE CLASSROOM IN AN OPEN AREA WHERE THERE ARE DIRT, ROCKS, SHARP PIECES OF ALUMINUM SCREWS, WIRES, BROKEN GLASS AND OTHER HAZARDOUS MATERIALS.

AND THOSE ARE JUST SOME OF THE ITEMS THAT CLASSROOM STAFF ARE PICKING UP ON THEIR OWN IN ATTEMPTS TO KEEP THEIR STUDENTS SAFE.

THAT IS NOT OK PREVIOUS INCIDENCES FOR THIS CHILD IN THE LAST COUPLE OF WEEKS INCLUDE SWALLOWING A BOTTLE OF OR THE LIQUID FROM A WITE-OUT, THE LIQUID PAPER. FORTUNATELY, POISON CONTROL FELT IT WAS NOT A LARGE ENOUGH AMOUNT THAT IT WAS.

IT WAS INCREDIBLY DANGEROUS.

BUT AT THE SAME TIME, STUDENTS SHOULD NOT BE SWALLOWING NON-EDIBLE ITEMS. THE PREVIOUS REPORT WAS THAT SHE WAS CHEWING ON A RUSTY SCREW THAT SHE FOUND OUTSIDE THE CLASSROOM.

WE BELIEVE THE SUPERINTENDENT'S RAISE SHOULD BE DEFERRED UNTIL THE SAFETY ISSUES ARE RESOLVED AND ALL BARGAINING UNITS HAVE A CONTRACT.

WHAT ONE SCHOOL DISTRICT TEACHES ABOUT OUR LOCAL MUWEKMA OHLONE PEOPLES IS COMPLETELY DIFFERENT FROM WHAT ANOTHER DISTRICT DOES, AND THERE'S MANY DISTRICTS THAT DON'T TEACH IT AT ALL. AND IT REALLY VARIES CLASSROOM TO CLASSROOM BY CREATING A TASK FORCE, THIS IS GOING TO BE AN INCREDIBLE FIRST STEP AND NORMALIZING AND STANDARDIZING WHAT EFFECTIVE NATIVE STUDIES FOR OUR LOCAL TRIBES LOOKS LIKE.

AND WHAT'S EVEN BETTER IS THAT WE ARE GOING TO BE BRINGING THEM TO THE TABLE TO MAKE THIS HAPPEN.

THE FANTASTIC THING ABOUT THIS AS WELL IS THAT A TASK FORCE LIKE THIS IS NOT ONLY A SPACE TO CREATE CURRICULUM AND TO HAVE AMAZING DISCUSSIONS ABOUT WHAT EFFECTIVE AND RIGHT CURRICULUM LOOKS LIKE, BUT ALSO TO IDENTIFY THE SOURCES OF THE ACHIEVEMENT GAPS THAT ARE AFFECTING NATIVE YOUTHS.

ONE ON NOVEMBER 10TH, I ACTUALLY WAS ABLE TO GIVE A CLASS PRESENTATION AT PROFESSOR DI SALVO'S JUSTICE STUDIES CLASS AT SJSU, AND I GAVE IT WITH TRUSTEE JORGE PACHECO ON CLIMATE LITERACY, WHICH WE REALLY ENJOYED THIS PRESENTATION.

YOU KNOW, WE TALKED ABOUT SOME OF THE WORK FROM OUR COUNTY OFFICE OF EDUCATION ON CLIMATE LITERACY.

WE TALKED ABOUT THE SANTA CLARA COUNTY CLIMATE LITERACY COALITION, WHICH TRUSTEE PACHECO AND I ARE CO-PRESIDENTS OF, TO HELP MOBILIZE MORE SCHOOL DISTRICTS TO INCREASE CLIMATE LITERACY.

AND THIS IS STARTING WITH A COALITION OF LOCAL SCHOOL BOARD MEMBERS IN SANTA CLARA COUNTY.

WE ALSO TALKED ABOUT STATE ADVOCACY EFFORTS, ALSO FUNDING FOR THE LAUNCH OF THE SANTA CLARA COUNTY YOUTH CLIMATE INITIATIVE TO BE HOUSED IN THE COUNTY OFFICE OF SUSTAINABILITY.

AND WE PRESSIE PACHECO WAS ABLE TO GIVE A TEACHER'S PERSPECTIVE, SO THAT WAS GREAT.

AND THE SECOND MEETING I WASN'T ABLE TO ACTUALLY ATTEND BUT WANTED TO HIGHLIGHT IN FREMONT UNION HIGH SCHOOL DISTRICT IN TRUSTEE AREA TOO, THEY HAVE LAUNCHED THE PH.

D STUDENT SUSTAINABILITY COMMISSION FOR THAT HIGH SCHOOL DISTRICT, WHICH IS REALLY EXCITING.

I HOPE THAT THIS CAN SERVE AS A MODEL FOR OTHER SCHOOL DISTRICTS, WHICH IS THEIR GOAL.

AND SO THEY HAD THEIR FIRST MEETING, THE SUSTAINABILITY COMMISSION ON NOVEMBER 14.

AND SO THIS INCLUDES STUDENT LEADERS IN THEIR ENVIRONMENTAL CLUB, ALSO SILICON VALLEY YOUTH CLIMATE ACTION TO MEET WITH THEIR FACILITIES.

AND BOND DIRECTOR AND ALSO OTHER STUDENT LEADERS ARE GOING TO BE PART OF THE NEW STUDENT SUSTAINABILITY COMMISSION FOR THAT HIGH SCHOOL DISTRICT. SO THAT'S SUPER EXCITING.

SO THOSE ARE THE TWO MEETINGS I WANTED TO HIGHLIGHT.

THE TWO THINGS I WANTED TO REPORT WAS THAT I ATTENDED THE BIG LIFT COLLABORATIVE MEETING THAT WAS HELD IN REDWOOD CITY AT THE CHAN ZUCKERBERG INITIATIVE BUILDING IN REDWOOD CITY.

THE BIG LIFT IS SAN MATEO COUNTY'S COUNTY OFFICE OF ED PARTNERSHIP WITH THE SUPERVISOR CAROL GROOM, AND ALSO WITH THE SILICON VALLEY COMMUNITY FOUNDATION.

THEY HAVE A WONDERFUL PROGRAM THAT WAS STARTED REALLY OVER TEN YEARS AGO.

IS KIND OF A CELEBRATION AT THIS MEETING TO NOT ONLY COMMEMORATE TEN YEARS OF THIS COLLABORATIVE WORK AND A LOT OF MONEY THAT WAS CONTRIBUTED FROM ALL OVER, INCLUDING FEDERAL GRANTS, BUT TO ALSO HONOR SUPERVISOR CAROL GROOM, WHO WAS REALLY INITIATIVE AND MAIN INITIATIVE AND TO GET THE SAN MATEO COUNTY BOARD OF SUPERVISORS TO BUY IN REALLY WITH A CARVE OUT FROM THEIR BUDGET AND START THE MONEY ROLLING WITH MATCHING FEDERAL GRANTS AND ALSO THE COMMUNITY FOUNDATION.

THEY ALSO INCLUDED IN THIS MEETING STRATEGIC PLANNING AND DISCUSSIONS FOR WHAT'S KIND OF NEXT IN THE NEXT THREE YEARS.

SO THAT WAS A GREAT MEETING.

I ALWAYS HOPE THAT OUR STRONG START COALITION WOULD GROW UP INTO A BIG LIFT COLLABORATIVE.

THE OTHER THING I DID WAS I ATTENDED AS OBSERVER TO THE BUDGET STUDY COMMITTEE MEETING TODAY.

WE HAD GREAT PARENTS LAST YEAR, BUT THESE NEW PARENTS THAT ARE COMING ON ARE COMING IN STRONG.

SO I REALLY APPRECIATE THEIR EFFORTS.

WE DO HAVE A NUMBER OF OPENINGS THAT I WANTED TO HIGHLIGHT, ESPECIALLY IN OUR CLASSIFIED STAFF.

SO I REALLY WANTED TO PUT THAT OUT THERE FOR OUR COMMUNITY, LET PEOPLE KNOW THAT WE ARE LOOKING TO FILL THOSE POSITIONS.

BUT ONE THING I WANTED TO HIGHLIGHT THAT DIRECTOR FUENTES WAS TALKING ABOUT YESTERDAY IS THE INTERNSHIP PROGRAM THAT OUR COUNTY BOARD HAS STARTED WITH HEAD START, WHICH REALLY FOR FOR MYSELF, WHEN I WAS A STUDENT TEACHER, STUDENT TEACHERS AREN'T PAID DURING THEIR STUDENT TEACHING TIME.

AND SO THIS INTERNSHIP PROGRAM THAT HAS BEEN DEVELOPED IS ACTUALLY PAVING PATHWAYS FOR PEOPLE, FOR EDUCATORS TO START IN THE CLASSROOMS, GETTING PAID FOR THE WORK THAT THEY'RE DOING IN ORDER TO GET THEM FULLY CREDENTIAL TO BE IN THESE PROGRAMS. AND SO THEY'RE ABLE TO START WITH US AND THEN CONTINUE TO GROW AND HELP FILL THESE POSITIONS THAT WE SO DESPERATELY NEED AND SERVING OUR COMMUNITY.

AND THAT WAS FANTASTIC.

BUT WHAT WAS EVEN BETTER TO HEAR ABOUT THAT IS ONE OF OUR PARENT MEMBERS, AND I BELIEVE THE CHAIR OF OUR POLICY COUNCIL ACTUALLY TOLD US THAT THIS INFORMATION ALSO HAD GONE OUT TO THE PARENTS, AND I THINK THAT WAS FANTASTIC AND JUST REALLY DOING WORK IN GETTING MORE EDUCATORS, ESPECIALLY FOR OUR HEAD START PROGRAMS. WE'RE IN EDUCATOR SHORTAGE IN ANY AND EVERYTHING.

SO EVERY STEP THAT EVERY EFFORT THAT WE'RE MAKING IS FANTASTIC.

WE ALSO PROVIDED AN UPDATE ON THE HEAD START EARLY HEAD START FISCAL YEAR PROGRAM ALIGNMENT, AND AS WELL AS ENROLLMENT IN EARLY HEAD START AND HEAD START, WHERE UNFORTUNATELY OUR ENROLLMENTS ARE FAR BELOW OUR GRANT.

AND SO WE ARE NOT EARNING OUR FULL GRANT AT THIS TIME.

WE ALSO PROVIDED A REPORT ON OUR ALTERNATIVE EDUCATION PROGRAMS, INCLUDING COURT AND COMMUNITY SCHOOLS AND THE ENROLLMENT IN THOSE PROGRAMS. AND WE PROVIDED AN UPDATE RELATED TO OUR WILD AND WEST PROGRAM, SPECIFICALLY RELATED TO THE DURING THE SCHOOL YEAR SCIENCE CAMP, WHICH IS BACK TO FULL ENROLLMENT AT THIS TIME, OUR SUMMER PROGRAM, AS WELL AS SOME OF THE SPECIAL EVENTS THAT WE HOST AND THE NEXT BUDGET STUDY COMMITTEE MEETING WILL BE ON JANUARY THE 18TH.

THERE ARE A NUMBER OF ITEMS THAT WE WILL BE PROVIDING INFORMATION ABOUT, INCLUDING GIVING THE BOARD UPDATES RELATED TO THE DATA ON BULLIS CHARTER SCHOOLS ENROLLMENT AND THEIR ENROLLMENT ACTION PLAN.

LET ME BACK UP. SO IN FEBRUARY OF 20, 2003, LOS ALTOS SCHOOL DISTRICT CLOSE BULLIS ELEMENTARY SCHOOL IN THE LOS ALTOS HILLS.

AND THEN IN MAY 2003, THE LOS ALTOS SCHOOL DISTRICT BOARD OF TRUSTEES DENIED A CHARTER PETITION THAT WAS SUBMITTED TO THEM FOR THE ESTABLISHMENT OF BULLIS CHARTER SCHOOL.

THEREFORE, IN JULY 2003, CC BOE RECEIVED THE CHARTER PETITION ON APPEAL AND AUTHORIZED IT IN SEPTEMBER 2003 FOR A THREE YEAR TERM FROM JULY ONE, 2004 TO JULY 30, 2007, THE SCHOOL OPENED AS A K6 AND EXPANDED EXPANDED TO A K8, PURSUANT TO A MATERIAL REVISION THAT WAS APPROVED IN FEBRUARY 2008.

FROM 2003 UNTIL TODAY, THERE HAVE BEEN SEVERAL LEGAL ACTIONS INITIATED BY BOTH BY AND AGAINST BOTH BCS AND LASD REGARDING FACILITIES AND ENROLLMENT PREFERENCES.

THE LASD COMMUNITY HAS LARGELY SPOKEN IN OPPOSITION TO THE RENEWAL OF OF BULLIS AND HAS CALLED UPON THIS THE COUNTY BOARD OF EDUCATION TO REQUIRE BULLIS TO MAKE CHANGES TO ITS PETITIONS AND OPERATING PRACTICES.

AND IN FACT, IN 2012, LASD PARENTS SUBMITTED A PETITION TO THE BOARD SEEKING REVOCATION OF THE BULLIS CHARTER.

THE BOARD REVIEWED THE PETITION AND FOUND IT NOT TO MEET ANY OF THE CIRCUMSTANCES UNDER WHICH A CHARTER CAN BE REVOKED.

MOST RECENTLY LASD PARENT COMMUNITY I'M SORRY, MOST RECENTLY THE LA SD PARENT COMMUNITY AND DISTRICT OFFICIALS HAVE VOICED CONCERNS THAT BULLIS HAS ENGAGED IN SYSTEMATIC DISCRIMINATION VIA ITS LACK OF EQUITABLE ACCESS TO ALL STUDENTS.

AND THOSE ARE THE WORDS OF THE PARENT COMMUNITY AND THE DISTRICT.

ON FEBRUARY 28TH, 2022, SCCOE SENT A LETTER REQUESTING THE SCHOOL DEVELOP A PLAN THAT INCREASED THE DIVERSITY OF THE STUDENT POPULATION CONSISTENT WITH THE UPCOMING CHANGES TO STATEWIDE LAW.

BULLIS'S RESPONSE WAS AFFIRMATIVE, BUT LITTLE TO NO ACTION TOOK PLACE.

ON JULY 1ST, 2020, AB 1505 MADE SIGNIFICANT CHANGES TO THE CHARTER SCHOOLS ACT.

ONE SUCH CHANGE REQUIRED CHARTER SCHOOLS TO ACHIEVE A BALANCE OF STUDENTS FROM RACIAL, ETHNIC, SPECIAL EDUCATION AND LEARN ENGLISH LEARNER BACKGROUNDS THAT IS REFLECTIVE OF THE GENERAL POPULATION RESIDING WITHIN THE TERRITORIAL JURISDICTION OF THE DISTRICT.

AND THEN IN MARCH 2001, SCCOE AGAIN REACHED OUT TO BULLIS WITH A LETTER THAT SERVED TWO PURPOSES.

THE LETTER FIRST SERVED TO NOTIFY BULLIS OF SCCOE'S DETERMINATION THAT BULLIS IS DEMONSTRABLY UNLIKELY TO SUCCESSFULLY IMPLEMENT THE PROGRAM SET FORTH IN ITS EXPECTED CHARTER RENEWAL PETITION BECAUSE OF NOT SERVING ALL STUDENTS WHO WISH TO ATTEND.

THE LETTER SECONDLY PROVIDED BULLIS WITH A REASONABLE OPPORTUNITY TO CURE THE VIOLATION BY PROVIDING AND IMPLEMENTING A CORRECTIVE ACTION PLAN.

IN JULY 2001, AB 130 PASSED AND EXTENDED BY TWO YEARS THE TERM OF ALL CHARTER SCHOOLS WHOSE TERMS EXPIRED ON OR BETWEEN JANUARY 1ST, 2022 AND JUNE 30TH, 2025 INCLUSIVE.

BULLIS''S TERM WAS DUE TO EXPIRE JUNE 30, 2022, AND THUS BULLIS RECEIVED A TWO YEAR EXTENSION, GIVING THE SCHOOL ADDITIONAL TIME TO PUT INTO PLACE ITS PLAN TO MAKE A STUDENT POPULATION MORE REFLECTIVE OF THE POPULATION IN LASD.

SO BULLIS DEVELOPED WHAT'S CALLED AN ENROLLMENT ACTION PLAN THAT WAS THERE CORRECTIVE ACTION PLAN AND BEGAN IMPLEMENTATION DURING THE COVID 19 PANDEMIC.

THE DATA THAT WE'RE GOING TO REVIEW TONIGHT REFLECTS BULLISH STUDENT DEMOGRAPHICS FOLLOWING THE IMPLEMENTATION OF THEIR ENROLLMENT ACTION PLAN.

SO DUE TO AB 1505 EDUCATION CODE NOW STATES THAT A CHARTERING AUTHORITY MAY DENY RENEWAL OF A CHARTER SCHOOL AND ANY OF THE THREE PERFORMANCE CATEGORIES. AND IF YOU RECALL, I TALKED ABOUT THE HIGH, MIDDLE AND LOW PERFORMING CATEGORIES UPON A FINDING THAT THE SCHOOL IS DEMONSTRABLY UNLIKELY TO SUCCESSFULLY IMPLEMENT THE PROGRAM SET FORTH IN THE PETITION DUE TO EITHER SUBSTANTIAL FISCAL OR GOVERNANCE FACTORS, OR TO NOT SERVING ALL PUPILS WHO WISH TO ATTEND.

SO AB 1505 MADE IT POSSIBLE FOR ANY CHARTER SCHOOL, REGARDLESS OF ITS PERFORMANCE, TO BE DENIED ON THIS BASIS.

IN MAKING THE DECISION, HOWEVER, THE AUTHORIZER MUST PROVIDE AT LEAST 30 DAYS NOTICE TO THE CHARTER SCHOOL OF THE ALLEGED VIOLATION, AND MUST ALSO PROVIDE THE CHARTER SCHOOL WITH A REASONABLE OPPORTUNITY TO CURE THE VIOLATION, INCLUDING A CORRECTIVE ACTION PLAN PROPOSED BY THE CHARTER SCHOOL.

SO IF YOU RECALL, MARCH 20, 2021, WE PROVIDED THEM WITH A NOTICE TO CURE, AND AS A RESULT, THEY CREATED THEIR ENROLLMENT ACTION PLAN.

SO FURTHER, THE CHARTERING AUTHORITY MAY THEN DENY RENEWAL ONLY AFTER MAKING EITHER OF THE FOLLOWING FINDINGS.

SO FIRST, THE CORRECTIVE ACTION PLAN PROPOSED BY THE CHARTER SCHOOL HAS BEEN UNSUCCESSFUL, OR THE VIOLATIONS ARE SUFFICIENTLY SEVERE AND PERVASIVE AS TO RENDER THE CORRECTIVE ACTION PLAN UNVIABLE.

SO THE DATA WE'RE LOOKING AT TONIGHT WILL HELP US TO DETERMINE WHETHER BULLIS CHARTER SCHOOL IS ON A PATH THAT WILL MAKE, YOU KNOW, THAT SHOWS US THAT THEIR CORRECTIVE ACTION PLAN HAS BEEN OR IS GOING TO BE SUCCESSFUL.

SO IN AUGUST 2021, BULLIS REQUESTED TO REVISE ITS ADMISSION POLICY AND PROCEDURES TO ADD ADMISSION PREFERENCES, NUMBER TWO AND NUMBER SEVEN.

THOSE ARE THE TWO IN BOLD FONT FOR STUDENTS WHO QUALIFY FOR FREE AND REDUCED PRICE MEALS AND LIVE WITHIN AND OUTSIDE LASD FOR UP TO 10% OF ITS OPEN SPACES BY GRADE LEVEL.

THE PURPOSE WAS TO IMPROVE THE LOTTERY CHANCES FOR STUDENTS FROM LOW SOCIOECONOMIC BACKGROUNDS.

CBOE APPROVED THE REVISED PREFERENCES IN SEPTEMBER 2021 AND BULLIS BEGAN OPEN ENROLLMENT FOR THE 2223 SCHOOL YEAR, WHICH IS THIS CURRENT YEAR THAT WE'RE IN WITH A NEW PREFERENCES AND HELD ITS LOTTERY IN FEBRUARY 2022.

ADDITIONALLY, BULLIS, IN ITS ENROLLMENT ACTION PLAN, HAD FOUR MAIN STRATEGIES AND ONE OF THE STRATEGIES WAS TO EXPAND EXPAND ITS SUMMER CAMP, WHICH IS A WEEK LONG DAY CAMP FOR INCOMING SECOND THROUGH SIXTH GRADERS FROM LOS ALTOS AND MOUNTAIN VIEW.

AND IT ALLOWED STUDENTS WHO ARE ELIGIBLE FOR FREE AND REDUCED PRICE MEALS TO ATTEND THE CAMP FOR FREE.

AND PRESUMABLY THEY INVITED THOSE STUDENTS TO THEN APPLY FOR A.

ADMISSION THROUGH THE BULLIS LOTTERY.

THEY ALSO INCREASE THEIR COMMUNITY OUTREACH.

THEY EXPANDED THEIR CONTACT LISTS AND HAD OUTREACH COORDINATORS VISIT DIRECTLY ORGANIZATIONS AND SPREAD THE WORD ABOUT THE OPEN ENROLLMENT PROCESS WITH FAMILIES THAT THOSE ORGANIZATIONS OR ORGANIZATIONS SERVED.

THEY. ALSO HOSTED OUTREACH EVENTS AT THE SAN ANTONIO NEIGHBORHOOD, INCLUDING APARTMENT COMPLEXES, PRESCHOOL PROGRAMS, CHURCHES, TEMPLES AND OTHER COMMUNITY CENTERS AND HIGH VISIBILITY AREAS SUCH AS SUPERMARKETS, RESTAURANTS AND LAUNDROMATS.

AND THEN THEY ALSO ENGAGE SOME FAMILY AND STAFF MEMBERS AS AMBASSADORS OF BULLIS.

ADDITIONALLY, THEY IMPROVE THEIR WEBSITE, THEIR ADVERTISING AND THEIR PRINT MATERIALS AND SOCIAL MEDIA PLATFORMS TO DEMONSTRATE THAT BULLIS WELCOMES ALL STUDENTS BY USING IMAGES AND MESSAGES AND WORD CHOICE TO HIGHLIGHT THE DIVERSITY OF THE COMMUNITY AND SHOW THE SCHOOL PROVIDES A FULL CONTINUUM OF PLACEMENTS AND SERVICES FOR STUDENTS WITH SPECIAL NEEDS.

AND THEY UPDATED THEIR WEBSITE RELATED TO THE MATERIAL RELATED TO MATERIALS TO CLEARLY INDICATE THAT NO MONETARY DONATIONS ARE REQUIRED OR EXPECTED.

AND THEN FINALLY, THEY EMPHASIZE THAT BULLIS ATTENDANCE AT BULLIS IS FREE.

THEY TRAIN THEIR STAFF AND VOLUNTEERS, INCLUDING THEIR BOOSTERS, CLUB AND FOUNDATION, FOCUSED ON THE REQUIREMENTS AND PROHIBITIONS OF THE FREE SCHOOL GUARANTEE TO ENSURE THAT THEY DON'T COMMUNICATE OR IMPLY THAT DONATING OR VOLUNTEERING IS PART OF OR IS REQUIRED OR WILL HAVE AN IMPACT ON WHETHER OR NOT A STUDENT IS INITIALLY GRANTED SPACE OR IS ALLOWED TO CONTINUE TO ENROLL OR PARTICIPATE AT BULLIS.

307 OF THOSE STUDENTS WERE OFFERED A SEAT AT BULLIS FOR THIS CURRENT YEAR.

159 OF THOSE STUDENTS WHO WERE OFFERED A SEAT ACTUALLY ENROLLED AT THE SCHOOL.

AND OF THOSE WHO WERE OFFERED A SEAT, 12 STUDENTS RECEIVED A SEAT UNDER PREFERENCE NUMBER TWO.

AND NINE OF THOSE STUDENTS WHO WERE OFFERED A SEAT UNDER PREFERENCE, NUMBER TWO ENROLLED AND ONE STUDENT SOMEHOW ENDED UP BACK ON THE WAITLIST FOR PREFERENCE. NUMBER SEVEN, THERE ARE 30 STUDENTS WHO QUALIFY FOR FREE OR REDUCED PRICE MEALS, WHO LIVE OUTSIDE OF LASD, AND THEY WERE NOT OFFERED A SEAT.

THEY REMAINED ON THE WAITLIST.

AND I WANT TO NOTE THAT, YOU KNOW, IF YOU LOOK AT THE TABLE, YOU CAN SEE UNDER 2022-2023, THE MOST RECENT DATA, AND YOU'LL SEE THAT THE BIGGEST NUMBER OF STUDENTS WHO WERE ADMITTED WERE IN TRANSITIONAL KINDERGARTEN OR KINDERGARTEN.

BUT EVEN THOSE ARE SMALL NUMBERS, AND THE NUMBERS GET EVEN SMALLER AS YOU GO UP THE GRADES.

SO WE CAN SEE THAT OVER A FIVE YEAR PERIOD WHEN STUDENTS OUTSIDE THE DISTRICT ARE NOT INCLUDED IN THE DATA, THERE HAS BEEN A STATISTICALLY SIGNIFICANT DECREASE IN ENGLISH LEARNERS AND AT LASD AT I'M SORRY AT BULLIS AND AT LASD SO THOSE ARE THE PINK CELLS.

AND THAT'S PERHAPS DUE TO EITHER STUDENTS DECREASE IN ENROLLMENT OR IT COULD BE THAT BOTH LEAS ARE DESIGNATING STUDENTS AS FLUENT ENGLISH PROFICIENT.

SO THERE COULD BE A COUPLE OF NUMBERS FOR THAT REASONS FOR THAT.

WE ALSO SEE THAT OVER A FIVE YEAR PERIOD, LASD HAS STATISTICALLY SIGNIFICANTLY INCREASED IN STUDENTS WHO ARE HISPANIC, LATINO AND IN STUDENTS WHO ARE SOCIOECONOMICALLY DISADVANTAGED.

AND THOSE ARE THE SALMON CELLS.

HOWEVER, WHEN WE LOOK AT THE CHANGE IN DATA FROM LAST SCHOOL YEAR TO THIS SCHOOL YEAR, SO THE COLUMN THAT SAYS ONE YEAR CHANGE, WE SEE THAT THERE THAT THERE WERE NO STATISTICALLY SIGNIFICANT INCREASES OR DECREASES AT BULLIS OR LASD FOR ANY OF THE RELEVANT SUBGROUPS.

AND SO BECAUSE MOST OF THE SEATS AVAILABLE WERE IN KINDERGARTEN, WE DECIDED TO DO AN ANALYSIS OF KINDERGARTEN AND FIRST GRADE TO SEE IF BULLIS ENROLLMENT ACTION, IF THE BULLIS ENROLLMENT ACTION PLAN HAD ACTUALLY MADE AN IMPACT ON THE BALANCE OF STUDENTS FROM VARIOUS RACIAL, ETHNIC, ENGLISH LEARNER AND SPECIAL NEEDS BACKGROUNDS.

AND SINCE THE NUMBER OF STUDENTS INVOLVED IN THE KINDERGARTEN FIRST GRADE ANALYSIS IS SO MUCH SMALLER THAN WHEN WE COMPARED ALL OF THE STUDENTS AT ALL GRADE LEVELS, WE MADE A DECISION TO CHANGE THE SIGNIFICANCE LEVEL.

FROM 5% TO 10% SO THAT WE COULD MAKE THE TEST MORE MEANINGFUL.

BUT YOU SHOULD NOTE THAT MEANS THAT WE ARE BASED ON THIS.

WE ONLY KNOW THAT WE CAN ONLY BE 90% CONFIDENT THAT THE DIFFERENCES THAT WE SEE ARE STATISTICALLY SIGNIFICANT RATHER THAN THE 95% CONFIDENCE. THAT IS USUALLY WHAT STATISTICIANS LOOK FOR.

AND THE PROPORTION OF FIRST GRADERS WHO WERE HISPANIC, LATINO ENGLISH LEARNERS OR SOCIO ECONOMICALLY DISADVANTAGED WERE SIGNIFICANTLY LOWER AT BULLIS THAN LA SD. AND THEN IN 2223, THE PROPORTION OF KINDERGARTNERS WHO ARE HISPANIC LATINO IS SIGNIFICANTLY LOWER AT BULLIS THAN AT LASD, AND THE PROPORTION OF KINDERGARTNERS WHERE ENGLISH LEARNERS IS SIGNIFICANTLY HIGHER AT BULLIS THAN AT LASD.

AND SO I THINK THAT BULLIS HAS MADE SOME CHANGES THAT WILL MAKE IMPACT, BUT IT'S GOING TO TAKE TIME.

AND THEN CONSIDERING THE TAKEAWAYS FOR THE DATA THAT ONLY INCLUDED KINDERGARTEN AND FIRST GRADE, THE DATA SET IS SMALL.

THERE WERE LOTS OF DIFFERENT, YOU KNOW, CONCLUSIONS TO DRAW.

BUT I THINK WHAT WE CAN FINALLY SAY IS THAT BULLIS'S EFFORTS APPEAR TO HAVE MADE SOME IMPACT AT THE KINDERGARTEN.

THE LOS ALTOS SCHOOL DISTRICT AND MANY WITHIN OUR COMMUNITY HAVE LONG BEEN CONCERNED WITH THE BULLIS CHARTER SCHOOL PROGRAM AND ISSUES WITH THE ABILITY AND WILLINGNESS OF BCS TO SERVE ALL STUDENTS, REGARDLESS OF RACE, ETHNICITY, SOCIOECONOMIC STATUS, LANGUAGE STATUS OR DISABILITY.

YOUR BOARD OF EDUCATION FINDINGS IN MAY OF 21 TO BCS CLEARLY LAYS OUT THE REALITY THAT BCS UNDERSERVED PROTECTED CLASS STUDENTS.

THE DISTRICT APPRECIATES THE COUNTY OFFICE OF EDUCATION AND THE COUNTY BOARD OF EDUCATION'S ATTENTION TO THE ISSUE AND THE NEED FOR BULLISH CHARTER SCHOOL TO MEET THE LEGISLATURE'S INTENT THAT CHARTER SCHOOLS PROVIDE EQUAL ACCESS AND NONDISCRIMINATION AND ACCESS TO ENROLLMENT IN CHARTER SCHOOLS.

THE DISTRICT CONTINUES TO URGE MEANINGFUL CHANGE DESIGNED TO CORRECT THE DEFICIENCIES WITH EQUITY AND ACCESS IDENTIFIED BY THE COUNTY OFFICE AND BOARD.

WE DO HAVE CONCERN THAT THE IDENTIFIED EFFORTS ARE INADEQUATE AND DO NOT PROVIDE FOR MEANINGFUL CHANGE IN A TIMELY MANNER.

THE FAILURE TO SERVE ALL STUDENTS HAS BEEN AN ISSUE SINCE THE CHARTER SCHOOLS INCEPTION, BUT THE ONLY TANGIBLE ACTION APPEARS TO BE A SECONDARY ADMINISTRATION ADMISSIONS PREFERENCE FOR STUDENTS WHO QUALIFY FOR FREE AND REDUCED PRICE MEALS AND RESIDE WITHIN THE DISTRICT, WHICH IS LIMITED TO 10% OF TOTAL OPENINGS AT EACH GRADE LEVEL. THE EDUCATIONAL PARTNER GROUPS THAT WILL BE INTERVIEWED ARE SITE AND CHARTER MANAGEMENT ORGANIZATIONS LEADERSHIP, STUDENTS, TEACHERS AND PARENTS.

AB 1505 REMOVE THAT FLEXIBILITY FROM THE LAW AND ALIGN CREDENTIALING REQUIREMENTS FOR TEACHERS IN CHARTER SCHOOLS WITH THOSE FOR ALL OTHER PUBLIC SCHOOL TEACHERS. THIS MEANS TEACHERS EMPLOYED IN CHARTER SCHOOLS ARE NOW REQUIRED TO HOLD A CERTIFICATE PERMIT OR OTHER DOCUMENT APPROPRIATE FOR THEIR CERTIFICATED ASSIGNMENT.

IF A TEACHER WITHOUT THE APPROPRIATE CREDENTIAL AUTHORIZATION WAS EMPLOYED IN A CHARTER SCHOOL DURING THE 2019-20 SCHOOL YEAR AND CONTINUES TO HOLD THE SAME ASSIGNMENT, THAT TEACHER HAS UNTIL JULY ONE, 2025, TO OBTAIN CERTIFICATION FOR THEIR POSITION.

BEGINNING LAST YEAR IN 2021, NEWLY HIRED TEACHERS AND TEACHERS WHO CHANGE ASSIGNMENTS ARE REQUIRED TO HOLD THE APPROPRIATE CERTIFICATE FOR THEIR ASSIGNMENT IF THEY DO NOT.

CHARTER SCHOOLS CAN OBTAIN A NUMBER OF EMERGENCY CREDENTIALS AND PERMITS FROM THE COMMISSION ON TEACHING CREDENTIALING THAT ALLOW QUALIFIED INDIVIDUALS TO BE LEGALLY AUTHORIZED TO SERVE IN THEIR TEACHING ASSIGNMENT WHILE THEY ARE WORKING TOWARDS COMPLETING THE CREDENTIALS REQUIREMENT.

CISCO'S CREDENTIAL SERVICES DEPARTMENT, LED BY TERRY PARKS, CONDUCTS THE MONITORING AND TEACHING ASSIGNMENTS.

MONITORING OF TEACHING ASSIGNMENTS FOR CBOE AUTHORIZED CHARTER SCHOOLS AND THE REVIEW FOR THIS YEAR.

THE 22-23 SCHOOL YEAR HAS BEEN COMPLETED AND I WILL NOW TURN THE PRESENTATION OVER TO ASSISTANT DIRECTOR MICHELLE JOHNSON, WHO WORKED WITH MISS PARKS AND STAFF FROM THE SCCBOE AUTHORIZED CHARTER SCHOOLS TO CORRECT THE INITIAL 173 ASSIGNMENTS.

EACH OF THE ORGANIZATIONS WERE GIVEN THE OPPORTUNITY TO CORRECT THE MISSED ASSIGNMENTS THROUGH A VARIETY OF WAYS, EITHER TO GET A SHORT TERM STAFFING PERMIT, A PROVISIONAL INTERNSHIP PERMIT, GET THE APPROPRIATE CREDENTIALS, OR TO REMOVE THE PERSON FROM THE CLASSROOM.

AS OF TODAY, ALL SCHOOLS, BUT ONE HAVE CORRECTED ALL OF THEIR MISASSIGNMENTS.

THE ONE SCHOOL THAT CURRENTLY HAS MISASSIGNMENTS IS VOICES MT.

PLEASANT. THERE ARE CURRENTLY FIVE ISSUES OF THOSE FIVE ISSUES.

FOUR ARE IN REGARDS TO HAVING A BILINGUAL AUTHORIZATION IN SPANISH.

THE FOUR TEACHERS DO HAVE THE APPROPRIATE CREDENTIALS TO TEACH IN ENGLISH.

THOSE FOUR VASPS OR BILINGUAL AUTHORIZATIONS ARE CURRENTLY IN A WAIVER FORMAT THAT HAVE BEEN FILED DIRECTLY WITH THE CALIFORNIA TEACHER CREDENTIALING COMMISSION.

FLU SHOTS AND OTHER VACCINES THAT THEY MAY NEED TO STAY CURRENT.

ADDITIONALLY, OUR OPIOID AND NARCAN AWARENESS EVENTS HAVE BEEN VERY SUCCESSFUL AND ARE HAVING A POSITIVE IMPACT.

SO WE PLAN TO HOLD TWO ADDITIONAL EVENTS.

THERE WILL BE ONE ON DECEMBER 15TH AND THE SECOND ONE ON JANUARY 15TH, AND WE'LL BE SENDING OUT FLIERS FOR PEOPLE TO REGISTER FOR THOSE.

FINALLY, I WANTED TO TO CELEBRATE AND RECOGNIZE THAT PROPOSITION 28, THE ARTS AND MUSIC FUNDING INITIATIVE PASSED FROM THE NOVEMBER 8TH BALLOT.

I WANT TO THANK THE BOARD FOR THEIR SUPPORT AND PASSING A RESOLUTION IN SUPPORT OF PROPOSITION 28, WHICH WE DID FILE ALONG WITH THE BALLOT MEASURE IN SUPPORT OF THE BALLOT MEASURE.

THIS FUNDING WILL PROVIDE ADDITIONAL RESOURCES TO EXPAND AND ENHANCE ARTS AND MUSIC EDUCATION IN ALL PUBLIC SCHOOLS IN SANTA CLARA COUNTY.

THE LAST THING I WANTED TO SAY, AND THIS WILL BE OUR TRANSITION BACK TO THE ACTION ITEM.

FIRST OF ALL, I JUST I WANT TO THANK THE TRUSTEES FOR THE DELIBERATION, FOR YOUR QUESTIONS, FOR YOUR SUPPORT, FOR YOUR FEEDBACK ON MY EVALUATION.

I UNDERSTAND THE PRESSURES AND THE PREDICAMENTS THAT EACH OF US ARE FACING AND OUR RESPECTIVE ROLES AND AS LEADERS IN THE COMMUNITY. I WENT TO ASSURE THE TRUSTEES AND ALL OF THE COUNTY OFFICE OF EDUCATION EMPLOYEES OF HOW MUCH I VALUE THEM PERSONALLY AND PROFESSIONALLY, AND THEIR CONTRIBUTIONS TO OUR STUDENTS AND FAMILIES.

AND THAT DURING MY TIME AS A LEADER AND THROUGHOUT MY ENTIRE CAREER, I HAVE ALWAYS TAKEN THE COMPLAINTS AND NEEDS AND INTEREST OF MY EMPLOYEES AND MY COLLEAGUES SERIOUSLY AND HAVE STRIVEN TO ADHERE TO ALL STATE RULES, REGULATIONS, POLICIES AND PROCEDURES.

I'M AWARE THAT THE THAT SEIU HAS FILED A CAL OSHA COMPLAINT ALLEGING WORKPLACE VIOLENCE RELATED TO ACTIONS OF STUDENTS AND OUR PROGRAMS OF STUDENTS WITH DISABILITIES AND WANT TO JUST HONOR AND SAY TO THE FAMILIES OF THE STUDENTS WE SERVE WHAT A PRIVILEGE IT IS FOR OUR OFFICE TO SERVE THE MOST SIGNIFICANTLY DISABLED STUDENTS IN OUR COUNTY AND ASSURE THEM OF OUR COMMITMENT TO CONTINUE TO PROVIDE THEM WITH HIGH QUALITY SPECIAL EDUCATION PROGRAMING AND SUPPORT, AND TO THANK ALL OF THE TEACHERS AND PARA EDUCATORS AND STAFF MEMBERS WHO SUPPORT OUR STUDENTS WITH SIGNIFICANT DISABILITIES.

AND WE WILL CONTINUE TO DO SO AT THE HIGHEST LEVEL POSSIBLE.

I ALSO WANT TO THANK ALL OF MY ADMINISTRATIVE TEAM MEMBERS WHO ARE WORKING TIRELESSLY UNDER SOME VERY DIFFICULT SITUATIONS, AND I WANT TO ASSURE THE BOARD AND THE COMMUNITY THAT OUR NEGOTIATIONS TEAM HAS BARGAINED IN GOOD FAITH WITH ALL OF THE BARGAINING UNITS OF THE SANTA CLARA COUNTY OFFICE OF EDUCATION, AND WE WILL CONTINUE TO DO SO.

AND I DO BELIEVE TRUSTEE DI SALVO, THAT YOU MAY HAVE MISSED THE LAST PORTION THAT IS PORTION THREE OF THE TRAINING, BUT I DID INCLUDE THE ATTORNEY GENERAL OPINIONS AND THE CITATIONS FOR THEM REGARDING THE BOARD NOT TO BEING THE EMPLOYER, THE COUNTY SUPERINTENDENT BEING THE SOLE EMPLOYER, AND THEREFORE THE COUNTY SUPERINTENDENT BEING THE SOLE NEGOTIATOR.

AND AGAIN, THAT IS OUTSIDE THE JURISDICTION OF THE BOARD.

AND SO I TO THE EXTENT THAT SOME OF THE ISSUES THAT WERE BEING RAISED TONIGHT FROM THE COMPLAINTS ARE ABOUT EMPLOYEE COMPLAINTS OR ABOUT NEGOTIATIONS, AGAIN, THAT IS OUTSIDE THE JURISDICTION OF THE BOARD.

AND THAT'S ALL I'M WILLING TO SAY AT THIS MOMENT ON THAT, GIVEN THAT THIS IS AN OPEN SESSION.

AND THE PREVIOUS SUPERINTENDENTS HAD NOT DONE THIS FOR SEIU MEMBERS.
